Islamic banking in Indonesia has experienced significant growth, including assets, financing provided and the number of customers. In 2012-2017 Sharia bank financing 70-80% is given to the community by using the contract of murābaḥah, in the form of consumptive and productive. The activities of sharia banks should be guided by the National Sharia Council Fatwa in performing its functions optimally and implementing the Shari'a comprehensively. While murābaḥah financing is still reaping a variety of criticism from Islamic finance experts because there are provisions that are not in accordance with fiqh muamalat and also need to find solutions how to calculate the price and mark up allowed so that customers do not burden at a cost much more expensive than the interest applied in conventional banks. This is so that Sharia banks can compete with other banks. Therefore, this article will explain concept concept of murābaḥah conceptually and application in Bank Islam in Indonesia. Purpose In relation to the critical problem, this paper aims to present an understanding of the agency theory and the stakeholder theory from the perspective of the Islamic principles. Indeed, a thorough examination of the theoretical background explaining corporate governance from the Islamic perspective is necessary to conduct research analysing corporate governance in Islamic banks. Design/methodology/approach The authors followed a critical review discussion; this method takes into consideration presenting important theories and comparing those theories with Islamic perspective. Findings The authors presented important arguments on the difference between ordinary theories to explaining corporate governance and Islamic perspective. The paper browsed into whether the Shariah Supervisory Board is a fit with the agency theory by explaining the agency theory and how it differs from the Islamic banking concepts. The paper involved an analytical review on stakeholder theory and presented a critique and the rationale as to why there is ample room for the Shariah Supervisory Board to be considered a fit with the stakeholder theory, as the Shariah Supervisory Board is an independent body influencing the firm. Originality/value The paper is of important value to those conducting research in the area of governance in Islamic banks; they may find it beneficial in terms of underlining theory building their research framework.

Despite the enormous growth in Islamic banking, most studies, using DEA/Stochastic Frontier Analysis, find Islamic banks are either equally or less productive than conventional banks. We apply the Olley–Pakes (OP) and Ackerberg–Caves–Frazer (ACF) approaches for estimating the production functions of conventional, Islamic and mixed banks in Bahrain and Malaysia between 1990 and 2011. The ACF results are the most plausible. Though Islamic banks tend to be less efficient than conventional banks the difference is not statistically significant. In Malaysia, mixed banks are significantly more productive than other banks and tend to have faster productivity growth.

With the development of increasingly advanced times, the bank continues to make new innovations so that at this time the bank is no longer just an institution that functions to collect and distribute funds, but at the same time also as an intermediary in the payment traffic. However, the Muslim community strives to realize banking based on sharia principles. For this reason, several Muslim countries have slowly begun to establish Islamic Banks. The development of Islamic banking is quite significant in several countries, but of the many countries, Indonesia actually has a different side. The difference lies in the term used to refer to a non-conventional bank. While other countries commonly refer to it as an Islamic Bank, in Indonesia it is actually called the Sharia Banking because the idea of the Islamic Bank is alleged to have contained political and SARA elements. With high stretches owned by several Muslim countries to establish shari'ah banking, Indonesia as the country with the largest Muslim population in the world established the first sharia banking under the name Bank Muamalat Indonesia (BMI) which was officially operated in 1992. From year to year, Sharia banking growth is very fast. Keywords : Banking, Sharia Banking,Indonesia.
