The purpose of this study is to analyze the legal construction of the Regional Property Management Agreement. Regional property in the form of land and/or buildings and other than land and/or buildings that have been handed over by the user to the manager can be utilized optimally in order not to burden the Regional Budget and Revenues particularly maintenance costs. This article are reviewing several types of agreements by analyzing the application of the legal agreement principles in the cooperation contract  in the management of property in Regional Government of Banyumas Regency. The principles of treaty law which is a concept of civil law applied in the concept of state administration law are interesting because the agreement is in the regulation of private law and public law. Government Contract is a routine legal act of government, to ensure legal certainty for the parties involved required legislation that specifically regulates commercial contracts by the government regarding procedures and authority limits.

Although inherent in him as a body or public official, the government in implementing the contractual relationship with another party (private) legal act is not governed by public law, but based on the laws and regulations of civil law (privaat recht), as the case of legislation that underlie civil legal actions carried out a body of citizens and civil law. The research shows that in a contractual relationship, the government as a party to the BOT contracts have no equal footing with their counterparts. This will be discussed in more depth in the study of law with the approach of juridical normative or study in a BOT contract as an agreement policy.

Government in administrative law considered as a unit, as an authorized body. Therefore, it is authorized to establish action, according to administrative law, and affect the legal circumstances of others, or to carry out legal action (under the civil law) in the meaning of government bodies legally. The dutch literature interpreted administrative with the terms administrative recht with administrative besturen. Besturen has a functional meaning to means the function of governance, and institutional or structural whole organs of government. Bestuur is an environment outside formation of regulations (regulgeving), and judicature (rechtspraak). The data of this research was collected by library research. This research aims to know the form of legal protection for the people to government action based on the concept of State Administrative Law. The result of this research shows that Legal decisions were those which fulfill formal and material requirements. This was based on the presumptive principle of rechtmatig, that was het vermoeden van rechtmatigheid or presumtio justea causa (every decisions issued by the government or the administrative of the state were considered lawful). This principle means that every decision was not revoked, unless there was a vernietiging of the court closely related to the principle of legal certainty (rechtszekerheidbeginsel).

ABSTRAK Berubahnya sistem pemerintahan dari sentralisasi menjadi desentralisasi, menuntut pembangunan yang merata di setiap daerah sehingga pembangunan yang tadinya dilaksanakan secara terpusat diberikan kepada daerah untuk mengatur daerahnya sendiri. Kebijakan pemerintah dibidang otonomi daerah pada dasarnya dimaksudkan untuk menata ulang hubungan antara pusat dan daerah dalam berbagai tugas dan tanggung jawab yang menyangkut urusan penyelenggaraan pemerintahan. Inspektorat merupakan suatu lembaga pengawasan di lingkungan pemerintah daerah, baik untuk tingkat provinsi, kabupaten atau kota memaikan peran yang sangat penting dan signifikan untuk kemajuan dan kebersihan pemerintah daerah dan perangkat daerah di lingkungan pemerintah daerah dalam menyelenggarakan pemerintahan di daerah dan mencapai tujuan dan sasaran yang telah ditetapkan. Dengan semakin meningkatnya tuntutan masyarakat atas penyelenggaraan pemerintah yang bersih, adil, transparan dan akuntabel harus disikapi dengan serius dan sistematis.Tujuan dari penelitian ini untuk menganalisis apakah pengawasan berpengaruh terhadap APBD  dan pertumbuhan ekonomi di Kota Manado. Teknik analisis yang digunakan adalah analisis jalur (Path Analysis). Hasil penelitian menunjukan bahwa Anggaran Pengawasan Reguler berpengaruh negatif tidak signifikan secara statistik terhadap APBD. Anggaran Pengawasan Khusus berpengaruh positif  tidak signifikan secara statistik terhadap APBD  Kota Manado. Anggaran Pengawasan Reguler berpengaruh negatif tidak signifikan terhadap Pertumbuhan Ekonomi. Variabel Anggaran Pengawasan Khusus berpengaruh positif tidak signifikan secara statistik terhadap Pertumbuhan Ekonomi dan variabel APBD berpengaruh positif signifikan secara statistik terhadap Pertumbuhan Ekonomi Kota Manado. Kata kunci: Anggaran Pengawasan, APBD, Pertumbuhan Ekonomi  ABSTRACT The change in the government system from centralization to decentralization requires demand for equitable development in each region so that the development that was carried out centrally was given to the regions to regulate their own regions. Government policy in the area of regional autonomy is basically intended to rearrange relations between the center and the regions in various tasks and responsibilities concerning the affairs of administering the government. The Inspectorate is a supervisory institution within the local government, both at the provincial, district or city levels displaying a very important and significant role for the progress and cleanliness of regional government and regional apparatus in the local government in carrying out governance in the regions and achieving the goals and objectives set. With the increasing demands of the community for the administration of a clean, fair, transparent and accountable government, it must be taken seriously and systematically. The purpose of this study is to analyze whether supervision influences the regional budget and economic growth in the city of Manado. The analysis technique used is path analysis. The results showed that the Regular Oversight Budget had a negative effect not statistically significant on the APBD. The Special Supervision Budget has a positive and not statistically significant effect on the Manado City Budget. The Regular Oversight Budget has no significant negative effect on Economic Growth. The Special Supervision Budget variable has a positive and not statistically significant effect on Economic Growth and the APBD variable has a statistically significant positive effect on the Economic Growth of the City of Manado. Keywords: Supervision Budget, Regional Budget, Economic Growth

Tax amnesty policy has been issued by the Government of Indonesia for six times, i.e., 1964, 1984, 2007, 2009, 2015, and 2016. But actually, such policy is not a common one, because taxes are obligation for everyone who has met the criteria as a taxpayer. Therefore, the emergence of this policy often leads to controversial responses from many people. This research aims to reveal how the analysis of the philosophy of public law (justice, expediency and legal certainty) toward tax amnesty policies in Indonesia, which is integrated with the theory of maṣlaḥah (public benefit) in Islamic legal philosophy (Usul al-Fiqh). The findings of this study indicate that the implementation of the three legal principles in the tax amnesty policy in Indonesia actually has a legal legitimacy (i’tibār syar’iy) in the perspective of maṣlaḥah (public benefits). As the character of the maslahah, then the hierarchy of the three is tentative depending on the level of urgency driven by surronding situations and conditions.

Abstrak Dalam menyelenggarakan urusan pemerintahan, pemerintah melimpahkan sebagian urusan kepada perangkat pemerintah atau wakil pemerintah di daerah. Pemerintah daerah terdiri dari kepala daerah dan wakil kepala daerah sebagai pemegang pemerintahan tertinggi di daerah dan sebagai bagian dari penyelenggara Negara. Penelitian ini merupakan penelitian yuridis normatif, oleh karena itu teori ini di arahkan secara khas ilmu hukum. Keberadaan teori ini adalah untuk memberikan landasan yang mantap, pada umumnya setiap penelitian harus selalu disertai dengan pemikiran teoritis yang berkaitan dengan analisis dan konstruksi yang dilakukan secara metodologis, sistematis dan konsisten. Temuan dari penelitian ini adalah pentingnya mengisi kekosongan wakil kepala daerah untuk membantu kepala daerah dalam menjalankan tugas dan fungsinya. Hal ini disebabkan karena Kementerian Dalam Negeri belum secara tegas mengatur dalam suatu produk hukum, pengisian jabatan wakil kepala daerah dilakukan sesuai dengan ketentuan peraturan perundang-undangan mengenai pemilihan kepala daerah yakni Pasal 176 Undang-Undang Nomor 10 Tahun 2016 tentang Pemilihan Gubernur, Bupati dan Walikota. Abstract In government affairs, the government delegates part of the affairs to the government apparatus or regional government representatives. The regional government consists of the regional head and deputy regional head as the highest government holders in the area and as part of the State administration. This research is a normative juridical research, therefore this theory is in the discussion that is typical of legal science. The theory of this research is to provide a solid foundation, in each study must discuss the analysis relating to the analysis and construction carried out methodologically, systematically and consistently. The findings of this study are important which help the deputy regional head vacancies to help regional heads carry out their duties and functions. This is because the Ministry of Home Affairs has not confirmed in a legal product, the filling of regional representative positions is carried out in accordance with the provisions of the legislation concerning the election of regional heads Article 17 of Law Number 10 of 2016 concerning Election of Governors, Regents and Mayors. The essence of transparency and accountability in land registration within the legal system in Indonesia has not been realized properly. Due to the weakness of the guarantee of legal certainty and legal protection from the government.  In addition, the publication system of land registration adopted is negative with a positive tendency, not applied in Article 32 paragraph (2) of Government Regulation Number 24 Year 1997 regarding expiration to file a five-year lawsuit there is a synchronization / non-harmonization concerning land authority between local government Article 14 paragraph (2 ) Letter k of Law Number 23 Year 2014 regarding Regional Government and Authority of National Land Agency (Regulation of Head of National Land Agency No.2 Year 2013 regarding Abundance of Land Rights and Land Registration Authority) and regulation of grace period of entitlement right. AbstrakEsensi transparansi dan akuntabilitas dalam pendaftaran tanah dalam sistem hukum di Indonesia belum terealisasi dengan baik. Karena lemahnya jaminan kepastian hukum dan perlindungan hukum dari pemerintah. The position of the customary rights of the customary law community in the Toba Batak community, namely the rights owned by a clan (State land), controlled, managed, utilized, the land and its contents for the needs of the citizens / descendants of the partnership as collective property that can be passed down from generation to generation (geneological) based on customary law. The UUPA recognizes the position of the ulayat rights of the customary law community in a formal juridical manner with discussion if in reality it still exists and does not conflict with the interests of the national, nation and state. The 1945 Constitution of the Republic of Indonesia Article 18-B paragraph (2), Article 28-I paragraph (3) The State recognizes and respects the customary public and their traditional rights as long as they are still alive. The cultural identity of traditional community rights is respected in accordance with the times and civilizations. The position of the customary rights of the Batak Toba community (land marga) in this study is still not as expected, in regulating and protecting laws from the past to the present, regulation and protection are still based on local customary laws. In Law No. 23/2014/9/2015 concerning Regional Government grants the authority of rights and responsibilities to provincial, regency / city governments to regulate and manage their own regions, one of the areas of defense based on the widest possible regional autonomy. The authority, rights and responsibilities of regional governments in regulating and protecting, managing their own ulayat rights (clan land) in certain areas are also in line with Presidential Decree No. 34 regarding policies in the defense sector, one of which is stipulation and is also in line with the government regulation of the Republic of Indonesia No. 38 Year 20007 concerning the Division of Government Affairs between the government and the Provincial Government of the Regency / City Government as a government affair which becomes the authority of the regional government towards the position of the ulayat rights of the customary law community in certain areas. In this study, in the Daily District of Samosir Regency. The authority, rights and obligations of Regional Government through stipulation in the form of Regional regulations have not been implemented, especially regarding local clan lands (ulayat rights of indigenous peoples). Therefore, this problem needs to be researched to get a true picture of the status of customary community rights in relation to regional autonomy in the Daily District of Samosir Regency. The results of this study, in the Samosir Kewenagan Regency Daily sub-district, the rights and obligations of regional government, it turns out that Tanah Marga (Hak Ulayat) is still regulated by local customary law, in fact the local government has the authority, rights and obligations to regulate and protect Ulayat Rights (Tanah Marga). certain by stipulation in the form of regional regulations, with the aim of providing legal certainty and benefits for the customary law community. Based on the research, it shows that the Land of Marga / Ulayat Rights of Indigenous Peoples in Harian District, generally in Samosir Regency, both horizontally and vertically until this research was conducted, there has been no settlement of certain customary rights of customary communities, in other words conflict resolution is still stagnant. The government needs to immediately establish the customary rights of customary communities in the form of a law. To ensure legal certainty / benefit and justice for all certain Customary law communities. Because ulayat rights are basically still found and still live according to the civilization of the Batak Toba people in the Daily District of Samosir Regency, which does not conflict with the development and interests of the Nation and the State.

The era of information disclosure is characterized by increasingly sophisticated information technology and well-educated society. That matter has implications for the demands of increasing the quality of public services managed by the government, amid the limitations of the budget, human resources, institutions, and governance. This research encourages the development of the state administration innovation system (SINAGARA) to leverage the performance of regional government. The ways can be taken is to establish an innovation implementation unit/task force where the Regional Research & Development Agency as the leading sector, provide incentives for tasks unit Innovators and innovator agents and encourage innovation-based budgeting. The importance of building a state administration innovation system (SINAGARA) for regional governments-by utilizing developing information technology - is an indicator of regional head and high leadership performance, and optimizing the role of regional government as the leading sector of development the state administration innovation system.

This research aims to determine the factors affecting human development index (HDI) in regency/city in Indonesia. Based on data from BPS (Statistics Indonesia), human development index (HDI) of each regency/city in Indonesia has a heterogeneous achievement value from the low, middle to high categories of HDI. This indicates that there are still underdeveloped areas and inequality in human development in Indonesia. Meanwhile, regional government expenditure on education, health, and economic functions tends to increase considerably each year. The methods used were panel data regressions with time series data from 2011-2017 and cross section data of 465 regencies/cities in Indonesia. Econometrics results show variables that have significant positive effect on HDI, which are regional government expenditure on education function, health function, economic function, GRDP (Gross Regional Domestic Product), education infrastructure (number of junior high schools), health infrastructure (number of community health center), and BPK (The Audit Board of Indonesia) opinion. While poverty has negative effect, infrastructure (road length) has no effect. To avoid inequality from affecting human development in Indonesia, the government role to prioritize human development in regency/city with HDI achievement values that are still low or underdeveloped is necessary. These contributions can be made by prioritizing expenditure on health, education, and economic functions in the regional budget.
