The third Amendment of UUD 1945 in 2001 put the position of MPR is no longer as the highest state institution but equal with another state institutions. This is certainly make a legal consequence to the legal product that produced by MPR and that legal product is Tap MPR. Tap MPR is no longer regulated in hierarchy of legislation in article 7 (1) Constitution No. 10 of 2004 on the establishment of legislation because Tap MPR is not included in the general legislation. But then the issuance of Constitution No. 12 of 2011 set back Tap MPR in hierarchy of legislation because some of Tap MPR is still valid in accordance with the Tap MPR number of I / MPR / 2003 on Judicial Review Matter and Legal Status of the Tap MPR Decree from 1960-2002. If it viewed through a political perspective, it can be said that Tap MPR Decree setting tug in the hierarchy of legislation can be said to be inconsistent of legal political or unclear. Said to be inconsistent or unclear because it is not in line with changes in the MPR authority and contrary to the theory of hierarchy of norms as a result of changes in the authority of MPR must also align with the legislation and do not deserve to be above the legislation. The debate re-occurs when the authority of the Constitutional Court to review the constitutionality of MPR is considered contrary to the 1945 Constitution questionable. Is the Constitutional Court is authorized to review the constitutionality of Tap MPR towards the UUD 1945? According to the Article 24C of UUD 1945, Constitutional Court is only authorized to review legislation towards UUD 1945. There is void of norm on the authority of the Constitutional Court but on the other side, citizens who feel their constitutional rights are  violated by the existence of the MPR cannot do anything. The Constitutional Court was established with the aim of legislation under the Constitution does not conflict with the UUD 1945, the next purpose is to protect and ensure the constitutional rights of citizens contained in the UUD 1945 in order not to be violated by officials or state agencies. Departed from that purpose then the Constitutional Court is authorized to review the constitutionality of Tap MPR is considered contrary to the UUD 1945.

AbstractThe Constitutional Court is a state institution that has the authority to reviewing laws against the Constitution (Judicial Review). Several times in issuing its decisions, the Constitutional Court has acted as a Positive Legislator. The potential for a legal vacuum as the implication of revoking a law is large. and also the slow formation of laws by the legislative body (DPR) and the lack of quality of regulations. The current law making does not pay attention to legal ideals based on Pancasila so that the resulting legal products lose their meaning. This has resulted in many people whose constitutional rights have been violated. The state should be present to give full constitutional rights to its citizens. The Constitutional Court needs an additional authority to maintain the supremacy of the constitution. additional authority as a preventive mechanism is Judicial Preview. The French state places Judicial Preview as an authority of the Constitutional Council. Austria and Germany apply Judicial Preview as a preventive measure for losses that can occur if the Draft Law is passed. A renewal of the Constitutional Law to perfect existing ones makes the prospect of Judicial Preview in Indonesia an Urgency for immediate implementation. Keywords: Constitutional Court, Authority, Judicial Preview AbstrakMahkamah Konstitusi merupakan lembaga negara yang memiliki kewenangan pengujian Undang-Undang terhadap Undang-Undang Dasar (Judicial Review).

The existence of Constitutional Court becomes important as requisite for the rule of law principle and democracy in Indonesia. Amendment of the Constitution by Indonesia National Assembly has chosen to share judicial power held by the Supreme Court and Constitutional Court with the authority to judicial review of legislation to the Constitution. The Constitutional Court as Guardian of the Constitution has its own role in establishing constitutional culture in Indonesia. Commitment to constitutionalism is adistinctive constitutional culture which will also develop the constitution itself. Commitment to UUD 1945 as the limitation to the powers and a guarantee of constitutional rights that must be protected by the Constitutional Court with the authority to review as the implementation of Indonesia constitutionalism. Constitutional culture discuss in this paper is focused on understanding constitutional culture which will affect the implementation of the constitution by "the formal institutions of the state", especially in relation to the citizenry. The Constitutional Court in review of the legislation to the constitution has used various methods of Constitutional interpretation to uphold the law and substantive justice. From several decisions seem that the constitutional interpretation made by the Constitutional Court was expanding the existing notions of UUD 1945 or event change the constitution. The Constitutional Court leads to judicial activism and can be said that the constitutional court has become super body. On the other side, presence of the Constitutional Court expected to complement the government system of Indonesia, in accordance with the function can motivate the performance of other state institutions, in this case the legislator in order to establish better legislation.

Becoming one of the materials inside the fifth amendment of Undang-Undang Dasar Negara Republik Indonesia 1945 (The 1945 Constitution of Republic Indonesia), Constitutional Court authority now has become one of the essential concerns given that the function as "the guardian of the constitution" it became crucial in the protection of the constitutional rights of citizens. Along with times, violations of citizens constitutional rights are no longer based solely on legal norms, but violations committed against the application of norms by state institutions or public bureaucratic institutions (Constitutional Complaint). In addition, the need for institutions that deal with constitutional questions over the existence of a legal norms whose constitutionality is doubtful (Constitutional Question) as well as the authority of the Judicial Review carried out by institutions holding judicial power, called the Supreme Court and the Constitutional Court, led to a dualism of Judicial Review which turned out to be vulnerable to presenting legal issues. The methodology used in this study is normative juridical with a qualitative approach and using literatures. From the results of this study it was concluded that the need for additional of Constitutional Complaint and Constitutional Question authority as the authority of the Constitutional Court as well as a one-stop Judicial Review system in the Constitutional Court became very important carrying out its function as a guardian of the Constitution.

Hasil penelitian ini menggambarkan betapa pentingnya upaya preventive sebelum suatu aturan hukum kemudian ditetapkan, disahkan dan dilaksanakan, dimana ada persoalan konstitusionalitas terhadap implementasi suatu produk hukum yang kemudian oleh Mahkamah Konstitusi dinyatakan bertentangan dengan Undang-Undang Dasar Republik Indonesia 1945.Basically, judicial review has done to create a balance of law and to fulfill the constitutional right for every stakeholder to act and apply for application to constitutional court by stating the rule was contradicted to the constitution of Republic of Indonesia 1945. The application was made as an effort to perfect the law which is based on the constitution. Each rule has to be based on the basic rules, not only on its consideration but also is made and implemented in basic values and norms of contitutionality. Judicial review done by many people on constitutional court has proven that the quality of law product or rules of law made by the legislative often contradict with constitutional order of law, so it is necessary to take a step on preventive legal measurer to keep up the integrity of the rule maker of being judged making unqualified legal products. This research used juridical normative method with legal and conceptual approaches. The results of this study illustrate how important preventive efforts before a rule of law are then set, ratified and implemented. In which there is a constitutional issue on the implementation of a legal product, that will be later declared by the Constitutional Court to be contradictory to the 1945 Constitution of the Republic of Indonesian.

The formation of the 1974 Marriage Law is based on Islamic Law, which became a problem when the Constitutional Court gave a decision on the judicial review of the Marriage Law with a decision that was considered by the public that the decision was against Islamic law. The research problem in this article is, How is the Politics of Law in the Reform of Legislation in the Post-Constitutional Court Ruling on Marriage related to the status of children outside of marriage? Does the Constitutional Court Decision No 46 / PUU-VII / 2010 contradict Islamic law?The research approach used in this research is normative juridical. The results of the study indicate that children who are born must receive legal protection. If this is not the case, then the children who are born outside of marriage will suffer losses. The relationship between the child and the father does not only occur because of a legal marriage, but can also be based on evidence of a blood relationship between the child and the boy as the father. This is because birth is a legal result of a legal relationship in which there are reciprocal rights and obligations between the child, mother and father. This decision refers, because there is a relationship that is carried out without any legal conditions for marriage, both religiously and in a state, so that it does not cause harm which implies a child who has not done anything wrong. In conclusion, the Constitutional Court granted the renewal of the norm in article 43 of the Marriage Law No. 1 of 1974, which is to provide constitutional rights for children born out of wedlock whether born from a legally valid marriage or not. The decision of the Constitutional Court related to the addition of article 43 paragraph (1) of this marriage law is still in the spirit of Islam as the struggle of Muslims to be able to apply their religious values in this law is not only legally religiously or nationally.

The emergence of the recognition of health as a human right shows an extraordinary paradigm shift, because health is no longer seen only as a private matter but as a form of state responsibility and legal rights. The purpose of the enactment of various laws related to health is to provide a constitutional guarantee of the right to health, however, the enactment of these various laws does not mean the guarantee of constitutional rights to health, this is showed by the number of judicial review of various laws. The number of requests for material tests is interesting to be examined on the principles that underlie the contents of various health related to laws and consistency between decisions of the Constitutional Court (MK) and consistency of decisions of the Constitutional Court to the principles that underlie the content of laws related to health. By using the normative juridical research method, it can be concluded that principles have an important meaning as a basis for the material of the law so that they can be used as a touchstone in conducting the testing of laws. Another conclusion is that there are inconsistencies between the Constitutional Court's decisions and the inconsistency of the Constitutional Court's decision to the principle on the basis of the material content of various laws related to health.

Rule lower against the rules of higher then lower regulation it can test the material (judicial review) to be canceled entirely or partially canceled. The assertion of hierarchy intended to prevent overlap between legislation that could give rise to legal uncertainty. Principally, legal development is a sustainable development, its function  as human interest protection, legal aims to reach an order and balance. Order in society guarantees the protection on human interest.  Even though, the development on law is directed to create order in society, meaning law and society are interconnected, there are still plenty of legal products that are not able to meet people needs, and one of them is the judicial review on  the Act no. 19 year 2013 on Protection and Enforcement to Farmers. This  reflects that the Act does not represent social factors. This shows no harmony and benefit connections between the Act no.19 year 2013 as written legal product and society. This phenomenon, then, is analyzed from Theory of John Henry Merryman on Legal Development Strategy (Orthodox and Responsive). The process of making a responsive legal product is a participative one meaning that the process involves greatly the participation of society through social groups and individual in community. Reversely, orthodox legal product is characterized by its centralistic process in which state institutions dominate the process, especially  the authority of executives.
