The use of the environment today is very important in order to provide benefits to the community. Utilization must also be balanced with good management and avoid damage. Anomaly in the use of the environment that causes widespread damage occurs where there is a role of the corporation as the main actor. The presence of the PPLH Law has not been able to be a solution amid the chaotic environment utilization that is in line with the damage because the existing legal instruments are not able to overcome the problem. This paper has a purpose to analyze the weakness in the resolution of criminal acts of the environment and the extent to which restorative justice is able to overcome the conflict due to environmental criminal act between the corporation and the community. This research method uses normative legal research methods with a conceptual approach. This study obtained the first result, the legal instrument in the PPLH Law has not shown success where there is still widespread environmental destruction today. Second, through the restorative justice approach it is expected to be able to reduce the number of environmental criminal acts by corporations using the dual mediation pattern, namely the merging of the concepts of civil case mediation and penal mediation so as to create a balance pattern that is in line with the direction of the renewal of national criminal law.              Pemanfaatan lingkungan hidup dewasa ini amat penting dilakukan guna memberikan manfaat terhadap masyarakat. Pemanfaatan harus pula diimbangi dengan pengelolaan yang baik dan menghindari kerusakan. Anomali pemanfaatan lingkungan hidup yang menyebabkan kerusakan marak terjadi, di mana terdapat peran korporasi sebagai aktor utama. Kehadiran UU PPLH masih belum mampu menjadi solusi di tengah carut marutnya pemanfaatan lingkungan yang sejalan dengan kerusakan karena instrumen hukum yang ada tidak mampu mengatasi masalah tersebut. Tulisan ini memiliki tujuan untuk menganalisa kelemahan dalam penyelesaian tindak pidana lingkungan hidup dan sejauh mana restorative justice mampu mengatasi konflik akibat tindak pidana lingkungan hidup antara korporasi dan masyarakat. Metode penelitian yang digunakan yaitu penelitian hukum normatif dengan pendekatan konseptual. Penelitian ini memperoleh hasil pertama, instrumen hukum di UU PPLH belum menunjukkan keberhasilan di mana masih maraknya kejadian pengrusakan lingkungan hidup hingga saat ini. Kedua, melalui pendekatan restorative justice diharapkan dapat menekan angka tindak pidana lingkungan hidup oleh korporasi menggunakan pola dual mediasi yaitu penggabungan konsep mediasi perkara perdata dan mediasi penal sehingga dapat menciptakan pola keseimbangan yang selaras dengan arah pembaruan hukum pidana Nasional.

This research aims to analyze the norms that have a blur (Vague Norm) against Cyber Espionage related to Indonesia's legal ability to accommodate Cyber Espionage attacks. In addition, this study also aims to analyze Indonesia's efforts to overcome the Cyber Espionage attack that could threaten the stability of national defense and security. The type of research in the legal research method used is normative juridical with three problem approaches, namely the Statute Approach, Conceptual Approach, and Comparative Approach. Primary and secondary legal materials that have been collected will be processed through deductive methods and an analysis of legal materials is carried out, namely by systematic interpretation and extentive interpretation. So based on the results of the discussion, then there is a Vague Norm about Cyber Espionage that affects Indonesian law in accommodating. The efforts taken by Indonesia to deal with Cyber Espionage outside of juridical efforts began with the preventive efforts of Cyber Security and Cyber Defense, optimizing the role of the TNI, BIN, and POLRI as national resources in defending the country's defense.

This research is conducted to find out and analyse the implementation of criminal law in motive element of planed murder perpetrator as well as to find out and analyse the vindication of motive of planed murder perpertator by applying normative legal research method. Aimed to analyze the implementation of positive law norms under statute, case and historical, comparative and conceptual approach. Research result shown that implementation of Article 340 KUHP depends on judge’s point of view poured in his legal considerations. The point of view can be Monistic where motive is not a significance consideration as long as the crime lead to certain legal consequences or dualistic where motive is important to consider in order to determine perpetrator’s grade of guilt (psychologically) since dualistis point of view differentiate between objective element and subjective element (guilt element). To proof that there is motive element in a planed murder, Judge shall apply vindication principle used in Indonesia’s criminal law procedure according to Article 184 KUHP and law number 48 of 2009 concerning judiciary power.

This article aims to determine the role of judges in resolving family law cases through mediation in the Religious Courts, where judges have the position as state officials as regulated in Law Number 43 of 1999 concerning Basic Personnel, can also be a mediator in the judiciary. as regulated in Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures where judges have the responsibility to seek peace at every level of the trial and are also involved in mediation procedures. The research method used in this article uses normative legal research methods. Whereas until now judges still have a very important role in resolving family law cases in the Religious Courts due to the fact that there are still many negotiating processes with mediation assisted by judges, even though on the one hand the number of non-judge mediators is available, although in each region it is not evenly distributed in terms of number and capacity. non-judge mediator.

Tulisan ini bertujuan untuk mengetahui serta mengkaji penerapan serta pelaksanaan dari konsep keadilan restoratif yang tercantum dalam Perarem Desa Adat Renon Tentang Perlindungan Anak. Metode penelitian yang digunakan dalam tulisan ini yaitu menggunakan metode penelitian hukum empiris. Hasil penelitian ini menunjukkan bahwa dalam hal penerapan konsep keadilan restoratif melalui Perarem Desa Adat Renon Nomor 001/Par-DPR/VI/2017 tentang Perlindungan Anak khususnya dalam hal penyelesaian perkara anak yang cenderung ringan, di desa adat renon mengutamakan penyelesaian secara damai dan berdasarkan pemulihan keadilan guna memberikan perlindungan terhadap anak agar perkara tersebut tidak masuk ke ranah peradilan formal, serta menghindari anak dari labelisasi dalam masyarakat. Adanya keberlakuan perarem desa adat renon tentang perlindungan anak tersebut menjadi acuan serta memberikan penguatan dalam penyelenggaraan penyelesaian perkara anak berdasarkan konsep keadilan restoratif. Sehingga dalam hal implementasi atau pelaksanaan dari adanya perarem tersebut dapat dikatakan telah efektif diterapkan serta dilaksanakan di Desa Adat Renon. This paper aims to identify and examine the application and implementation of the concept of restorative justice as stated in the Perarem of the Traditional Village of Renon concerning Child Protection. The research method used in this paper is to use empirical legal research methods. The results of this study indicate that in terms of the application of the concept of restorative justice through Perarem Traditional Village Renon Number 001/Par-DPR/VI/2017 concerning Child Protection, especially in terms of resolving cases of children who tend to be mild, in traditional villages Renon prioritizes peaceful and recovery-based solutions in order to provide protection for children so that the case does not enter the realm of formal justice, and prevents children from being labeled in society. The implementation of the Renon traditional village regulations regarding child protection is a reference and provides reinforcement in the implementation of settlement of child cases based on the concept of restorative justice. So that in terms of implementation of the perarem, it can be said that it has been effectively implemented in the traditional village of Renon.

Indonesia is a developing country where each region has its own natural wealth. This advantage cannot be used because there are many people who send out of the region without permission and vice versa, goods from outside countries are smuggled into Indonesia only to avoid the applicable taxes. This study aims to examine the regulation of smuggling in criminal law in Indonesia and reveal the responsibility of the director of PT. Garuda Indonesia, which carried out the act of smuggling luxury motorcycles. This research is a type of normative legal research conducted with research methods based on legal materials, while the problem approach used is a legislative and conceptual approach. Sources of data used are primary and secondary legal materials. Another bad example is shown by one of the people who has a big name in Indonesia, the smuggling case by the president of Garuda Indonesia is an illustration of how weak the law in Indonesia is and this incident has resulted in criminal and administrative sanctions. The results of the study indicate that the regulation of smuggling crimes in Indonesia is contained in Law Number 17 of 2006 concerning Customs. Handling of violations of customs provisions is more focused on the fiscal settlement, namely in the form of payment of a sum of money to the State in the form of a fine. The criminal liability of smugglers is regulated in Law No. 17 of 2006 the president director of PT. Garuda Indonesia is threatened with criminal and administrative sanctions

Supervision of Bhabinkamtibmas in the use of village funds, aims to ensure that Bhabinkamtibmas can carry out their duties properly. The method used is a normative legal research method with a statutory and conceptual approach. The results of this study indicate that the supervision of Bhabinkamtibmas in the use of village funds is needed to increase the role of Bhabinkamtibmas in village development and coordinate with village community leaders. Because when many community leaders supervise, it is better for the Village Government not to abuse their positions and KKN in the implementation of village development because village funds can tempt officials to do wrong. Bhabinkamtibmas should be involved since planning or deliberation in the hamlet/village, village deliberations (musrenbangdes) so that the development direction is according to priorities in the village and monitoring the village development process. Thus the task of supervising Bhabinkamtibmas can run smoothly, so that it can build a prosperous village without corruption, collusion and nepotism.

Restorative justice or more precisely keadilan restoratif in the Indonesian context is based on the principle of building joint participation between perpetrators, victims, and community groups in resolving a criminal act. The problem has been that in the formulation of the laws and government regulations diversion (diversi) is carried out if a criminal act is committed by a child who is punishable by imprisonment under seven years other than that if criminal acts that were committed by a child is not a repetition of criminal acts (recidive). A research using a normative legal research method found that through legal findings or rechtsvinding (penemuan hukum), judges can formulate criminal law policies through their decisions based on mens rea. Tt is a must for judges to settle criminal cases with a child of 12-years-old age perpetrator and/or the delinguent actor is a recidive via diversion. The provisions of Indonesian criminal procedure law dicates that judges are also obliged to seek diversion towards the settlement of all criminal cases whose actions were committed by children, both those with a criminal penalty over seven years and/or recidive or those who does not included in the two categories.

A wistleblower is someone who is aware of a criminal act and notifies it to law enforcement officials. The role of whistleblowers is very important to help expose acts of narcotics abuse. The purpose of this study is to determine the legal protection arrangements for whistleblowers in narcotics abuse and to find out legal protection for whistleblowers in narcotics crime. The research method used in this research is normative legal research method normative legal research method which is carried out by examining a statutory regulation related to the problem being discussed and through a conceptual approach or conceptual approach which shows a concept, and uses a conceptual approach. doctrine, namely the views or thoughts of experts related to the science of law. A person who is a whistleblower or notifier in narcotics abuse always bears a reply from those who feel aggrieved or aggrieved as a result of a notification or report from a whistleblower, legal security for a person who is a pioneer or whistleblower in investigating criminal acts of narcotics abuse is important given to the authorities so that all people are willing to become reporters in order to support legal institutions to reveal and arrest narcotics abuse. Security for whistleblowers must be made strictly in law so that security for whistleblowers can be upheld.

The phenomenon of radicalism based on terrorism in Indonesia shows a frightening symptom. This can be seen from a number of events that took place in several cities in Indonesia which took action in the name of acts of terror or terrorism such as the 2nd Bali Bombing which killed 22 people and 102 injured. The JW Marriot and Ritz Calton Hotel bombings in 2009 killed nine people and 50 people were injured and the Sarinah Plaza Bomb Jl. MH Thamrin Jakarta on January 14, 2016. With the many actions in the name of terrorism, it is necessary to take steps to anticipate similar actions not being repeated back. This study wants to examine and analyze further about efforts to counter terrorism-based radicalism in Indonesia through criminal law policy. The research method used is normative legal research, namely legal research conducted by examining library materials or secondary legal material while the problem approach is carried out using a legal approach and conceptual approach. The policy in counteracting terrorism in Indonesia is carried out through criminal law policies, namely criminal law policies through means of reasoning and non-reasoning. Penal means in the form of granting criminal sanctions for perpetrators of terrorism with the threat of imprisonment to the most severe threat in the form of capital punishment. But this effort has not provided a deterrent effect for the perpetrators. In criminal law, punishment is not an end in itself and is not the only way to achieve criminal objectives or objectives of the criminal justice system. Therefore another effort is needed which in criminal law is known as a non-reasoning effort.
