A wistleblower is someone who is aware of a criminal act and notifies it to law enforcement officials. The role of whistleblowers is very important to help expose acts of narcotics abuse. The purpose of this study is to determine the legal protection arrangements for whistleblowers in narcotics abuse and to find out legal protection for whistleblowers in narcotics crime. The research method used in this research is normative legal research method normative legal research method which is carried out by examining a statutory regulation related to the problem being discussed and through a conceptual approach or conceptual approach which shows a concept, and uses a conceptual approach. doctrine, namely the views or thoughts of experts related to the science of law. A person who is a whistleblower or notifier in narcotics abuse always bears a reply from those who feel aggrieved or aggrieved as a result of a notification or report from a whistleblower, legal security for a person who is a pioneer or whistleblower in investigating criminal acts of narcotics abuse is important given to the authorities so that all people are willing to become reporters in order to support legal institutions to reveal and arrest narcotics abuse. Security for whistleblowers must be made strictly in law so that security for whistleblowers can be upheld.

Penelitian ini dilakukan dengan bertujuan untuk mengetahui peranan justice collaborator dalam pengungkapan suatu kasus tindak pidana; untuk mengetahui bagaimana pengaturan perlindungan hukum terhadap justice collaborator. Jenis penelitian ini adalah penelitian hukum normatif, dengan pendekatan perundang-undangan dan beberapa contoh kasus. Hasil penelitian ini menunjukkan bahwa  kehadiran seorang justice collaborator dalam mengungkap tindak pidana korupsi sangat membantu dalam proses persidangan atau penjatuhan hukuman kepada terdakwa, sehingga secara tidak langsung memudahkan para aparat penegak hukum. Perlindungan yang diterapkan pada Undang-Undang Nomor 31 Tahun 2014 dan SEMA No. 04 Tahun 2011 belum memberikan kesan positif dalam hal pemberian perlindungan fisik dan hukum, penanganan secara khusus, dan penghargaan kepada justice collaborator. Namun dalam hal perlindungan hukum yang diberikan kepada justice collaborator dianggap belum signifikan terhadap pemberian reward dan punishment.This research was conducted with the aim of: 1) To determine the role of justice collaborators in disclosing a criminal case; 2) To find out how to regulate legal protection against justice collaborator. This type of research is normative legal research, with a legal approach and several case examples. The results of this research show that: 1) the presence of a very justice collaborator in uncovering criminal acts of corruption is very helpful in the trial process or sentencing of the accused, thus indirectly facilitating law enforcement officials. 2) protection applied to Law Number 31 of 2014 and SEMA No. 04 of 2011 has not given a positive impression in terms of providing physical and legal protection, special handling, and appreciation to justice collaborator. However, in terms of legal protection given to justice collaborators it is deemed not significant to the provision of reward and punishment.

This research aimed to: (a) obtain the forms of copyright infringement of songs and/or music (with or without lyrics); (b) understand the role of the police, in this case the Police Precinct, in the law enforcement; (c) identify the factors that influenced the law enforcement. The research method used the normative-empirical legal research, with the initial stages of specifying norms in order to get the proper picture, and then specifying empirical events in order to get the real picture. The research results showed several matters: 1) The forms of copyright infringement of songs and/or music (with or without lyrics) found included: the distribution of the works or the copies, the performances of the works, and the announcements of the works; 2) Police Precinct did notultimately carry out their role as a law enforcer for the copyright infringement of songs and/or music (with or without lyrics); and 3) The factors that influenced the law enforcement on the copyright infringement of songs and/or music (with or without lyrics), namely: legislation factor, in the matter of complaint offenses; law enforcement factor, in terms of the capacity of members; less supportive factor of facilities and infrastructure; legal awareness factor, in the problem of the lack of legal counseling; and cultural factor, related to the differences in norms in the copyright law between those in society and those in regulations.

Indonesia and even the world now feel the impact of the Corona virus outbreak (covid-19), in connection with it hindering the burial of the bodies of victims who died. The phenomenon of corpse rejection of corona virus patients (covid-19) continues to occur in various regions. In fact, the body must be buried immediately no later than 4 hours after being declared dead. The main reason people are reluctant to accept the bodies of patients co-19 because of fear of contracting. While the medical ensure that the body will not transmit the virus. The body in the coffin has been wrapped and declared sterile. The type of research used in this study is the type of normative legal research, which is a legal research method that uses a statutory approachThe results of the study showed that obstructing officers who will carry out official burials could indeed be convicted. Law enforcement officials can use Article 178 of the Criminal Code. not a complaint offense. Law enforcement officials can immediately take action without anyone complaining. "If the incident fulfills the elements contained in Article 178 of the Criminal Code, the perpetrators can be charged. However, it must look at intentions and actions as a condition for imposing a crime on someone.

This research aims to analyze the norms that have a blur (Vague Norm) against Cyber Espionage related to Indonesia's legal ability to accommodate Cyber Espionage attacks. In addition, this study also aims to analyze Indonesia's efforts to overcome the Cyber Espionage attack that could threaten the stability of national defense and security. The type of research in the legal research method used is normative juridical with three problem approaches, namely the Statute Approach, Conceptual Approach, and Comparative Approach. Primary and secondary legal materials that have been collected will be processed through deductive methods and an analysis of legal materials is carried out, namely by systematic interpretation and extentive interpretation. So based on the results of the discussion, then there is a Vague Norm about Cyber Espionage that affects Indonesian law in accommodating. The efforts taken by Indonesia to deal with Cyber Espionage outside of juridical efforts began with the preventive efforts of Cyber Security and Cyber Defense, optimizing the role of the TNI, BIN, and POLRI as national resources in defending the country's defense.

ABSTRAKSetiap anak yang menjadi korban tindak pidana berhak mendapatkan restitusi seperti yang tertuang di dalam peraturan pelaksana dari Pasal 71 D Undang-Undang Perlindungan Anak No. 35 Tahun 2014 yakni Peraturan Pemerintah Nomor 43 Tahun 2017 tentang Pelaksanaan Restitusi Bagi Anak Yang Menjadi Korban Tindak Pidana. Pelaksanaan restitusi kepada korban hanya ditujukan kepada beberapa tindak pidana tertentu saja termasuk tindak pidana kekerasan seksual. Diterbitkannya Peraturan Pemerintah tersebut bertujuan untuk memberikan perlindungan hukum terhadap korban khususnya anak-anak atas penerapan hak restitusi. Penelitian ini termasuk tipologi penelitian hukum empiris. Hasil penelitian menunjukkan bahwa pelaksanaan restitusi bagi anak yang menjadi korban tindak pidana kekerasan seksual di Provinsi Riau berdasarkan Peraturan Pemerintah Nomor 43 tahun 2017 belum berjalan dengan baik. Hal ini disebabkan oleh beberapa kendala yakni kurangnya kesadaran dari aparat penegak hukum untuk mendorong terlaksananya restitusi bagi anak yang menjadi korban tindak pidana, administirasi pengajuan permohonan restitusi yang rumit, dan kendala restitusi yang tidak dibayarkan dan ketentuan dalam Peraturan Pemerintah Nomor 43 Tahun 2017 yang kurang jelas. Fokus penelitian ini adalah penerapan restitusi pada anak korban tindak pidana berdasarkan Peraturan Pemerintah Nomor 43 Tahun 2017.Kata kunci: restitusi; anak korban tindak pidana; kekerasan seksualABSTRAKEvery child who is a victim of a crime is entitled to get restitution as stipulated in the implementing regulations of Article 71 D of the Child Protection Act No. 35 of 2014 namely Government Regulation Number 43 of 2017 concerning Implementation of Restitution for Children Who Become Victims of Criminal Acts. The implementation of restitution to victims is only aimed at a number of specific criminal acts including sexual violence. The issuance of this Government Regulation aims to provide legal protection for victims, especially children, on the application of restitution rights so that they can run well. This research is a typology of empirical legal research. The results showed that the implementation of restitution for children who were victims of sexual violence in Riau Province based on Government Regulation No. 43 of 2017 has not gone well. This is caused by several constraints namely lack of awareness from law enforcement officials to encourage the implementation of restitution for children who are victims of criminal acts, administration of submission of complex restitution applications, and restitution constraints that are not paid and the unclear provisions in Government Regulation Number 43 of 2017. The focus of this research is on the provisions stipulated in Government Regulation Number 43 of 2017 concerning the implementation of restitution for children who are victims of criminal acts.Keywords: restitution; child victims of crime; sexual assault

The regulation of legal protection for customers who have savings funds in village financial institutions (LPD) is unclear. This causes no legal certainty for customers if the LPD experiences financial problems. The existence of LPDs in Bali is regulated in two types of legal rules, namely state law and customary law (legal pluralism). Analyzing the legal certainty aspects of deposit guarantor in statutory regulations and customary law is the aim of this research. This study uses a normative legal research methodology. This study uses two types of approaches namely, the statute and the conceptual approaches. The legal materials chosen as the basic analysis are primary and secondary legal materials. The conclusion of this study shows that the role of state law is more dominant than customary law. The above conclusion is shown by the fact of the research that most of the matters related to the technical operations of the LPD are regulated by the state law, in this case, is regional regulation about LPD. Based on the results of the study on the norms of local regulations on LPD and the nine awig –awig as a form of customary law from representatives of the nine regencies and city in Bali, there is no regulation on deposit guarantor institutions for LPD customers in Bali to provide legal protection. So that, regulating LPDs in Bali with two legal systems, namely the state law and the customary law system, does not guarantee legal certainty for the safety of customer's deposits. Pengaturan perlindungan hukum bagi nasabah yang mempunyai dana simpanan  di Lembaga Perkreditan Desa (LPD) saat ini tidak jelas. Hal ini menyebabkan tidak ada kepastian hukum bagi nasabah apabila LPD mengalami masalah keuangan. Keberadaan LPD di Bali diatur dalam dua jenis aturan hukum yaitu hukum negara dan hukum adat  (pluralisme hukum). Mengkaji aspek kepastian hukum penjamin simpanan  dalam setiap norma dalam peraturan perundang-undangan serta dalam hukum adat merupakan tujuan penelitian ini. Penelitian ini menggunakan metode penelitian hukum doktrinal (normatif). Penelitian ini menggunakan dua jenis pendekatan yaitu pendekatan peraturan perundang-undangan (statute approach), dan pendekatan konsep (conceptual approach). Adapun bahan hukum yang dipilih sebagai dasar analisis adalah bahan hukum primer dan bahan hukum sekunder. Kemudian kesimpulan dari penelitian ini menyebutkan bahwa dua sistem hukum dalam pengaturan LPD di Bali menunjukkan peran hukum negara lebih dominan daripada hukum adat.  Kesimpulan ini ditunjukkan oleh fakta penelitian yang ditemukan bahwa sebagian besar hal yang berkaitan dengan teknis operasional LPD yang merupakan satu-satunya organisasi keuangan milik Desa Adat di Bali diatur oleh hukum negara dalam hal ini diatur dalam peraturan daerah tentang LPD. Kemudian, berdasarkan hasil kajian terhadap norma peraturan daerah tentang LPD dan terhadap sembilan awig–awig sebagai bentuk hukum adat dari perwakilan Kabupaten dan Kota di Bali, tidak ada ditemukan pengaturan tentang lembaga penjamin simpanan bagi nasabah LPD di Bali untuk memberikan perlindungan hukum. Dengan demikian pengaturan LPD di Bali dengan dua sistem hukum yaitu hukum negara dan sistem hukum adat ternyata tidak menjamin kepastian hukum bagi keamanan dana simpanan para nasabah.

Labor law in Indonesia has not comprehensively provided protection for the rights of resigning workers qualification. Since provisions of labor law does not mention the amount of separation pay for resigning workers. This research is conducted to analyze and find the ratio legis in providing separation pay for resigning workers in the Manpower Act and also the concept of giving separation pay to resigning workers in justice perspective. The research method used in this study is normative legal research by using several approach including philosophical approach, purposive approach, conceptual approach, case approach and historical approach. The result of the study shows that the regulation of separation pay in the Manpower Act is a form of reward for workers given by employers as a reward for devotion and loyalty of workers during a certain period of service. The Regulation of separation pay for resigning workers which reflecting justice is by formulating separation pay for resigning workers equal to the rights of terminated workers because of committing criminal act.

Peran Kearifan Lokal Masyarakat Membuka Lahan dengan Cara Membakar sebagai Upaya Mencegah Kebakaran Hutan dan Lahan   Ali Imran Nasution[1], Taupiqqurrahman[2] Abstract The majority of Indonesian people's livelihoods are farming, which requires a lot of land to be used as agricultural field. Limited land requires clearing land from forests so that it can be used as new land for farmers. Clearing land by cutting and burning trees in a forest area is prohibited by law. However, there are exceptions to local wisdom which burns land with a maximum land area of 2 hectares per family to be planted with local varieties of plants and surrounded by firebreaks to prevent the spread of fire to the surrounding area. The purpose of this study is to analyze the role of local wisdom in clearing land by burning in an effort to prevent forest and land fires and the law enforcement against violations of the rules on how to clear land by burning. The research method uses the type of normative legal research with the statue approach and conceptual approach. The results showed that the role of local wisdom in burning forests by local wisdom received constitutional recognition and could prevent extensive forest fires. Keywords: Local Wisdom, Burning, Preventing Forest Fires Abstrak Mayoritas pencaharian masyarakat Indonesia adalah bertani, yang tentunya membutuhkan banyak lahan untuk dipakai sebagai lahan bertani. Keterbatasan lahan membutuhkan pembukaan lahan dari hutan agar dapat dijadikan lahan baru bagi petani. Membuka lahan dengan cara menebang dan membakar pohon di kawasan hutan adalah perbuatan yang dilarang oleh undang-undang. Namun, terdapat pengecualian terhadap kearifan lokal yang melakukan pembakaran lahan dengan luas lahan maksimal 2 hektar per kepala keluarga untuk ditanami tanaman jenis varietas lokal dan dikelilingi oleh sekat bakar sebagai pencegah penjalaran api ke wilayah sekelilingnya. Tujuan penelitian ini menganalisis peran kearifan lokal membuka lahan dengan cara membakar sebagai upaya mencegah kebakaran hutan dan lahan serta penegakan hukum terhadap pelanggaran ketentuan tata cara membuka lahan dengan cara membakar. Metode penelitian menggunakan jenis penelitian hukum normatif dengan pendekatan undang-undang (statue approach) dan pendekatan konseptual (conseptual approach). Hasil penelitian menunjukkan peran kearifan lokal membakar hutan dengan cara kearifan lokal mendapat pengakuan konstitusional dan dapat mencegah kebakarn hutan yang luas. Tujuan penelitian ini untuk menganalisis perlindungan hukum terhadap produk wine salak desa sibetan berdasarkan Peraturan Pemerintah No 51 tahun 2007 tentang Indikasi Geogerafis. Tulisan ini menggunakan metode penelitian hukum empiris. Pendekatan yang digunakan dalam penelitian ini yakni pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukan bahwa perlindungan hukum terhadap wine salak produksi desa Sibetan, kecamatan Bebandem kabupaten karangasem ditinjau dari Peraturan Pemerintah Nomor 51 Tahun 2007 tentang Indikasi-Geografis belum mampu meningkatkan perekonomian masyarakat setempat terbukti belum terdaftarnya sebagai indikasi geografis dan hal ini berdampak pada nilai jual wine tersebut yang terbilang murah seukuran produksi wine serta pemasarannya belum luas hanya sebatas wisatawan yang berkunjung saja. The purpose of this study was to analyze the legal protection of salak wine products in the Sibetan village based on Government Regulation No. 51 of 2007 concerning Geographical Indications. This paper uses an empirical legal research method. The approach used in this research is the statute approach and the conceptual approach. The results showed that the legal protection of salak wine produced in Sibetan village, Bebandem sub-district, Karangasem district in terms of Government Regulation Number 51 of 2007 concerning Geographical Indications has not been able to improve the local economy, it is proven that it has not been registered as a geographical indication and this has an impact on the selling value of the wine. which is relatively inexpensive about the size of wine production and its marketing is not extensive, only limited to visiting tourists.

The use of the environment today is very important in order to provide benefits to the community. Utilization must also be balanced with good management and avoid damage. Anomaly in the use of the environment that causes widespread damage occurs where there is a role of the corporation as the main actor. The presence of the PPLH Law has not been able to be a solution amid the chaotic environment utilization that is in line with the damage because the existing legal instruments are not able to overcome the problem. This paper has a purpose to analyze the weakness in the resolution of criminal acts of the environment and the extent to which restorative justice is able to overcome the conflict due to environmental criminal act between the corporation and the community. This research method uses normative legal research methods with a conceptual approach. This study obtained the first result, the legal instrument in the PPLH Law has not shown success where there is still widespread environmental destruction today. Second, through the restorative justice approach it is expected to be able to reduce the number of environmental criminal acts by corporations using the dual mediation pattern, namely the merging of the concepts of civil case mediation and penal mediation so as to create a balance pattern that is in line with the direction of the renewal of national criminal law.              Pemanfaatan lingkungan hidup dewasa ini amat penting dilakukan guna memberikan manfaat terhadap masyarakat. Pemanfaatan harus pula diimbangi dengan pengelolaan yang baik dan menghindari kerusakan. Anomali pemanfaatan lingkungan hidup yang menyebabkan kerusakan marak terjadi, di mana terdapat peran korporasi sebagai aktor utama. Kehadiran UU PPLH masih belum mampu menjadi solusi di tengah carut marutnya pemanfaatan lingkungan yang sejalan dengan kerusakan karena instrumen hukum yang ada tidak mampu mengatasi masalah tersebut. Tulisan ini memiliki tujuan untuk menganalisa kelemahan dalam penyelesaian tindak pidana lingkungan hidup dan sejauh mana restorative justice mampu mengatasi konflik akibat tindak pidana lingkungan hidup antara korporasi dan masyarakat. Metode penelitian yang digunakan yaitu penelitian hukum normatif dengan pendekatan konseptual. Penelitian ini memperoleh hasil pertama, instrumen hukum di UU PPLH belum menunjukkan keberhasilan di mana masih maraknya kejadian pengrusakan lingkungan hidup hingga saat ini. Kedua, melalui pendekatan restorative justice diharapkan dapat menekan angka tindak pidana lingkungan hidup oleh korporasi menggunakan pola dual mediasi yaitu penggabungan konsep mediasi perkara perdata dan mediasi penal sehingga dapat menciptakan pola keseimbangan yang selaras dengan arah pembaruan hukum pidana Nasional.
