Regional autonomy is given broad authority, real and accountable to local governments in proportion. In line with the local government should be able to utilize the potential of area resources optimally. However, under Regulation No 25 ps 2 verse 3, yr 2000 showed that specific authority perbibitan and arrangements regarding disease prevention remains a central government authority in this regard is Breed Livestock Directorate. Do with the efforts to develop livestock breeding cattle in various respo . In an effort to increase the population of cattle beef cattle , a policy that could be done by the East Java Provincial Government "Berlian" program. Meanwhile, Bali local government has declared Simantri Program, Jambi Provincial Government still relies on the center's programs, while in West Java are still doing investigations were the provinces that have the potential technical and non- technical support. This paper is part of the research results about the prospect of Livestock Breeding Beef Cattle Expansion medium scale done in 2012 by the Center for Economic and Social Agriculture . This study is based on the low success of local governments' financial performance in West Java Province, as evidenced by the fact that financial reports of local governments that receive unqualified opinions are still being found. The detection of numerous frauds in local governments is responsible for the majority of incidents of poor financial performance in local governments. Local government financial performance is related to local government size, dependence on central government, local spending, and audit findings. The purpose of this study was to examine the influence of local government characteristics and audit findings on the financial performance of local governments. Techniques analyzing data used regression model selection test with STATA version 16. This study builds on agency theory to develop a conceptual framework that connects local government size, dependence on central government, local expenditure, audit findings, and financial performance. The results of this study show that the size of local government, local spending has a significant effect on local government financial performance based on independence ratio and operating expenditure activity ratio, local government financial performance is unaffected by the dependence of central government or audit findings. Contributions to the West Java Provincial Government are required to be taken into account when making decisions and policies for the improved financial performance of local government.

Penyelenggaraan kewenangan pemerintah daerah telah bergeser ke arah prinsip ultra vires doctrine yang nampak pada perumusan kewenangan pemerintah daerah menjadi urusan pemerintah daerah, dan pembagian kewenangan pemerintah pusat dan daerah mengedepankan prinsip yang kongkuren.Kondisi ini ditandai dengan penyelenggaraan urusan pendidikan yang terbagi antara pemerintah kabupaten/kota dengan pemerintah provinsi, dimana untuk pendidikan dasar diselenggarakan oleh pemerintah kabupaten/kota sedang pendidikan menengah dikelola oleh pemerintah provinsi. Penelitian ini dilakukan dengan pendekatan motode kualitatif melalui observasi dan kajian pustaka.  Hasil dari penelitian ini menunjukkan penyelenggaraan urusan pendidikan menengah yang dialihkan kepada pemerintah provinsi akan menimbulkan sejumlah kecenderungan baru dalam pengelolaannya baik pada pemerintah daerah maupun pada pemerintah provinsi. Pertama, bahwa kebijakan – kebijakan yang selama ini dikeluarkan oleh pemerintah daerah terkait bidang pendidikan tidak seluruhnya akan diakomodir oleh pemerintah provinsi. Kedua, kecenderungan pada meningkatnya alokasi anggaran pada pemerintah provinsi sebagai ekses pengalihan kewenangan tersebut. Ketiga, proses evaluasi, pengawasan dan pengendalian penyelenggaraan pendidikan menengah oleh pemerintah provinsi yang akan semakin berat dilihat dari sisi letak geografis wilayah, dan keempat kekhawatiran akan kurang terakomodirnya muatan kearifan lokal dalam penerapan kurikulum, dimana sebelumnya setiap kabupaten/kota tentunya memiliki karakteristik budaya yang berbeda sebagai bentuk kearifan lokal yang dapat menjadi penguat dalam penyusunan kurikulum pendidikan. Key Words : Penyelenggaraan Urusan Pemerintahan, Pendidikan Menengah   Abstract Implementation of local government authority has shifted towards the principle of ultra vires doctrine which appears on the formulation of local government authority to the affairs of local government, and the division of central and local government authority put forward the principle of kongkuren. This condition is characterized by the implementation of educational affairs divided between district / municipal governments and provincial governments, where basic education is administered by district / municipal governments while high school is managed by the provincial government. This research was conducted with qualitative motive approach through observation and literature review. The results of this study indicate that the implementation of secondary education affairs transferred to the provincial government will lead to new trends in the management of both local government and provincial governments. First, that the policies that have been issued by local governments related to the education sector will not be entirely accommodated by the provincial government. Second, the tendency to increase budget allocation to the provincial government as an excess of the transfer of authority. Third, the process of evaluation, supervision and control of the implementation of high school by the provincial government will be more severe in terms of geographical location of the region, and the four concerns will be less accommodated local wisdom content in the application of the curriculum, where previously each district government / different as a form of local wisdom that can be a reinforcement in the preparation of educational curriculum. This paper provides the organizational structure of institu-tional investment in the city of Bandung.Dalam Undang-Undang Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah dise-butkan mengenai urusan wajib dan urusan pilihan, dimana salah satu urusan wajib ini adalah pena-naman modal, kemudian dalam Peraturan Pemerintah Nomor 38 Tahun 2007 tentang Pembagian urusan antara pemerintah pusat, pemerintah provinsi, dan pemerintah kabupaten/kota, salah satu kewenangan pemerintah daerah adalah dalam bidang penanaman modal, di pemerintahan Kota Bandung, penanaman modal yang merupakan urusan wajib dan salah satu kewenangan pemerintah daerah ditempatkan dalam struktur organisasi Bappeda Kota Bandung yaitu pada Bidang Pena-naman Modal, ini tentu saja berseberangan dengan UU No. 32 Tahun 2004/UU No. 23 Tahun 2014 dan Peraturan Pemerintah No. 38 Tahun 2007. Artikel ini berisi tentang struktur organisasi kelem-bagaan penanaman modal di Kota Bandung.

In the National Medium-Term Development Plan 2015-2019 especially in West Java Province, namely the construction of Kertajati Airport, located in Majalengka Regency. Therefore, the West Java provincial government has drawn up Regional Regulation No. 13 of 2010 concerning the Development and Development of West Java International Airport and Kertajati Aerocity. Kertajati Aerocity will carry out its duty to promote and strengthen the creation of an engine of economic growth in the western part of Indonesia that will involve the participation of local governments, the central government, investors and the community. So, the purpose of this article is to analyze the investment scheme in the development of Aerocity Kertajati in Majalengka Regency which is oriented to the principles of good corporate governance. The conclusion of this article is the Investment Scheme in Kertajati Aerocity Development in Majalengka Regency, West Java, namely through cooperation between PT BIJB and investors (land authorities) in terms of land acquisition and development cooperation relationships and development of the Aerocity Kertajati area. Investment Scheme in Kertajati Aerocity Development in Majalengka Regency, West Java Oriented Principles of Good Corporate Governance namely by implementing Good Government Governance, namely the government as one of the parties in its role of building and developing the Aerocity Kertajati area must refer to good values, clean and fair, and Good Corporate Governance must be reflected in the management of PT BIJB's business activities as an extension of the West Java provincial government covering transparency, accountability, responsibility, independence, and justice.

AbstractLaw Number 3 of 2020 is a new chapter in the development of mining law politics in Indonesia. The latest Minerba Law brings a number of major changes, one of which is the regulation of the authority to issue mining permits which has been transferred entirely to the central government. These changes caused controversy because the were considered contrary to constitutional values and the spirit of reform by eliminating the role of local governments in mineral and coal mining activities. The purpose of this study is to determine the legal politics of transferring mining permits to the central government and its implications for local government authority. This research is quantitative study using a normative juridical method through a statue approach and conceptual approach. This research finds that the legal politics of transferring mining permits to the central government is aimed at solving mining permit problems that facilitate investment activities so as to increase the country’s economic growth. However, the implications of this transfer of authority make regional governments no longer have attributive authority to issue mining permits. The current mining law should move to create synergy between governments, not by placing the central government and local governments on different paths for the sustainability of future development.Keywords : Politics of law; Mining Permit; Local Government Authority.                     AbstrakUU Nomor 3 Tahun 2020 merupakan babak baru dalam perkembangan politik hukum pertambangan di Indonesia. UU Minerba terbaru membawa sejumlah perubahan besar salah satunya mengenai pengaturan kewenangan penerbitan izin pertambangan yang dialihkan seluruhnya kepada pemerintah pusat. Perubahan tersebut menimbulkan kontroversi karena dianggap bertentangan dengan nilai konstitusi dan semangat reformasi dengan menihilkan peran pemerintah daerah dalam kegiatan pertambangan minerba. Tujuan penelitian ini adalah untuk mengetahui politik hukum pengalihan izin pertambangan kepada pemerintah pusat dan implikasinya terhadap kewenangan pemerintah daerah. Penelitian ini merupakan penelitian kuantitatif dengan metode yuridis normatif melalui pendekatan undang-undang dan pendekatan konseptual. Penelitian ini menemukan bahwa politik hukum pengalihan izin pertambangan kepada pemerintah pusat ditujukan untuk mengurai permasalahan izin pertambangan yang memudahkan kegiatan investasi sehingga dapat meningkatkan pertumbuhan ekonomi negara. Namun, implikasi yang ditimbulkan akibat pengalihan kewenangan tersebut membuat pemerintah daerah tidak lagi memiliki kewenangan atributif dalam melakukan penerbitan izin pertambangan. Seharusnya hukum pertambangan yang ada saat ini bergerak untuk menciptakan sinergisitas antar pemerintahan bukan dengan menempatkan pemerintah pusat dan pemerintah daerah pada jalan yang berbeda demi keberlangsungan pembangunan di masa depan.Kata kunci : Politik Hukum, Izin Pertambangan; Kewenangan Pemerintah Daerah.

Abstract Amendments to the laws on local government undnagan impact on local government authority in running the affairs of government. For 10 years Indonesian running the regional autonomy system using Law No. 32 of 2004 on local government, and amendments thereto, for the moment the law declared invalid by the enactment of Law No. 23 Year 2014 on Regional Government, the State Gazette of the Republic of Indonesia Year 2014 No. 244, on October 2, 2014. in the Act governing the affairs of government that must be done by the central government, provincial government and local government district / city. Some affairs are regulated in more detail in the Government Regulation No. 18 Year 2016 concerning the Region, which regulates the scope of authority in dealing with government affairs. PP No. 1/2016 outlining the areas that must be held in an area with indicator, scale of values that can be found local work load. Environmental Management itself in Law number 23/2014 and Government Regulation No. 1/2016 is a category / classified in the Mandatory government affairs unrelated to basic services.Keywords: Local authorities, Environment, government affairs

As a staple food in Indonesia, the availability of rice are needed to continue until whenever. Because agriculture is still the source of livelihood of the majority of the workforce in Indonesia. Hence the presence of the government is necessary, governments can differentiate into central government and local governments. In UUD 1945 Pasal 18A ayat (1) mentions the relationship of authority between the central government and provincial government, counties, and cities, or between provinces and districts and cities, regulated by law with due regard to the specificity and diversity of the area. Regional autonomy is one manifestation of freedom for the regions to be involved in designing the activity of politics and government at the local level in order to strengthen the power of national government. Thus the role of local government is very important to the affairs of the availability of rice in the presence of local autonomy. The local government and regional autonomy can be free to design a territory in support of the central government towards food security.Undang-Undang No. 18 tahun 2012 tentang Pangan mentions the issue of food intended to achieve three things at once, namely food sovereignty, food self-sufficiency and food security. President Jokowi that: "Food security is distinct from food sovereignty. Food security is simply the availability of foodstuffs (logistics) in the warehouse and on the market irrespective of origin whether imported or locally produced. Food sovereignty means that we manufacture and market our own groceries, while surplus production is exported ". Here we can see that food sovereignty is significantly deeper than food security. thus, the optimization of local governments in order to achieve food sovereignty can be: 1. the agrarian reform (land protection by performing a spatial planning regulations); 2. the legal protection to farmers (by making regulations that aim the welfare of farmers); 3. the availability of seeds, fertilizers and tools supporting production; 4. Registering brands and geographical indications of agricultural products to the Directorate General of Intellectual Property Ministry of law and Human Rights Republic of Indonesia; 5. setting the price, product quality and market share of an agricultural product. Keywords: Food Security; Food Sovereignty; Rice; Regional Government.

Government financial reporting as public accountability and transparency is important. Previous research show that almost all local government in Indonesia have their official website, which is active use as presenting news, local potentials, and local government services. Unfortunately, there are still limited local governments which are disclose their financial information as well as budgeting reports and financial statements on their websites. This research aims to explore whether political competition, local asset, local dependency, population density, and information openness award have influenced IFR practice in government in Indonesia. We investigate financial report and budget report as of internet financial reporting (IFR) data of 32 provincial government websites. Indonesia consists of 34 provinces, which are 32 provincial websites consistently accessible and use as sample in this research. The empirical results show that local dependency toward central government and Information Openness Award positively significant influence IFR practices in provincial level in Indonesia. There is no significant influenced of political competition, local asset and population density to IFR in Indonesia Provinces website. Our research contribution is to extend previous research by concerning Information Openness Award as independent variable which influenced to IFR practice in local government.

Gaps in biodiversity conservation management within the Conservation Area that are the responsibility of the central government and outside the Conservation Areas or as the Essential Ecosystems Area (EEA) which are the authority of the Regional Government, have caused various spatial conflicts between wildlife /wild plants and land management activities. Several obstacles faced by the Local Government to conduct its authority to manage (EEA), caused the number and area of EEA determined by the Local Government to be still low. At present only 703,000 ha are determined from the 67 million ha indicated by EEA. This study aims to overview biodiversity conservation policies by local governments and company perceptions in implementing conservation policies and formulate strategies for optimizing the role of Local Governments. From the results of this study, there has not been found any legal umbrella for the implementation of Law number 23/ 2014 related to the conservation of important ecosystems in the regions. This regulatory vacuum leaves the local government in a dilemma for continuing various conservation programs. By using a SWOT to the internal strategic environment and external stratetegic environment of the Environment and Forestry Service, Bengkulu Province , as well as using an analysis of company perceptions of the conservation policies regulatary , this study has been formulated a “survival strategy” through collaboration between the Central Government, Local Governments and the Private Sector to optimize the role of Local Government’s to establish EEA in the regions.Keywords: Management gaps, Essential Ecosystems Area (EEA), Conservation Areas, SWOT analysis and perception analysis

The participation of a third party of the environmental service enterprise theoretically increases the level and efficiency of soil pollution control in China. However, Chinese-style fiscal decentralization may have a negative impact on the behaviors of participants, especially the local government. First, this paper conducts a positioning analysis on participants of the third-party soil pollution control in China and discusses the behavioral dissimilation of the local government under fiscal decentralization. Second, taking the government’s third-party soil pollution control as a case, a two-party game model of the central government and the local government is established around the principal-agent relationship, and a tripartite game model of the central government, the local government, and the third-party enterprise is designed around the collusion between the local government and the third-party enterprise. The results show that Chinese-style fiscal decentralization may lead to the behavioral dissimilation of local governments, that is, they may choose not to implement or passively implement the third-party control, and choose to conspire with third-party enterprises. Improving the benefits from implementing the third-party control of local governments and third-party enterprises, enhancing the central government’s supervision probability and capacity, and strengthening the central government’s punishment for behavioral dissimilation are conducive to the implementation of the third-party soil pollution control. Finally, this study puts forward policy suggestions on dividing the administrative powers between the central and local government in third-party control, building appraisal systems for the local government’s environmental protection performance, constructing environmental regulation mechanisms involving the government, market and society, and formulating the incentive and restraint policies for the participants in the third-party soil pollution control.
