The implementation of Constitutional Court Decisions often creates polemics in the Indonesian Constitutional System, especially those relating to the Implementation of Constitutional Court Decisions related to Ministries / Institutions where in implementing Constitutional Court Decisions can only be done through legal products issued internally by ministries / institutions related and often overlaps with legislation that has not been amended. This is caused by the relevant Ministries / Institutions not having the authority to make changes to the Law in which the authority is owned by the President as the executive and the House of Representatives as the legislative. While the Court's Decision The constitution often has a direct impact and can bring great changes to the people in obtaining justice. This type of research is used Normative Juridical Research Method, namely by examining library materials. This study uses a philosophical approach because the object of the study examines the principle of legal certainty in the implementation of the Constitutional Court's decision through the regulation of state institutions and Perppu. In addition, the legislative approach is also used to find out the reasons for the Constitutional Court's decisions that often overlap in implementation.Implementasi Putusan Mahkamah Konstitusi seringkali menimbulkan polemik dalam Sistem Ketatanegaraan Indonesia,terutama yang berkaitan dengan Pelaksanaan Putusan Mahkamah Konstitusi yang terkait dengan Kementerian/Lembaga yang di mana dalam melaksanakan Putusan Mahkamah Konstitusi hanya dapat dilakukan melalui produk-produk hukum yang dikeluarkan secara internal oleh kementerian/lembaga terkait dan seringkali mengalami tumpang tindih dengan  Peraturan Perundang-undangan yang belum mengalami perubahan.Hal ini disebakan Kementerian/Lembaga terkait tidak mempunyai kewenangan dalam melakukan perubahan  Undang-undang yang di mana kewenangan tersebut dimiliki oleh Presiden sebagai eksekutif  dan  DPR selaku legislatif.Sedangkan Putusan Mahkamah Konstitusi seringkali berdampak langsung dan dapat membawa perubahan besar bagi rakyat dalam memperoleh keadilan. Jenis Penelitian yang digunakan Metode Penelitian Yuridis Normatif,  yaitu dengan meneliti  bahan  kepustakaan.  Penelitian  ini  menggunakan  pendekatan  filosofis karena  objek  penelitian  mengkaji  asas kepastian hukum dalam implementasi putusan MK melalui peraturan lembaga negara dan perppu.  Di  samping  itu,  juga  digunakan pendekatan perundang-undangan untuk mengetahui alasan putusan MK seringkali mengalami tumpang tindih dalam implementasi.

Abstrak Kedudukan Komisi Pemberantasan Korupsi (KPK) dalam sistem ketatanegaraan Indonesia memang seringkali diperdebatkan, hal ini terbukti dengan Putusan-Putusan MK yang berubah-ubah. Mahkamah Konstitusi dalam putusannya pernah beberapa kali memutuskan berbeda tentang kedudukan KPK ini dalam sistem ketatanegaraan Indonesia. Mahkamah Konstitusi pernah memutuskan KPK merupakan lembaga negara independen di luar ranah kekuasaan eksekutif, legislatif, dan yudikatif. Pernah pula memutuskan bahwa KPK merupakan eksekutif dilihat dari kewenangannya. Putusan-putusan MK ini tentu saja membawa pengaruh terhadap undang-undang KPK. Revisi undang-undang KPK terbaru, yaitu Undang-Undang Nomor 19 Tahun 2019 menyatakan KPK masuk dalam ranah kekuasaan eksekutif sehingga dengan demikian KPK dapat menjadi objek hak angket Dewan Perwakilan Rakyat (DPR). Hal demikian tentu saja menambah panjang perdebatan di kalangan ahli hukum dengan argumentasinya masing-masing. Dari argumentasi-argumentasi tersebut penulis menganggap KPK adalah lembaga negara independen di luar struktur organ negara yang utama. Hal ini sejalan dengan theory the new separation of power sebagai konsekuensi dari teori negara kesejahteraan (welfare state) di era abad modern ini. Sebagai lembaga negara independen yang kedudukannya tidak sekuat lembaga negara utama dalam ranah kekuasaan eksekutif, legislatif, dan yudikatif tentu saja KPK bisa dibubarkan jika lembaga yang selama ini sebetulnya mempunyai wewenang kuat untuk melaksanakan penegakan hukum dalam rangka pemberantasan tindak pidana korupsi (Kepolisian dan Kejaksaan) mampu berbenah diri. Selama belum mampu berbenah maka wewenang tersebut bisa dilaksanakan oleh KPK yang keberadaannya sampai saat ini masih tetap diperlukan dalam rangka pemberantasan tindak pidana korupsi di Indonesia. Kata kunci: Kedudukan KPK, Sistem Ketatanegaraan, Indonesia Abstract The position of the Corruption Eradication Commission (KPK) in the constitutional system of Indonesia is often debated. This is evidenced by the inconsistent decisions of the Constitutional Court. The Constitutional Court has ever made different decisions several times regarding the position of the Corruption Eradication Commission (KPK) in the constitutional system of Indonesia. The Constitutional Court once decided that the Corruption Eradication Commission (KPK) was an independent state institution outside the realm of executive, legislative and judicial powers. It has also decided that the Corruption Eradication Commission (KPK) is an executive body in terms of its authority. These inconsistent decisions of the Constitutional Court, of course, have an influence on the law of the Corruption Eradication Commission (KPK). The latest revision of the law of the Corruption Eradication Commission (KPK), namely the Law Number 19 of 2019 states that the Corruption Eradication Commission (KPK) is classified to be in the realm of executive power so that the Corruption Eradication Commission (KPK) can become the object of the right to inquiry by the House of Representatives (DPR). This situation, of course, adds to the length of debate among legal experts with their respective arguments. Based on these arguments, the writer considers that the Corruption Eradication Commission (KPK) is an independent state institution outside the main state organ structure. This is in line with the theory of the new separation of power as a consequence of the theory of the welfare state in this modern era. As an independent state institution whose position is not as strong as the main state institutions in the realm of executive, legislative and judicial powers, of course, the Corruption Eradication Commission (KPK) can be dissolved if the institutions that actually have strong authority to carry out law enforcement in the context of eradicating criminal acts of corruption (Police and Prosecutors) are able to empower themselves to execute their authority. However, if those institutions have not been able to execute their authority, this authority can be exercised by the Corruption Eradication Commission (KPK), whose existence is still needed in the context of eradicating criminal acts of corruption in Indonesia.

<p><em>The purpose of this research was to determine the People's Consultative Assembly in the Indonesian constitutional system. This research was a type of library research which is descriptive analytic through a qualitative approach that is based on comparative studies. The results of this research indicated that there are fundamental differences between the People's Consultative Assembly before and after the amendment to the 1945 Constitution. The differences included (1) the change in the position of the People's Consultative Assembly from the highest state institution to a state institution that is equal to other state institutions, (2) changes in the membership structure of the People's Consultative Assembly from those previously consisted of House of Representatives, Group Envoys and Regional Representatives, then became members of the House of Representatives and Regional Representative Board members, (3) the policy to appoint People's Consultative Assembly members was replaced by an election system, (4) the People's Consultative Assembly no longer stipulates the Broad Outlines of the Nation's Direction along with filling the position of President through participation the people directly in the election, (5) limitation of the People's Consultative Assembly's authority in amending the 1945 Constitution, (6) the inauguration of the President and / or Vice President in normal and abnormal conditions, (8) the authority of the People's Consultative Assembly to dismiss the President and / or Vice President must be through a forum previlegiatum.</em></p><p><strong>Keywords</strong>: <em>People's Consultative Assembly, State Administration, Amendment to the 1945 Constitution.</em></p>

Starting from the need for capital, in practice some people are reluctant to make credit with banks, because the process is considered difficult, and too convoluted. Therefore, some people prefer to borrow a certain amount of money from individuals or what is better known as debt or credit. Talking about the debt and credit agreement, it will be closely related to collateral because every creditor needs a sense of security for the funds he lends. The author's research is made to examine and find out what efforts can be made if there is default in an underhand debt acknowledgment that guarantees the title of title to land without being preceded by a principal agreement, as well as the judge's consideration (Ratio Decidendi) in the Cassation Decision Number 837K / Pdt / 2019 concerning default in the debt acknowledgment. The research method used in this study is a descriptive normative juridical approach, namely research that refers to the legal norms contained in statutory regulations and court decisions. The results of the research obtained by the author in this study are the first consideration of the judge in deciding Case Number 837 / K / Pdt / 2019 is not quite right because in theory the judge's decision overrides legal certainty for a civil case by deciding in default of a debt acknowledgment, which then the judge also also declared null and void the debt acknowledgment. Where based on the provisions of Article 12 of Law Number 4 of 1996 concerning Mortgage Rights, the guarantee which is the object of the author's research, is a forbidden cause that is contrary to the validity of an agreement, so that the legal consequences are null and void from the start without having to obey prior default in the debt recognition deed. So that the author's suggestion is necessary for parties who want to carry out lending and borrowing activities, especially in terms of debt and credit, first understand any rules and legal norms that apply to their actions, so that they will not cause losses among the parties who bind themselves in the future.

The affirmation of the attorney general's authority in the Elucidation of Article 35 letter C of the Indonesian Prosecutor's Law after the decision of the Constitutional Court Number 29/PUU-XIV/2016 still leaves problems and has the potential to cause new legal problems. This research will look at and analyze how the authority of the Attorney General after the decision is as well as how the concept of an ideal arrangement that ensures legal certainty. This research uses normative juridical research with a statutory approach and case studies which in this case are court decisions. The results showed that after Constitutional Court decision, there was a change in the meaning of the Elucidation of Article 35 letter c of the Republic of Indonesia Prosecutor's Law. Based on the results of these interpretations and decisions, the legal implications that followed were related to the conditions for setting aside cases in the public interest, namely in setting aside cases in the public interest, the Attorney General was required to 'require' first to pay attention to suggestions and opinions from state power agencies that have relationship with the problem. The concept of an ideal arrangement that can guarantee legal certainty as an indicator to measure and assess the implementation of the Attorney General's obligations can be done by clarifying the definition of "state power agencies" for which advice and opinions are requested and making criteria for the term "public interest".

The Judicial Commission (JC) is a new independent state institution established as a product of the reform in the constitutional system and its existence is confirmed in the 1945 Constitution. The Judicial Commission was established following the idea of a one-roof system in the judicial authority. Among the roles and authority of the Judicial Commission are to propose appointment of the Supreme Court justices to the House of Representatives (DPR) and to supervise the conducts of justices/judges in order to maintain their respect, dignity and honor and good conduct.  However, in the performance of its duties, the Judicial Commission is not yet as independent as it has been expected. It can be seen from its limited authority. In supervising the conduct of the judges/justices, the Commission is not authorized to impose any sanctions and in the process of selection of candidates for the Supreme Court justices, its authority is limited only at the ratio 3:1. Therefore, the existence of the Commission under the 1945 Constitution becomes unclear, since it is placed under the chapter of the judicial authority, but in reality it does not exercise its judicial authority and only functions as a supervisory agency like the State Audit Board (BPK) instead. Consequently, the Commission only serves as the supporting institution to the Supreme Court, President and the House of Representatives. In order that the Commission becomes truly independent as an institution which supervises the implementation of the judicial power sitting at an equal level with other state institutions, it is necessary to strengthen the institution by making amendments (to re-determine the position of the Judicial Commission) in the 1945 Constitution and other relevant laws and regulations.

Thus, no doubt that the regulations set by state institutions, have binding force that must be obeyed by the parties set forth therein. While the Regulations issued policy also recognized as an Freies Ermessen in the execution of its duties and functions.<br /><br />

The research aims to enlight the overview about the urgent of the Broad Guidelines of State Policy (GBHN) as the product of the People’s Consultative Assembly (MPR) by using the dogmatic approach. The amendment of the 1945 Constitution has changed the Indonesian constitutional system. According to the article 2 paragraph (1) of the 1945 Constitution, highest authority remains in the hands of the people and is carried out according to the Constitution. The constitutional design of the Indonesian government system is presidential. However, the implementation often reaps many obstacles and problems, the consequences of amendments, eliminating the authority of the People’s Consultative Assembly (MPR) in terms of electing the President and Vice President, and determining the Broad Guidelines of State Policy (GBHN). MPR is no longer placed as the highest institution of the country and the perpetrators of popular sovereignity. The Constitution which is the holder of popular sovereignty in the practice adheres to a clear and strict understanding of the separation of powers. Like in the legislative field there are People’s Consultative Assembly (MPR), House of Representatives (DPR) and Regional Representative Board (DPD); in the executive field there are Presidents and Vice Presidents elected by the people; in the judicial sector there are the Supreme Court, the Constitutional Court and the Judicial Commission; in the field of financial supervision there is a Indonesian Supreme Audit Institution (BPK). Changes in the position, function and authority of the MPR have implications for the emergence of the National Development Planning System and the National Long-Term Development Plan which became the authority of the elected President. The President that won the election as a basic guidelines for implementing development as the replacement of the GBHN.

In Indonesia, the Constitutional Court is the sole interpreter and guardian of the constitution and the decision made by this Court is expected to meet a sense of justice, utility, and legal certainty. This paper argues that there is a contradiction between two decisions ruled by the Court resulted in inconsistent constitutional interpretations. Such inconsistency can be referred to the decision of the Constitutional Court Number 072-073/PUU-II/2004 declaring the Constitutional Court to have the power to adjudicate disputes over the results of regional head elections, while on the other hand, the decision of the Constitutional Court Number 97/PUU-XI/2013 ruled this institution no longer to adjudicate disputes over the results of regional head elections by revoking Article 236C of the revised Regional Government Act No. 12/2008. In doing so, this paper analyzes the impact of such contradictory decisions on uncertainty in the legal dispute regarding regional head election results. This paper concludes that such inconsistency was caused by the application of two different approaches: the first decision applied judicial activism and the latter considered judicial restraint. Tujuan penelitian untuk mengkaji akibat hukum serta penyelesaian terhadap harta bersama berdasarkan hukum perkawinan apabila terjadi perceraian dan pemisahan harta bersama karena suatu hal. Penelitian ini menggunakan metode penelitian hukum normative, yakni suatu penelitian yang berdasarkan pada pendekatan perundang-undangan, bahan pustaka, putusan pengadilan dan ketentuan yang sebagaimana mestinya. Serta teknik pengumpulan data dilakukan dengan studi dokumen. Hasil studi menunjukkan bahwa dengan adanya suatu perjanjian dalam perkawinan maka harta benda dan harta bersama dari kedua pihak akan memiliki kepastian hukum yang tetap jika dilihat dari perspektif hukum. Penyelesaian harta bersama biasanya dilakukan dengan cara pemisahan harta benda kedua belah pihak. Penyelesaian perkara mengenai pembagian harta bersama yang terbaik adalah dilakukan dengan cara kekeluargaan. Penyelesaian permasalahan mengenai pemisahan harta bersama melalui pengadilan, juga bisa diusulkan melalui pengajuan gugatan sendiri oleh pihak yang berperkara maupun perantara melalui pengacara hukum. Dan permohonan mengenai pemisahan harta bersama tidak bisa diajukan bersamaan dengan gugatan cerai. The purpose of this study is to examine the legal consequences and the settlement of joint assets based on marriage law if the event of divorce and separation of joint assets for some reason. This study uses a normative legal research method, which is a study based on a statutory approach, library materials, court decisions and appropriate provisions. As well as data collection techniques carried out by document study. The results of the study show that with agreement in marriage, the property and joint assets of the two parties will have permanent legal certainty from a legal perspective. Settlement of joint assets is usually carried out by familial way. The settlement of problems regarding the separation of joint assets through the court, can also be proposed through filing a lawsuit by the litigant or intermediary through a lawyer. And applications regarding the separation of joint assets cannot be filed at the same time as a divorce suit.
