AbstractArticle 22 paragraph (1) Constitution of the Republic of Indonesia Year 1945 gives the President attributive authority to determine PERPPU in compelling emergencies. The position of PERPPU is regulated in Article 7 paragraph (1) letter c of Law No. 12 of 2011 with the formulation of the phrase "UU/Perppu." The use of the slash (/) raises several interpretations, so in this study, there are two problem formulations, namely the meaning of the slash (/) and the legal implications of the use of the slash (/). This legal research is a normative study using a statutory approach, a conceptual approach, and a historical approach. Sources of standard materials used are primary, secondary, and tertiary, which are collected by the method of inventory and categorization and using the method of literature study. The analysis technique used in this research is the normative analysis technique, with legal interpretation to obtain answers and prescriptions related to the legal issues raised in this study. The results of this legal research are related to the meaning of the slash line in the phrase "UU/Perppu" in Article 7 paragraph (1) of Law No. 12 of 2011 is defined by a punctuation mark that states the alternative nature in a sentence. Judging from the hierarchy of statutory regulations, it is can detect that UU/Perppu has an equal or equal position, so it is considered similar because the contents, functions, and content of the range are the same. Second, the legal implications that arise, by equalizing the position of the contents, processes, and content of the Perppu content with the Law, all provisions regulated in the Law should also be controlling by Perppu, including the regulation of criminal conditions. Apart from that, concerning the Perppu examination, the Constitutional Court decision No. 138/PUU-VII/2009 stated that the Constitutional Court had the authority to review Perppu.Keywords: government regulation instead of law (Perppu); legal implications; slash lineAbstrakPasal 22 ayat (1) UUD NRI Tahun 1945 memasrahkan kewenangan atributif pada Presiden untuk memutuskan Perppu dalam hal ikhwal kegentingan yang mendesak. Penggunaan tanda baca garis miring (/) tersebut menimbulkan beberapa penafsiran, maka pada penelitian ini ada dua rumusan masalah yakni makna garis miring (/) dan implikasi hukum yang ditimbulkan terhadap penggunaan garis miring (/) tersebut. Penelitian hukum ini ialah penelitian normatif dengan memakai pendekatan peraturan perundang-undangan, konseptual, serta historis. Sumber hukum yang dipakai yakni primer, sekunder serta tersier yang dikumpulkan dengan metode inventarisasi dan kategorisasi serta menggunakan metode studi kepustakaan. Teknik analisis yang dipakai pada penelitian ini ialah teknik analisis normatif yang menggunakan metode penafsiran hukum sehingga diperoleh jawaban dan preskripsi terkait rumusan masalah yang diajukan pada penelitian ini. Hasil penelitian hukum ini, pertama terkait makna garis miring dalam frasa “UU/Perppu” pada Pasal 7 ayat (1) UU No. 12-2011diartikan bagaikan sebuah tanda baca yang menyatakan sifat alternatif dalam suatu kalimat. Dilihat dari hierarki peraturan peraturan perundang-undangan dapat diketahui jika UU/Perppu mempunyai perananan yang setara maka dianggap sejenis karena isi, fungsi serta materi muatannya adalah sama. Kedua, implikasi hukum yang ditimbulkan, dengan disamakannya kedudukan isi, fungsi, dan materi muatan Perppu dengan UU maka seluruh ketentuan yang diatur dalam UU seharusnya juga diatur dalam Perppu termasuk pengaturan ketentuan pidana. Selain itu terkait dengan pengujian Perppu, dalam putusan Mahkamah Konstitusi K No.138/PUU-VII/2009 mengungkapkan jika Mahkamah Konstitusi berwenang untuk melaksanakan pengujian terhadap Perppu.

This article aims to identify and analyze the legal implications and analyze the regulation of public interest as a condition for implementing deponeering by the Attorney General for the sake of the public interest in the perspective of the development of criminal procedural law. This research is a legal research, obtained from statutory studies (statute approach), concept (conceptual approach), cases. The result of this research is that there is discrimination against equality before the law contained in Article 27 Paragraph (1) of the 1945 Constitution of the Republic of Indonesia and can trigger misinterpretation by the Attorney General. Then in its implementation there is no clear regulation regarding the application of the opportunity principle related to the authority of the attorney general in the implementation of case waiver (deponeering) for the public interest in the Criminal Procedure Code.  Abstrak Artikel ini bertujuan untuk mengetahui dan menganalisis implikasi hukum serta menganalisis terhadap regulasi kepentingan umum sebagai syarat pelaksanaan pengesampingan perkara (deponeering) oleh Jaksa Agung demi kepentingan umum dalam prespektif perkembangan hukum acara pidana.  Penelitian ini merupakan penelitian hukum, yang diperoleh dari studi perundang-undangan (statute approach), konsep (conceptual approach), kasus. Hasil dari penelitian ini adalah adanya diskriminatif terhadap equality before the law yang terdapat dalam Pasal 27 Ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan dapat memicu salah tafsir oleh Jaksa Agung. Lalu di dalam pelaksanaannya belum terdapat regulasi yang jelas mengenai penerapan asas oportunitas yang berhubungan dengan kewenangan jaksa agung dalam pelaksanaan pengesampingan perkara (deponeering) demi kepentingan umum di dalam Kitab Undang-Undang Hukum acara Pidana (KUHAP).

Tulisan ini ingin menjawab dua isu utama mengenai hubungan hukum internasional dan pengujian undang-undang oleh Mahkamah Konstitusi RI (MKRI). Isu pertama adalah legitimasi penggunaan hukum internasional sebagai alat interpretasi dalam pengujian undang-undang, sedangkan isu kedua adalah urgensi penguasaan hukum internasional oleh hakim MKRI. Tulisan ini merupakan penelitian hukum yang menggunakan pendekatan konseptual dan pendekatan historis dalam menjelaskan perkembangan pengujian undang-undang di Indonesia sekaligus menemukan legitimasi penggunaan hukum internasional oleh MK RI. Kesimpulan dari tulisan ini menegaskan bahwa hukum internasional memiliki sumbangsih yang penting dalam perannya sebagai alat interpretasi dalam proses pengujian undang-undang oleh Mahkamah Konstitusi, khususnya terkait hak asasi manusia. Justifikasi keabsahan praktik penggunaan hukum internasional tersebut ditarik dari tradisi ketatanegaraan yang secara implisit dikehendaki UUD NRI Tahun 1945. Manfaat positif yang diberikan hukum internasional nyatanya harus disertai juga dengan penguasaan hukum internasional oleh hakim MK RI supaya hukum internasional dapat digunakan secara tepat. Pembahasan dalam tulisan ini dibagi ke dalam empat sub bahasan inti yakni, pengujian undang-undang, penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang oleh MK, legitimasi penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang, pentingnya penguasaan hukum internasional oleh hakim MK.This article intentionally answers two principal issues regarding the relationship between international law and judicial review by the Constitutional Court of the Republic of Indonesia. The first issue is the legitimacy of international use as an interpretative tool in judicial review. The second issue talks about the necessity of urgent international law mastery by the Constitutional Court’s judges. This legal research utilizes both a conceptual approach and a historical approach to explain the development of judicial review in Indonesia, and to find legitimacy of international law by the Constitutional Court. The analysis in this article affirms that international law positively contributes as an interpretative tool in judicial review by the Constitutional Court, particularly pertaining to human rights. A justification of a legitimate international law use is withdrawn from constitutional tradition which is implicitly desired by the Indonesian Constitution (UUD NRI 1945). Since international law has provided better insights into norms, a mastery of international law should be encouraged. There are four main discussions in this article: judicial review, application of international law in judicial review process, legitimacy of international law application in judicial review, and the importance of international law mastering by Constitutional Court judges.

The purpose of this research is to determine the constitutional complaint mechanism based on comparisons in other countries, practices, and adaptation of constitutional complaints under the authority of the Constitutional Court of the Republic of Indonesia. Many cases with constitutional complaint substance have been submitted to the Constitutional Court of the Republic of Indonesia even though they don’t have this authority. This research uses a normative legal research method using a statutory approach, a conceptual approach, a comparative approach, and a case approach. This research indicates that the constitutional complaint mechanism in Germany, South Korea, and South Africa has been well implemented. In practice, cases with constitutional complaint substance are filed to the Constitutional Court of the Republic of Indonesia by changing the form by using the legal means of a judicial review, such as case number 16/PUU-VI/ 2008, case number 140/PUU-XIII/2015 and case number 102/PUU-VII/2009. Due to the consideration of the structure, substance, and culture of law, adaptation of constitutional complaint within the authority of the Constitutional Court of the Republic of Indonesia needs to be carried out by amending Law Number 24 of 2003 jo. Law Number 7 of 2020 concerning the Constitutional Court.

This research aims to analyze about the significance of the Constitutional Court Decision No.46/PUU-VIII/2010 the position of anak astra in Bali customary law. The research method used is a normative study by selecting the type of statue approach and the conceptual approach. Sources of legal materials that were examined in this study consisted of primary legal materials and secondary legal materials and techniques were analyzed with the description, systematic, evaluation and argumentation. Based on the perspective ( review ) Constitutional Court Decision No. 46/PUU-VIII/2010, anak astra have a civil relationship with her biological father and his family along can be proved by science and technology and / or other evidence according to the law. The juridical consequences of the Constitutional Court Decision No. 46/PUU-VIII/2010 to the norms of Bali customary law about anak astra Bali is must conform to the directions of law in the Decision of the Constitutional Court.

The purpose of this study is to find out the position of the Constitutional Court which later? an understanding of the politic of International agreement law adopted by the Republic of Indonesia. This can be reviewed from the legal considerations that underlying the Constitutional Court Decision. It is a legal research that examines the laws and regulation related to Constitutional Court through several stages: elaborate textual studies, completing textual studies, analyzing legal materials and determine conclusions. The study shows that International and legalized agreement that has not been ratified are placed as part of national law and are used as a reference to enrich the reasoning horizon in interpreting the constitution. Law on the ratification of the International Agreement containing norms which are attachments and an inseparable part of the law, which in its existence as a law constitutes the authority of the Constitutional Court to examine its constitutionality. In this context, the constitutional Court embraced the politic law of monism with the primate of national law and the Constitutional Court embraced the politic law of dualism when examining the constitutionality of the law concerning the ratification of the International Agreement-in terms of subject matter. Tujuan dari kajian ini adalah untuk mengetahui sikap Mahkamah Konstitusi yang nantinya akan memberikan pemahaman tentang politik hukum Perjanjian Internasional yang dianut Negara Republik Indonesia. Hal ini dapat ditinjau dari pertimbangan hukum yang mendasari amar Putusan Mahkamah Konstitusi. Artikel ini merupakan suatu penelitian hukum yang mengkaji Peraturan Perundang-undangan dan Putusan Mahkamah Konstitusi yang ada dengan langkah-langkah melakukan studi tekstual, melengkapi studi tekstual serta melakukan analisis terhadap bahan hukum yang terkumpul dan menarik kesimpulan. Hasil penelitian menunjukan bahwa Perjanjian Internasional yang telah disahkan maupun yang belum disahkan ditempatkan sebagai bagian dari hukum nasional dan dijadikan rujukan guna memperkaya cakrawala penalaran dalam menafsirkan Undang-Undang dasar. Undang-Undang tentang pengesahan Perjanjian internasional memuat norma yang merupakan lampiran dan bagian yang tidak terpisahkan dari Undang-Undang bersangkutan, yang dalam keberadaannya sebagai Undang-Undang merupakan kewenangan Mahkamah Konstitusi untuk menguji konstitusionalitasnya. Dalam konteks ini Mahkamah Konstitusi  menganut  politik hukum monisme dengan primat hukum nasional dan Mahkamah Konstitusi menganut politik  hukum dualisme saat menguji konstitusionalitas Undang-Undang tentang pengesahan Perjanjian Internasional dalam hal menyangkut pokok perkaranya.

<p>Undang-Undang Nomor 17 Tahun 2014 tentang Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, Dan Dewan Perwakilan Rakyat Daerah (UU MD3) pasca putusan Mahkamah Konstitusi (MK) dinilai memiliki problem substantif/materil akibat materi muatannya bertentangan dengan Undang-Undang Negara Republik Indonesia Tahun 1945 (UUD NRI 1945), yang mengakibatkan kerugian konstitusional terhadap Dewan Perwakilan Daerah (DPD), meliputi dikuranginya kewenangan DPD untuk dapat mengajukan (Rancangan Undang-Undang) RUU, dikuranginya kewenangan DPD untuk membahas RUU dan dikuranginya kewenangan DPD dalam kedudukannya sebagai lembaga perwakilan daerah. Hal ini menunjukan bahwa pembentukan UU MD3 nyata-nyata tidak menghormati putusan MK yang diberi mandat UUD NRI 1945 sebagai lembaga penafsir dan penjaga konstitusi, dengan tidak menghormati, mematuhi, dan melaksanakan putusan MK ini menunjukkan ketidakpatuhan terhadap putusan lembaga negara yang telah ditunjuk konstitusi untuk mengawal kemurnian pelaksanaan konstitusi. Penelitian ini menggunakan metode normatif menggunakan pendekatan perundang-undangan ( statute approach ), pendekatan konsep ( conceptual approach ), dan pendekatan historis ( historical approach ). Ketidaktaatan penyusunan UU MD3 pada putusan MK merupakan pengingkaran UUD NRI 1945 dan perkembangan ini merupakan langkah mundur reformasi. Pembentuk Undang-Undang, dalam hal ini, Dewan Perwakilan Rakyat (DPR) dan Presiden harus segera melakukan perubahan UU Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan dengan berpijak pada rambu-rambu konstitusional Putusan MK Nomor 92/PUU-X/2012.</p><p>Law Number 17 Year 2014 on the People’s Consultative Assembly, House of Representatives, Regional Representatives Council, and the Regional House of Representatives (MD3 Law) after the decision of the Constitutional Court (MK) is considered to have a substantive problem due to the substance that is contrary to the 1945 Constitution of the Republic of Indonesia (the 1945 Constitution), which resulted in the constitutional loss of Regional Representatives Council (DPD), including the reduction of DPD authority to propose draft bills, to discuss draft bills and the reduction in its authority as the regional representative institution. This shows that the drafting of MD3 Law is obviously not respecting the decision of the Court that is mandated by the 1945 Constitution as the interpreter and guardian institution of the constitutional, by not respecting, obeying and implementing MK’s decision which indicates non-compliance with the decision of the state institution that has been designated to guard the purity of the constitution implementation of the constitution. This study uses normative method with statute approach, conceptual approach and a historical approach. The noncompliance of the drafting of MD3 Law towards the MK’s decision is a denial of MK and this development is a step back of Reformation. The legislators, in this case, the House of Representatives (DPR) and the President should immediately amend the Law Number 12 Year 2011 on the Establishment of Laws and Regulations based on the MK’s Decision No. 92/PUU-X/2012. </p>

The Constitutional Court as the guardian of the constitution and the guardian of human rights has the duty to ensure that the Law does not contradict the constitution and does not violate human rights. One of the manifestations of this can be seen in the Constitutional Court Decision Number 1 / PUU-X / 2013, where the Constitutional Court removed the element "Some other deeds or unpleasant treatment/act" in Article 335 paragraph (1) of the Criminal Code. With the removal of the core elements of Article 335 paragraph (1) of the Criminal Code, raises questions related to the existence of the offense whether it still exists or not. Based on this, this study will examine 1) Application of Article 335 of the Criminal Code Before the Decision of the Constitutional Court Number 1 / PUU-X / 2013 and 2.) Application of Article 335 of the Criminal Code After the Decision of the Constitutional Court Number 1 / PUU-X / 2013. This research is a normative legal research with a statute approach, conceptual approach, and case approach. Based on this research, it was found that after the Constitutional Court Decision Number 1 / PUU-X / 2013 that offenses of unpleasant acts had been reconstructed into forced offenses.

Article 24C Section (1) of the 1945 Constitution of the Republic of Indonesia authorizes the Constitutional Court to reviewthe law against the constitution. However, when referring to the hierarchy of legislation, the law has the equal hierarchy with government regulation in lieu of law. It makes a question whether the Constitutional Court truly has the authority to review government regulation in lieu of law against the constitution? Based on the research in this paper, it was found that by the Constitutional Court Decision Number 138/PUU-VII/2009, the Constitutional Court stated that the authority to review government regulation in lieu of law under the authority of the Constitutional Court because the substance of government regulation in lieu of law is similar with the substance of law. So, the Constitutional Court has the authority to review a government regulation in lieu of law materially. Such decision is correct; the Constitutional Court has the authority to review a government regulation in lieu of law in material because the substance is similar with the law. While formally reviewing should be the authority of the Supreme Court due to government regulation in lieu of law formally is in the form of government regulation

The granting of land rights is one way for legal subjects to be able to obtain a right to land in Indonesia. This study aims to determine the legal implications of the Decree on Granting Land Rights issued by the National Land Agency without implementing Article 7 of the Republic of Indonesia Government Regulation Number 34 of 2016 concerning Income Tax. This research is empirical legal research. The results of the research show that the Decree on the Granting of Rights to Land is still valid without implying that it is null and void, while Article 7 of the Republic of Indonesia Government Regulation Number 34 of 2016 is not in line with the principles in the theory of legal certainty and is not effective in its application or enforcement.

Corruption has been widespread, it is increasingly systematic, inducing losses to the national economy. Article 2 paragraph (2) of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption, the death penalty can be imposed under certain conditions, but so far there is no corruptor has been sentenced to death. This study discussed issues related with corruption, including: first, how is the urgency of death penalty applied to corruptors in Indonesia, and secondly how the implementation of death penalty for corruptors in Indonesia. The method applied in this study was a normative legal research type, with a statutory approach and a conceptual approach. This study used primary legal materials, by collecting data from literature study, then analyzed using qualitative methods. The following conclusions can be drawn from this study: first, death penalty is a punishment that still needs to be included in the law, to prevent extraordinary crimes such as corruption, secondly, the formulation of law must be more accentuated even if needed, to be expanded in order to avoid any issues that could complicate the implementation and to prevent multiple interpretations.
