The Birth of the Board of Ethics of the Constitutional Judges cannot be separated from the effort to uphold a code of ethics and maintain of the dignity of the constitutional judges. Abuse of authority in the judiciary has led to the destruction of the legal system and the non-fulfillment of a sense of justice. Judicial mafias has destroyed the foundation of the authority of the judiciary and undermine the honor and dignity of judges, therefore it is necessary to take concrete measures to restore the authority of the judiciary and maintaining the honor of judges as the main pillars of the judiciary in enforcing law and justice. One concrete step is the need for strengthening the supervisory system of ethics against constitutional judges, the results of which will provide input to the Constitutional Court, whether the monitoring system of ethics against constitutional judges applied so far has been able to maintain the honor, dignity, and constitutional justices, and whether the system has provided legal certainty in its enforcement against violations of the Code of Ethics and Conduct of Constitutional Judges. Strengthening the role of the board of ethics of constitutional judges as guardians of constitutional judges dignity can be constantly improved by opening access to complaints from the public against allegations of ethical violations committed by constitutional judges.

The purpose of this study was to analyze the optimization of the supervisory function carried out by the Judicial Commission for realizing a clear justice. This study used the legal research method, which means that research was conducted by examining existing library data and references, such as laws and regulations, books, magazines, and scientific journals. The optimization of the oversight function of the Constitutional Court was carried out by establishing a good relationship with the Supreme Court to identify the limits of their respective duties and authorities, forming the Liaison Judicial Commission, and the Network of the Judicial Commission. The role of Liaison Judicial Commission needed to be improved, not only receiving reports from the public but also actively finding violations of the code of ethics committed by judges. Socialization regarding the existence of the Judicial Commission should be carried out more through Network of the Judicial Commission to increase understanding of the community so that the community can play an active role in providing reports for the realization of a clear justice.

<p>Secara normatif hakim Indonesia disebut sebagai Penegak hukum dan keadilan tidak sebatas corong undang-undang. Hakim wajib untuk menemukan, menggali dan membentuk hukum yang sesuai dengan nilai dan rasa keadilan masyarakat. Secara teoritis pembentukan hukum oleh Hakim pun diakui sebagai salah satu sumber hukum formil dalam sistem hukum Indonesia dan dapat diakomodasi oleh DPR (Positif Legislator) dalam pembaruan undang-undang. Tulisan ini bermaksud untuk meneliti masalah eksistensi pembentukan hukum oleh hakim dalam dinamika politik legislasi (baik yang bersifat positif legislasi sebagaimana diwenangi oleh DPR bersama Presiden maupun negatif legislator yang diperankan oleh putusan Mahkamah Konstitusi). Dengan menggunakan metode penelitian hukum normatif, diperoleh kesimpulan bahkan dalam konteks tertentu Hakim didorong untuk melakukan pembentukan hukum baru yang berfungsi sebagai a tool of social engineering . Jika pembentukan hukum oleh Hakim diikuti secara konstan oleh Hakim lain maka dapat dijadikan sebagai sumber hukum formil dalam sistem hukum nasional (yurisprudensi).</p><p>Normatively in Indonesia, a judge is also known as the law and justice enforcement agency, not just decided cases based on written law. Judges are obliged to discover, explore and establish a legal system that suitable with local values and sense of justice. Theoretically Judge Decisions (known also as Jurisprudence) are also recognized as one of the source of formal lawsin the Indonesian legal system and can be accommodated by the Parliament (Positive Legislators) in the renewal of the law. This paper intends to examine the existence of the Judge made laws in dynamic-political process of legislation (whether positive legislation that is ruled by the House of Representatives and the President or negative legislator who are ruled by the Constitutional Court). Using a normative-legal research method, the conclusion even in the context of a particular judges are encouraged to establish anew legal construction that intended as a tool of social engineering. If the judge-made law is followed constantly by other judges, it can be used as a source of formal law in the national legal system (jurisprudence).</p>

Pencabutan Pasal 67 ayat (2) huruf g pada Undang-Undang Nomor 11 Tahun 2006 oleh Mahkamah Konstitusi Nomor 51/Puu-Xiv/2016 menyangkut pembatasan hak mantan narapidana untuk mencalonkan diri dalam pemilihan kepala daerah tentu akan berpengaruh pada undang-undang lain. Baik undang-undang yang sudah ada maupun yang akan dibentuk karena berkaitan dengan sifat final dan mengikat pada putusan Mahkamah Konstitusi. Tahun 2017 muncul undang-undang baru yang memuat kembali pembatasan hak mantan narapidana yaitu Undang-undang Nomor 7 Tahun 2017. Sehingga menarik diteliti kedudukan putusan Mahkamah Konstitusi dalam sistem hukum nasional? dan apakah kekuatan putusan Mahkamah Konstistusi bisa mempengaruhi perundang-undangan lain secara keseluruhan?. Penelitian ini bertujuan mengkaji kedudukan putusan Mahkamah Konstitusi dalam sistem hukum nasional dan pengaruh kekuatan putusan Mahkamah Konstitusi terhadap perundang-undangan. Penelitian ini menggunakan metode penelitian hukum yuridis normatif. Penelitian yang mencakup asas-asas hukum, sistematika hukum dan taraf sinkronisasi hukum. Sumber data yang digunakan diperoleh dari penelitian perpustakaan serta informasi dari para ahli akan dianalisis dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukkan bahwa Putusan Mahkamah Konstitusi merupakan aturan yang memiliki peranan setingkat dengan perundang-undangan untuk dilaksanakan. Putusan Mahkamah Konstitusi jelas mampu mempengaruhi semua undang-undang, sehingga undang-undang yang memuat prihal yang sama dipastikan tidak memiliki kepastian hukum. Disarankan adanya suatu aturan hukum yang mempertegas teknis implementasi putusan Mahkamah Konstitusi dalam peraturan perundang-undangan dan tersedianya suatu wadah pengujian kembali terhadap putusan Mahkamah Konstitusi.The revocation of Article 67 paragraph (2) letter g in Law No. 11 of 2006 by the Constitutional Court No. 51 / Puu-Xiv / 2016 concerning restrictions on the rights of former prisoners (ex-convicts) to involve themselves to be the candidate for local election will certainly affect other laws, both the existing laws and laws that will be formed, because they are related to the final and binding characteristic on the decisions of Constitutional Court. In 2017, new law emerged which restated about the restrictions on the rights of former prisoners, namely Law No. 7 of 2017. Thus, it is interesting to investigate the position of the Constitutional Court decision in the national legal system? And whether the power of the Constitutional Court’s decision could influence other legislations as a whole or not? This study aims to examine the position of the Constitutional Court decision in the national legal system and the influence of the power of Constitutional Court decision towards the legislation. This study is conducted by using legal research methods of normative juridical. This research covers legal principles, legal systematic and level of legal synchronization. The source of data used in this research is obtained through library research and information from the experts will be analyzed by legislative approach and case approach. The results of this research indicate that the constitutional court decision is a rule that has the same level as the role of legislation to be implemented. The decision of the Constitutional Court is clearly capable of influencing all laws, so that the law that contains the same subject is certain to have no legal certainty. It is suggested that there should be a legal regulation that reinforces the technical implementation of the Constitutional Court Decision in legislation and the availability of a place for re-testing towards the decisions of Constitutional Court.

The role of the Supervisory Council is very important in fostering and supervising the position of a Notary on an ongoing basis regarding personal behavior in carrying out his position and outside his position as the spearhead of ensuring legal certainty for the public who uses the services of a Notary. Enforcement of the Code of Ethics for the Notary profession is one way to preserve noble values in the Notary profession, so that this noble profession in its implementation will not experience a decrease in quality and even if necessary, obtain an increase in the quality of the profession. The problems examined in this research are: 1) What is the Role of the Regional Notary Supervisory Council on the Implementation of the Notary Code of Ethics in Serang Regency? and 2) What is the Implementation Mechanism for Supervision of the Code of Ethics for Notaries in Serang Regency? The purpose of this study was to determine the role of the Regional Supervisory Council in implementing the Notary Code of Ethics in Serang Regency. This study uses an empirical juridical approach which is used to look at legal aspects of social interaction in society. This research is descriptive-analytic, intended to provide data as accurate as possible about a condition or other symptoms. The results show that the role of the Notary Supervisory Council is to supervise Notaries, so that in carrying out their duties they do not deviate from their authority and do not violate the applicable laws and regulations and the Notary Supervisory Council is authorized to supervise, foster notaries and impose sanctions on notaries who are declared. violated the applicable provisions.

After almost 25 years of what could justifiably be called transformative change in South Africa, a truism is that the country’s new legal order, established by the Constitution in 1993 and 1996, provides the critical foundation of peace and security upon which its freedom has been built. The Constitutional Court was one of the most important of the new democratic institutions in the shaping of the country’s position as a constitutional democracy, upholding the values for which millions of people, black and white, had fought. This article is a brief reflection on the role of the Court in establishing the meaning of this democracy and giving it effect. The main goal of the article is to understand how the Court’s new jurisprudence works in particular contexts, how its work is related to crime and punishment, and what it means for the rights of marginalised groups in society. Using the examples of the Court’s decision in Makwanyane on the death penalty, and the Court’s decision on the findings of the Public Protector’s report on Nkandla, the article finds that the Court’s new jurisprudence takes quite a different view of legal developments in South Africa, insofar as the jurisprudence entrusts broad discretion to the Court and emphasises the need for sustained leadership of the Court to advance the battle for fundamental human rights, the rule of law, and democratic accountability.

Foundations, as permanent funds established by a certain legal act, can serve manifold purposes, but often pursue charitable goals. As such, they play an important role for the public good. Therefore, states always had an interest in fostering foundations by providing a pertinent legal framework. In Austria, this topic has not yet been the focus of scholarship. Through this study some light is shed on the implementation of the law on foundations in the Habsburg Monarchy. It focuses on the role of the state and its legal system regarding the regulation and supervision of foundations from 1750 to 1918. This period is characterized by the sovereigns’ endeavor to regulate the position of foundations via extensive legislation. In particular, a system of oversight for foundations was created in order to guarantee the attainment of their charitable goals. In fact, this system prevailed until the end of the 20thcentury.

The main objective of this paper is to highlight the essential role of professional accountants in enhancing public sector accountability in the present democratic era. The spate of public sector unaccountability scandals in the present democratic era in Nigeria evidently engenders the quest for proper accountability in the public sector. The paper begins with a conceptualization of accountability from the public sector perspective. It also attempts to cursorily highlight the nexus between public sector governance and accountability, before examining the issues currently undermining public sector accountability in Nigeria. It ends by pointing out the ways in which professional accountants can contribute to public sector accountability in Nigeria. In line with the many issues articulated in this paper, it is believed that a sense of value reorientation and strict adherence to professional code of ethics by professional accountants, among others, would reposition professional accountants to effectively contribute to public sector accountability in Nigeria.

The article analyzes methods of ensuring the migrants rights by the public authorities of the Russian Federation, the individual elements of the migration policy of the Russian Federation relating to the activities of public authorities. It considers the activities in the field of protection of the migrants rights by such authorities as the Russian President's Office for Constitutional Rights of Citizens, the Presidential Council for Civil Society and Human Rights, the Council for Interethnic Relations, General Directorate for Migration, Chief Directorate for Migration Issues of Ministry of Internal Affairs of the Russian Federation, their normative documents, that regulate their activities. It examines separately the activities of the RF Government in the field of protection of the migrants rights, as well as judicial authorities; it identifies the special role of the RF Constitutional Court in the field of ensuring the rights of migrants, refugees, the internally displaced and stateless persons. It underlines the role of authority bodies of the RF entities in ensuring the migrants rights in terms of Irkursk Oblast. The article offers to differentiate strictly the role of each authority body in the field of migrants rights protection, as well as to pay specific attention to regulation of activities of the FR entities authority bodies in this direction.

ABSTRAK Artikel ini bertujuan untuk membahas dasar pertimbangan hakim dalam menjatuhkan pidana terhadap pelaku penyalahguna narkotika. Tipe penelitian adalah yuridis empiris. Berdasarkan penelitian, ditemukan bahwa tindakan terdakwa telah memenuhi unsur-unsur dari syarat pemidanaan atau telah memenuhi ketentuan penerapan sanksi terhadap tindak pidana penyalahguna Narkotika Golongan I jenis shabu-shabu. Dalam Putusan yang di teliti, hakim menjatuhkan pidana penjara selama 8 (delapan) bulan. Seharusnya Hakim tidak hanya mempertimbangkan fakta yuridis, fakta persidangan dan fakta sosiologis para terdakwa tetapi juga peranan para terdakwa dalam tindak pidana karena tindak pidana dilakukan lebih dari 1 orang. Hakim seharusnya menjatuhkan pidana yang lebih berat terhadap Rida Susana dan Jasrul Harja dibanding Syahrul Yanto karena yang memulai perbuatan pidana ini adalah Rida Susana dan Jasrul Harja sebagai seorang anggota Polri. Oleh karena itu dalam menjatuhkan beratnya pidana terhadap para terdakwa, hakim diharapkan untuk lebih mempertimbangkan peranan terdakwa dalam tindak pidana agar menimbulkan efek jera dan rasa keadilan baik bagi para terdakwa dan masyarakat. ABSTRAK This article aims to discuss the basis for the judges’ consideration in imposing sanction against narcotics offender. The type of research is empirical juridical. It is found that the actions of the defendant had fulfilled the provisions for the application of sanctions against the abuse of Narcotics Group I. In the verdict examined, the judge sentenced him imprisonment for 8 (eight) months. Judges should not only consider the juridical facts, the facts of the trial and the sociological facts of the defendants but also the role of the defendants in the criminal act as the crime was committed by more than 1 person. Judges should have imposed more severe penalties on Rida Susana and Jasrul Harja compared to Syahrul Yanto, as those who started the crime were Rida Susana and Jasrul Harja while in the same time served as member of the National Police. Therefore, in sentencing the sanction against the defendants, the judges are expected to better consider the role of the defendants in the crime in order to create a deterrent effect and sense of justice both for the defendants and the public.

Kitab Undang-undang Hukum Pidana atau biasa disebut dengan KUHP adalah warisan kolonial Belanda yang diberlakukan di Indonesia melalui asas konkordasi dan disahkan melalui UU Nomor 1 Tahun 1946 serta diberlakukan untuk umum melalui UU Nomor 73 Tahun 1958. Artinya, KUHP yang sedang berlaku bukan terbentuk sesuai dengan karakteristik masyarakat Indonesia meskipun ada penyesuaian, itu dianggap tidak cukup. Karena itu, pembaruan KUHP secara universal juga perlu dilaksanakan agar kontras dengan bangsa Indonesia. Pengajuan permohonan uji materiil terhadap pasal dalam KUHP dengan Nomor Perkara 46/PUU-XIV/2016 merupakan gambaran bahwa pembaruan KUHP juga dikehendaki oleh masyarakat banyak. Artikel ini dibuat bertujuan untuk menggambarkan betapa lapuknya KUHP dan memberikan pengetahuan kepada pihak yang berkepentingan untuk menyegerakan pembaruan. Metode pengumpulan data dalam penelitian ini melalui tiga tahap. Pertama, wawancara dengan ahli yaitu peneliti-peneliti MK RI. Kedua, studi kepustakaan untuk memperkuat jarum analisis betapa urgennya suatu pembaruan. Ketiga, obserasi yang dilakukan selama proses persidangan perkara. Salah satu kewenangan Mahkamah konstitusi adalah menguji Undang-Undang terhadap Undang-undang Dasar. Dalam permohonan tersebut, Pasal 284 ayat (1), (2), (3), (4), (5), Pasal 285, dan Pasal 292 KUHP menggambarkan bahwa betapa pentingnya pembaruan KUHP karena keidaksesuaian ruh yang ada didalamnya. Pasal-pasal tersebut dipandang sudah sangat urgen untuk diubah. Pembaruan KUHP secara universal sangat urgen untuk disegerakan karena ini dapat menjadi faktor kriminogen bagi masyarakat dan dapat mencederai rasa keadilan. Harapannya Mahkamah Konstitusi dapat menjawab kebutuhan masyarakat tentang suatu hukum yang benar-benar hidup dalam masyarakat.The Penal Code or commonly called KUHP is the Dutch colonial legacy that prevailed in Indonesia through the principle of concordance and legalized with The Constitusion No. 1 of 1946 and enacted for the public through The Constitution No. 73 of 1958. Its means, Criminal Code that are applicable not formed by the characteristics of Indonesian society although there was an adjustment, it was not enough. Therefore, the universally Criminal Code reform should be carried out to contrast with the nation of Indonesia. The submission of judicial review of the clause of the Criminal Code with Case No. 46 / PUU-XIV / 2016 is a representation that reformation of Criminal Code is also desired by many people. This report aims to describe how old the Criminal Code is and provide the knowledge to interested parties to hasten the reform.The method of collecting data in this report through three stages. First, interviews with experts that researchers in The Constitutional Court of Indonesia. Second, the study of literature to strengthen a needle analysis of how the urgency of reform. Third, observation that committed during court proceedings.The one of authority of the Constitutional Court is reviewing the Constitution. In the petition, Article 284 paragraph (1), (2), (3), (4), (5), Article 285 and Article 292 illustrates how important reform the Penal Code because there is unsuittable spirit inside. Such articles deemed to have been very urgent to be changed. Reformation Penal Code universally is very urgent to be expedited because this can be a kriminogen factors for society and can injure the sense of justice. Hopefully the Constitutional Court can answer the necessary of community on a law that actually live in the community.
