The article deals with the analysis of electronic evidence as a new means of evidence in civil proceedings. Due to the constant changes of the information environment and the improvement of information technologies there arises the question of consolidating the evidence obtained in the information space. The example of this evidence is the electronic evidence that provides information in electronic (digital) form containing information about the circumstances that matter to the case. There is defined, for the first time, the electronic evidence and the procedure for its submission and investigation at the legislative level. In procedural law such innovations are one of the means of achieving the effectiveness of civil justice, as they facilitate the full, comprehensive consideration and resolution of a civil lawsuit, the establishment of the true circumstances of the case, and the adoption of lawful and grounded decisions by courts, which is the purpose of civil justice. Electronic evidence is submitted to the court in three ways: in the original, in the electronic copy certified by an electronic digital signature, in paper copies, certified in the manner prescribed by law. Besides, the party submitting a copy of the electronic evidence must indicate that he/ she or some other person has the original of the electronic evidence. It is the responsibility of the claimant to attach to the statement of claim all the evidence available to support the circumstances on which the claim is based (if written or electronic evidence is provided, the claimant may attach a copy of the relevant evidence to the statement of claim). The claimant can submit electronic evidence using the Unified Court Information and Telecommunication System. In the article, there are highlighted the issues of the concept, nature and types of electronic evidence, the views of scientists on the features and significance of electronic evidence in civil proceedings. Moreover, the article focuses on problematic issues that the legislator should regulate to ensure that participants of the case are able to submit electronic evidence to court and implement their constitutional right to judicial protection. To reach these goals there were analyzed the views of scientists who investigated this type evidence. Unfortunately, the current CCP of Ukraine and other by-laws regulating the Institute of Electronic Evidence do not provide answers to many questions about the use of evidence from purely technical to legal ones. The legislator limited the work only to the general principles of applying a new type of evidence. Therefore, the judicial practice today is controversial when deciding whether electronic evidence is admissible and appropriate. Also in the article there is analyzed the judicial practice regarding the presentation of electronic evidence as the means of evidence to the court by the parties of the case. According to the results of theoretical study, there were made some suggestions to improve the civil procedural legislation of Ukraine.

A significant leap in the development of information technology over the past twenty years has made the global legal community respond to new challenges that have come along with the progress in the digital environment. Together with the convenience of using electronic resources, society has developed a need for a simple and understandable legislative regulation of legal relations arising from the use of computer information technologies and various products of electronic digital activity in order to protect their interests potentially. The concept and types of electronic evidence in civil proceedings in different countries have different meanings. Meanwhile, the regulations of their procedural admissibility and applicability differ. The common thing is the tendency towards an increase in the use of electronic information carriers in court proceedings, increasing importance for establishing specific facts, and the decisive evidentiary role in making decisions by the court. India became one of the first countries to realize the growing level of implementation of Internet technologies, electronic digital storage media, and computer dominance in society and the state's daily life [1] (Artemyeva, Y.A. et al.). The consequence of this understanding was the timely development and implementation of the substantive and procedural bases in evidence law for practical, understandable, and convenient use of electronic evidence in civil proceedings. The article examines the types and procedural status of electronic evidence and analyzes the current legislation and law enforcement practice in the admissibility and application of electronic evidence in civil proceedings in India. The study identifies the existing system of electronic evidence in the legal field of India, the determination of the advantages and disadvantages in the gathering, presentation, research, and evaluation of electronic evidence by the court in civil proceedings, as well as the identification of the procedural order for their provision. The researchers have identified the following tasks to achieve the goals: • to define and research the legislation of India governing the concept, types and procedural order of applicability and admissibility of electronic evidence in civil proceedings in India; • to develop a particular procedural order for the effective use of the institution of electronic evidence in civil litigation in India; • to identify the current trends in the gathering, presentation, research, and evaluation of electronic evidence in India's courts, based on the established judicial practice study. The research methodology is based on general theoretical and scientific methods of cognition, including abstraction and specification, analysis and synthesis, modeling and comparison, and systemic, logical, and functional analyzes. The scientific novelty of the research consists of a comprehensive study of the instruments of legal regulation of the institution of electronic evidence in India's legal field, including regulatory legal acts and judicial precedents, and a consideration of the possibility of applying Indian approaches in the jurisdictions of other countries. The analysis of legislation and jurisprudence regarding electronic evidence in India's civil proceedings was carried out using the synergistic principle of object study, statistical-sequential analysis, and empirical research method. This study's results can be used in lawmaking to develop and improve regulations regarding the procedural status and use of electronic evidence in civil litigation in any country. The reference, citation, and use of this article's conclusions and materials are permissible when conducting lectures and seminars on civil procedure and private international law, research activities, law enforcement practice, and teaching.

The aim of the study is to reveal the features of the use of information technology in civil proceedings in terms of compliance with its basic principles, because the digitalization of judiciary through the implementation of modern IT technologies in Ukraine is one of the most effective ways to improve the level and quality of administration, of justice, fulfillment of its tasks. Fair, impartial and timely consideration and resolution of civil cases is impossible without adherence to its principles, which are key guidelines in the formation of procedural law. The study was conducted using general and special methods of scientific knowledge: comparative, historical and legal, formal-logical, dialectical, system-structural. After analyzing current and future legislation, doctrinal approaches, best practices of foreign countries, the authors revealed the benefits of implementing information technology in civil proceedings and their impact on the realization of such principles as: rule of law, equality of all participants before the law and court, publicity and openness of the trial, reasonable time for consideration of the case by court, adversarial parties. On the basis of the conducted research generalizations and conclusions regarding the state and prospects of application of information technologies in civil proceedings through a prism of its principles are made.

Due to the development of information technologies, electronic document flow is actively becoming a part of modern life, and the activity of courts is not an exception. Electronic documents are increasingly considered by courts as evidence in civil cases. Judicial practice faces certain problems when evaluating such evidence due to the insufficiency of legal regulation of such kind of evidence. The article examines the theoretical and practical aspects of the existence of an electronic document as a type of written evidence, attempts to reveal the essence of an electronic document, define its features as compared to a traditional written document, and analyzes the approaches to the definition of the concept of ‘electronic document’, which have developed in Russian legal science. The analysis of the practice in the application of an electronic document as evidence with regard to relevance, admissibility and adequacy is carried out. Certain problems which judges have to face when using an electronic document as evidence have been identified. The authors’ understanding of an electronic document is submitted, the framework of problems and gaps under current civil procedure legislation is defined, and methods of solution are proposed. The need to define an independent type of evidence – electronic evidence is substantiated, with it further being enshrined in the Civil Procedural Code of the Russian Federation, as well as to formalize in legislation the concept of an ‘electronic information medium’.

In this article, a comparative legal and empirical study of the principle of good faith in law and the prevention of abuse of procedural rights as one of its element are conducted. These phenomena should be recognized as relevant objects for research, given that in civil procedural Ukraine specific measures were taken to prevent abuse of procedural rights for the first time, during the reform of the legislation in 2017, and unfortunately such actions occur as a habits of legal reality of Ukraine. in court practice quite often. Given the need to ensure effective protection of rights through timely and proportionate consideration of the case by the courts, their proper application is essential for science and practice. The article analyzes the provisions of the civil procedural law of Ukraine, where for the first time this institute was reflected in the legislation in the wording of 2017, as well as other states (Italy, England and Wales, France, Australia). It also analyzed the practice of the Supreme Court of Ukraine, which reveals the concept of bona fide as a principle of law, as well as examines the institute of abuse of procedural rights as one of the manifestations of implementation of this principle, specific manifestations of unfair behavior of participants of the process, taking into account the practice of the European Court of Human Rights. The analyzed provisions of the civil procedural legislation, which stipulates the ways of overcoming the abuse of procedural rights, as well as the doctrines, allowed the conclusions to substantiate more rational approaches to the prevention of abuse of procedural rights in civil proceedings. In particular, ensuring the cooperation of judges and parties and defining their roles not from the standpoint of antagonistic approaches, but based on the ideas of sustainable development, will overcome the major pressing problems of modern civil justice. The introduction of rational measures to prevent abuse of procedural rights and to encourage parties to act in good faith will ensure the efficiency and accessibility of justice. The purpose of the article is to explore the issues of electronic means of proof in the civil process of Ukraine and foreign countries, the problems of application, as well as to identify possible ways to improve them. Relevance of research is due to that the issue of electronic evidence is gaining new importance at the present stage during the rapid development and improvement of electronic means of communication and media which causes the emergence of new theoretical and practical problems in their application. In this regard, a comparative analysis of the legislative consolidation and practice of application of this topic in civil proceedings of foreign countries and Ukraine will provide an opportunity to identify further ways to modernize electronic evidence in general. Also, the problematic issues concerning their application during the trial have not been fully resolved and the peculiarities of other countries have not been singled out. Therefore, effective use of the achievements of scientific and technological progress has become an important issue in the judiciary due to the continuous computerization and informatization. The methodology includes a comprehensive analysis and generalization of available scientific and theoretical material and the formulation of relevant conclusions and proposals. The following general scientific methods of cognition were used during the research: dialectical, terminological, logical-semantic, system-structural, logical-normative, comparative. The issues of legislative regulation of electronic evidence in Ukraine and other countries, their key differences, as well as the author’s ways to improve electronic evidence by borrowing best practices from other countries, including the United States. Problematic aspects of legislative consolidation of electronic evidence have been identified, the possibility of introducing forensic methods into the civil process to establish the authenticity of the provided electronic evidence and application of the blockchain system in order to prevent their destruction has been assessed. The current legal positions from judicial practice were given and analyzed on the issues under consideration. The results of the study can be used in lawmaking and law enforcement activities for the use of electronic evidence in civil proceedings.

This article examines and summarises judicial practice in cases related to the use of new information technologies. The study primarily focuses upon the decisions of Russian courts (general jurisdiction and arbitration) and the European Court of Human Rights (ECHR). Employing ECHR practice, the author also refers to numerous decisions by courts in Hungary and the United Kingdom. Cases related to the use of new information technologies can be distinguished between, and this article examines the judicial practice of three categories of cases: 1) blocking of internet resources; 2) employers’ control over employees’ electronic correspondence; 3) journalists’ use of hyperlinks in author’s texts and their responsibility of such placements. Within each category of cases, the rights of citizens can be seriously violated. The article highlights that in an era of rapid development of new information technologies, states, represented by special services and authorised state bodies, are making unprecedented efforts to ensure that they maintain at least partial control over the activities of new actors (bloggers, Internet media, Internet platforms, etc.). Similarly, courts often compromise with authorities when resolving such issues. Notably, national Russian courts did not consider parties’ interests, nor did they assess the need to block all sites with a particular IP address. They did not even follow the Supreme Court of the Russian Federation’s decision to apply the requirements of the European Convention on Human Rights within the framework of the ECHR. The courts limited themselves to pointing out that Roskomnadzor acted within its power. Thus, the decisions of the national courts did not offer a mechanism for protecting rights. Within the norms regulating the new sphere of relations, there are often norms of a restrictive and prohibitive nature, and these norms are dominant in the Russian Federation. In this regard, there remains grounds for concern among lawyers involved in the protection of rights related to new information technologies.

An analysis of the amendments made to the Constitution of the Russian Federation in 2020 made it possible to conclude that the provisions concerning the judicial protection of fundamental human and civil rights and freedoms are stable. The role and content of the legal regulation of the participation of the prosecutor in the implementation on behalf of certain participants in civil proceedings of this right emphasizes the specifics of his procedural position. At the same time, the existence in the legal doctrine and in law enforcement practice of various positions that determine the legal status of the prosecutor in the exercise of the constitutional right to judicial protection, and the lack of a unified approach to resolving this issue give rise to constant interest in this problem. In this study, through the prism of analyzing the content of the procedural rights and duties of the prosecutor, the grounds for the implementation by the prosecutor of constitutional guarantees for protecting the interests of society and the state protected by law, the determinism of his legal status in civil proceedings is substantiated.

The article is devoted to the study of international experience of theoretical and practical aspects of proceedings in class actions. This study will present various models of regulation in this area of the Anglo-Saxon and mixed legal families. By analyzing this legal basis, the practice of application will be possible to establish the essence of the class action in civil proceedings by disclosing the main features that are inherent in it and are such that distinguish it from other procedural structures aimed at protecting violated rights and legitimate interests as effective judicial mechanism.The subject of the study is issues related to one of the jurisdictional ways to protect the rights and legitimate interests of large groups of people. The purpose of this work is to publish the results of the study, which was conducted as part of a dissertation study on "Group lawsuit in civil proceedings in Ukraine." During the study, a general scientific dialectical method of use was used, which allowed to comprehensively study the main provisions of class action in foreign procedural law and the possibility of its development in the legislation of Ukraine, and provided an opportunity to reveal the nature of class actions in civil proceedings. stages.
