The study presents the theoretical foundations of crowdfunding, describes its models and classifications. SWOT analysis is used as the main method. Weaknesses and strengths, opportunities and threats of alternative financing are considered. The correspondence of different models of crowdfunding to the peculiarities of the activities of enterprises is shown. Of particular interest is the organization of crowdfunding in foreign countries, where this phenomenon is not considered new and is a healthy competitor to traditional sources of business financing. The advantage of the legal regulation of crowdfunding is considering the peculiarities of many its varieties and models.

In this article, the author presents a study of the changes in legal regulation of the digital economy caused by the imposition of economic sanctions by the foreign states as well as the Russian Federation. The paper analyzes the restrictive measures imposed in the USA against Russian persons in the field of digital technology. The author concludes that the economic sanctions of foreign countries limit the ability to conduct foreign economic operations in the digital sphere both by Russian persons to foreign persons and vise versa. An analysis of the Russian legal framework for the imposition of restrictive measures and the latest legislative amendments, in particular with regards to the preinstallation requirement of the Russian software, showed that currently the measures introduced in Russia are aimed not at reducing the effect of foreign sanctions, but at developing a national market of digital technologies and decreasing the dependability level ofthe Russian economy on exported technologies in general. The author also highlights that it is necessary to assess the consequences of imposing prohibitions in the field of digital technologies and to consider introduction of more flexible measures of legal regulation upon the results of such assessment.

Purpose: The development of the digital economy has become essential in the modern world. Entrepreneurs use digital technologies to carry out their activities, through which they enter into various civil-legal relations. One of the most pressing topics discussed in the legal community is the use of cryptocurrency in trading. Currently, there is no mechanism for the legislative regulation of the circulation and the use of the cryptocurrency. The main purpose of this study was to develop legal proposals and effectively regulate cryptocurrency. Method: the development trend of cryptocurrency in the Russian Federation was analyzed, and the experiences of foreign countries (USA, Germany, France, China, and Japan) were studied. Findings: This research analyzed the problem of the legal regulation of the cryptocurrency, which is a logical continuation of the development in digital technologies and digital economy. Finally, the authors offer a legal community with single matrix of the legal regulation of the cryptocurrency consisting of international, regional and domestic levels.

The paper reveals the etymology of the Public-Private Partnership (PPP) and features of legal regulation in Russia. The authors have carried out an analysis of the main modern models of legislative management in this sphere of legal relations in foreign countries. Moreover, they consider the main projects of construction and reconstruction of the JSC RZD railway infrastructure implemented or planned for implementation on the principles of PPP. The SWOT analysis identified not only the risks of using existing forms of PPP in Russia but also the high potential of using such projects on the railway network contributing to the rapid renewal and development of public infrastructure to meet the needs of customers and the population with budget savings. However, at the present stage, methodological aspects of the legislative calculation and assessment of project efficiency, complexity of regulatory and legal interaction of parties and a process of investment return hinder the rapid implementation of PPP system on the railway transport in the Russian Federation. The authors propose a modification of direction for strategic planning of operation of investment objects through relational interaction of parties to the agreement by creating a state system of instances of PPP. For this purpose, they introduce a concept of «relation potential of Public-Private Partnership instances» that characterizes a complex availability of reserves from parties to ensure the long-term functioning of the chosen strategy. The paper provides a method of integral performance assessment of PPP project that allows analysing the efficiency of using allocated resources and assessing the potential of investment object exploitation.

The subject of the research is new tools for business financing using the initial coin offering (ICO) in the context of the development of cryptocurrencies and the blockchain technologies as their basis. The purpose of the work was to analyze the advantages and disadvantages of the ICO in comparison with traditional financial tools as well as prospects, limitations and problems of using digital financial tools. Conclusions are made in relation to possibilities, limitations and application areas of digital business financing tools, particularly in the real sector, taking into account the specifics of the Russian economy and legislation. It is shown that the main problems of using the digital financial tools are related to the economic sphere and caused by the lack of adequate approaches to evaluation of assets as well as the shortage of objective information. The problems and new tasks of corporate finance in the digital economy are defined.

Objectives. The purpose of this study is to study the essence of ethical problems that arise in the field of genetic screening for prenatal diagnosis (PND) and determine possible ways to overcome them by legal means, taking into account the existing foreign experience. Materials and methods. Normative legal acts and doctrinal sources of Great Britain, Germany, Ireland, France and Switzerland are studied. Methods used: General philosophical, General scientific, private scientific, special (structural-legal, comparative-legal, formal-legal). Results. Ways to resolve ethical problems that arise or may arise in the future as a result of genetic screening for PND, which can be applied within the Russian legal system, are proposed. Conclusions. It is stated that most of the identified ethical problems are related to the lack of normative consolidation of the legal status of the fetus. It is presumed that the beginning of ethics should serve as the guide for legislation in this area. At the same time, it is emphasized that the legal regulation of genetic screening in PND should be flexible enough to optimally ensure the interests of all participants in these relationships. In addition, in this direction, it seems appropriate to refer to the experience of a number of foreign countries, whose legislation provides for fairly strict requirements in the field of PND.

The study investigates the foreign experience of constitutional and legal regulation of restrictions on human rights in conditions of emergency and martial law in Macedonia, Armenia, Belarus, Moldova, Georgia, Latvia, Lithuania, Albania, Azerbaijan, which is relevantin modern conditions, based on the presence of local military conflicts, emergencies, or the possibility of their existence in many countries of the world. The purpose of this study was to analyse the text and content of the constitutions of foreign countries to clarify and explain the groundsfor restricting human and civil rights and freedoms in conditions of emergency and martial law. To achieve this purpose, the study employed a system of methods of scientific cognition, namely general scientific (analysis, synthesis), particular (comparative, quantitative and qualitative analysis, approximation), as well as special legal (formal legal, comparative legal) methods. The practical value of the study lies in the identification of four prevailing trends in the constitutions of foreign states to the procedure for determining the scope of restrictions on human rights under special regimes: 1) consolidation of an exhaustive list of rights and freedoms in the constitutions, which cannot be restricted during the period of emergency and martial law; 2) consolidation of an exhaustive list of rights and freedoms in the constitution, which can be restricted to protect human rights, the democratic structure of the state, public safety, the well-being of the population and morals; 3) combining the first two options for consolidating restrictions in the text of the constitutions; 4) consolidation of the possibility of limiting the rights and freedoms of the individual in the texts of constitutions by state authorities under special legal regimes in the interests of national security without specifying partiular rights and freedoms that may (or may not) be restricted
