Features of administrative responsibility for road safety violations

Problem setting. At present, road traffic is one of the main elements of modern states. Using different types of vehicles, people have the opportunity to move faster, do freight, thereby facilitating their work in all areas of activity. This contributes to the development of economic activity, social activity and road infrastructure, but at the same time there are a number of negative consequences associated with traffic injuries, economic and social damage caused by road accidents. Today, about 7,000 people die in road accidents each year and nearly 4,000 are injured; every 12 minutes there is a car accident; almost every 1.5 hours a person dies. In Ukraine, the statistics of road accidents for the period from 01.01.2021 to 31.05.2021 amounted to 70774 – 22.2%. It is possible to reduce these indicators under the condition of introduction of the state program of the correct design of roads, and also increase of administrative responsibility for violation of traffic rules. And what do we see when we look at the statistics of the last five years? And the fact that accident statistics are really scary, and is constantly growing. Law enforcement officers are constantly publishing regular collections of data on road accidents in the country. The tables are full of red numbers, the color of which indicates the deterioration of basic safety indicators. Target of research is a comprehensive scientific study of administrative liability for violations of traffic legislation, its features, as well as improvement by amending legal acts will positively affect the development of transport – road complex of Ukraine and contribute to strengthening road safety as a component of national security. The main purpose of the study is to lay the groundwork for administrative liability for road safety offenses on the basis of a comprehensive analysis of scientific sources, generalization of legal material and law enforcement practice. The object of this work is public relations, which are formed in the process of ensuring administrative liability for violations of legislation in the field of road safety in modern conditions. Analysis of recent researches and publications. Issues of road safety in different volumes are reflected in studies conducted by: O. Bandurka, T. George, D. Medvedev, Yu. Piroshkova and others. At the general level, the concept of “road safety” as a component of public safety was studied by A. Basov, В. Glushkov, M. Inshin, O. Copan and others. These scientists analyzed the problem of improving the administrative and legal responsibility of road safety and proposed to improve measures that will ensure the safety of all road users. However, the relevance of this topic is due to the constant updating of Ukrainian legislation, based on the provisions of which is the rule-making regulation of this area of public relations. Article`s main body. The article defines the features of administrative responsibility for violation of road safety. The author considers changes in the legislation regulating administrative responsibility in the field of road safety. The analysis of the number of road traffic accidents (RTA) and their consequences over the past five years was also carried out. The study of this problem is relevant, since the analysis of static data on the number of road accidents indicates a low level of traffic safety and a high accident rate on highways. Conclusions and prospects for the development. Based on the above, we can conclude that the current legislation in the field of administrative liability for violations of road safety is quite extensive and provides for various types of administrative penalties aimed at saving lives and reducing socially dangerous accidents. Also, the legislative definition of the term “traffic” is not provided either in the Code of Administrative Offenses or in the Law of Ukraine “On Road Traffic”. I propose to define and legislate the concept of “road safety” as a set of factors and mechanisms that regulate legal relations, establish responsibility, describe the typical mechanisms and rules of conduct of all road users in the state.

This article analyzes the relationship and influence of factors such as the population, the level of motorization, economic development, and the state of the state road network on the state of the risk of road accidents, including the level of mortality and road injuries, as well as the relevance of improving methods for assessing, managing and predicting the risk of accidents in road traffic. National indicators of the level of road deaths and injuries in different countries were studied. The relationship between road accidents and the level of motorization, income of the population, the state of the road network, and other indicators were revealed. The urgency of the problem of road accidents and the organization of measures to reduce the level of road accidents is emphasized. It also takes into account the special importance of forming conceptually new approaches to the task of improving the efficiency of public administration in the field of organization and maintenance of road traffic through the implementation of the Concept of Road Safety in the Republic of Uzbekistan for the period 2018-2022, which includes the following main directions: further improvement of the regulatory framework in the field of road safety, including significant strengthening of responsibility for gross violations of traffic rules; comprehensive improvement of road infrastructure, improving the quality of roads, creating reliable conditions for the safe movement of vehicles; improving the legal culture, the necessary knowledge, and skills of road users, strengthening their discipline.

The article is devoted to the study of the implementation of the global goals of the Decade of Action for Road Safety 2011–2020 in Ukraine. It is stated that the precondition for the adoption of the UN General Assembly resolution № 64/2551, which proclaimed the Decade, was that according to the analysis, almost 1.3 million people are victims of road accidents every year, and its goal is to reduce mortality from Accidents by 50 percent by 2020. The key elements of the activities of national and local government bodies proposed by the Global Plan for the Decade have been identified. An analysis of the dynamics of road traffic injuries in Ukraine for 2010–2020. The influence of the measures introduced by the state on the state of road traffic injuries is investigated and the real indicators of mortality and injuries on the highways of Ukraine are determined. It is established that the mortality rate from road accidents in Ukraine during the Decade decreased by 27.4 %, and during the implementation of the Strategy to increase road safety in Ukraine until 2020 managed to reduce mortality on Ukrainian roads by only 11.5 %. The ambitious goal of the State Program to increase the level of road safety in Ukraine for the period up to 2020 – reducing the number of deaths due to road accidents to 4 people per 100 thousand population – also failed to be achieved. Given the steady decline in the population of Ukraine, this figure is 11.7 deaths in road accidents per 100 thousand population in 2020. It is proved that the measures taken do not fully correspond to the content of strategic decisions taken at the international level. The results of the state initiatives introduced in Ukraine, although outlined the tendency to stabilize road traffic injuries, did not provide even the average European level of dynamics of reducing accidents on highways. The Decade of Action for Road Safety 2011–2020 and the goals of sustainable development, apparently significantly influenced countries that take measures, so they need to be continued until 2030 to maintain the current level of awareness.

The article deals with the issue of road safety. The aim is to analyze the accident rate on the roads of rkutsk region and assess the risk of road traffic accidents (RTA). The research is based on statistical data. A comparative analysis of the risks of road accidents and the risks of death of road users is carried out. The risk of death in accidents is higher in Slyudyanka district than in Irkutsk region, which is due to the complex route and mountainous areas. The damage caused by road traffic accidents is increasing every year.

AbstractThe steady increase in the number of road users and their growing mobility mean that the issue of road safety is still a topical one. Analyses of factors influencing the number of road traffic accidents contribute to the improvement of road safety. Because changes in traffic volume follow a daily rhythm, hour of the day is an important factor affecting the number of crashes. The present article identifies selected mathematical models which can be used to describe the number of road traffic accidents as a function of the time of their occurrence during the day. The study of the seasonality of the number of accidents in particular hours was assessed. The distributions of the number of accidents in each hour were compared using the Kruskal-Wallis and Kolmogorov-Smirnov tests. Multidimensional scaling was used to present the found similarities and differences. Similar hours were grouped into clusters, which were used in further analysis to construct the ARMAXmodel and the Holt-Winters model. Finally, the predictive capabilities of each model were assessed.

Purpose: Road accident has been claiming lives and no amount of research will be enough to expose the causes and dangers. This study appraises the causes and analyses the variation of road accidents in the Kaduna metropolis, intending to reduce it. Research methodology: The data used was obtained from Federal Road Safety Corps and complemented by the researchers’ field survey. Eight members of the research team went to the 24 bus stops identified each month rotationally. Both descriptive and inferential statistics were applied in the analysis. Results: There was a high correlation of mortality and road accident injuries as confirmed by r-value 0.7 using pearson product moment correlation. Accidents occur most in the morning and afternoon and the season with most accident occurrence was the dry season. The combination of over speeding and other factors were the major causes of road accidents. Limitations: The study used data published in 2016, although a follow-up data verification was conducted in 2017 and 2018. Therefore, the study is old and the results might have changed and might not necessarily be reliable. Contribution: Road accidents hot spots areas, causes, and patterns were exposed to guide the road users in order to avoid the accident. The study can also be replicated in other study areas with similar characteristics.

Introduction. The issue of road traffic safety has been studied by many modern scientists. However, despite the research, this issue remains relevant to this day, both theoretically and practically. This is due to the fact that the concept of road traffic safety is not currently enshrined in law, and there is no unanimity among scientists on its content. Moreover, the relevance of the practical component is evidenced by the fact that over the past three years a number of important regulations in the field of road traffic safety and procedures for their implementation have been developed. The purpose of the paper is to determine the state of road traffic safety in Ukraine. In accordance with the goal, the main objectives of this study are to formulate a definition of “traffic”, “road traffic safety”, outlining their elements; determining the state of road traffic safety in Ukraine and further development trends, establishing the main directions of implementation of state policy in the field of road traffic safety. Results. Covering the issue of road safety, it should be noted that the current legislation of Ukraine does not provide a definition of this concept, but in 2016 there was an attempt to legislate both the legal category of “road traffic safety” and a number of closely related to it. Thus, the authors of the draft Law on Road Traffic and Safety defined traffic as “the process of traffic on roads and other places where it is not prohibited by the draft law”, and road traffic safety as “a state of the road system, due to which the appropriate level of protection of road users from road accidents and their negative consequences is determined and achieved”. It should be emphasized that road traffic safety is achieved through the application of appropriate measures of organizational, administrative, socio-economic and technical nature, which are enshrined in regulations and which are aimed at ensuring the proper and safe level road traffic safety for all its participants. It should be noted that neither the Ukrainian legislator nor the state executive bodies reduce the state of danger on the roads of Ukraine, so they are constantly developing appropriate programs and taking measures to increase the level of road traffic safety. Thus, in 2020, a state program was approved, the main goal of which is to reduce the level of accidents on the roads and the severity, first of all, of the socio-economic consequences of road accidents. Conclusion. According to the legislation of Ukraine, road traffic safety should be understood as a set of socio-economic and organizational-technical measures to ensure road traffic safety and road user, prevention of road traffic accidents and elimination or minimization of their negative consequences.

The article discusses the state of road traffic safety on the A1 motorway, on its section passing the territory of the Kuyavian-Pomeranian Voivodeship. The presented data concerns the years 2016 - 2017. As it is evidenced by statistical data prepared by Police, motorways are characterized by the highest level of accidents rates of fatalities and injuries from all types of public roads at present in Poland. Therefore, it is necessary to take effective actions to improve road safety on all motorways in Poland, including the A1 motorway passing the Kuyavian-Pomeranian Voivodeship. The paper presents the generic structure of road accidents, the time of their occurrence and circumstances, conditions of the surface caused by weather, as well as the reasons road accidents occurs.

Ensuring road safety is one of the basic statutory tasks set against the Police. Out of concern for the safety of the youngest road users, brought to educational institutions, the policemen of the Masovian Police from October 2017 to the end of June 2018 carried out activities under the name „GIMBUS”. These activities consisted mainly of checking the technical condition of vehicles and the sobriety and working time of drivers. They are an important instrument of actions aimed at improving the state of road safety in Poland, reducing the costs of road accidents and achieving the objectives of European transport policy. This article presents the results of the control activities carried out.

Every year we lose many young road users in road traffic accidents. Based on traffic accident data issued by the Indonesian National Police in 2017, the number of casualties was highest in the age group 15-19, with 3,496 minor injuries, 400 seriously injured and 535 deaths. This condition is very alarming considering that student as the nation's next generation lose their future due to the accidents. This figure does not include other traffic violations, not having a driver license, not wearing a helmet, driving opposite the direction, those given ticket and verbal reprimand. To reduce traffic accident for young road user, road safety campaigns were organized in many schools in Jakarta. This activity aims to socialize the road safety program to increase road safety awareness among young road users/students including the dissemination of Law No. 22 of 2009 concerning Road Traffic and Transportation. Another purpose of this program is to accompany school administrators to set up a School Safe Zone (ZoSS), a location on particular roads in the school environment that are time-based speed zone to set the speed of the vehicle. The purpose of this paper is to promote the road safety campaigns strategies by considering various campaign tools.

ABSTRACT: The paper deals with the analysis of traffic accidents involving pedestrians in the Slovak Republic. The development of traffic accidents involving pedestrians is processed through statistical data for the period 2011 - 2019. The paper defines the risk groups of road users, identified areas with the highest traffic accidents, evaluated the negative consequences of traffic accidents and identified their possible causes. A separate chapter is a case study consisting of an analysis of a vehicle - pedestrian accident. Based on the performed analysis of traffic accidents involving pedestrians, safety measures are set to minimize the number of traffic accidents involving pedestrians and their negative consequences. The study is one of the outputs of the APVV-17-0217 project "Staffing of police officers and application of the principle of proportionality in criminal and administrative law.
