In a multilevel governance system such as the European Union (EU) policy processes at one level may create challenges and dilemmas at lower levels. Multilevel governance involves a multiplicity of regulatory regimes and succeeding governance ambiguities for national actors. These regulatory challenges and ensuring governance dilemmas increasingly affect contemporary European public administration. These challenges and dilemmas are captured by the term turbulence. The inherent state prerogative to formulate and implement public policy is subject to an emergent and turbulent EU administration. Organized turbulence is captured by the supply of independent and integrated bureaucratic capacities at a “European level.” Throughout history (1952 onwards) the EU system has faced shifting hostile and uncertain environments, and responded by erecting turbulent organizational solutions of various kinds. Studying turbulence opens an opportunity to rethink governance in turbulent administrative systems such as the public administration of the EU.

The article examines the recent developments in public administration training in Hungary and draws conclusions for the future. The paper analyzes the connection between legalism and professionalism in Hungary. Legalism and professionalism are displayed as contrary notion by a considerable number of theorists. It appears that »legalism« is an appropriate label for the past status of public administration that reformists long to abandon. Since Hungary is considered to be part of the legalistic culture of European public administration (PA), the assumed conflict between legalism and professionalism appears more vividly. As part of the currently undergoing reform, professionalism received an influential institutional promoter within the Hungarian PA: the National University of Public Administration that is primarily a university but is also a successor of the government agency that used to be in charge of civil service professional training. The article concludes with summarizing the currently undergoing reform regarding professionalism that is also presented as being contrary to the legalistic PA in the government reform program for modernizing PA.

The article examines public administration reform (PAR) in Bulgaria and the main factors that shaped the reform agenda and dynamics. PAR is examined along five key dimensions – transparency and accountability, civil service and human resources management (HRM), public service delivery and digitalisation, organisation and management of government, and policy-making coordination and implementation. The article argues that there are four main factors influencing reform dynamics and determining policy outcomes in the Bulgarian case: the specific political choices made by government elites, external influence of the EU and of past national legacies, and the importance of institutions and reform mechanisms. To illustrate these factors at work, the article examines three policy initiatives, i.e. e-government, the reduction of administrative burden, and civil service reform. The article presents a longitudinal analysis and a qualitative case-study approach, utilising Annual Reports on the Status of the Public Administration 2001–2018, mapping European Semester Documents 2011–2017, an inventory of PAR initiatives 2005–2018, and interviews of public officials. The pushes for reform have been top-down, externally-driven, and stop-and-go in nature. The results confirm previous findings that Bulgaria is among the EU countries with the poorest record in PAR, struggling to overcome communist legacies and high levels of corruption and politicisation. The Bulgarian case highlights several important lessons: the importance of political will and political dynamics for the outcome of reform efforts; the importance of external pressure and financing; the difficulty of uprooting long-standing legacies in administrative traditions; and the limitations of the top-down approach as an obstacle to the sustainability of reform efforts.

The comparative characteristics of European public administration systems are presented. Particular attention is paid to new models of public administration in EU countries: New Public Management (NPM); New Public Governance (NPG) or New public service (NPS); Good Governance (GG). Both positive and negative characteristics of these government models are listed. Successful reform of public administration is revealed through the creation of appropriate institutions and adherence to the relevant principles, procedures, and standards of public administration and values that should be guided by civil servants. It is proved that the sphere of organization of public administration and civil service in the EU has wide experience through the implementation of so-called «soft» standards. The focus is on highlighting effective tools for reforming public administration in the EU, their main functions. The implications of NPM implementation for European regions, which were adapted by Walter Kicker’s presentation, are outlined. The key features of the new public administration and the cardinal directions of administrative reforms implemented in each EU country are identified, as well as the improvement of the main interconnected components of the public administration system, which include: institutions; rules and procedures, processes and mechanisms for coordination of cooperation; personnel potential. The realization of the reform of the public administration through the reform of administrative procedures, the development of the civil service, the process of decentralization and agencification were clarified. In modern democratic states, managerial innovations are aimed at supporting market mechanisms for democratization of public authorities; market marketing (transformation) of the work of the state with the mass introduction of methods of state managerialism. In these government models, a customer-centric approach is put in place to develop an appropriate strategy based on consumer values, meeting expectations from service providers and implementing information technology.

AbstractThe goal of this paper is to document and to analyse public administration reform dynamics and outcomes in three selected areas – transparency and accountability, civil service and local self-governments.The high level of potential access to government information in Slovakia does not “produce” increased accountability, predictability and also does not effectively serve as a tool to control corruption. We argue that citizens are not only victims, but also accomplishers: their tolerance for corruption, excessive bureaucracy and rentseeking is confirmed by many existing studies.Concerning civil service reform, Slovakia shows a substantial reform reversal towards politicisation and centralisation after 2001, which clearly threatens the fundamental features of democratic governance. Soon after the EU accession in 2004 major regressive changes took place, and the Civil Service Office was abolished in 2006. The new legislation in force from 2017 (forced by the EU conditionality) should return the Slovak civil service back on the right track – let us to see.With regard to self-government the reforms aimed towards the establishment of more independent local and regional self-government. However, the major issue here is the extreme fragmentation on the municipal level – almost 3,000 municipalities in the country, most of them bellow 1,000 inhabitants. Many studies confirm that amalgamation (or at least functional amalgamation) is necessary – but there is no political will to start it.What are the main lessons from the Slovak case ? The information provided indicates that the Slovak Republic belongs to the “standard” group of CEE countries – after the first wave of democratisation reforms immediately after 1989, most of the later changes were realised “thanks to” external motivations and pressures – and not always really welcomed. The specific issue, however, is the decentralisation reform in 2000 – 2005. This change, providing really fragmented local self-government by extra rights and responsibilities, was internally driven, with positive results from the point of view of self-government principles, but with many hurdles caused by too large a number of too small municipalities.

The article reveals the main features of the competence approach in the practice of European public administration. The features of the competence approach in public administration are determined on the basis of analysis of the basic concepts of public administration. In the dynamics of the formation and development of popular theories of interaction between state and local authorities, such as the theory of a free community, community (public) and public and state (the theory of municipal dualism), we can trace a number of characteristic features of a competency approach, which manifests itself both through the general theoretical relations and manifestations, and through the practice of coexistence of public authorities. There is a problem of definition and distribution of public functions as a prerequisite for defining and shaping the competences of public institutions. An important issue in the context of a competent approach is the institutional consolidation of functions in the context of the existence of the basic models of territorial organization of power. In each of the varieties of the Governance concept (Responsive Governance concept, Democratic Governance concept, Good Governance concept), the specifics of the use of competencies are defined. The archetypal symbols in the European public administration are singled out using the analysis of competence in public administration in its main constituents. A brief description of the archetypal aspect of European public administration is given. The main components of competence are shown in connection with the existing archetypal symbols and the characteristic trends of their development. Their connection is shown according to the scheme “the entity component (who?) — the object component (what?) — the administrative component (how?) — the basis (in what environment?)”. Concerning the trends of development of a competence approach in the context of practice and theory of public administration, it is determined that modern concepts of public administration are characterized by shifting the balance between state and public institutions to the sphere of common goals and tasks, and thus responsibility. The joint activity of all subjects of society requires new forms of cooperation, definition of the spheres and subjects of each entity’s activity for effective cooperation, distribution of functions and competences of the entities, formation and consolidation of their status characteristics.

The article examines the formation of the statehood of modern Turkmenistan through the prism of historical changes that have occurred in the post-Soviet countries. It is noted that after 1991 all former republics of the USSR built new independent states on a fundamentally different basis – interaction between government and society. The authors emphasize that the establishment of trust between the state as an institution and citizens is possible under certain conditions, among which a special place is occupied by a clear organization of civil service and the professionalism of civil servants. The measures that have already been implemented and are being taken by the leadership of Turkmenistan at the present time to solve these problems are considered. It is noted that Turkmenistan acts within the framework and in accordance with the key world-class standards regarding the requirements for the organization of civil service. The measures taken in the country to combat corruption are analyzed.

This article comments on four important judgments given by the European Court of Human Rights in 2016. Al-Dulimi v. Switzerland addresses the issue of how, in the context of sanctions regimes created by the UN Security Council, European states should reconcile their obligations under the UN Charter with their obligations under the European Convention on Human Rights to respect the fundamentals of European public order. Baka v. Hungary concerns the separation of powers and judicial independence, in particular the need for procedural safeguards to protect judges against unjustified removal from office and to protect their legitimate exercise of freedom of expression. Magyar Helsinki Bizottság v. Hungary is a judgment on the interpretation of the Convention, featuring a review of the “living instrument” approach. Avotiņš v. Latvia addresses the principle of mutual trust within the EU legal order and the right to a fair trial under Article 6 of the Convention.

In order to achieve the EU emission reduction goals, it is essential to renovate the building stock, by improving energy efficiency and promoting total decarbonisation. According to the 2018/844/EU Directive, 3% of Public Administration buildings should be renovated every year. So as to identify the measures to be applied in those buildings and obtain the greatest reduction in energy consumption at the lowest cost, the Directive 2010/31/EU proposed a cost-optimisation-based methodology. The implementation of this allowed to carry out studies in detail in actual scenarios for the energy renovation of thermal envelopes of public schools in the city of Valencia. First, primary school buildings were analysed and classified into three representative types. For each type, 21 sets of measures for improving building thermal envelopes were proposed, considering the global cost, in order to learn about the savings obtained, the repayment term for the investment made, the percentage reduction in energy consumption and the level of compliance with regulatory requirements. The result and conclusions will help Public Administration in Valencia to draw up an energy renovation plan for public building schools in the city.
