ABSTRAKT Employment of officers in customs and tax administration after the reform The article presents the legal regulations concerning the officers of the former Customs Service adopted by the legislator on the occasion of the reformed customs and tax administration and the establishment of the National Tax Administration. The institution of terminating the service relations of officers by law was introduced, as well as transforming the service relations into contractual relations as a result of offering the officer further work in the structures of this administration and accepting this proposal by him. Problems with interpreting these solutions were visible in the varied jurisprudence of administrative courts as well as common courts. In order to understand these difficulties, some of the justifications of the judgments have been presented more broadly. In line with these considerations, the thesis is justified that in recent years the legislator has increasingly resorted to this type of solutions and introduced institutions of termination of employment relations by law, and their cause is not “exceptional, special circumstances justified by the state system reform,” which was emphasized by the Constitutional Tribunal, only reforms related to organizational transformations in public administration. This is viewed as the means of replacing public administration staff.

The study considers how the phenomenon of state entrepreneurship has been examined in theoretical works by world-famous researchers. It has been brought to light that a comparison of the performance of state-owned enterprises is rather difficult due to divergent views on their socio-economic and institutional framework in different countries. The characteristics of privatization processes that have taken place since the 1990s as well as their current trends are identified. The contribution of an entrepreneurial state in financing and stimulating innovations is analyzed. Bearing in mind the ever-growing role of state entrepreneurship in building business processes, it is noted that the current stage of the development of state entrepreneurship needs significant changes in the state system of economic governance. Taking into account shortcomings over the analyzed period, suggestions have been put forward on how to improve the effectiveness of state entrepreneurship seen as a tool of public administration.

The problematic issues related to the definition of public administration as one of the forms of exercising state power are considered. The level of how the quality of public administration processes affects the functioning of the state system and its key mechanisms is analyzed. An important emphasis is placed on the fact that the most useful of the successful practices of public administration in developed countries can be adopted for the state system of Ukraine. Modern problems and ways of their effective solution at different levels of state and local administration are actualized. The analysis of the basic structural elements of qualitative public administration, the level of their influence on processes of realization of the state-power powers within functioning of the state system is offered. For example, it explains whether transparency and impartiality do have a significant impact on the efficiency of public administration. The efficiency (effectiveness) of various, "non-traditional" ways and means of realization of public-administrative activity is established. The conclusions of both leading scholars are analyzed, and the author's assessment of the extent to which the adoption of strategies and tactics of management activities borrowed from other areas of socially useful activity are useful for the field of public administration. First of all, this applies to the sphere of private business. Tingkat bagaimana kualitas proses administrasi publik mempengaruhi fungsi sistem negara dan mekanisme kuncinya dianalisis. Penekanan penting ditempatkan pada fakta bahwa praktik administrasi publik yang paling berguna dan yang berhasil di negara maju dapat diadopsi untuk sistem negara Ukraina. Masalah modern dan cara penyelesaiannya yang efektif di berbagai tingkat administrasi negara bagian dan lokal diaktualisasikan. Analisis elemen-elemen struktural dasar administrasi publik kualitatif, tingkat pengaruhnya terhadap proses realisasi kekuatan-kekuatan negara dalam fungsi sistem negara ditawarkan. Misalnya, menjelaskan apakah transparansi dan ketidakberpihakan memang memiliki dampak signifikan terhadap efisiensi administrasi publik. Efisiensi (efektivitas) dari berbagai, "non-tradisional" cara dan sarana realisasi kegiatan administrasi publik didirikan. Kesimpulan dari kedua cendekiawan terkemuka dianalisis, dan penilaian penulis tentang sejauh mana penerapan strategi dan taktik kegiatan manajemen yang dipinjam dari bidang lain dari kegiatan yang bermanfaat secara sosial berguna untuk bidang administrasi publik. Pertama-tama, ini berlaku untuk bidang bisnis swasta. Bagaimanapun, pengalaman yang dianalisis dari negara-negara maju membuktikan bahwa Ukraina dapat meminjam banyak solusi yang berguna dan alat praktis yang efektif dari industri swasta.Kata kunci: Administrasi Publik; Kekuasaan Negara; Ilmu Pemerintahan; Aktivitas Efektif Государственное управление как одна из форм осуществления государственной власти Аннотация В статье рассматриваются проблемные вопросы, связанные с определением публичного администрирования как одной из форм реализации государственной власти. Проанализирован уровень влияния качества процессов государственного управления на функционирование государственной системы и ее ключевых механизмов. Важный акцент делается на том, что именно полезного из успешных практик функционирования публичного администрирования в развитых странах можно перенять для государственной системы Украины. Актуализируются современные проблемы и пути их эффективного решения на разных уровнях государственного и местного управления. Предлагается анализ основных структурных элементов качественного публичного администрирования, уровень их влияния на процессы реализации государственно-властных полномочий в пределах функционирования государственной системы. Например, объясняется, действительно ли прозрачность и беспристрастность оказывают значительное влияние на эффективность публичного администрирования. Устанавливается эффективность (действенность) различных, «нетрадиционных» способов и средств реализации публично-административной деятельности. Анализируются выводы как ведущих ученых, так и предлагается авторская оценка того, в какой степени для сферы публичного администрирования полезно заимствование стратегий и тактик осуществления управленческой деятельности. The focal point of this paper is an analysis of instances of regulations that prescribe the variability (interchangeability) of legal forms of public administration’s actions. Therefore, it is a matter of special (if only because rarely occurring) cases, in which the multiformity of public administration’s activity results from the consent to accept alternative administration. The author’s intention is to present a multifaceted contemporary public administration in terms of indication and description of legal institutions, within which the legislator has introduced the possibility of choosing different forms of action by the authority, such as: the ability to issue a regulation, order or decision by the relevant authority if it proves necessary to restrict freedom and rights during the state of natural disaster, the exchangeability of an administrative decision and the administrative settlement and alternative use of administrative silence. The considerations concern the legal forms of actions on the part of public administration, because (for them) interchangeability of the forms of public administration’s actions is extremely rare and incidental, while looking at the actual (non-legal) forms of public administration allows seeing greater acceptance of the alternative behavior in the analyzed context. The reflections are supported by an attempt to answer questions about the reasons, variants and consequences of building legal regulations in a way that allows the legal forms of public administration’s action to change.

The digital transformation of the structural components of the state system forms new socio-organizational forms and practices of political interaction. The transformation process is based on the dialectical overcoming of existing elements of the old order, the development of new goals and the formation of new specific ways to achieve them. As a result of the digital transformation of the structural components of the state system, new socio-organizational forms and practices of political interaction are being formed. Before our eyes, the transition of initially networked social formations into political offline processes is unfolding, new power resources and mechanisms of influence on the political organization as a whole are emerging in society. These processes relate to social self-organization and are characteristic of the adaptive algorithm of social changes. At the same time, changes in system parameters do not violate the contours of the existing state system. However, in the conditions of deliberate stimulation by the authorities of the digital transformation of all spheres of society’s life, the limited ability of the political system and the state to ensure the manageability of social and political processes is more clearly manifested.The article considers the process of deformation of the state system caused by the digitalization of public relations, analyses changes in theoretical models of explaining social reality and related changes in the organization of the political system and political practices.The multi-component nature of the impact of the global ICT paradigm on the sphere of public administration of a particular state is noted. In the era of the diversity of broadcast information, the dominance of the mass media and social networks, the public becomes a mass / crowd and an object of manipulation. The impact of information and communication technologies on the functioning of society is manifested in maintaining the gap between formal and informal institutions, intensive introduction of innovations, launching new mechanisms of social inequality, and the like, as a result, the integrity of the social system is violated. The risk of loss of manageability of social processes increases due to the fact that the recommendations for authorities on digital transformation, as well as most scientific publications on the topic of digitalization of public administration do not contain a critical assessment of the ICT paradigm itself and the concepts, concepts and practices formed on its basis.

The recent initiative to integrate National Tax Service and Local Tax Service at the provincial level and below is a major step towards reforming the tax administration. The State Administration of Taxation will be the main supervisor of the integrated taxation agencies. Social insurance contributions by employees and employers will be collected by tax authority nationwide and not by social security bureaus.

This chapter summarizes the propositions that are emphasized within the proposed macro-level approach to public administration. These propositions suggest that the fundamental unit of political organization is the state. Every state has leaders; that is, a relatively small group of people who have substantial influence over the ordering of state goals and the means by which those goals are pursued. Generally, leaders try to maintain and improve their own positions within the state apparatus; increase power and legitimacy within the state system; increase power and legitimacy within the state's own territory; and increase national prosperity. In addition, leaders ought to advance human rights for the population that is subject to their authority. The behavior of leaders is guided by governance strategies that describe priorities and the means by which those priorities will be pursued. The chapter then details the aspects of the governing environment which must be taken into account as leaders set priorities and decide how those priorities will be pursued. Ultimately, scholars and practitioners in the field of public administration should be experts in the overall design, construction, administration, and renovation of those institutions that constitute a state. They should use this expertise to help leaders craft governing strategies that are effective, durable, and normatively defensible.

Kyrgyzstan is a relatively young state that was previously part of the USSR. As a legacy from this state, Kyrgyzstan received an outdated command-and-control system. Almost immediately, the question of changing the state system became acute. It was necessary to reform the education system for state cadres because earlier employees could be sent from other regions of the USSR. Still, now it became necessary to train qualified personnel for each region completely independently. The subject of the chapter is the training of government personnel in Kyrgyzstan. The work aims to identify all the specific features in the training of government personnel in Kyrgyzstan, compare training with other countries, and highlight the key problems in this area. As a result of the work, the main problems will be summarized, and recommendations for eliminating these difficulties will be proposed. The work will use the following methods: analysis, generalization, description, comparison, synthesis, deduction, induction, and abstraction.

THE CRIME OF PUBLIC PROPAGATION OF A FASCIST OR OTHER TOTALITARIAN GOVERNMENTAL SYSTEM ARTICLE 256 OF THE PENAL CODE: A DOCTRINOLOGICAL ANALYSIS OF SELECTED SCHOLARLY WRITINGS AND JUDICATURE. DETAILED PART IIIThe paper presents interpretations of the content of art. 256 of the Polish Penal Code of 1997 The crime of public propagation of a fascist or other totalitarian governmental/state system, which were developed amid amendment in 2009. The most difficult problem for commentators, much like authors, about whom we have deliberated earlier, was to understand the complexity of the phenomenon of totalitarianism and the consequences resulting from accepting one of the competing concepts of totalitarianism. Similarly, interpretational problems led to misunderstandings of the concept of  fascism and the state system. As a result, individual authors incorrectly found resemblance between the regulations contained in the Penal Code of 1969 and the regulation contained in art. 256 from 1997. In this paper we prove that the Polish Supreme Court and even Polish Constitutional Tribunal also had the same problem with the interpretation of the content of art. 256.
