The development of information technology not only covers social, political and cultural but also affects the economy. One that is being widely discussed is Fintech. This article aims to analyze fintech on PT. iGrow Resources Indonesia towards fatwa DSN number 117 / DSN-MUI / II / 2018 about information technology-based financing services based on sharia principles. This research is a library research using a descriptive analysis approach. PT. iGrow is not directly participate in the lending and borrowing process but provides a digital technology-based platform to facilitate the lending-borrowing process. The development of technology and information, especially Peer to Peer (P2P) Lending, has made innovation in fintech-based financial services more practical and modern. The concept of adapting to technological developments combined with the financial sector by iGrow which was development step that is very aware of the needs of fintech for the business world. Regarding the extent to which the Islamic principles applied in PT. iGrow, can be seen in the discussion of the agreement. It is concluded that the standard contract is not in accordance with sharia principles based on the DSN fatwa number 117 / DSN-MUI / II / 2018 concerning information technology-based financing services based on sharia principles.Keywords: Contract, Fintech, iGrow, Sharia,  AbstrakPerkembangan teknologi informasi tidak hanya mencakup kehidupan sosial, politik, dan budaya tetapi juga berpengaruh terhadap perekonomian. Salah satu yang sedang ramai diperbincangkan adalah Fintech. Artikel ini bertujuan untuk menganalisa fintech di PT. iGrow Resources Indonesia berdasarkan fatwa DSN nomor 117/DSN-MUI/II/2018 tentang layanan pembiyaan berbasis teknologi informasi berdasarkan prinsip syariah. Penelitian ini merupakan penelitian kepustakaan (library research) dengan menggunakan pendekatan deskriptif analisis. PT. iGrow tidak turun langsung dalam proses pinjam meminjam tetapi  menyediakan platform berbasis teknologi digital dalam memfasilitasi proses pinjam-meminjam. Perkembangan teknologi dan informasi khususnya Peer to Peer (P2P) Lending telah menciptakan inovasi  layanan keuangan berbasis fintech menjadi semakin praktis dan modern. Konsep adaptasi perkembangan teknologi yang dipadukan dengan bidang financial oleh iGrow merupakan langkah pengembangan bisnis yang sangat menyadari kebutuhan fintech bagi dunia bisnis. Terkait sejauh mana prinsip syariah yang diterapkan dalam PT. iGrow, dapat dilihat pada pembahasan akad dalam kontrak. Disimpulkan bahwa kontrak baku belum sesuai dengan prinsip syariah berdasarkan fatwa DSN nomor 117/DSN-MUI/II/2018 tentang layanan pembiyaan berbasis teknologi informasi berdasarkan prinsip syariah. Kata Kunci: Fintech, iGrow, Kontrak, Syariah

Financial Technology is the implementation and utilization of technology to improve banking and financial services which are generally carried out by startup companies by utilizing the latest software, internet, communication and computing technologies.The research conducted was juridical empirical and normative juridical research, namely field research with interviews as a basis for problem solving and analyzing statutory regulations. The data used are primary and secondary data, then the data collection methods used in this study are library research and field research. The data analysis used is a qualitative method.The results show that the legal protection of users of the Financial Technology (Financial Technology) service of borrowing and borrowing money based on information technology (Peer to Peer Lending) has been carried out by the Financial Services Authority (OJK) and its staff by means of supervision, examination and investigation based on the Financial Services Authority Regulation No. 77 / POJK.01 / 2016 concerning Information Technology-Based Lending and Borrowing Services.The conclusion is that the legal protection of users of the Financial Technology (Financial Technology) service of lending and borrowing money based on information technology (Peer to Peer Lending) can be realized in a preventive and repressive manner. This article discusses how the sudden shift in policy reform and innovation has the potential to liberate the financial markets. The economic potential of internet finance is beginning to take hold across the capital markets as industries like Peer – to – Peer Lending, Equity and Debt based Crowdfunding and virtual currencies and cryptocurrencies which are types of digital currency are quickly transforming the way businesses are being financed. From borrowing and lending, buying and selling securities, to conducting wire transfers internationally, these innovations are creating a new class and generation of investors will source investments opportunities. Helping institutions and governments assess risks and manage performance in order to determine where to deploy capital; and showing signs of lessening the inequality gap. Following the neolithic agricultural revolution and the industrial revolution, this new revolution will enable more people to access financial services in less traditional ways, especially the unbanked world with its huge potential. These new financial opportunities, such as peer – to - peer (P2P) lending, will be discussed and examined, and we will stress how they can allow people to bypass current barriers in the global economy. We conclude by arguing that all these developments, energized by the efforts of innovators and entrepreneurs, have the potential to radically transform the world in which we live, while promoting the core values of industrialized societies including democracy, capital formation, sustainability, and equality without solely relying on tax increases.

<p>Technological developments have transformed the cash-money payment model into e-money, but the law on the use of e-money is still a debate in Indonesian Moslim society. This paper aims to analyze the legal use of e-money based on DSN-MUI fatwa No: 116/DSN-MUI /IX/2017 concerning Sharia Electronic Money. This research is a library research with descriptive analysis approach. E-money that was studied in this study was the BCA Flazz cards, Go-Pay, and Grab-Pay. Based on the Fatwa of MUI DSN on Shari’ah electronic money, the e-money system used in Indonesia today is not permitted because the issuer places the nominal amount of electronic money in conventional banks, if the card is lost the nominal amount of money in the issuer is also lost, and electronic money holders cannot be taken or cashed back.</p><p>Perkembangan teknologi telah mentransformasi model pembayaran dari cash-money menjadi e-money, tetapi hukum penggunaan e-money masih menjadi perdebatan di kalangan masyarakat Muslim Indonesia. Tulisan ini bertujuan untuk menganalisis hukum penggunaan e-money berdasarkan fatwa DSN-MUI No: 116/DSN-MUI/IX/2017 tentang Uang Elektronik Syariah. Penelitian ini merupakan penelitian kepustakaan (library research) dengan menggunakan pendekatan deskriptif analisis. E-money yang menjadi kajian dalam penelitian ini adalah kartu Flazz BCA, Go-Pay, dan Grab-Pay. Berdasarkan fatwa DSN MUI tentang Uang elektronik Syari’ah, maka sistem e-money yang dipakai di Indonesia hari ini tidak diperbolehkan karena penerbit menempatkan jumlah nominal uang elektronik di bank konvensional, apabila kartu hilang maka jumlah nominal uang yang ada di penerbit juga hilang, dan uang elektronik pemegang tidak bisa diambil atau diuangkan kembali.</p>

AbstractPartnership is a collaboration between one party and another, where each party plays its respective roles in a reciprocal relationship that benefits each party. Hasil dalam penelitian ini yaitu kerja sama penyaluran kredit dilaksanakan dengan memperhatikan ketentuan mengenai layanan pinjam meminjam uang berbasis teknologi informasi sedangkan kerja sama penjualan investasi ritel dan kerja sama pengelolaan non-performing loan dilaksanakan dengan memperhatikan ketentuan mengenai bank dan/atau bank umum sebagaimana dalam kerja sama bank umum. <p>The aim of this study is to explore and analyze the development of fintech peer to peer lending (fintech) regulation in Indonesia and Indonesia's readiness in facing the fintech industry, especially fintech loans. This study is important since the Indonesian government has begun to ratify fintech as one of the legal financial services in Indonesia. This is a normative legal research, by collecting secondary data including primary, secondary, and tertiary legal materials. The results show that after the Indonesian government approved Fintech as a legitimate financial service in Indonesia, many Fintech Start up companies begin registering their companies, the Indonesian government separate the granting of fintech licenses to the financial services authorities and Indonesian banks according to the types of the fintech, specifically for fintech peer to peer licensing is granted by the financial services authority. Although Fintech P2P Lending can be a prospective business area, there is not infrequently the risk of default by borrowers. The Fintech Provider does not guarantee ongoing loans if they fail to pay. The purpose of this study is to analyze the impact of Fintech on Micro Small and Medium Enterprises (MSME) capital with the P2P Lending model. The formulation of the problem is What is the impact of Fintech on MSME capital with the P2P Lending model? Research locations in the Banyumas Regency area with a concentration of 110 MSME as a research sample, with the criterion that ever or currently lending with P2P Lending system. Primary data were obtained from the results of questionnaire processing and interviews with respondents, namely MSME, while secondary data was sought from OJK, BPS, the Ministry of Cooperatives and Micro, Small and Medium Enterprises, BI, articles, and textbooks relevant to research. Data analysis methods are descriptive analysis methods, paired difference analysis and ordinary least square (OLS). The conclusion obtained in this study is a tendency to increase in the Number of Workers, Turnover, Product Sales, Profits and Business Costs after the use of Fintech with the Peer to Peer (P2P) Lending model in MSME. So venture capital loans obtained through FinTech with the P2P Lending model have a positive effect on the improvement and development of the MSME business.

Purpose China is a country with the most number of operating peer-to-peer (P2P) lending platforms (approximately 2,000) worldwide. This study aims to provide an overview on FinTechs in China. It was examined why payment services and P2P lending are so popular in China and what are the determinants for the emergence of P2P lending platforms in different provinces in China. Design/methodology/approach This study conducted a descriptive analysis of P2P lending in China and an empirical analysis of determinants of P2P lending in China. Findings This descriptive analysis shows that the surge in the number of the P2P platforms in China follows an inverted U-shaped phenomenon. However, the outstanding balances of P2P lenders is still increasing, while average yields of P2P lenders have sharply plunged. The empirical findings indicate that P2P lending is more extensive in the region with more mobile phone subscriptions; outstanding balance of P2P lenders in region is negatively associated with the size of traditional banking sector; and the number of the P2P platforms in negatively related to the fixed assets investments in region, whereas average yield is positively associated with the fixed assets investments. Originality/value Currently, almost no research papers with empirical analysis of FinTechs, especially P2P lenders, exist. This study estimates a simple model to find determinants of P2P lending.

This research is motivated by the existence of a standard contract which is a written agreement made or provided by one party, by including various contract clauses that have been standardized by one party without giving the other party the opportunity to negotiate them. The existence of a standard contract in the sharia business world is a pros and cons among the public, especially among legal experts, because in addition to making it easier and saving time, it is also considered to be against the principles of sharia, namely persecuting other parties. The theory used in this research is that the grand theory uses the rule of law theory; Middle Rangge Theory uses the Shahadah Theory from al-Syafi'i then the Social Juctice Theory; and the application theory uses a legal system supported by the theory of legal change. This study uses descriptive qualitative research, in collecting data, the authors use the method of observation, interviews and documentation using descriptive analysis to describe and describe the data obtained by using words or sentences that are separated according to the research data category in order to obtain a conclusion. The result of the research shows that the standard contract is legally valid because it has fulfilled the terms and conditions of contract in Islam which are marked by the signing of the standard contract by both parties as proof that both parties are equally pleased.
