The pattern of political culture is the pattern of people's behavior in the life of the state, nation, state administration, government politics, and the law carried out by the whole community every day. One of these political cultures is influenced by immigrant communities living in one area. This study aims to determine the cultural patterns of the immigrant community, especially the Palembang people in Pangkalpinang City, which are cognitive, affective, and evaluative oriented. Knowing the immigrant community's cultural way in Pangkalpinang City will produce conclusions and prove that the immigrant community (Palembang people) carries out the pattern of political culture in Pangkalpinang City.

The paper presents the fundamental factors of expropriation (term, concept, history, law reasons, object, subjects) and the role of administration in the procedure of expropriation. From the aspect of whole procedure the author concludes that the state administration has a crucial role. Because of that in the law schools, expropriation in the largest volume would enter the scope of administration law.

The article examines the disturbances of warriors from Selenginsk, Udinsk, Ilyinsky and Kabansky fortresses, which occurred in 1696. The author of the study believes that the events were not a direct struggle against state administration. Most of the actions of Transbaikalye residents, directed against the voivode A. Savelov, were not the riot and in most cases did not go beyond the legal framework. On the basis of those events were the erroneous policy of the state aimed at the garrisons formation in Western Transbaikalye, not at anti-feudal process as it was previously thought. The article focuses on the fact that the stage of involvement of Selenginsk and Udinsk military corporations in «troubles» was unequal. While Selenginsk warriors and part of the «old» Udinsk warriors had taken a moderate position in anticipation of conflict resolution with Irkutsk voivode with the help of the state some of Udinsk warriors, mainly the newly-recruited, were inclined to arbitrariness and violation of the law.

Chapter 5 focuses on the vulnerable conditions of stateless people because the state regulates their everyday lives in various forms, committing severe injustices and producing various inequalities by yielding illegibility in the state structure. The modern nation-state has produced the concept of citizenship rendering some stateless. Since the state of statelessness sanctions that some people do not belong to any state, they cannot claim any rights from any state and therefore easily become subject to injustice, inequality, and discrimination and are even subjected to death. The treatment of stateless people as illegal human bodies and as animals can be termed as ‘bare life’, as Agamben would argue. A life is ‘bare’ because it can be taken by anyone without any legal intercession, as this life does not exist ‘before the law’. This chapter depicts a vivid picture of the Rohingyas, where the state intervenes in their everyday lives amid the reproduction of vulnerabilities in order to reconfirm their statelessness.

Over the last fifteen years, legal historians have been exploring conceptualizations of the state and state capacity as phenomena of police. In this essay, I offer a genealogy of police in nineteenth-century American constitutional law. I examine relationships among several distinct strands of development: domestic regulatory law, notably the commerce power; the law of indigenous peoples and immigrants; and the law of territorial acquisition. I show that in state and federal juridical discourse, police expresses unrestricted and undefined powers of governance rooted in a discourse of sovereign inheritance and state necessity, culminating in the increasingly pointed claim that as a nation-state the United States possesses limitless capacity “to do all acts and things which independent states may of right do.”

<p align="justify">Este trabajo de investigación analiza las competencias que corresponden a la Administración estatal, autonómica y local en materia de protección y fomento del patrimonio histórico y cultural, prestando especial atención a las competencias municipales; para posteriormente centrarnos en el estudio de los instrumentos de protección del patrimonio histórico andaluz, el Catálogo General y el Inventario de Bienes Reconocidos, en los que aquellas competencias se proyectan. Así, nuestro objeto de estudio son los bienes que los integran, el procedimiento de inscripción y el régimen jurídico aplicable a los titulares o poseedores de los bienes inscritos. Y todo ello, analizando no solo la Ley de Patrimonio Histórico Andaluz de 2007, sino también, la normativa estatal relacionada y la jurisprudencia referente al tema.</p> <p align="justify"><b>This work of investigation analyses the competitions that correspond to the state Administration, regional and local in matter of protection and promotion of the historical and cultural heritage, loaning special attention to the municipal competitions; for later centre us in the study of the instruments of protection of the historical heritage of Andalusia, the General Catalogue and the Inventory of Recognized Goods, in which those competitions are projected . Like this, our object of study is the goods that integrate them, the procedure of registration and the applicable juridical diet to the headlines or possessors of the goods inscribed. This study aimed to examine two objectives: first, legal considerations of court decision Number 05/G/2011/PTUN.Yk regarding state administrative decision on intermittent termination and replacement (PAW) a member of the Bantul Regional Representative Council (DPRD), and second, panel of judges rationale concluded that the decision on PAW was not absolute competence of PTUN. This research is classified as normative legal research using  both  primary  data by conducting interviews with PTUN judges and the expert, and secondary data in the form of legal material. The results showed: first, there are three main legal considerations used by judges: 1. the decision on PAW is a decision in the field of politics and constitutionality; 2. the decision on PAW does not fullfil the unilateral will element; 3. the existence of jurisprudence. Second, the judge's judgments rested on the conclusion that the decision did not fulfill the 'state administration' element and was emphasized in the 'initial process' of the PAW stage series, not to the 'final process' in the form of issuing decisions. The judgments put forward the interpretation based on doctrine, while if compared with the provisions of the Law on Administrative Court, the decision on PAW had actually been fulfilled as the KTUN which was the absolute competence of PTUN.

The Administrative Court and Law No. 5 of 1986 on State Administrative Justice have been provided facilities for the public to sue the government and ask to cancel the decision made by the government. Law No. 30 of 2014 on Government Administration has been stipulated that Government Administration Act more or less supersedes the provisions contained in the Law of the State administrative justice. Especially in this Law which attracts attention is the expansion of object disputes state Administration. The object of the state Administration dispute in this Act is different from its elements to the Law of the State administrative justice. One of these is a written stipulation that includes factual action. There is no explanation for the meaning of factual acts in this Administrative Administration Act. Therefore, further research is needed in this regard. This study aims to find out and understand the meaning of factual actions in Article 87 letter (a) of Law Number 30 of 2014. This study uses a qualitative approach to the type of research Normative Juridical. Data collection techniques are Library study is to collect data conducted by reading, quoting, recording and understanding various literature that have to do with research material. The object of the state Administration disputed in Law Number 5 of 1986 and its amendment has expanded on Law Number 30 Year 2014 on Government Administration. When the object of the dispute expands, it will affect the decision taken by the legal practitioner in this case is the state Administration judge.

At the current stage of the development of society the problem of social protection and state support for people with disabilities is particularly relevant and requires reform and improvement. Ukraine, as a country aspiring to join the European Union, should take into account the best foreign experience of the leading countries of the world in the field of state policy to support people with disabilities and its implementation. The process of reforming the national healthcare system demonstrated the ineffective policy in this area, the high level of corruption and the inability to transform this system to the level of world standards of medical care, especially for people with disabilities. The problem of disability in Ukraine is becoming particularly acute. The goal of this article is to investigate the system of economic means of state administration of the rights of people with disabilities to healthcare, to identify the areas of budgetary management and the formation of a new mechanism of economic administration. Scientific analysis was carried out by using the method of systematic approach and analysis, which enabled us to study theoretical aspects of economic methods of state administration of the right of people with disabilities to healthcare, formation of the budget management in Ukraine for the economic security of the rights to healthcare, and features of the new mechanism of the economic administration of the right of people with disabilities to health care. It has been researched that along with administrative methods of state management of the right to health protection of people with disabilities the economic group of methods is important. These include programs of economic development of health care, rehabilitation programs for people with disabilities, implementation of pilot projects to change the mechanism of financial support for operative treatment, etc. Methods of regulating influence (indirect management) are becoming increasingly important, and economical methods of management belong to them. Implementation ensures that the financial and material interests of the management objects are satisfied through the activities of its subjects, which create favorable conditions for achieving the goals and objectives of management. For example, local self-government bodies, within the limits of their competence, can finance local programs for the development and support of community healthcare institutions. In 2019, a new mechanism of rehabilitation support for children with disabilities was introduced based on the principle of "money follows the people", which should ensure targeting, transparency and improve the quality of rehabilitation services. Resources are divided vertically among regional bodies, which divide budgetary funds among local bodies in proportion to the number of children who require rehabilitation measures, according to the place of their residence (location). The national legislation also reflects the norms that created the conditions for the implementation of the right to work of people with disabilities, as well as ratified Convention on the Rights of Persons with Disabilities and the ILO Convention on professional rehabilitation. From the point of view of the Ministry of Healthcare of Ukraine, the funds allocated by the state are extremely insufficient for the uninterrupted functioning of the medical system. In its budget memorandum for 2021 the ministry has allocated twice as much – 296 billion UAH, 225 billion UAH of which for the implementation of the medical guarantee program (which is 5% of GDP, as required by the Law of Ukraine "On State Financial Guarantees of Medical Services to Population"). But the proposals of the Ministry of Health both at the time of formation of the state budget and at the time of its approval were not taken into account. The requirement of the Law of Ukraine "On State Financial Guarantees of Medical Services to the Population" for the establishment of financing of the program of medical guarantees at the level of 5% of GDP was lengthened for one more year.

Abstract: The tendency to apply sharia to the state or government by some Muslims is a very interesting new phenomenon in many Muslim countries. Several Muslim countries, such as Indonesia, Pakistan, Jordan, Sudan, Egypt, Morocco, Kuwait and Iran are examples of countries where "Islamist" groups want to implement sharia into government. Of course this desire raises different views from Islamic figures, some support and some oppose it. This paper seeks to find answers to the problems that arise from the views of supporters and opponents of the Islamic state, with the core of the problem are:  (1) seeking and knowing the concept of Islam and Caliphate in the Islamic political system; (2) explaining the government system according to historical perspective; namely in the era of the Prophet Muhammad and Khulafa ar-Rasyidin; and (3) explaining the relationship between religion and state in the concept of siyasa fiqh. The conceptual framework used in this paper is that there are two important things to be achieved in politics, namely (1) politics as anything related to state administration; and (2) politics as all activities directed to seek and maintain power in society. In relation to this, there is often a "tension" between groups that want to implement the Shari'ah into the rules of government with groups that oppose it. If the desires of the two groups cannot be met, then there is no possibility of various acts of violence in a country, and can even lead to a coup against the current government. Some findings from this study are that (1) System of government in an Islamic perspective is not clearly stated in the Quran and Sunnah so that Islamic political thinkers disagree over what government system must be applied in a nation state; (2) In a historical perspective, the system of government in the time of the Prophet Muhammad was more concerned with the substance of Islamic values into the system of state government. This can be seen rules of the Madina Constitution, while the government of the Khulafa ar-Rasyidin used a system of power of autocracy and monarchic dynasty; (3) Islamic political thinkers differ in their views on the relation between religion and state in the concept of siyasa fiqh into three groups, namely (1) religion and state must be integrated and cannot be separated because the state is a political and religious institution; (2) religion and state are not related at all because the Prophet Muhammad was only an ordinary prophet like the previous prophet with the single task of inviting people back to noble life; (3) religions and state relate reciprocally and need each other. Abstrak: Kecenderungan untuk menerapkan syariah Islam ke dalam negara atau pemerintahan oleh sebagian orang Islam merupakan gejala baru yang sangat menarik di banyak negara Muslim. Beberapa negara muslim, seperti Indonesia, Pakistan, Yordania, Sudan, Mesir, Maroko, Kuwait dan Iran merupakan contoh negara-negara di mana kelompok-kelompok “Islamis”-nya ingin menerapkan syariah ke dalam pemerintahan. Tentu saja keinginan tersebut menimbulkan pandangan yang berbeda-beda dari tokoh-tokoh Islam, sebagian ada yang mendukung dan sebagian lagi menentangnya. Tulisan ini berusaha untuk mencari jawaban terhadap permasalahan-permasalahan yang muncul dari pandangan para pendukung dan penentang  negara  syariah, dengan inti permasalahannya adalah : (1) mencari dan mengetahui konsep Islam dan Kekhalifahan dalam sistem politik Islam; (2) menjelaskan sistem pemerintahan dalam perspektif historis, terutama pada masa Nabi Muhammad dan Khulafa ar-Rasyidin, dan (3) menjelaskan hubungan agama dan negara dalam konsep fiqh siyasah. Kerangka konseptual yang dipergunakan dalam tulisan ini adalah bahwa terdapat dua hal penting yang hendak dicapai dalam politik, yaitu       (1) politik sebagai segala yang berkaitan dengan penyelenggaraan negara; dan (2) politik sebagai segala kegiatan yang diarahkan untuk mencari dan mempertahankan kekuasaan dalam masyarakat. Dalam kaitannya dengan hal tersebut, seringkali terjadi “ketegangan” antara kelompok yang ingin menerapkan syari’ah ke dalam aturan-aturan pemerintahan dengan kelompok yang menentangnya. Apabila keinginan dari kedua kelompok tersebut tidak dapat dipertemukan, maka tidak menutup kemungkinan akan terjadi berbagai tindak kekerasan dalam suatu negara, dan bahkan dapat menimbulkan kudeta terhadap pemerintahan yang sedang berjalan. Beberapa temuan dari peneletian ini adalah (1) Sistem pemerintahan dalam perspektif Islam tidak disebutkan secara jelas dalam al-Quran dan Sunnah sehingga para pemikir politik Islam berbeda pendapat tentang sistem pemerintahan apa yang harus diterapkan ke dalam sebuah negara-bangsa (nation-state); (2) Dalam perspektif historis, sistem pemerintahan pada masa Nabi Muhammad lebih mementingkan substansi nilai-nilai Islam ke dalam sistem pemerintahan negara. Hal ini dapat dilihat pada aturan-aturan yang tertuang dalam Piagam Madinah, sedangkan pemerintahan pada masa Khulafa’ ar-Rasyidin menggunakan sistem “autocratic power” (kekuatan autokrasi) dan a dynastic monarchy” (dinasti monarkhi); (3) Para pemikir politik Islam berbeda pandangan dalam menyikapi relasi agama dan negara dalam konsep fiqh siyasah menjadi tiga kelompok, yaitu pertama, agama dan negara harus terintegrasi dan tidak dapat dipisahkan sebab negara merupakan lembaga politik dan sekaligus keagamaan, kedua, antara agama dan negara tidak berhubungan sama sekali (terpisah) karena Nabi Muhammad hanyalah seorang Rasul biasa seperti halnya rasul-rasul sebelumnya, dengan tugas tunggal mengajak manusia kembali kepada kehidupan yang mulia, ketiga, agama dan negara berhubungan secara timbal balik dan saling membutuhkan.
