TASKS OF LOCAL GOVERNMENT UNITS IN THE FIELD OF FIRE IN LEGAL AND PRACTICAL TERMS, BASED ON THE EXAMPLE OF THE CITY OF BIELSKO-BIAŁA AND BIELSKI COUNTY – SELECTED ISSUES

The article presents the tasks imposed on the city of Bielsko-Biała in the field of fire protection, consisting of bearing the costs of equipment and maintenance of fire protection units in the field of Voluntary Fire Brigades by the commune. The amounts of financial resources spent on the above-mentioned purposes were given on the basis of the report on the condition of the city of Bielsko-Biała for 2018 and 2019. The poviat’s tasks in the field of fire protection were also discussed, and based on the report on the state of the Bielski poviat for 2018 and 2019, data on financial aid granted by the Bielski poviat for poviat structures of the State Fire Service and Volunteer Fire Brigades were provided. Some of the issues were devoted to indicating the legal basis for the operation and tasks performed by fire protection units performing tasks in the field of fire protection in the city of Bielsko-Biała and the Bielski poviat, i.e. the Municipal Headquarters of the State Fire Service in Bielsko-Biała and units of the Volunteer Fire Brigades. As regards the Municipal Headquarters of the State Fire Service, its organizational structure has been presented, with particular attention being paid to the rescue and firefighting units located in the city of Bielsko-Biała and the station located in Czechowice-Dziedzice. Tasks performed by the Municipal Headquarters of the State Fire Service in 2019 and for the period January - November 2020 for the city of Bielsko-Biała and the Bielski County were presented on the basis of statistical data of the Municipal Headquarters of the State Fire Service in Bielsko-Biała available on the website of the Headquarters. The tasks of the Volunteer Fire Brigades units, the rules of qualifying units of the Volunteer Fire Brigades to the National Rescue and Firefighting System and the rules of their departure to events in the city of Bielsko-Biała and the Bielski County were discussed. Tasks carried out by units of the Volunteer Fire Brigades in 2019 for the city of Bielsko-Biała and the Bielski County were presented on the basis of statistical data from the Municipal Headquarters of the State Fire Service in Bielsko-Biała available on the website of the Headquarters

The commentary mainly concerns procedural issues related to the monetary equivalent for members of voluntary firefighters. The commentary is entirely approving. The resolution on the amount of the equivalent is of a general and abstract nature, and therefore is an act of local law. A councillor, who is at the same time a member of the voluntary fire brigade and takes part in rescue operations or fire training organized by the State Fire Service or the municipality, has a legal interest (derived from Article 28(1) and (2) of the Fire Protection Act) in adopting a resolution on the amount of the equivalent. The resolution on the amount of the equivalent, which was adopted by the city council with the participation of councillors (at the same time members of the voluntary fire brigade), who were excluded from voting by virtue of the law itself, is invalid.

Abstract Amendment to the Act on special rules of preparation and implementation of investment in public roads resulted in an accelerated mode of acquisition of land for the development of roads. The decision to authorize the execution of road investment issued on its basis has several effects, i.e. determines the location of a road, approves surveying division, approves construction design and also results in acquisition of a real property by virtue of law by the State Treasury or local government unit, among others. The conducted study revealed that over 3 years, in this mode, the city of Krakow has acquired 31 hectares of land intended for the implementation of road investments. Compensation is determined in separate proceedings based on an appraisal study estimating property value, often at a distant time after the loss of land by the owner. One reason for the lengthy compensation proceedings is challenging the proposed amount of compensation, unregulated legal status of the property as well as imprecise legislation. It is important to properly develop geodetic and legal documentation which accompanies the application for issuance of the decision and is also used in compensation proceedings.

Subject. The article discusses the financial aid the State provides to business during the COVID-19 crisis. Objectives. We analyze the financial aid the State provides to the Russian businesses as a single model, considering the national specifics. Methods. The study involves methods of analysis and synthesis, comparative analysis, generalization, etc. The study is based on factual and official data for H1 2020. Results. There is a national model of the financial aid the State provides to businesses in Russia, which is intended to temporarily provide businesses with funds in force majeure and ensure their uninterrupted operation, protect small and medium-sized business and market competition. We analyze key tools of the State support and substantiate our suggestions how it should be maintained for certain types and areas of business in the post-crisis period. Conclusions and Relevance. The current situation with COVID-19 made the State organize business support, provide businesses with financial resources on certain terms or use business protection tools.

The article is devoted to the clarification of the peculiarities of the use of investment instruments for the development of the water supply and wastewater sector in Ukraine. The sphere of water supply and wastewater of Ukraine requires significant investments for the renewal of fixed assets of water supply and wastewater enterprises, reconstruction and development of engineering infrastructure, introduction of the latest technologies, improvement of the quality of services, etc. The authors consider the concept of investment, investment activity, investment program in the general context and in the field of water supply and wastewater. The structure of planned volumes of financing of measures of investment programs of water supply and wastewater enterprises in 2018 is being analyzed. Issues of application of other modern financial and economic mechanisms in the field of water supply and wastewater are considered. The article analyzes the state of realization of public-private partnership in the field of water supply and wastewater on the basis of statistical data. Investment approaches based on participative financing, which involves the use of financial resources not only of the state but also of local communities, business and civil society institutions, and financing through the use of opportunities of the market of debt obligations, including at the expense of the issue of municipal securities in the form of bonds of a local loan.

The paper is dedicated to the estimation of the state of the road economy of Voronezh up to date. The state of the Voronezh road system is analysed, statistical data are given, and the problems of the city transport system are studied. On the basis of all the data obtained, ways to solve existing problems are proposed and long-range programs for the construction of new and reconstruction in operation roads are considered. The complex of works of the improvement state of the road system planned for the near future is described in detail.

The paper studies the activities of the All-Union Association “Torgsin” in Ukraine between 1931 and 1935. It proves that the Soviet state needed to mobilize financial resources for implementing the industrialization programme and, therefore, sought additional sources of income. The Soviet authorities elaborated complex measures for this purpose. The grain procurement policy caused mass famine in Ukraine. The establishment of the Torgsin system demonstrated a pseudo-concern of Soviet authorities about the starving population. The Torgsin trade network, founded in the years of mass famine in the early 1930s, extended to the territory of Ukraine and strengthened its organizational structure due to exporting food and industrial goods of high quality. It enabled the state to swindle gold, family values and antiques from the starving population in exchange for foodstuffs and trade currency with foreigners and Soviet citizens through the Torgsin network.

Introduction: The scope and schedule of immunization in Poland is regulated by the Immunization Programme prepared and announced by the State Sanitary Inspector. There are two kinds of vaccines: compulsory vaccines, financed by the state budget at the disposal of the Minister of Health, and vaccines recommended by the central health authorities but financed by local governments within health policy programmes. Compulsory vaccines cover people up to 19 years of age and individuals at higher risk of infections. The public health programmes organized and financed by local governments play an important role in infectious disease control in the country. Objective: The objective of this study is to analyse health policy programmes including immunization programmes, which were developed, implemented and financed by local government units of all levels in Poland between 2016 and 2019. Material and Methods: This analysis covers data compiled by voivodes and submitted to the Minister of Health as annual information on public health tasks carried out by local government units. From the aggregate information, data on all health policy programmes conducted by individual local government units between 2016 and 2019, including immunization, were extracted and analysed. The data were obtained pursuant to the provisions of the act on access to public information. Results: In the analysed period, local government units implemented a total of 1737 health policy programmes that financed the purchase of vaccines, qualification tests for immunization and carrying out immunization by authorized medical entities. Among the vast majority of programmes, promotional activities were also implemented. Conclusions: In Poland, local governments are deeply engaged in the immunization of their citizens by organizing and financing specific health care programmes. These programmes are an essential addition to the state financial resources in infectious disease control. This engagement expresses local government maturity regarding the health needs of the population and public health measures. Communes are the most engaged units among all levels of local governments. It is probably due to close mutual communication between the people and local governments. The growing awareness of the important role of HPV immunization in the prevention of cervical cancer among local government units is reflected in the increase in the number of girls vaccinated against HPV and the increase in financial resources allocated for primary HPV prevention. The decrease in the number of people vaccinated against pneumococci may result from including pneumococcal vaccines in the compulsory immunization schedule.

It is shown how the methodology used to estimate net fiscal incidence, presented in a previous paper, can be applied to British local government. The example chosen is Leeds, and four services—education, fire protection, library provision, and swimming pool provision—are studied. Estimates of net fiscal incidence are presented for the period 1966–1975. The choice of appropriate geographical areas within the city is discussed and analysis zones are defined on the basis of a principal components analysis of characteristics likely to give rise to significant variations in expenditure participation and revenue contribution. A brief outline of service delivery in Leeds is then presented. Net fiscal residuals are estimated separately for each service. Service expenditure allocation is estimated by spatial interaction techniques and it is shown that there are significant variations in the distributions. However, the spatial pattern of net fiscal imbalances in the City turn out to have some overall similarities. Because of local government reorganisation and other factors, it is not possible to directly compare changes over the study period. Nevertheless, the methods by which local authority finances are raised, movement of client groups, and changes in service delivery are all important mechanisms contributing to change. Further possible explanations are also briefly discussed.

The article analyzes the influence of exponential development on the transformation of the modern Ukrainian university. The most significant, interdependent and influencing factors that lead to the creation of new models of the modern university's existence are singled out. Provided is a systematic analysis of the most acute problems inherent in Ukrainian universities in the context of the philosophy of exponential development which requires the university to continuously strive for excellence and maximum involvement in innovation and technological and socio-economic processes. Also, specific steps are suggested that will allow Ukrainian universities which do not meet the challenges of exponential development today, to overcome a deep mental, organizational, financial and innovation crisis. In particular, the emphasis is placed on certain legislative changes with the purposeful activities of executive authorities, local government and the academic community; overcoming stereotypical attitudes towards the state property, which leads to overburdening of the state by unusual functions and inefficient use of material and financial resources; the implementation of a mental revolution in the academic communities of universities, the attraction of renewed universities to socio-economic transformations on the basis of innovative technologies and philosophy of responsibility; overcoming the consequences of a reductionist worldview and the fragmentation of knowledge; provision of continuous technological re-equipment of universities; the development of new philosophical meanings of being for the newly created reality.

Resumo: O presente artigo propõe-se a apresentar os resultados da pesquisa sobre os índices do crime de ameaça (art. 147 do Código Penal Brasileiro - CPB) praticado contra a mulher no âmbito familiar-doméstico, na cidade de Belém/PA, no período de 2010 a 2014, registrados pela Delegacia Especializada no Atendimento à Mulher (DEAM). A expressividade da pesquisa revela-se pela constatação de que crimes de maior potencial ofensivo, como o feminicídio, são geralmente precedidos do delito previsto no art. 147 do CPB, o que deveria estimular uma atuação preventiva do Estado, como a apuração e repressão regulares, eficazes e céleres das ameaças cometidas no campo das relações domésticas. Para a realização do trabalho pesquisou-se na legislação, na doutrina forense, na jurisprudência e na práxis dos órgãos que compõem a rede de enfrentamento à violência doméstica no estado do Pará, como funciona a persecução penal do delito de ameaça e como a mulher pode proceder para acessar a justiça. Por fim, para averiguar como a ameaça vem sendo registrada e investigada em Belém/PA, foram coletados dados estatísticos dos boletins de ocorrência e dos inquéritos policiais correspondentes na DEAM/Belém. Após a análise dos dados obtidos, constatou-se que a ameaça foi o tipo penal mais recorrente nas estatísticas policiais da Especializada, no período examinado, mas apenas parcela irrisória dos casos foi apurada através de Inquéritos, evidenciando que a exigência de representação penal, a morosidade e a burocracia processuais têm sido óbice ao acesso à justiça e à efetividade da tutela estatal.Palavras-chave: Ameaça; Lei Maria da Penha; Estatísticas da DEAM/Belém; Acesso à Justiça. Abstract: The present article proposes to present the results of the research on the indexes of the crime of threat (article 147 of the Brazilian Penal Code - CPB) practiced against women in the family-domestic environment, in the city of Belém / PA, in the period from 2010 to 2014, registered by the Delegacia Especializada no Atendimento à Mulher (DEAM). The expressiveness of the research is revealed by the fact that crimes with greater offensive potential, such as femicide, are generally preceded by the offense established in art. 147 of the CPB, which should encourage a preventive action by the State, such as regular, effective and speedy investigation and prosecution of threats in the field of domestic relations. In order to carry out the work, the legislation, forensic doctrine, jurisprudence and praxis of the organs that compose the network to deal with domestic violence in the State of Pará, how the criminal prosecution of the crime of threat works and how the woman can proceed to access justice. Finally, to find out how the threat has been registered and investigated in Belém / PA, statistical data were collected from the corresponding occurrence bulletins and police inquiries at DEAM/Belém. After analyzing the obtained data, it was verified that the threat was the most recurrent criminal type in the police statistics of the Specialized, during the period examined, but only a negligible part of the cases was verified through Inquiries, evidencing that the requirement of criminal representation and Morbidity and procedural bureaucracy have been an obstacle to access to justice and to the effectiveness of state tutelage.Keywords: Threat.
