Resumen:La estabilidad presupuestaria y los límites a la deuda pública se han convertido en los principios referenciales de la política económica de la Unión Europea tras el paso por la crisis económica de los últimos años. La aplicación de estos principios supone hacer grandes recortes en el Estado del Bienestar que puede afectar sustancialmente a los derechos sociales e, incluso, el modelo de Estado de nuestro país. El presente artículo pretende dejar constancia que tanto la interpretación de esos principios como el nuevo artículo 135 de la CE deben ser interpretados de conformidad con las reglas económicas constitucionales que aseguran la vigencia del Estado social y democrático deDerecho.Summary:Introduction 1. The tense balance between economic and social rights and budget stability. Conclusions.Abstract:Budget stability and public debt limits have become key economic policy factors in the European Union in the wake of the recent economic crisis. The application of these principles involves major cuts to the Welfare State that may substantially affect social rights and even the model of State in our country. This article argues that both these principles and the new article 135 of the Spanish Constitution must be interpreted in accordance with constitutional economic rules that ensure the continuing validity of the social and democratic Statebased on the rule of law.

Resumen:Este trabajo analiza la situación en el modelo constitucional español del principio de no regresividad de los derechos sociales. Se parte del análisis sucinto del modelo social de nuestra Constitución lo que implica el reconocimiento de derechos económicos y sociales. Este reconocimiento es la plasmación constitucional de los principios de solidaridad y de cohesión social. El principio de cohesión social ha sido definido por el Consejo de Europa e incluido explícitamente en los tratados constitutivos de la Unión Europea. La necesidad de lograr la cohesión social fundamenta la inclusión en las Constituciones y en los tratados internacionales del principio de no regresividad de los derechos sociales. En la Constitución española de 1978 este principio no se incluye expresamente. La no inclusión en la Constitución de este principio supone un peligro para la cohesión social en tiempos de crisis económica. Por su parte, el Tribunal Constitucional ha sentado una doctrina ambigua sobre este asunto, que ha sido analizada en este trabajo, así como las más significativas aportaciones doctrinales sobre la materia. Para saber cuáles son los limites de la regresividad de los derechos sociales que dotan de contenido este principio se ha realizado una comparativa internacional y de los principios constitucionales. Del estudio del ordenamiento internacional y de los valores y principios constitucionales se ha obtenido una serie de límites a la regresividad del contenido, eficacia y protección de los derechos sociales. Concluye este trabajo sugiriendo una propuesta de reforma constitucional que incluya el principio de no regresividad de los derechos sociales en el texto constitucional estableciendo una serie de requisitos de aquellas medidas que puedan suponer una regresión de contenido de los mismos tales como que deberán justificarse plenamente en referencia a la totalidad de los derechos, valores y principios recogidos en la Constitución y en los tratados internacionales suscritos por el Estado español y en el contexto del aprovechamiento pleno del máximo de los recursos de que se disponga; se aplicarán tras el examen más exhaustivo de todas las alternativas posibles; tendrán en todo caso carácter temporal hasta que las circunstancias económicas permitan restablecer el ámbito material de contenido, eficacia, protección y garantía prexistente de los derechos sociales afectados; en todo caso respetarán el contenido mínimo esencial de los derechos sociales como manifestación de la dignidad humana; serán razonables y estarán suficientemente motivadas; no vulnerarán, entre otros, los principios de seguridad jurídica, confianza legítima, no discriminación e irretroactividad de disposiciones restrictivas de derechos individuales, serán proporcionadas y respetarán los principios de solidaridad, cohesión y sostenibilidad social. Summary1. Conclusion: constitutionalamendment and non-regressivity of social rights.Abstract:This paper analyzes the constitutional recognition of the principle of non-regressivity of social rights in Spain. It starts from the succinct analysis of the social model of our Constitution which implies the recognition of economic and social rights. This recognition is the constitutionalization of the principles of solidarity and social cohesion. The principle of social cohesion has been defined by the Council of Europe and explicitly included in the constitutive treaties of the European Union. The need to achieve social cohesion underpins the inclusion in the Constitutions and international treaties of the principle of non-regression of social rights. In the Spanish Constitution of 1978 this principle is not expressly included. The non-inclusion in the Constitution of this principle poses a danger to social cohesion in times of economic crisis. For its part, the Constitutional Court has established an ambiguous doctrine on this subject, which has been analyzed in this work, as well as the most significant doctrinal contributions on the subject. In order to know which are the limits of the regressivity of the social rights that give content of this principle an international comparison has been made as well as a study of constitutional principles. Limits to the regressivity of content, effectiveness and protection of social rights have been obtained from the study of international order and constitutional values and principles. This paper concludes by suggesting a proposal for constitutional amendment that includes the principle of non-regressivity of social rights in the Spanish Constitution establishing some requirements of those measures that imply a regression of their content such as: they shall be fully justified in relationship with all the rights, values and principles contained in the Constitution and in the international treaties signed by the Spanish State and in the context of full exploitation of the maximum resources available; Shall be applied after a more comprehensive examination of all possible alternatives; Shall in any case be of a temporary nature until the economic circumstances permit the restoration of the content, effectiveness, protection and pre-existing guarantee of the social rights affected; In any case they will respect the essential minimum content of social rights as a manifestation of human dignity; Shall be reasonable and sufficiently motivated; Shall not infringe, inter alia, the principles of legal certainty, legitimate expectations, non-discrimination and non-retroactivity of provisions restricting individual rights; Shall be proportionate and shall respect the principles of solidarity, cohesion and social sustainability.

Recently Claus Offe has put the question that concerns the fate of the European model of social capitalism: Can the model of social capitalism survive the European integration in the context of certain contemporary tendencies? Offe has presupposed that the mentioned model is challenged by the processes of globalization and the integration of the post socialist countries into the European Union. The working hypothesis of the article is that there is an opportunity to provide a coherent answer to this question. The article consists of two parts. In the first part the author starts with the Polanyi's socio-economic theory and emphasizes the importance of this approach for the analyzing of the tendencies of capitalism in Western Europe and in the post socialist countries. The author argues that with the Polanyi's theory we are able to explicate the forms of the embedded liberalism in Western Europe after 1945 and the orientation of non-embedded neo-liberalism and the functioning of the workfare state after the crisis of the Keynesian welfare state. Despite the tendencies of the globalization projected by neo-liberalism, the central element of the social capitalism namely, the welfare state, remains with the dimensions of the continuity. In the next part the author points out that there is an asymmetrical structure between the Western-Europe and non-Western part of Europe concerning the socialization of capitalism. The neoliberalisation in accordance with the model of the transfer of ideal-type of capitalism is more strongly implemented in the countries of transition. In addition, the mentioned theoretical approach provides opportunities to explain the failures of implementing of neo-liberalism in the post socialist countries. On the basis of the endorsing of the socio-economic aspects we can address the issue pointed out by Offe.

The welfare state and its constant development accompanied by the appearance of new characteristics or changing old require to update scientific approaches to this phenomenon. The author researches existing approaches to the allocation of signs of the Welfare state. The article proposes a new system of formal legal criteria of the welfare state, which allows to determine the social orientation of the state excluding quantitative economic and social indicators. The author includes following criteria: 1) implementation of the principle of the social state; 2) reflected in the constitution of the list of social rights; 3) characteristics of the constitutional status of social rights; 4) enabling of the application of international law in the national legal system; 5) legislative consolidation of state duties in the social sphere and the mechanism of their implementation; 6) constitutional recognition of legal guarantees for the implementation of social rights (standards, specifying the general requirements for the economic structure of the state, taxation, redistribution processes); 7) legislative concretization of the mechanism of realization of social rights; 8) constitutional recognition of the special institutions, typical of the welfare state; 9) the presence of specific public authorities and other structural elements; 10) consolidation of the rule of law; 11) the status of social legislation. The proposed system of criteria based on international indicators of quality of life, takes into account the historical experience of the formation of the social state.

Uno de los ejemplos estudiados es el de la constitucionalización del principio de estabilidad presupuestaria. Se sostiene en el texto que se ha «desconstitucionalizado» el estado social en España, como consecuencia de estas reformas acometidas en los años de la crisis económica, de manera que se han vaciado de contenido las cláusulas del Estado social previstas en nuestra Constitución.Summary:1. One of the studied examples is the constitutionalization of the principle of budgetary stability. It says in the text that it has «deconstitutionalized» the Welfare State in Spain, as a result of these reforms undertaken in the years of the economic crisis, so have emptied of content clauses of the Welfare State provided for in our Constitution.

His recently published book on the economic crisis Wolfgang Streeck, one of the advisors of the former chancellor Gerhard Schröder, is a harsh critique of the trajectory of economic policies parties in Germany followed since the late sixties. The article discusses the arguments and proves the contradictions in Streecks approach. Streecks argues that mass support of the welfare state capitalism in the early seventies eroded. Capital withdrew its trust in democratic capitalism as the compromise between social classes. Thus an unexpected crisis of legitimation began. The state under the leading role of social democratic parties started with measures to ensure the loyalty of the working class but failed in a specific way. Crisis management led to crises on a higher level. Streecks approach claims to be critical. But nevertheless it doesn’t draw the necessary consequences, i.e. a critique of the social democracy that finally turns out to fail as a project: crisis management leads to the recent crisis of the EU and the monetary union. His recommendations: to go back to the ruins of the welfare state are not convincing. The book shows that social democracy confronted with the results of its own policies is perplexed.

In the article, within the framework of the general exploration of human rights was made an attempt to substantiate the importance of social rights as a separate category of rights that belongs to the «second generation» of human rights and needs analysis within the state and legal reality. Attention was paid to the historical aspect of the development of social rights. The events, that inevitably influenced the emergence, development and ideological justification of the need for recognition of social rights are analyzed, the causal links involved in their formation are also indicated. In publication the connection of social rights with the concept of the welfare state is revealed, the main purpose of this state is to promote the realization of these rights. The fundamental features of this form of organization of government and society make it possible to evaluate the great dependence of the realization of social rights on socially oriented policy and economy of the country. For a deep understanding of the essence and ideas embedded in the content of social rights, the features and characteristics of this category of rights are studied. Attention is also paid to the different approaches to the concept of social rights expressed by researchers in this issue. The sources in which social human rights are legally fixed are considered (the Universal Declaration of Human Rights, the European Social Charter, the Constitution of Ukraine, the German Social Code). Also there is a comparative analysis of the enshrinement of these rights in courses mentioned above. Particular attention is paid to the characteristics of social rights listed in the German Social Code, as well as to the content of the agreement between Ukraine and Germany about cooperation in the social sphere. Great attention in the publication is paid to the studying of events in Ukraine that hinder the realization of social rights. The coronavirus pandemic and military events in the East of the country have negative impact on the implementation of social rights. The statistical data confirming the violation of the housing rights and medical care at present are given. Conclusion is formulated about the need of analyzing social rights as a specialized group of human rights, which have passed a significant historical path of formation and have unique characteristics and features.

This chapter contributes to the discussion of public and private social welfare by drawing together recent information on these different ways of providing social benefits. It presents data on public social expenditure for 2015–17 and accounts for the impact of the tax system and private social expenditure to develop indicators on net social expenditure for 2015. The chapter shows that conventional estimates of gross public spending differ significantly from estimates of net public spending and net total social expenditure, leading to an incorrect measurement and ranking of total social welfare effort across countries.Just as importantly, the fact that total social welfare support is incorrectly measured implies that the outcomes of welfare state support may also be incorrectly measured. Thus, the main objectives of the chapter include considering the implications of this more comprehensive definition of welfare state effort for analysis of the distributional impact of the welfare state and for an assessment of the efficiency and incentive effects of different welfare state arrangements.
