This research aim to understand the condition when a customer is no longer able to pay or repay a loan is called bad credit. This condition can actually cause many problems, ranging from difficulties in obtaining credit approvals to blacklisting by the bank. Collaterals are one of the requirements from the Bank when giving credit loans so that those collaterals can guarantee the credit’s acquittal should the debtor be breached. If there is a case of bad debts, banks have the option to solve the credit loan through the process of Foreclosed Collaterals. This journal is written on a legal and juridical-normative research, emphasizing the usage of written documents as the main sources of law. The collateral purchases are written in Article 12A Number 10 of 1998 of the Constitution on how banks may purchase the collaterals with or without auctions to solve bad credits even faster. Considering that Article 20 of the Constitution on Mortgage Rights has already written ways on collateral executions, therefore the warrant payment will follow the option of Foreclosed Collaterals. Reporting from the official website of Bank Indonesia (BI), to minimize the risk of increasing bad loans, BI issued PBI (Bank Indonesia Regulation) No. 14/2/PBI/2012 concerning APMK (Card-Based Payment Instruments). The regulation was made to reduce the risk of negative impacts from using credit cards as debt instruments to the extent that they reach excessive limits. Using statute and conceptual approaches, it is inferred that Foreclosed Collateral purchase procedures can be done in 3 (three) different ways, followed through the Settlement Efforts, where the ownership of the collaterals must be switched to another in 1 (one) year time.

This study found that poor recovery measures, lack of proper credit and risk management system at bank level, wilful default by borrowers, lack of stringent regulation, poor level of corporate governance and misuse of funds by borrowers are the key factors behind the rising level of bad loans of Indian banks. It was found that public sector banks (PSB) are suffering the most from rising level of NPA, high rate of NPA of banks have adverse impact on banks’ balance sheets, their assets quality, increased provisioning coverage ratio of banks and low return on assets. Although various concerned stakeholders have taken numerous measures to curb the situation, such as recapitalization of PSB, construction of assets reconstruction companies (ARC), Debt Recovery Tribunals for speedy recovery of bad loans and enactment of insolvency and bankruptcy code (IBC),still there is much more to do, and have a huge scope to bring reforms in banking sector, especially in PSB of India.

This article demonstrates the effect of bad loans in India which was developed recently by the Indian Finance Minister. Bad banks operate like a concept in the domestic debt sector where the amount of domestic debt is high and even the market has enough scale to bear enough price-discovery and market-making. there was a proposal made to the government, to merge the NPA portfolio with a new establishment known as an Asset Rehabilitation Corporation (ARC), that would purchase the principal of the Non-performing Assets (NPA) portfolio at a book valuation (not market value) and these accounts would be taken over by the new company to manage the portfolio of the new command (which will be established with a capital of Rs 10,000 crore). The government says that it is intervening to mitigate potential damages that the banks could suffer as a result of the provisioning for non-performing assets and recapitalisation that the government (as a majority investor of most PSBs) may be required to invest on. With the forthcoming Union budget’s planning an outpouring of clamour and market demand is being felt to set up a ‘poor bank’ to sweep bad debts.

Significance Debt restructuring was offered to good and bad companies alike. This indiscriminate approach delayed insolvency that would otherwise have overtaken 'zombie' companies. Impacts Permanent shifts in demand, value chains and consumer preferences will make it more difficult for banks to assess companies' credit quality. After last year's 2020 lending and restructuring spree, smaller banks may roll over rather than write off bad loans. The low number of new company registrations will, among other factors, deter recovery in the labour market this year.
