The European Union’s Foreign Policy since the Treaty of Lisbon: The Difficult Quest for More Consistency and Coherence

Summary In the past, the effectiveness of the European Union’s (EU’s) foreign policy suffered from a lack of consistency as well as horizontal and institutional coherence. In order to enhance the consistency and coherence of the EU’s foreign policy, the Heads of States and Governments reformed the position of High Representative and created a European External Action Service (EEAS) under the Treaty of Lisbon. This article deals with negotiations on the decision regarding the organization and functioning of the EEAS by examining the preferences of the actors involved, the negotiation process and the eventual outcome. Will the institutional set-up of the EEAS and the new position of the High Representative enable the EU to play a more consistent and coherent role in the world? The article concludes that the EU’s foreign policy is now characterized by an even more complex institutional framework, resulting in the expectation that the EU will have even more difficulties in conducting an effective foreign policy.

Abstract Romania is the EU Member State with the highest numbers of emigrants, according to Eurostat. The annual growth of the Romanian diaspora is one of the fastest in the world, and quite recent (over the past 20 years). In light of these developments, the institutional network for engagement with Romanians abroad, first established in the mid-1990s, has recently increased in an attempt to respond to the fast-growing Romanian diaspora. A Ministry entirely dedicated to maintaining the relations with the Romanian diaspora was formally institutionalized 10 years after Romania officially joined the EU in 2017, replacing scattered departments and institutional bodies. However, the role of the recently set up diaspora institutions still needs to be clarified and firmly determined. Policies were developed with the goal of ensuring the integration of Romanian citizens in their countries of residence, but also to encourage return to Romania. In particular, as few other European diaspora populations, the Romanian diaspora is represented in the Romanian Parliament by two Senators and four Deputies who represent the interests of three to five million Romanians abroad.

Despite the ascendance of other regions in the world, the transatlantic relationship remains paramount. The cultural, historic and economic links between the US and Europe are strong and important. Notwithstanding the strength of these bonds, Europe has lost currency for US foreign policy as it has moved its focus to Asia. This can be attributed to the lack of coordination on the part of the Europeans and preoccupation with the EU's institutional debate. Now that the Lisbon Treaty has been ratified, the institutional debate is in the past and the EU must redouble its efforts to strengthen the transatlantic partnership. Going forward, the only way that the transatlantic partnership can be strengthened and for prosperity on both sides of the Atlantic to be assured is the removal of all trade barriers and the introduction of the free movement of goods, services, capital and labour across the Atlantic.

India has emerged as a leading voice in global affairs in the past two decades. Its fast-growing domestic market largely explains the ardour with which Delhi is courted by powers great and small. India is also becoming increasingly important to global geostrategic calculations, being the only Asian country with the heft to counterbalance China over time. Nevertheless, India’s foreign policy has been relatively neglected in the existing literature. On 1st July 2013, the Republic of Croatia officially became the 28th member of the European Union. This event marked the fulfillment of a foreign policy goal, along with joining NATO in 2009, as a major step forward in the country’s long-term consolidation process. The article therefore analyzes the key events of the Croatia – EU relations in 2007-2008, which moved this Balkan country closer to implementing its Euro-integration course. Particular attention is paid to the peculiarities of the pre-accession negotiations with the European Union, as well as to internal and foreign policy factors that had a direct impact on the Euro-integration dialogue between Croatia and the European Union. In this context, emphasis is placed on problem issues that slowed down the dynamics of the negotiation process to a certain extent, in particular the unilateral application by Croatia of the Ecological and Fisheries Protection Zone, and measures taken by the Croatian authorities to settle them. Significant achievements of Croatia in the negotiation process with the European Union are highlighted, in particular, progress of the country in meeting the European Union criteria as well as a date determination the of pre-accession negotiations completion as an important political sign of the European Union readiness to accept a new member in future.

In the discussion on the EU migration policy, it is impossible to evade the issue of the relation between this policy and the EU foreign policy, including EU common foreign and security policy. The subject of this study are selected links between migration issues and the CFSP of the European Union. The presented considerations aim to determine at what levels and in what ways the EU’s migration policy is taken into account in the space of the CFSP as a diplomatic and political (and subject to specific rules and procedures) substrate of the EU’s external action.

Leaving the EU is one of the major political decisions made in the UK over the past half-century. Brexit brought about a virtual political earthquake not only in EU-UK relations but also in terms of UK future place and role on the international scene. Immediately after the decision of UK citizens to leave the EU at a referendum held on 23 June 2016, the question arose as to whether the UK will lose some of its international influence, whether Scotland will remain part of the Union, whether the UK will retain its privileged relations and special status with the USA, and what its future relations with the EU will be. The purpose of this article is to point to the basic priorities of the contemporary British foreign policy as well as to place and role of the UK on the contemporary international scene particularly in view of its decision to leave the EU. We shall first try to define the status of present-day Britain in international relations. Second, we shall address the traditional dilemma of the UK foreign policy - what should be given priority - relations with the USA, Europe or the Commonwealth? After that, we shall discuss in more detail the phases the UK foreign policy went through following the end of the cold war. In the third phase, we shall analyze the British contemporary foreign and economic policy towards Gulf countries and China. In the fourth part of the article, we shall discuss relations with the USA. It should be pointed out that the article does not seek to analyze all aspects of British foreign policy, even if we wanted to, due to a shortage of time. Of course, the topic of Brexit will be present in all chapters and especially in the last one and conclusion remarks. By its decision to leave the EU, the UK appears to have given priority to its relations with the USA, China, Gulf countries as well as Commonwealth countries instead of the EU which has been economically and politically dominant over the past few decades. This decision taken by UK citizens will no doubt have a great impact not only on their personal lives and standard of living but on the UK role in international relations. Despite its military, political, economic and cultural capacities, it is highly unlikely that the UK will manage to overcome the consequences of an exit from the single market, currently generating 18 trillion dollars on an annual basis as well as the loss of a privileged partner role with the USA within the Union. We are, therefore, more likely to believe that in the foreseeable future, the role of the UK on the international scene will continue to decline and be increasingly focused on its economic and financial interests. Problem setting. Today the European Union interacts with the whole world and represents the interests and values of the European community far beyond one continent. Carrying out such activities provides for the existence of effective institutions for its implementation, which today are the European External Action Service and the European Uniondelegations around the world. It significantly differs from the classical manifestations of diplomacy, which determines the relevance of research into the establishment and development of the European Union diplomatic service. Moreover, understanding the process of formation and features of European Union diplomacy is interesting for domestic researchers of European Union law given the pro-European aspirations of Ukraine. Shapovalova, etc. Target of research is to research the basic preconditions and features of the establishment and development of the European Union diplomatic service and its functioning in today’s conditions. Article’s main body. The article is devoted to the study of the main prerequisites and features of the establishment and development of the diplomatic service of the European Union. The authors paid attention to the coverage of the status, competence and procedure for sending the first representations of the Communities abroad, in particular the delegations of the European Commission. The changes made by the Maastricht, Amsterdam and Lisbon treaties on foreign policy are analyzed as well. All the reforms implemented by these treaties were aimed primarily at making the European Union more effective and coordinated in the international arena, and finally resolved the issue of the institutionalization of the body that deals with the European Union diplomatic service. So now it has the status of the European External Action Service and successfully performs its functions in the current conditions. Conclusions and prospects for the development. The modern European Union diplomatic service is the result of a long process of formalization and institutionalization of a whole set of its foreign policy bodies. The development of the European Union representation system shows that the spread of its representative activities has become global, as well as the dynamic transformation of the content of its goals to interact with the world in order to implement its foreign policy. However, despite the current and rapid dynamics of development and evolution of this institution, the question remains whether the European External Action Service is the final option for the external design of the European Union diplomatic service, or whether it will be another step in the process of building pan-European diplomacy.

This chapter explores the ways in which the EU uses its external relations powers and its wide range of external instruments to extend the reach of EU law, and the ways in which law shapes the EU’s external action. It examines three dimensions of the relationship between law and external action: first, the role law plays in the construction of the EU’s international presence as a ‘Union of values’; second, the use of law by the EU as a way of conducting its foreign policy and constructing its relationships; third, the EU as a regulatory actor engaged in shaping, importing and promoting international legal norms. These dynamics illustrate different aspects of the notion of the global reach of EU law and in so doing they raise questions about the ambivalent role that law plays in these processes, challenging our understanding of law as the foundation of the EU’s external power and the instrument through which, and in accordance with which, it expresses that power.
