Environmental Jurisprudence in India (Is People’s Attitude Under Its Purview?)

It is environmental laws that regulate the environmental protection bodies and make them effective. With this view in mind, the article intends to examine the environmental jurisprudence in India in terms of evolution, pattern of delivery of environmental justice and place of people’s attitude in the process. It was found that the superior judicial bodies including National Green Tribunal have set certain norms to deal with environmental cases against the polluters (mainly government bodies and private firms), but not for day-to-day activities of the people which pollute the environment sizeably. Besides, the article, on the basis of empirical studies, finds that despite having been aware of the menace of the environmental degradation and its gravity, people are less intended to be sensitive towards the problem owing to three-pronged reasons: First, they perceive environmental protection as the sole responsibility of state; second, sizeable of them have no spare time out of their livelihood engagements; and third, lack of leadership or community action at local level for the cause. The article prima facie finds that environmental jurisprudence in India has inadequately addressed the issue of people’s say and environmentally hostile people’s attitude towards environmental protection in the process.

Present study focuses on the national and European popularity of public employment programs within the Active Labour Market Policies (ALMP) between 2009 and 2013, and emphasizes the lack of their transitive effects by two national empirical researches. It is a crucial question at either the governmental level or the local level or even at the level of the people that after the participation whether the supported employees can find a job, whether the programs have transitive effects or the possibility of re-employment is greater. 50% one-time participation defined in the first hypothesis was examined in two empirical studies. In the first case this ratio was verified neither in input sampling (45,6%) nor in output sampling (40,83%). In case of the sampling in 2013 it was successful (78%). In Hajdúböszörmény revealing the situation of the labour market we concluded that practically people after the supported employment have minimal chance to find a job, there are still negative tendencies in the primary market, and local government tries to struggle with the price by utilizing public employment as a single tool. The two empirical sampling drew the attention that the lower the transitive effects of the examined programs are, the stronger the phenomenon of locking-in and rotating is.

It is our prime importance to protect our environment in which we live. Our ancestors left with good environment and now pollution comes in with air, water, noise, soil and so on. The paper suggests a possible way to protect our society especially for the people of Chennai from air, water and radiation by protecting the environment. If same is followed in other cities it can save many, it is only a small means of a bigger initiative of saving our people.

Within the last few years, changes have been carried out in the public administration of Germany which will affect the military government to be established during and after Germany's defeat. Their general trend has been to subordinate state (i.e., Reich, regional, and local) administration to the Party, which has been vested with more and more power. This is of particular interest in the light of the present “total mobilization,” in which the Party plays a dominant part. To some extent, the changes discussed in this note show a definite trend toward decentralization, although there has been no actual delegation of powers to smaller units, since all power remained in the hands of the Party—this being, of course, the reason why the Nazis could afford to “decentralize.” On the local level, the reforms aimed at tying together the loosening bonds between the régime and the people. Only the most recent emergency measures of “total mobilization” are touched on in this note.1. Gauarbeitsaemter. When the Reichsanstalt was created in 1927–28, the Reich was organized in 13 economic regions, each having one regional labor office (Landesarbeitsamt). The idea was to establish large economic districts containing various industries so that a crisis in one industry could be absorbed by the labor market of another within the same district, thus creating “ausgleichsfaehige Bezirke.”

The principle of good governance is difficult and controversial. Governance opens new space which provides a concept that allows us to discuss the role of government in coping with public issues and the contribution that other players may make. It opens one’s mind to the possibility that groups in society other than government. Good governance is responsive to the present and future needs of society. Strengthening local governance can be ensured through the importation of the component of good governance at the local level. This paper intent to  examine spaces where principles of good governance are required to apply to ensure better service delivery system at Union Parishad. This paper has been followed by social survey method. The data collection technique of this study has covered quantitative technique. Union Parishad as a local self government body ensuring community participations, people can approach and communicates clearly to their representatives and regularly issuing its progress report to the people for their transparency. Besides, dealing with convicted corruption was found most effective in manner.

AbstractThe proper division of responsibility for environmental protection between national and state governments has long been the subject of fierce debate. During the 1970s the United States Congress decided to shift the most important environmental responsibilities from state governments to the federal government. The main reason for this decision was to prevent a ‘race to the bottom’ in that states competing for industries could otherwise be lax in implementing and enforcing federal environmental standards. Yet, some scholars have argued that there could just as easily be a ‘race to the top’ among states as they compete to attract people and businesses concerned with environmental protection. China, in turn, is plagued with severe air and water pollution and soil contamination, which is attributed largely to ineffective enforcement of its national environmental laws. This article investigates whether China’s experience confirms the race-to-the-bottom theory. It demonstrates that devolution of responsibility for environmental protection to lower levels of government tends to result in lax implementation and enforcement of national environmental laws, particularly where national governments also create strong incentives for economic growth. It concludes that China’s highly devolved system of environmental governance is consistent with this theory, even if it does not provide conclusive evidence of its correctness.

Oil was discovered in large quantities in Nigeria in 1956 and exploration began in the same year. Before oil, agriculture and fishing had assured the Niger Delta people of a bright future. Since 1956, oil has been extracted from the Niger Delta with destructive consequences on the environment, bringing about environmental degradation and destruction of the people’s primary means of livelihood. Land and water were badly polluted, and the health of the people affected because of leaks from oil pipelines, gas flaring and acid rains. Several petitions and non-violent protests by Delta communities, women and youth against environmental destruction failed to receive attention. Rather, opposition to peaceful protests earned the people military invasions of their communities, clampdowns and jailings. The rise of militarism and terrorism in the Niger Delta was the result of the Federal Government and Oil Companies’ clampdown on non-violent protests for environmental justice in the Niger Delta. This paper discusses the history of oil exploration in the Niger Delta, oil laws, effects of oil exploration in the region, and the rise of militants and terrorists in the area. The paper uses the term, ‘environmental Justice’ to denote unfair treatment and destruction of the Delta environment resulting from oil exploration, non implementation and enforcement of environmental laws and regulations, and abuse of human rights.The paper suggests solutions for peace in the Niger Delta.

Local government plays an integral part in the mechanism of Disaster Management in Mizoram. The local bodies are the direct representatives of the local community and the local community places their full trust in them. Post disaster measures such as mock drills, training of search and rescue teams, physical and economic relief and rehabilitation are not something new to us, yet the aspect of disaster mitigation is something which has not bred familiarity among the Mizos. The need for sensitization of the public on the importance of Disaster Mitigation is a necessity. The saying ‘Earthquakes do not kill people; buildings do’ is pertinent in urban areas. Urban areas are congested and more prone to disasters. High rise buildings, squatter settlements due to high densities and low availability of land has endangered not just the lives of the public but has also caused a massive disturbance of the ecological system. The paper covers certain Acts and Regulations of the Aizawl Municipal Corporation dealing with structural mitigation and the detection of illegal construction, unsafe buildings, and encroachments on municipal and public properties. At the local level, the councillors are involved in making, unmaking and carrying out these rules and regulations, with direct bearing on the local people. The paper also gives an account of the need of reimplementation to generate awareness, knowledge and education on Disaster Management to the people of Mizoram.

Status is a position provided to the person of the concern society based on societal norms, values and customary practices. It is further being divided into two parts, first one is the Ascribed status, and another is Achieved status. The ascribed status is assigned to a person by the group or society, whereas achieved status is earned by the individual through his/her personal attributes and is taken note of by the people in and around his/her location. It is also evident that in majority of the cases, the ascribed status always determines the nature and extent of the achieved status. The ascribed status of the Dalits contributes or hinders in the formation of their achieved status. It also includes their social interaction and social relations with non-Dalits in the exiting local level social structure. This status is being characterized and specified by the process of Sanskritization, social and religious reforms, and the constitutional provisions in the formation of achieved status of Dalits in their different strata of life. The social status is the convergent form of both the ascribed and achieved statuses of a person in each society or social structure. In every circumstance, one’s higher ascribed status always contributes positively to his or her higher achieved status. Conversely, lower the ascribed status, lower is the achieved status though this may be other way round in the exceptional case. Anyway, the symmetrical or linear relationship between the lower ascribed and achieved statuses gets more crystallized, if the person comes from a group which remains socially excluded forever. But due to the prospects of Independence, Education, Constitutional safeguards and Modernisation several kinds of changes occurred in the status of Dalit’s in the society. Through this paper, I have tried to identify the process of social status formation among Dalits in Jharkhand.
