The article describes the results of the expertise of normative acts of 22 regions of Russia, carried out by the authors in order to identify the best practices of legal regulation of children and youth, student and adaptive sports. The analysis of the listed normative acts has showed that the provisions on youth, student and adaptive sports were reflected through the consolidation of the relevant norms as the powers of the authorities of the subjects, the powers of local governments, priority areas of support or principles of legislation, provisions on additional support. Some normative acts contain separate articles or chapters devoted to physical education and the development of physical culture and sports in educational organizations, as well as devoted to adaptive physical culture. The provisions on children and youth, student and adaptive sports are most extensively reflected in the corresponding laws of the city of Moscow, the Republic of Sakha (Yakutia), Sverdlovsk Oblast, the Omsk Oblast, the Novosibirsk Oblast. The studied issue has received the smallest amount of legal regulation in the law of the Samara Oblast. The article also provides the results of a selective expertise of the regulations of the autonomous communities of Spain and the regulations of some US states. Based on the results of the expertise, recommendations have been formulated for the further improvement of the Russian regional legislation in the studied field. In particular, it has been recommended to formulate and consolidate the norms determined by the characteristics of a particular region, to include them in the text of law provisions on specific measures, in particular, on the development of sports infrastructure, using the possibilities of the institution of social partnership, to include provisions aimed at creating a positive attitude towards a healthy lifestyle and sports from an early age, tolerant attitude towards physically impaired athletes.

The purpose of the article is to determine the conceptual fundamentals of modern sport system in the Strategy for the Development of Physical Culture and Sports in our country for the period until 2030, using the analysis of the fundamental changes in modern sports and the orientation of population to the values of sports. Methods and organization of the research. Analysis of the problem occurs on basis of the au-thor’s theory of sports, the study of relevant empirical facts, the results of sociological studies, as well as an analytical review of publications. Results and discussion. Analysis of the fundamental changes in modern sports and the orienta-tion of the population to the values of sport activities resulted in substantiation of conceptual provisions on the significance of the number of activities. These activities include development of various models of modern sports; priority of its health and recreational function; organizing sports for health and recreation as a new model of mass sports and as an element of the structure of children and youth sports; implementing sports for health and recreation into the education system for children and youth. Conclusion. Practical implementation of the formulated conceptual fundamentals of the modern sport system in the Strategy for the Development of Physical Culture and Sports for the period until 2030 primarily depends on changing the priorities of the state social policy in the field of sports. Innovative delivery of sport activities resulted in promotion of healthy lifestyle and crea-tive recreational activities of local communities should take the place of the practice of putting forward sports records and victories of a narrow group of people.

Introduction. In modern conditions of socio-economic development of the Russian Federation, physical culture and sport are the key to the formation of a healthy lifestyle of the population and are important indicators of the success of the Russians participating in various sports events at various levels. At the same time, the number of people involved in physical education and sports in Russia is insignificant, due to the insufficient level of citizens' legal awareness, the inaccessibility of receiving high-quality services in this area, the underdeveloped infrastructure, and the presence of gaps and conflicts in the legal regulation of this block of public relations. One of the ways to solve these problems is to develop a system of sources of legal regulation of sports relations. Purpose. Based on the studied sources of legal impact on sports relations in Russia and foreign countries, theoretical developments and materials of judicial practice, the authors attempted to form a model of legal regulation of sports relations. Methodology. The authors in the process of writing the article used formal legal, logical, systemic and comparative legal methods. Results. A study of existing sources of Russian and foreign law governing sports relations suggests the presence of a complex multi-level system of legal regulation. The state level of legal impact is represented by a set of regulatory legal acts, which are formal sources of regulation of sports relations. The non-state level includes customs, unified rules, other recommendatory acts, as well as local and contractual norms created by the participants in sports relations themselves, taking into account the specifics of the relations established between them. Conclusion. Based on the analysis of various sources regulating relations in the field of physical culture and sports in Russia and foreign countries, the authors propose a model of legal regulation of sports relations in the Russian Federation, which is a multi-level system of sources of state and non-state influence on the behavior of participants in these relations. It is concluded that it is necessary to expand the dispositive principles in the system of legal regulation of sports relations through the active use of such regulators as local and contractual rulemaking, as well as other forms of non-state influence on the behavior of participants in these relations.

The relevance of the chosen research topic is due to the fact that in recent years in the constituent entities of the Russian Federation great attention is paid to physical culture and sports, federal programs for the development of physical culture and sports are being developed and implemented, sports facilities are being built for all categories of citizens. There is an active promotion of a healthy lifestyle, in connection with which, an interest in regular sports has been entrenched in society. The purpose of the study is to analyze the legislative regulation of the legal status of a sportsman in the constituent entity of the Russian Federation, since each region has its own distinctive features. To achieve the goal, the authors set the tasks to study the legislation on sports of the Republic of Mordovia. The article considers the current regional regulatory legal acts.

Carrying out in Ukraine of constitutional, administrative and municipal reforms highlighted a number of pressing issues, not only related to the formation territorial and legal basis for the activities of local authorities self-government, providing them with organizational, legal and material financial independence, but also the issue of effective decentralization management in the system of physical culture and sports and higher education that are capable respond to changing living conditions, needs and problems of modern youth and society as a whole. With the participation of domestic and foreign experts the Roadmap of reforms in the system of physical culture and sport and plan of events are worked out on her realization. In particular, the decision of questions is envisaged in relation to decentralization of plenary powers of Ministry of Youth and Sport of Ukraine as central executive and the transfer of children and youth sports schools into communal ownership. During the implementation of these standards there are serious problems with the functioning of children and youth sports schools in connection with their transfer to funding from the local budgets, which led to a significant reduction in these institutions in 2015. The challenge of sustainable development of physical culture and sports is the efforts of the previous leadership of the Ministry of Education and Science of Ukraine to organize physical education classes in institutions of higher education in the form of electives, without final control and inclusion in curriculum. On the numerous appeals of the rectors, scientific-pedagogical and sports community of Ukraine to the leadership of the Ministry, provided answers that in accordance with the Law of Ukraine "On higher education "activities of higher education institutions are carried out on the principles autonomy and self-government. Unfortunately, we have to state that in decentralization time, these problems have not been resolved. Public authorities, in fact, withdrew from support mass physical culture and sports, which in terms of legislation uncertainty leads to serious territorial problems in communities whose leadership does not pay the necessary attention to issues physical culture and sports. And in terms of autonomy and self-government some institutions of higher education are destroying the physical system education. All this significantly affects the strengthening of physical, mental and reproductive health of young people and the defense capabilities of the State as a whole. Therefore, the search for an effective model of public balance regulation combined with organizational and legal and material financial independence of local governments and autonomy higher education institutions is a top priority.

The state policy of health preservation of Russians and the process of introducing a healthy lifestyle into their everyday life is hampered by the lack of sufficient self-activity and purposefulness of the individual ecological and valeological behavior of representatives of various population groups. According to the authors of the article, one of the important indicators of the maturity of professional and labor competencies of school and student youth is their readiness and desire for permanent self-preserving behavior. “With numbers in hand,” the authors show the scale of deviant deviations and the phenomena of spontaneous irresponsibility in the educational and leisure activities of students, hindering the preservation and development of physical culture, the accumulation and effective use of their psychophysiological and labor potential. The conclusions of the proposal of the authors of the article are based on the results of a number of sociological surveys conducted in 2000-2020. at the Institute of Economics of the Ural Branch of the Russian Academy of Sciences in a number of secondary schools and universities of the Ural and Volga Federal Districts.

Development of a territorial community requires efficient use of its capacity taking into account all possible aspects in the course of elaboration and implementation of the development strategy and other local legal and regulative documents. The approach is directly related to maintaining the living activity of a territorial community and should correspond to the interests of population and European standards of state regional policy. In addition to the definition of a community provided by the Law of Ukraine “On Local Governance in Ukraine”, there are also some other. For example, some authors understand territorial community as a single natural and social entity that operates in spatial boundaries of a state and realizes daily needs and interests of population. The paper aims to analyze legal and regulative foundation of the development of territorial communities in conditions of decentralization. The authors analyze current condition of legal and regulative maintenance of local governance reforming in Ukraine in conditions of decentralization of authorities. The paper argues that the major elements of management strategy in CTCs in Ukraine are independence, efficiency, management innovations, quicker and more substantiated decision-making and everything to meet the needs of community’s residents. Management of this sector is grounded on the principles of the provisions of European Charter of Local Self-Government that provides for decentralization of authorities and transfer of resources and responsibilities to local governments. Liabilities of local governments (of consolidated territorial communities) and the mayors are analyzed. The authors prove that in general legal provision of decentralization of local governance corresponds to European requirements and creates reliable ground for practical stage of the reform. The list of issues that require further legal regulation is outlined.
