The concept of ownership in Islamic economics states that individuals or legal entities that have the right to ownership of a property may use it freely as long as it does not violate Islamic economic principles and the public interest. However, for Islamic banking, the ownership of funds used as business capital comes from investor customers who deposit their funds in Islamic banks. This has an effect on the ownership status of these funds. This article uses a descriptive literature research method taken from various factual references with a focus on using a normative juridical approach. This type of research is qualitative research using data analysis through several steps such as focusing data, presenting funds and drawing conclusions. The results of this study reveal the fact that the ownership rights of funds in Islamic banking are sourced from the first party funds as the bank's founder, the second party funds as shareholders and third party funds as investor customers. Ownership of these funds cannot be separated from the contract mechanism used. So that the contract used is the cause of Islamic banks having ownership rights to use these assets for business activities. The use of these funds is guaranteed by law, which shows the role of Islamic economic politics through the legal umbrella that regulates the operational system of Islamic banking, especially in the permitting of the use of investor funds for business activities through the mechanism of channeling funds and service mechanisms.

The problem of Islamic economics is also increasingly complex with the large number of banks. To meet the needs of transactions, banks have products that are offered to the public. In accordance with the function of the bank, namely collecting and distributing funds to the public. The purpose of channeling funds by Islamic banks is to support the implementation of development, improve justice, togetherness and equal distribution of people's welfare. This paper will answer what is the meaning of al-mashaqqah tajlib al-taysir and how do the Implications of al-mashaqqah tajlib al-taysir in the development of Islamic economy? The result of research shows that the meaning of the rule of al-mashaqqah tajlib al-taysir is the difficulty of bringing convenience. The point is that if implementing a provision of shara' mukallaf faces obstacles in the form of difficulties and limitations that exceed the limits of reasonable capabilities, then the difficulty automatically creates relief provisions. In other words, if we find difficulty in carrying out something that is to be sharia, then the difficulty becomes a justifiable cause to facilitate in carrying out something that is to be provision of sharia, so that we can continue to run the sharia of Allah easily. The implications raised by the rules of al-mashaqqah tajlib al-taysir are the determination of the law of Islamic financial institutions. This impact is seen when Islamic law allows transactions in Islamic banking financial institutions, so that the community will easily meet the needs by transacting with Islamic banking through contracts that have been agreed upon. Keywords: al-Mashaqqah Tajlib al-Taysir, Islamic Economic Development

Banking is a very important part in the economy, one of them as intermediary institutions whose duty to collect funds from the public and then channel them back in the form of financing.This study aims to determine the effect Number of DPK, NPF and SBIS partially to finance portfolio of Islamic banking in Indonesia, and to determine the effect Number of DPK, NPF and SBIS simultaneously to the finance portfolio of Islamic banking in Indonesia.This study proceed from the assumption that (1) the size distribution of the funds offered by Islamic banks is very influenced by the size DPK means that the higher the number of third-party funds collected, the higher also finance portfolio, (2) the higher non-performing financing the worse the quality of banking assets, (3) the higher the bonus level set SBIS Indonesian bank will lower the financing undertaken by the banking Shari'ah. But based on data from Islamic banking statistics from the years 2008-2014 there is a gap between theory and facts on the ground. These assumptions are tested empirically so that the truth can be scientifically recognized. When there is a justification or rejection of these assumptions, then this is a scientific truth that can be considered Islamic banking in Indonesia.Quantitative research methods in this study using research formats explanation, source data used in this research is secondary data, then the type of data used in this research is quantitative data time series, the quarterly data of financing, deposits, NPF and SBIS Islamic banking in Indonesia from 2008 to 2014. Data were then processed by means of statistical analysis using Eviews 7, which comprises the classical assumption of them: normality test, heteroscedasticity, multicollinearity test, autocorrelation test. statistical tests include: regression, t test, F test and R2.The conclusion that can be drawn from this study that partially, DPK variable is positive and significant effect on the financing, NPF variable is negative but not significant effect on the financing, while SBIS is negative and significant effect on the financing. Then simultaneously the number of DPK, NPF and SBIS significant effect on the distribution of funding. Those variables could explain freely by 99.45% and the remaining 0.55% can be explained by other variables not examined.

This study aims to examine the effect of knowledge, promotion, and religiosity on the interest in using Islamic banking services. The purpose of the next research is to examine the effect of knowledge on religiosity. In addition, this study also examines the effect of educational background and age on saving interest in Islamic banks. The population in this study are customers of Bank Syariah Mandiri, Brebes, Central Java, Indonesia. Ninety-nine research samples were obtained. The data collection method used was questionnaires. The data analysis method used was SEM-PLS. The results showed that only promotion proved to have a positive and significant effect on interest in using the services of Islamic banks. Knowledge and religiosity have not been proven to have a significant effect on interest in using services of Islamic banks. Likewise, background and gender do not have a significant effect. The next research result is that there is a positive and significant influence of knowledge on religiosity; there is also a positive and significant influence on the promotion of knowledge. This study recommends the importance of continuing socialization and education from Islamic banking stakeholders in Indonesia to continue introducing Islamic banks to the public.

Compared to conventional banking, the distribution of Islamic banking financing is more optimal, growth is continuous and asset enhancement is very good. This is indicated by the Financing to Deposit Ratio (FDR) which ranges between 94.88%. This means that a Sharia Bank is able to meet the targets and expectations of Bank Indonesia. Given the lack of Islamic banks and their limited assets, this optimization is certainly influenced by many factors, therefore it is necessary to test the factors that influence the distribution of Islamic banking financing, which includes Third Party Funds (DPK), Non Performing Financing (NPF) and Bank Indonesia Syariah Certificate (SBIS). This study uses the Sharia Commercial Bank and the Sharia Business Unit as a whole as a unit of research object, with the research period from 2009-2019 (in the quarterly period). The analysis technique used is multiple linear regression, while hypothesis testing uses the t-test to test the effect of variables partially, and the F-test to test the effect of variables simultaneously with a significance level of 5% or 0.05. Based on the research, it was found that Third Party Funds (TPF) had a positive and significant effect on the distribution of Islamic Banking financing. Non Performing Financing (NPF) has a positive and insignificant effect on the distribution of bank financing. While Sharia Bank Indonesia Certificates (SBIS) have a negative and significant effect on the distribution of bank financing.

The application of AHP method in financing risk management and analysis efforts, especially for KURS program in BRI Syariah is implemented in the decision making system application that is built with PHP programming language and uses the "MySql" database application which is expected to create a system that can help the bank in determining KURS recipients. by online. But in the implementation of the application, the AHP analysis process at BRI Syariah can be said to be in harmony with the Maqashid of Sharia and the terms of the distribution of financing as stipulated in the applicable laws. Based on these problems, the authors compile the formulation of the problem as outlined in the form of questions as follows: What are the provisions of Islamic economics regarding the determination of the distribution of financing for customers in Islamic banks? How is the implementation of the analysis of determining the priority of financing for customers using the Analyticalcal Hierarchy Process (AHP) method at BRI Syariah Ujungberung KCP? And how is the analysis of sharia economics towards the determination of financing provision for customers using the Analitycal Hierarchy Process (AHP) method in BRI Syariah Ujungberung KCP? The research method used is a descriptive analysis research method that aims to describe the use of the AHP method in analyzing financing for the MSME sector in the KURS program at BRI Syariah Ujungberung KCP. The conclusion of this study is that the determination of financing distribution for customers in Islamic banks is implemented into the application of the precautionary principle by using elements of the 5C standard and Islamic economic principles such as the principles of openness, honesty and fairness. The financing analysis using the AHP method at BRI Syariah Ujungberung KCP is carried out systematically and conical so as to produce the right, proportional and efficient decisions. And the determination of financing for customers using the Analyticalcal Hierarchy Process (AHP) method in BRI Syariah Ujungberung KCP in general is in accordance with the values and principles of economics in Islam which includes openness, fairness, prudence and openness and various aspects related to with human interests by providing for order in life and well-being (maslahah). Keywords : Process, Analysis, Financing, and Islamic Banks.Penerapan metode AHP dalam upaya analisis dan manajemen risiko pembiayaan khususnya bagi program KURS di BRI Syariah diimplementasikan pada aplikasi sistem pengambilan keputusan yang dibangun dengan bahasa pemograman PHP dan menggunakan aplikasi database “MySql” yang diharapkan dapat membuat sistem yang dapat membantu pihak bank dalam menentukan penerima KURS secara online. Namun dalam pelaksanaan aplikasinya, prosesn analisa AHP di BRI Syariah ini bisa dikatakan selaras dengan maqashid syariah maupun ketentuan penyaluran pembiayaan sebagaimana yang diatur perundang-undangan yang berlaku. Berdasarkan permasalah tersebut, maka penulis menyusun rumusan masalah yang dituangkan ke dalam bentuk pertanyaan sebagai berikut : Bagaimana ketentuan ekonomi syariah tentang penetapan penyaluran pembiayaan bagi nasabah di bank syariah ? Bagaimana pelaksanaan analisis penentuan prioritas pemberian pembiayaan bagi nasabah dengan metode Analitycal Hierarchy Process (AHP) di BRI Syariah KCP Ujungberung ? Dan bagaimana analisis ekonomi syariah terhadap penetapan pemberian pembiayaan bagi nasabah dengan metode Analitycal Hierarchy Process (AHP) di BRI Syariah KCP Ujungberung ? Metode penelitian yang digunakan adalah metode penelitian deskriptif analisis yang bertujuan untuk mendeskripsikan mengenai penggunaan metode AHP dalam melakukan analisis pembiayaan bagi sektor UMKM pada program KURS di BRI Syariah KCP Ujungberung.  Simpulan dari penelitian ini adalah penetapan penyaluran pembiayaan bagi nasabah di bank syariah diimplementasikan ke dalam  penerapan prinsip kehati-hatian dengan menggunakan unsur standar 5C dan prinsip ekonomi Islam seperti prinsip keterbukaan, kejujuran dan keadilan. Pelaksanaan analisis pembiayaan dengan metode AHP di BRI Syariah KCP Ujungberung dilakukan secara sistematis dan mengkrucut sehingga menghasil keputusan yang tepat, proporsional dan efisien. Serta Penetapan pemberian pembiayaan bagi nasabah dengan metode Analitycal Hierarchy Process (AHP) di BRI Syariah KCP Ujungberung secara umum telah sesuai dengan nilai-nilai dan prinsip-prinsi pekonomi dalam Islam yang meliputi keterbukaan, keadilan, kehati-hatian dan keterbukaan serta berbagai aspek yang terkait dengan kepentingan manusia dengan menyediakan untuk ketertiban kehidupan dan kesejahteraan (maslahah).Kata kunci : Proses, Analisia, Pembiayaan, dan Bank Syariah.

The purposes of this research were to determine the effect of the financial performance of Islamic commercial banks in Indonesia on financing, both individually and simultaneously. The performance was measured through Third Party Funds (TPF), Capital Adequacy Ratio (CAR), Non-Performing Financing (NPF), and Financing to Deposit Ratio (FDR). These four independent variables to be tested influence on the dependent variable. This research used census method that includes all of the Islamic banks in Indonesia for observational data. Research data observation period from 2009 until 2013 a total of 11 banks. Multiple linear regression was used to analyze the data.The results of this study found that the Third Party Funds (TPF), Capital Adequacy Ratio (CAR), Non Performing Financing (NPF), and Financing to Deposit Ratio (FDR) affect the financing, both individually and simultaneously. Fluctuations in either an increase or decrease of financing that occurred in Islamic banking in Indonesia is determined by the four independent variables. That is to say, the four independent variables that have an important role in the financing of Islamic banking in Indonesia. =========================================== Penelitian ini bertujuan untuk menguji pengaruh kinerja keuangan bank umum syariah di Indonesia terhadap pembiayaan, baik secara parsial maupun simultan. Kinerja keuangan diukur melalui Dana Pihak Ketiga (DPK), Capital Adequacy Ratio (CAR), Non Performing Financing (NPF), dan Financing to Deposit Ratio (FDR) Keempat variabel bebas tersebut akan diuji pengaruhnya terhadap satu variabel tidak bebas. Penelitian ini adalah penelitian sensus, yakni memasukan semua bank umum syariah yang ada di Indonesia ke dalam data pengamatan. Periode pengamatan data penelitian dari tahun 2009 s.d 2013 yang berjumlah 11 perbankan. Metode analisis yang digunakan adalah regresi linear berganda. Hasil penelitian ini menemukan bahwa Dana Pihak Ketiga (DPK), Capital Adequacy Ratio (CAR), Non Performing Financing (NPF), dan Financing to Deposit Ratio (FDR) berpengaruh terhadap pembiayaan pada perbankan syariah di Indonesia, baik secara parsial maupun simultan. Fluktuasi baik itu peningkatan atau penurunan pembiayaan yang terjadi pada perbankan syariah di Indonesia ditentukan oleh keempat variabel bebas tersebut. Sehingga dapat dikatakan bahwa, keempat variabel bebas tersebut mempunyai peranan penting atas pembiayaan pada perbankan syariah di Indonesia.

This research attempts to study the determinants of third party funds on the Islamic banking in Indonesia with eight years of research from published journals in Indonesia. To reach the above objectives, investigation to check the relationship between promotion cost, inflation, GDP, interest rate, number of offices, and equivalent rate to third party funds on the Islamic banking in Indonesia is conducted. This research applies the meta-analysis technique to a sample of 34 articles with time variation from 2010-2018. The articles used are selected studies from Sinta Journal and Google Scholar databases. This research shows that promotion cost, number of offices, and equivalent rate have a significant correlation with third party funds on the Islamic banking in Indonesia. Meanwhile, inflation, GDP, and interest rate have no significant correlation with third party funds on the Islamic banking in Indonesia. The Findings from this study imply that if Islamic banks in Indonesia wish to enhance their third party fund, they must focus on internal indicators (promotion cost, number of offices, and equivalent rate), rather than looking at macro indicators.

Bank Negara Malaysia (BNM) had introduced Value-Based Intermediation (VBI) initiatives to help Islamic banks implement a structuralised form of maqasid al-shariah (objectives of shariah (Islamic law)) in their banking operations. Thus, questions were raised by the public on whether or not Islamic banking institutions in Malaysia had been achieving maqasid al-shariah in their banking operations prior to VBI. This paper aims to discuss the real concept of maqasid al-shariah that should be realised in Islamic banks and investigate whether Islamic banks had truly been achieving maqasid al-shariah in their banking operations before the introduction of VBI. Library research is conducted to obtain information on maqasid al-shariah and the qualitative methodology is adopted to gain information from three bankers representing three Islamic banks in Malaysia via semi-structured interviews. The researchers found that the fundamental concept of maqasid al-shariah in Islamic banks includes the protection of religion, life, intellect, progeny and wealth in human life through the products and services offered by the banks. The Islamic banks were found to have developed their products and services to achieve maqasid al-shariah even before VBI was introduced by BNM. However, with VBI, a proper framework in achieving maqasid al-shariah has been developed.

Purpose This paper aims to analyse whether the practices of Islamic banks in Bahrain are in line with value-based Islamic banking (VBIB) and reporting disclosure in the annual reports towards achieving their fundamental objectives of human-centred economic development and social justice. Design/methodology/approach Based on Islamic finance, Islamic economic principles and perception of Maqasid al-Shari’ah, this paper examines and assesses the current practices of Islamic financial institutions (IFIs) in Bahrain through content analysis of financial and annual reports of Islamic banks in Bahrain and interviews of Islamic banking experts. Findings The findings reveal that value-based banking (VBB) has not been translated fully into practice by the Islamic banks in Bahrain. Research limitations/implications The data analysis was restricted to Islamic banks in Bahrain. Practical implications This paper identifies the need for reporting standard development to improve the VBB practice in Bahrain in the future. Looking at the objectives of the IFIs, this paper introduces the concept of VBB in Bahrain, which includes ethical banking, responsible banking and social responsibility. The study adds value not only to the current Islamic finance literature but also helps many stakeholders, including prospective academics, who may conduct comparative studies in different jurisdictions throughout the world. Originality/value The specific contribution of this paper is the identification of the VBB practices and related disclosure in the Islamic banking industry in Bahrain. The study is useful to harmonise and standardise the practices of VBIB by the contemporary Islamic banks in Bahrain.

Land is an important commodity in society that it is both permanent and indestructible, two features which distinguish it from other forms of property. More than one person can have a relationship with the land and share the right to possess it. The right to possess a land is known as ownership right, but it is also common for people to have enforceable rights in other people’s land. This is the third party right, an example of which is where the owner of a house in a residential area agrees with neighbours that the house will only be used as a residence. This chapter discusses land and property rights, ownership rights, third party rights, and conveyancing. It also examines the distinction in English law between real property and personal property, the meaning of land, items attached to the land, fixtures and fittings, and incorporeal hereditaments.
