A austeridade permanente e a disputa de quem ganha o quê, quando e como, lógica intrínseca às políticas públicas, colocam as políticas sociais brasileiras em constantes testes. O universalismo tentativo iniciado com a Constituição de 1988 pareceu caminhar para uma ampliação da cidadania social no país, mas tem sofrido constantes ataques por falta de um compromisso de classes em torno de um projeto de país mais ou menos homogêneo. Diante dessa falta de precisão no estabelecimento Estado de Bem-estar brasileiro, em especial, pelo encolhimento no investimento público previsto para os próximos anos e com os governos mais alinhados a maior mercadorização dos serviços sociais, torna-se importante revisitar a trajetória do Welfare State em suas origens e objetivos, a fim de compreender como chegamos até aqui, o que podemos esperar do futuro e quais a intervenções necessárias para que nos aproximemos de uma inclusão sensível do grande contingente de pessoas ainda sujeitas a uma cidadania de segunda classe no Brasil. Para atender a esse objetivo, este trabalho realizou uma revisão bibliográfica convencional sobre o Estado de Bem-Estar Social, elencando a partir dela as razões históricas de seu surgimento, a tipologia de Esping-Andersen, a noção de funcionamentos e capacitações de Amartya Sen e os períodos constitutivos do bem-estar no Brasil.   PALAVRAS-CHAVE: Proteção social. Direitos sociais.     ABSTRACT The permanent austerity and the dispute over who wins what, when and how, logic intrinsic to public policies, puts Brazilian social policies in constant tests. The tentative universalism that began with the 1988 Constitution seemed to be heading for a broadening of social citizenship in the country, but it has been under constant attack for the lack of a class compromise around a homogeneous country project. Given this lack of precision in the establishment of the Brazilian Welfare State due to the shrinking public investment expected in the coming years and with the governments most aligned to the greater commodification of social services, it is important to revisit the trajectory of the Welfare State in its origins and objectives, in order to understand how far we have come, what we can expect from the future and what interventions are needed to bring us closer to a sensitive inclusion of the large contingent of people still subject to second class citizenship in Brazil. To meet this objective, this paper has carried out a conventional bibliographical review of the Welfare State, listing from it the historical reasons for its emergence, Esping-Andersen's typology, Amartya Sen's notion of functioning and capabilities and the constitutive periods of welfare in Brazil.   KEYWORDS: Social protection. Social rights.     RESUMEN La austeridad permanente y la disputa sobre quién gana qué, cuándo y cómo, la lógica intrínseca a las políticas públicas, pone a las políticas sociales brasileñas en pruebas constantes. El tentativo universalismo que comenzó con la Constitución de 1988 parecía dirigirse a una ampliación de la ciudadanía social en el país, pero ha estado bajo ataque constante por la falta de un compromiso de clase en torno a un proyecto de país más o menos homogéneo. Dada esta falta de precisión en el establecimiento del Estado de bienestar brasileño, en particular, debido a la reducción de la inversión pública esperada en los próximos años y con los gobiernos más alineados con la mayor mercantilización de los servicios sociales, es importante revisar la trayectoria del Estado de bienestar en sus orígenes y objetivos, para comprender cómo hemos llegado hasta ahora, qué podemos esperar del futuro y qué intervenciones son necesarias para acercarnos a una inclusión sensible del gran contingente de personas aún sujetas a una ciudadanía de segunda clase en Brasil. Para cumplir con este objetivo, este documento ha llevado a cabo una revisión bibliográfica convencional del Estado del Bienestar, enumerando de él las razones históricas de su surgimiento, la tipología de Esping-Andersen, la noción de funcionamiento y capacidadess de Amartya Sen, y períodos constitutivos de bienestar en Brasil.   PALABRAS CLAVE: Protección social. As undocumented Latino immigrants transition into adulthood, they also transition into illegality. They move from a somewhat protected status under which they had access to education and other social benefits, to the more vulnerable category of undocumented adults without access to social rights. How undocumented immigrants’ interactions with social services contribute to the formation of their ethnic identity and feelings of belonging to the United States is the focus of this research. Drawing on qualitative interview data from undocumented adults who grew up in the United States, this article shows that as undocumented children transition into adulthood, they face a new system that forces them to learn how to become an immigrant if they want to remain part of American society.

O presente trabalho tem por tema a efetividade dos direitos sociais e como recorte central a sua vulnerabilidade no cenário de severa crise econômica estatal. Elege-se como problema de pesquisa o risco de perecimento das prestações jurídicas sociais indispensáveis, enfrentando os desdobramentos da proibição de retrocesso na proteção e na efetividade dos direitos sociais. A pesquisa se justifica pela atual conjuntura política e econômica do Brasil, que gradativamente repercute no âmbito de proteção dos direitos sociais. A estrutura do trabalho compreende, em um primeiro momento, uma retomada histórica do reconhecimento dos direitos humanos, dos direitos fundamentais e dos direitos sociais; em seguida, investiga-se a dimensão de efetividade dos direitos sociais com enfoque no princípio da proibição de retrocesso e, por fim, são examinados os reflexos do princípio nominado na proteção e efetividade dos direitos sociais em ambiente de severa e indiscutível crise econômica. Para o desenvolvimento desta pesquisa de natureza qualitativa e bibliográfica, aplicou-se o método dedutivo.AbstractThis essay takes for issue the effectiveness of social rights and focus a central view on their vulnerability in the scenario of a severe state economic crisis. It is adopted, as the main research problem, the risk of perishing of indispensable social services, facing the unfolding of prohibition of social retrogression in the protection and effectiveness of social rights. The research is justified by the current political and economic conditions in Brazil, which gradually affects the scope of protection of social rights. The labor structure comprises, at first, an historical revival of recognition of human rights, fundamental rights and social rights; then it is investigated the extent of effectiveness of social rights, focusing on the principle of prohibition of social retrogression and, finally, the consequences of this so called principle on the protection and in the effectiveness of social rights under severe conditions and indisputable economic crisis are examined. To develop this research, it is adopted the qualitative and bibliographical enforcement, applied the deductive method as well.

Problem setting. In the transition to a market economy, social rights acquire a fundamentally new meaning, as they are designed to guarantee radical changes in the socio-economic situation of man as a participant in market relations. The Constitution of Ukraine reflects a wide range of social rights of a person and a citizen to work, leisure, social protection, health care, medical care, health insurance, family protection, childhood, motherhood and fatherhood, education, etc. One of the central and universally recognized in the system of social rights of citizens is the right to social protection, the requirement of which is embodied in international acts ratified by Ukraine. The right to social protection is guaranteed by the obligatory state social insurance at the expense of insurance contributions of citizens, enterprises, institutions and organizations, budgetary and other sources of social security, as well as the creation of a network of state, municipal and private institutions for the care of the disabled. Without these guarantees, this right becomes an intention (wish) in the relevant field, has no practical value either for the individual or for society as a whole. Analysis of recent researches and publications. Issues of social insurance were the subject of research by such scientists as V. M. Andriyiv, D. V. Bozhko, N. B. Bolotina, M.M. Klemparsky, O. L. Shumylo, O. M. Yaroshenko, and others. Target of research to consider compulsory state social insurance as a guarantee of the right of citizens to social protection due to accidents and occupational diseases at work. Article’s main body. The main guarantee of a person’s right to social protection due to accidents and occupational diseases at work is compulsory state social insurance. The task of social insurance against accidents at work and occupational diseases that have caused disability is to carry out preventive measures aimed at eliminating harmful, dangerous production factors; prevention of accidents at work, other cases of threat to the health of the insured, caused by working conditions; restoration of health and working capacity of victims at work; compensation for damage related to the loss of insured persons’ wages or the relevant part of it during the performance of their duties, provision of social services in connection with damage to health, as well as in the event of their death, making insurance payments to incapacitated members families. Confirmation of the central place of social insurance against accidents and occupational diseases at work in the system of guarantees of the right of citizens to social protection can serve as indicators of the cost of material support in this area. Conclusions and prospects for the development. As a result of studying the place and role of compulsory state social insurance in the system of guarantees of the right of citizens to social protection due to accidents and occupational diseases at work, we can state that the right to social protection is one of the central and universally recognized social human rights. Compulsory state social insurance is the main material guarantee of the realization of the right of citizens to social protection due to accidents and occupational diseases at work. Its main essence and purpose are to receive the insured person in the event of an insured event from the insurer of material support (temporary disability benefits, burial) and social services (payment for treatment in the rehabilitation departments of the sanatorium after illness and injury) at the expense of the insured.

AbstractThis article examines private sector complicity in governmental corruption that violates economic and social rights. Although banks and multinational corporations typically play critical roles in facilitating the diversion of public revenues away from the provision of social services, the link between the private sector, corruption, and human rights violations remains underexplored. This article therefore examines this relationship and explores the viability of a standard for assessing the complicity of the private sector in such violations of economic and social rights. Ultimately, the state-centred nature of the international human rights system limits the utility of any complicity standard for non-state actors.

In this chapter, Robert Pinker examines how civil war influences T.H. Marshall's hypothesis that the civil, political and social rights of citizenship developed under conditions of peace. Using the examples of Ireland and Northern Ireland, Pinker discusses the conditions in which the advancement of welfare or well-being is likely to be seriously disrupted by focusing on Marshall's theory of citizenship and welfare. Marshall describes three key elements in the status of citizenship: civil rights, political rights and social rights. Pinker traces the history of the often conflictual relationship between England and Ireland in order to address a gap in Marshall's theory of citizenship and welfare, rendering it open to criticism. He suggests that civil wars ‘are not fought over the conventional issues of social welfare. Ordinary people are not prepared to kill or be killed in the cause of better social services’.

O artigo possui como feixe temático o processo contemporâneo que reedita ciclo de ruptura da institucionalidade democrática no Brasil, desencadeado pelas forças reacionárias/conservadoras de agosto de 2016. Para as classes trabalhadoras estão em curso duras consequências da crise econômica mundial, combinadas com a disputa política decorrentes de uma governabilidade ilegítima: desemprego massivo, contenção salarial, perda de históricos direitos trabalhistas e garantias sociais recém-conquistadas, em suma, agravamento da pauperização, no cenário histórico da superexploração e dependência. Com esses vetores de análise, o fio condutor da reflexão versará sobre as contradições que sobredeterminam os direitos sociais e as políticas sociais na periferia do capitalismo, atentando para as modulações dos direitos sociais no contexto da programática neodesenvolvimentista e de seu desmonte, bem como acerca dos dilemas contemporâneos do serviço social na intrincada conjuntura de afirmação/regressão dos direitos sociais.

This article focuses on the current process that is reshaping the cycle of democratic breakdown in Brazil, triggered by the reactionary/conservative forces of August 2016.  The working classes are experiencing the harsh consequences of the global economic crisis combined with the political dispute arising from illegitimate governance:  massive unemployment, wage restraint, loss of historic labor rights and recently gained social guarantees; in short, worsening poverty against a historic backdrop of overexploitation and dependency. Based on these vectors of analysis, this article reflects on the contradictions that govern social rights and social policy on the periphery of capitalism, centering on variations in social rights within neodevelopmentalist framework and its breakdown, as well as the contemporary dilemmas faced by social services in the complex affirmation/regression of social rights.

Initially, we analyze how these benefits are incorporated into the Spanish legal system as a result of international external influences. Furthermore, we evaluate the nature of social rights in the Constitution, in the Constitutional Court jurisprudence, and in the state and regional legislation.
