Practice Makes Dialogue: Reconceptualizing Constitutional Interaction between Courts and Legislatures

Abstract The question of how to understand and conceptualize inter-institutional interaction between courts and legislatures, particularly in the context of constitutional challenges, has drawn considerable attention over the years. This question is of special importance to the apprehension of constitutional dialogue as simultaneously describing and shaping constitutional interaction. This article focuses on the descriptive aspects of the constitutional dialogue and through them proposes a reconceptualization of constitutional dialogue, which is not based on the mere existence of legislative responses or the number thereof, or on the existence of different structural constitutional mechanisms. Instead, this reconceptualization is based on the de facto use in constitutional practices during the routine constitutional examination process, by the judiciary and political branches altogether. The article introduces a breadth-and-depth approach, which observes many constitutional decisions and legislative responses and uses them to analyze the nature of courts-legislatures dynamics. These insights are derived not only from the mere existence of a ruling or a statute, but also from the content and design of the institutional outcome thereof. The conclusions drawn using this approach are comprehensive, providing insight into the constitutional and dialogic interaction between courts and legislatures in each constitutional system, as well as identifying trends and changes as they occur. The article also offers an application of this approach to Israeli jurisprudence, illuminating the depth and complexity of this interaction, and enabling us to recognize it as a constitutional system with strong dialogic characteristics.

As various information technologies are penetrating everyday life, private and business matters inevitably mingle. Separating private and business past records, public information, actions or identities may, however, be crucial for an employee in certain situations. In this chapter we review the interrelated areas of employee privacy, and analyze in detail two areas of special importance from the viewpoint of the separation: web and social network privacy. In relation to these areas we discuss threats and solutions in parallel, and besides surveying the relevant literature, we also present current Privacy Enhancing Technologies applicable in each area. Additionally, we briefly review other means of workplace surveillance, providing some insight into the world of smartphones, where we expect the rise of new privacy-protecting technologies as these devices are getting capable of taking over the functions of personal computers.

AbstractMost Pb and Cd neurotoxicity studies investigate exposure to either of the toxic metals alone, while data on co-exposure are scarce. The aim of our study was to fill that gap by investigating acute combined effects of Pb and Cd on redox and essential metal status in the brain of Wistar rats. Animals were randomised in four groups of six to eight rats, which received 15 or 30 mg/kg of Cd, 150 mg/kg of Pb, or 150 mg/kg of Pb + 15 mg/kg of Cd by gavage. The fifth, control, group received distilled water only. Co-treatment with Pb and Cd induced significant increase in malondialdehyde (MDA) and thiobarbituric acid-reactive substances (TBARS) compared to control and groups receiving either metal alone. This is of special importance, as MDA presence in the brain has been implicated in many neurodegenerative disorders. The groups did not significantly differ in Zn, Cu, Mn, and Fe brain levels. Our findings highlight the importance of metal mixture studies. Neurotoxicity assessments of single chemicals do not provide a real insight into exposure to mixtures in real life. Further research should look into interactions between these metals to reveal complex molecular mechanisms of their neurotoxicity.

The skill of dealing with people was given a special importance by the persons interviewed during my examination by means of questionnaires although most of the specialist works Iconsulted did not pay too much attention to this fact. When asked about the particular fields of further studies, only a small proportion of the respondents regarded the development of theirpersonality important. I think to dissolve this paradox is necessary as without the development of personality it is impossible to improve interpersonal skills, that is one of the basic pillars of good performance at work. Regarding that it is the graduates who fill managerial posts, dealing with people belongs to one of their tasks.Among the respondents if the first degree were from a college and not from a university, the greatest proportion of those studying further would live in Heves and Borsod-Abaúj-Zemplén counties. However, this connection cannot be proved in Budapest. Individual motivation is the main drive of studying further after obtaining a degree in a greater and greater proportion.The graduates’ studying further is significantly directed to acquiring extra knowledge rather than a totally new profession and they get a deeper insight into the knowledge necessary fortheir profession driven by their own motivation.

AbstractAn understanding of molecular interactions is essential for insight into biological systems at the molecular scale. Among the various components of molecular interactions, electrostatics are of special importance because of their long-range nature and their influence on polar or charged molecules, including water, aqueous ions, proteins, nucleic acids, carbohydrates, and membrane lipids. In particular, robust models of electrostatic interactions are essential for understanding the solvation properties of biomolecules and the effects of solvation upon biomolecular folding, binding, enzyme catalysis, and dynamics. Electrostatics, therefore, are of central importance to understanding biomolecular structure and modeling interactions within and among biological molecules. This review discusses the solvation of biomolecules with a computational biophysics view toward describing the phenomenon. While our main focus lies on the computational aspect of the models, we provide an overview of the basic elements of biomolecular solvation (e.g. solvent structure, polarization, ion binding, and non-polar behavior) in order to provide a background to understand the different types of solvation models.

Marcus Powell was a secretive man blessed with genuine curiosity. Myths abound concerning him, many of which cannot be verified given the long interval since his death, and a problem for his biographer is to separate myth from reality. Maybe it is a mistake to try because its mere existence provides insight into the person he was. He was an observer of life and a sympathetic and amusing commentator on it, and he wrote unusually well. What of his personal writing remains reflects his sense of humour and his humanity, and quotations from it are provided without further attribution throughout this memoir. He was not a tall man (5 ft 2 in; 1.57 m) and ‘when he went to Oxford he was unimaginatively called Tiny. This stuck and was used within the University and in the scientific world. Marcus, the name he liked, was kept for the few.’ Where any confusion might arise we shall presume to use this name. Those who knew him outside his laboratory have only the fondest memories of him, but some academic colleagues occasionally found him difficult.He was born in Coventry, the youngest child of Henrietta and William Herbert Powell, to whom a daughter, Christina, had been born two years earlier. William was born in Kidderminster. His profession was given on Marcus's birth certificate as a bicycle machinist. It was printed by use of a rubber stamp, which reflected the prevalence of the industry in Coventry at that time, bicycle manufacture having superseded the sewing machine industry to the extent that in 1906 a single company produced 75 000 bicycles.William and Henrietta had married in Calne, Wiltshire, in August 1902. William was the sixth of eight children born to Charles and Eliza Powell, who registered a cross on the birth certificate. Charles was variously described as a gamekeeper and a farm labourer, and he died at the age of forty–seven, leaving his wife to bring up the seven children still at home, ranging in age from two months to twenty–one years. Eliza became a dressmaker, and the two elder remaining children a laundress and a housemaid. The eldest daughter, Annie, had left home by this time and had married at some time; she attended his deathbed as Annie Shill, and possibly the wedding of William and Henrietta twenty-two years later as Annie Blackman.

Purpose – The purpose of this paper is to report research findings on the perspectives of overseas trained psychiatrists (OTPs) on the “The Overseas Trained Specialist Up-Skilling Programme” (OTSUP), initiated in Queensland, Australia to assist OTP's to prepare for the Royal Australian and New Zealand College of Psychiatrist (RANZCP) Fellowship examination. Ascertaining and utilisation of OTP's views about the programme will enable improvements to be made to the programme and better implementation. Design/methodology/approach – An exploratory qualitative design was utilised for the study in order to provide insights on the quality and effectiveness of the OTSUP. Findings – Centred around two main themes. The first theme included participant's knowledge about the up-skilling programme with its subthemes of “finding out about the programme”; “perceived aims of the programme”; and “educational events supporting the programme”. The second theme revolved around participants’ perceived benefits of the up-skilling programme with its four subthemes such as, first, individualised support, second, the opportunity to improve practical and communication skills through OTSUP educational events, third, access to peer support and fourth, provision of specific information on the RANZCP examination process. Research limitations/implications – Limitations as this was a qualitative study, the findings can only be applicable to a similar context. Nevertheless, the findings do provide support for an educational initiative that assisted the OTS to better prepare for the RANZCP examination. To gain further insight into challenges faced by OTS with successfully passing the examination in less frequent attempts, programmes such as the OTSUP need to be improved and sustained. Originality/value – The findings provide valuable insight into how OTPs view the up-skilling programme. Moreover, the findings pave the way forward in how the programme can be improved in the future to assist OTPs prepare for the RANZCP examination.

The 1938 term of the Supreme Court brought substantial changes in its personnel. Mr. Justice Cardozo died on January 9, 1938. He was succeeded by Mr. Justice Frankfurter, who took office on January 30, 1939. On February 13, 1939, Mr. Justice Brandeis retired, and on April 17 Mr. Justice Douglas was appointed to fill his place. By the end of the term, therefore, four justices appointed by President Roosevelt had taken office. It is too early to appraise the results of these appointments upon the decisions and doctrines of the Court. One statement may be made, however, which throws some light upon the recent trend of judicial decisions. In preparing the present survey of the Court's decisions, some sixty cases were examined, all but one or two of them turning upon constitutional issues. In these sixty-odd cases, Mr. Justice McReynolds and Mr. Justice Butler, the two remaining members of the conservative “old guard,” dissented together twenty-five times. In several instances they were joined in dissent by Mr. Justice Roberts, and once or twice by the Chief Justice. In the main, however, they stood alone against a compact majority of six or seven justices. With the death of Mr. Justice Butler in the fall of 1939, Mr. Justice McReynolds stands like the boy on the burning deck amidst what obviously appears to him to be the imminent destruction of the old constitutional system.

The operational eco-intensity of a heat supply system is dependent upon the interaction of its elements and their common performance. It is of special importance to gain insight into possibilities to reduce chip fuel consumption in the case when an additional element – a gas condenser – is installed in a boiler house. The efficiency of a system's operation is estimated by its eco-intensity; such estimates concern the influence exerted by technological parameters on the reduction in natural resource consumption, allowing this problem to be thoroughly analysed by means of definite factors promoting the eco-intensity rise. Based on the results of commercial experiment, the authors have found the independent variables for the case of gas condenser without packing. The eco-intensity of a boiler house operation decreases as the outdoor temperature falls and therefore the boiler's load should be increased. This aspect could be due to several causes, among which the most important are: the deviations of the operating parameters of the gas condenser, the increase in the flue gas velocity, and temperature. Analytical treatment of the influence exerted by a boiler's specific load on the operational efficiency of its energy has shown that as this former grows, the efficiency decreases and therefore less heat energy could be derived from the gas condenser. This should be taken into account at simulation of the control over a gas condenser's operation. Tai ypač svarbu tiriant galimybes sumažinti skiedrų kuro sąnaudas tuo atveju, kai šildomame name yra įdiegtas papildomas elementas – dujų kondensatorius. Sistemos veikimo efektyvumas įvertinamas pagal jos ekologinį intensyvumą; tokie vertinimai susiję su įtaka technologiniams parametrams mažinant gamtinių išteklių naudojimą. Remdamiesi tyrimo duomenimis, autoriai nustatė nepriklausomuosius dujų kondensatoriaus kintamuosius. Šildomo namo ekologinis intensyvumas susijęs su lauko temperatūra. Kai ji nukrinta, apkrova turėtų būti padidinama. Tai lemia kelios priežastys, iš jų svarbiausios: dujų kondensatoriaus darbinių parametrų nuokrypiai, išmetamųjų dujų greičio padidėjimas ir temperatūra. Atlikta analizė parodė, kad didinant katilo formą, sistemos efektyvumas mažėja, ir todėl mažiau šilumos energijos tiekiama iš dujų kondensatoriaus. Tai turėtų būti įtraukta į dujų kondensatoriaus veikimo kontrolės modeliavimo skaičiavimus.

Due to its geographic position, geomorphology and certain signs of frequent occurrencesof atypical conditions, the south area of the southern part of the Kornati islands and the island of Žirje is very interesting for the thermohaline analysis. The analysis has not been completed,however, the activities necessary for getting an insight into justifiability and the need for radical interventions have been made. On the basis of the data obtained from longtime measurements, separate analyses of the sea water temperature, salinity and density have been made, defining annual courses of mean monthly and extreme values, mean monthly values at characteristic depths, and vertical distribution of mean monthly values. Special importance was given to external and internal influences.

Within the framework of a European Erasmus+ project, trainee mediators were interviewed about their experience. The encounters took place in unstructured, in-depth qualitative biographical-narrative interviews, in which individuals who are engaged in dialogic interaction create shared understanding and give meaning to their stories. The interview is interactive, co-constructed. The detail of the interview language documents how meaning-making takes place, and how this is affected by group belonging, ethnic or cultural discourses, as well as gender, age, professional and educational relationships, and so on. The interview is sensitive to language resources and their use in the co-construction of meaning. This paper, using extracts from one biographical narrative, shows that the languaged form that these narratives of the biographical learning of mediators take can offer insight into the learning processes triggered by learning in communities of practice, and that the creation of a common space of experience can be heard as it emerges in biographical talk. Biographical resources, biographicity, and their relationship with language and society are considered, and in the interview narratives the creation of a learning space, a space for the development and unfolding of notions and practices of mediation can be observed, heard and shared.
