This article analyzes the background of the legal pattern of the community at Kalisat Pasuruan in making local mediation as the main model to resolve divorce cases. This study uses a socio-legal approach with the Legal System Theory initiated by Lawrence Meir Friedman. This article is based on the emergence of the Supreme Court Regulation on Mediation in order to change the image of the Religious Courts from judicial paradigm to dispute resolution paradigm, including in divorce cases. The mediation in the case is imperative and the denial of mediation process in the court results in the cancellation of the decision by law. This study concludes that the alignment of the Kalisat community towards local mediation is much more due to non-legal factors which are categorized into elements of legal culture than to structural elements or legal substances. The legal culture element that is intended for example concerns the understanding of the Kalisat community on the teachings of their religion, their perceptions of the proceedings in the Religious Court in resolving divorce cases, or other factors such as the emotional closeness between them and community leaders who are local mediators.

This article discussed regulatory policy on mediation in religious courts way dispute resolution through mediation according to Islamic law and implementation of mediation in settlement court cases in Religious Courts Bandung Class I A. This research base on the policy rules by mediation in the  Religious Courts;  (a)  the  benefits to  be  gained if mediation used as a means in the  settlement  of  disputes,  namely  the  mediation process  could overcome  the  problem  of  accumulation of  matter,  the  mediation process is viewed as a means of dispute resolution that is faster and cheaper than the litigation process, enforcement of mediation can expand access for all parties to gain a sense  of  justice,  (b)  provision their peace  efforts in legislation.  (c) Indonesian society is a society that likes peace. The Implementation of the mediation process done with two ways, namely mediation initial litigation, and over litigation.

Abstract: The phenomenon of marital disputes that often end in divorce has been a serious concern of the government, resulting in a regulation on mediation, namely the Regulation of the Supreme Court of Republic of Indonesia (PERMA) Number 1 of 2016. This regulation was made with the hope of reducing the divorce rate caused by marriage disputes. This article discusses the form of marriage dispute resolution at Manado Religious Court with a focus on one type of dispute resolution, namely mediation. This study uses an empirical juridical approach. The research was conducted at the Manado City Religious Court in 2017 and 2020. The result is that the mediation process has been carried out in accordance with the provisions of PERMA No.1 of 2016. However, there have been many obstacles. Thus, the efforts to reduce the divorce rate due to marriage disputes have not undergone significant changes. Keywords: mediation; marriage dispute; Manado religious court. Abstrak: Fenomena sengketa perkawinan yang sering berakhir pada perceraian menjadi perhatian serius dari pemerintah sehingga melahirkan aturan tentang mediasi yaitu Peraturan Mahkamah Agung RI (PERMA) No. 1 Tahun 2016. Aturan ini dibuat dengan harapan menekan angka perceraian yang diakibatkan oleh sengketa perkawinan. Artikel ini membahas mengenai bentuk penyelesaian sengketa perkawinan di Pengadilan Agama Manado dengan fokus pada salah satu jenis penyelesaian sengketa yaitu mediasi. Penelitian ini menggunakan pendekatan yuridis empiris. Penelitian ini dilakukan di Pengadilan Agama Kota Manado pada tahun 2017 dan tahun 2020. Hasilnya adalah proses mediasi sudah dilakukan sesuai dengan ketentuan PERMA No.1 Tahun 2016. Namun mengalami benyak kendala sehingga upaya untuk menekan angka perceraian akibat sengketa perkawinan belum mengalami perubahan yang signifikan. Kata-kata kunci: mediasi; sengketa perkawinan; pengadilan agama Manado.

This paper discusses the process of resolving inheritance disputes through the mediation process in the Purworejo religious court, in this paper the author aims to reveal the effectiveness of dispute resolution through the mediation process, this research uses an empirical juridical method and analysis of the results of the religious court judge's decision through a copy of the peace certificate number: 1081 /Pdt.G/2019/PA.Pwr. The mediation step is an obligation for the judge to offer to the parties to the dispute, because mediation is expected to be an alternative non-legal litigation in order to reduce the pile of cases in religious courts and minimize the costs incurred by the disputing parties. Mediation conducted by the purworejo religious court judges and advocates for legal counsel from the LBH Sakti office on inheritance disputes between the defendant and the plaintiff resulted in a peaceful decision by issuing a peace deed on Wednesday 5 February 2020 in an open session.

Purpose of the study: The general objective of this study was to explore the potential of the mediation process as a reformulation of Islamic banking dispute settlement after the Supreme Court Regulation (SCR) on mediation procedure in the court. On the one hand, this study tries to find a repositioning of mediation procedures in resolving disputes over Islamic Banking in religious courts. Methodology: This research was normative and empirical. The data collection techniques of this literature would be done utilizing literature study and field research. Primary data was obtained through field research with interviews. The participants from Judges of Religious Court, Abdul Manan as a Judge of in the Supreme Court Institution, Islamic banking legal unit. Data were processed by a qualitative descriptive analysis technique. Secondary data used consisted of primary legal material sourced from SCR No. 1 of 2016 and the contract. Principal Findings: The mediation process as a reformulation of Islamic banking dispute settlement especially in the Religious Court is according to Article 2 Paragraph (1) SCR No. 1 of 2016. The repositioning of mediation procedures in resolving Islamic banking disputes in the Religious Courts applied by making changes as part of the case registration process implemented through honesty, fidelity, and justice. Applications of this study: This paper is essential for the parties to get the legal certainty in maintaining the continuing development of Islamic banking business, product development, risk management and efficiency of the bank. The study may be instrumental in helping to improve the development of the legal studies programs, notably the Islamic Economic Law. The results of this study will provide benefits for the religious court to improve its performance effectively and efficiently in dispute settlement through mediation. Novelty/Originality of this study: Determination of the mediation as reformulation of dispute settlement on Islamic banking post-enactment or issuance of the SCR No. 1 of 2016 and to find out about repositioning of the mediation procedure and proposing changes in the position (repositioning) of the mediation process and reaffirming the roles, duties and accountability of professional mediators or non-judge mediators so that it is expected that the role of non-judge mediators can active in resolving Islamic banking disputes both in procedures in the court or outside the courts applied at the Indonesian Religious Court. The contribution of this paper will be the revision of the curriculum of legal studies and Islamic Economic Law. The importance for researchers of the study is to develop and improve the capability of researchers for developing the law study program called Islamic Economic Law.

This paper aims to find the basis for the philosophical rationality of applying sharia principles in resolving sharia economic disputes in religious courts as well as the prerequisites required by religious court judges to apply sharia principles in resolving sharia economic disputes. The type of research used is normative legal research to find philosophical rationality and the institutionalization of sharia principles in resolving sharia economic disputes. The approach used is a conceptual approach. Secondary data were collected through literature study. The research results obtained first, the philosophical rationality of the application of sharia principles in sharia economic dispute resolution in line with the first and third principles of Pancasila. Second, the institutionalization of sharia principles becomes effective if there are prerequisites that must be met, firstly enough information for judges to understand sharia principles, secondly the obstacles that come from the judges themselves who are still oriented towards the flow of legism / positivism will have an effect on providing legal basis and third the speed of instilling the institutionalization of sharia principles can be done through education and training organized by the Supreme Court for Religious Court judges.

This article is a field research to answer the role of community leaders as mediators in the settlement of inheritance disputes in Wonosalam, Demak and how the legal power of resolving inheritance disputes through mediator community leaders in Wonosalam, Demak. Research data are collected through interviews and observations, then are analyzed with descriptive analytical techniques with inductive thought pattern. Wonosalam community leaders have an important role in the settlement of inheritance disputes, namely as a mediator, including: opening and leading the mediation process, explaining and determining the heirs' parts, providing the best advice and solutions, deciding and determining what has been agreed by the parties to the dispute, preventing the emergence of even bigger disputes, and still maintaining harmony and harmony in social life. The results of the settlement of inheritance disputes through mediators of community leaders in Wonosalam do not have an enforceable legal force, because they are not confirmed by making a peace certificate or a peace agreement letter, which is contained in: article 27 of the Supreme Court Regulation No. 1 of 2016 concerning Mediation Procedures and article 1851 Civil Code. Nevertheless, the determination of community leaders as mediators in the settlement of inheritance disputes is obeyed and implemented by the people of Wonosalam.

This research aims to determine the implementation of mediation in divorce cases in The Religion Court Semarang, the substance perspective for PerMA No. 1 of 2008 on Mediation Procedure in the Court, and the legal culture for citizen proposing their problem to the court. This study uses the non-doctrinal law approach that puts the law as "skin out system" or the study of the law in action and also uses doctrinal law approach as a "skin in the system" or the study of law in book, PeMA No. 1 of 2008. The next, the study analysis uses the theory of Lawrence M. Friedman in law enforcement, Lucy V. Kazt theory in the mediation process, and content analysis. The researcher concludes that the mediation in the Religious Courts has not been effective yet because the litigants do not want to make peace, the lack of knowledge about science mediation judge, Religious Court cases are overload and limited means. Besides the existing mediation has just been done in court by requirement in which the parties should attend, whereas this requirement sometimes becomes the mediation success constraints. That is why, the success of mediation must be supported by a legal culture that preceded the dissemination and socialization of justice of peace in the mediation process, prioritybased divorce amicably and based on culture and local wisdom

The sharia economic dispute resolution process in Indonesia has two paths which can be taken by litigants, namely litigation in court and non-litigation. This research was motivated by sharia economic dispute cases handled by Blitar Religious Court which were carried out through a mediation but failed. The failure of this mediation process and the factors behind the failure are important issues to be studied. Consequently, Supreme Court Regulation No. 1/2016 becomes important to be used as the basis of analysis, whether this regulation has been implemented or not. Therefore, this study aims to describe and analyze the implementation of the Supreme Court Regulation Number 1/2016 concerning the procedure of in-court mediation on economy sharia disputes in Blitar Religious Court, along with various obstacles and solutions.

Mediasi merupakan cara penyelesaian sengketa yang cepat, sederhana dan biaya yang ringan, mediasi merupakan penyelesaian sengketa dengan cara damai yang dibantu pihak ketiga yaitu mediator. Pelaksanaan mediasi dalam penyelesaian perkara perdata di Pengadilan pada hakikatnya merupakan bentuk implementasi dari musyawarah mufakat. Hal ini diatur dalam Peraturan Mahkamah Agung Nomor 1 Tahun 2016 Tentang Prosedur Mediasi di Pengadilan. Tujuan dari penelitian ini adalah untuk mengetahui prosedur proses mediasi di pengadilan agama, faktor yang mempengaruhi dan sejauhmana keberhasilan proses mediasi dalam mencapai kesepakatan damai di Pengadilan agama. Metode yang digunakan dalam penelitian ini adalah Penelitian kualitatif yaitu dilaksanakan untuk membangun pengetahuan melalui pemahaman dan penemuan. Pendekatan penelitian kualitatif adalah suatu proses penelitian dan pemahaman yang berdasarkan pada masalah manusia. Hasil dari penelitian ini adalah proses dari mediasi terdiri dari Pra mediasi dan proses mediasi selama kurang lebih 30 hari. Faktor yang mempengaruhi proses mediasi diantarnya kualifikasi mediator, kepatuhan masyarakat, fasilitas, itikad baik para pihak Kata kunci: Mediasi di Pengadilan, Perkara Perceraian, Pengadilan Agama Karawang   Mediation is a way of resolving disputes that is fast, simple and low cost, mediation is a peaceful settlement of disputes assisted by a third party, namely a mediator. The implementation of mediation in the settlement of civil cases in court is essentially a form of implementation of consensus agreement. This is regulated in the Supreme Court Regulation No.1 of 2016 concerning Mediation Procedures in Courts. The purpose of this study was to determine the procedures for the mediation process in religious courts, the factors that influence and the extent of the success of the mediation process in reaching a peace agreement in religious courts. The method used in this research is qualitative research, which is carried out to build knowledge through understanding and discovery. A qualitative research approach is a process of research and understanding based on human problems. The result of this research is the process of mediation consisting of pre-mediation and mediation process for approximately 30 days. The factors that influence the mediation process include the qualifications of the mediator, community compliance, facilities, and good faith of the parties.
