TO THE QUESTION OF CHANGES IN THE STRATEGY OF THE RUSSIAN FEDERATION NATIONAL SECURITY IN 2021

The paper considers a number of changes made to the Strategy of the Russian Federation National Security, which was approved by the Decree of the President of the Russian Federation on July 2, 2021, in comparison with the previous strategy approved in 2015. The study is important since a new strategy has been recently enacted, and a uniform understanding of the key concepts reflected in this document seems essential. Some issues related to the fixed definitions of such concepts as “national security of the Russian Federation”, “national interests of the Russian Federation”, “strategic national priorities of the Russian Federation”, “national security protection”, “threat to national security”, “national security protection system” are analyzed. The study compares the definition of the concept “national security” fixed in the Strategy of the Russian Federation National Security, which was approved in 2021, with the options for other definitions given in the similar documents that were previously in force in Russia during the post-Soviet period of Russian history. The study additionally focuses on the transformation of national interests of the Russian Federation, which are enlisted in the recent strategy. In particular, the paper discusses the wording “saving the people of Russia, developing human potential, improving the quality of life and the well-being of citizens”. The author emphasizes that undervaluation of the strategic importance of the social sphere as a security factor in the course of economic and political reforms may cause threat of loss of citizens’ confidence in government officials, which, under certain conditions, can lead society and the country to a constitutional crisis and the collapse of federal status.

The National Security Strategy of the Russian Federation, approved by Presidential Decree no. 400 of July 2, 2021, is the first strategic planning document in the history of modern Russia, which called the preservation of the people of Russia and the development of human potential a primary national interest and strategic national priority, and improving the quality of life and well-being of citizens is among the priorities. The scientific research of document that changed the paradigm of national security is just beginning. In the study, using a comparative historical methodology, an intersectoral analysis of the transformation of the labor-legal and social-protective component of the National Security Strategy is carried out, the timeliness of the changes is empirically proved on the basis of statistical data. In the course of the study, we develop a classification of tasks to ensure the implementation of state policy goals, depending on the degree of determination with the sphere of labor and social protection, creates the basis for intersectoral research on national security issues, improving current legislation and its application through the prism of constitutional guarantees in the social protection and labor law spheres. We substantiate the increasing role of social partnership, social solidarity, socially responsible business and the principle of respect for human labor as necessary conditions for the implementation of strategic plans to ensure national security for the preservation of the people of Russia and the development of human potential.

Problem setting. The article establishes that the objective impossibility of rapid integration of Ukraine into the European European community turns it into a platform for the constant relations clarification between the West and the East. The uncertain situation of our country due to this fact dictates specific rules, according to which Ukraine should pursue an inconsistent policy related to the political and economic conjuncture, and this increases the likelihood of possible security challenges to Ukraine in the context of destabilization of the international security space. In such a situation, the adoption by a state of relevant regulations of a profile nature, which would completely meet all the challenges of our time, comprises a very important fact. Recent research and publications analysis. Many works consider general issues of national security in Ukraine, a fundamental place among which belongs to H. Sytnyk, the co-author of the National Security Strategy of Ukraine, many bills, conceptual scientific strategies and political programs in the sphere of national security of Ukraine, as well as the works by V. Abramov, N. Nyzhnyk, V. Oluyko, V. Pasichnyk et аl. The assessment of real threats and challenges to national security, as well as their geopolitical context, was conducted by S. Bielay, V. Hulay, K. Kononenko, M. Malsky, L. Novoskoltseva et al. Highlighting previously unsettled parts of the general problem. To analyse the prerequisites, main provisions, security risks, challenges and tasks of the 2020 National Security Strategy, find out its novelties in comparison with previous strategies, as well as to determine its significance for the current situation in Ukraine. It has been established that since 2014, full-scale aggression of the Russian Federation has continued in Ukraine, which has all the typical features of so-called “hybrid war”, and is implemented in the forms of military and other illegal actions, reflected in almost all key spheres of life of the Ukrainian state and society in general, including information, economic and diplomatic space. So, on September 14, 2020, the President of Ukraine signed the Decree “On the National Security Strategy of Ukraine”. The content and structure of the Strategy is quite different from its previous versions adopted in 2007, 2012 and 2015. The adoption of this document was really expected, because it should have shown the authorities’ vision of threats, risks and challenges to Ukraine’s national security and determination of the ways to neutralize such threats. The new Strategy replaced one dated 2015. 2020 Strategy makes the appropriate accents and articulates problems that clarify the view of security component and this is important from the point of view of the activities of state bodies, because this is what they will rely on in the coming years when forming their action plans, primarily in the security sector. For the first time, the new Strategy is based on the following basic principles: 1) deterrence; 2) resilience; 3) interaction. This document focuses not only on military issues, but also on areas related to the security sector, information, diplomatic and economic spheres. The Strategy focuses on the fact that the Russian Federation, while continuing military actions against Ukraine, systematically uses economic, political, military, information and psychological, as well as cyber means. In addition, the Strategy takes into account the latest changes related to the crisis in global economy, the spread of the COVID-19 disease caused by coronavirus, as well as the increased risk of natural and man-made emergency situations. With the spread of the COVID-19 pandemic, there were also critical problems in the health and social protection systems, in the information sphere, and this in turn led to an increase in unemployment, destruction of established lifestyles and, in general, it threatens food development, hinders free movement of capital, goods and labour force, damaging the service sector. There is also an intensification of rivalry between key world players in the geopolitical position, in particular, between the United States of America and the People’s Republic of China for world leadership. The document stipulates that acquisition of full membership of Ukraine in the EU and the North Atlantic Treaty Organization is the strategic course of the state. Conclusions of the research and prospects for further studies.The 2020 National Security Strategy meets the challenges of our time and is more narrative than similar documents of previous years. Its basic principles such as deterrence, resilience and interaction provide more opportunities for updating the security sector and responding quickly and flexibly to new challenges and threats facing Ukraine. At the same time, the implementation of ideas set out in the Strategy will depend on those sub-strategic documents (strategies and programs) that are to be adopted within six months according to the new Strategy. If these documents manage to offer effective means of counteracting hostile activity, the newly adopted Strategy will become an effective planning tool, rather than another bureaucratic pro forma. Research and analysis of other new regulations defining security challenges and threats for Ukraine can be a prospect for further scientific research.

National security issues are crucial, multifaceted, and integral phenomena of social and political life of the country. This article explores the normative legal framework that regulates this sphere of social relations. The article presents an analysis of the features of legal support for national security as a problem of stabilizing society. Analysis is conducted on the peculiarities of legal support of national security as the problem of stabilization of society. The author notes that the national security policy, first and foremost should be aimed at ensuring geopolitical interests of the Russian Federation, its sovereignty, political stability, and progressive socioeconomic development. Research methodology employs complex and systemic approaches; systemic, functional, historical general scientific methods; analysis and synthesis as private scientific methods; formal-legal analysis of normative legal acts; and comparative legal method. It is claimed that in the sphere of domestic policy, the key prerequisite for achieving the protection of national interests should consists in unification of the nation in order to solve spiritual, cultural and material tasks due to the overall sustainability and consent in the country, nonviolent resolution of domestic social conflicts; while in the sphere of foreign policy – planning and implementation of foreign policy actions from the perspective of ensuring national interests. The author gives practical recommendations for further improvement of national security system of the Russian Federation.

In the early 1990 s, the foreign policy concept in Russia was based on the policy of «Euro-Atlanticism», which presumed orientation towards the Western model of development, integration with the Western countries and a conflict-free vision of international relations. But unlike the era of «Cold War» with the USSR, the Western countries did not consider the Russian Federation to be equal in status and did not hasten the process of establishing strategic partnership. Russia has never managed to establish an alliance with the Western countries and become «part of the Western world», «Euro-Atlanticism» has not proved itself. In the late 1990s, a shift began to a course of «multi-vector» foreign policy, implying a multipolar system of international relations. Moreover, at the end of the twentieth century, the Russian Federation faced growing threats from the United States and the countries that make up the military-political bloc of NATO, which necessitated a rethinking of priorities and possibilities for ensuring the protection of Russia’s national interests and security, and the development and adoption of new doctrines and concepts on the subject. This article thus deals with the process of establishing State priorities on the basis of the principle of protecting the national interests and safeguarding the national security of the Russian Federation during the period 1999-2007.

The article offers readers a brief description of the content of the Model Education Program in Russian educational institutions, developed on the basis of state documents: “Strategy for the development of education in the Russian Federation for the period up to 2025”; “Concept for the development of additional education for children”; “Concept of state family policy in the Russian Federation for the period up to 2025”. The program is designed to provide support in the creation of in-school education programs aimed at the successful socialization of the student, the establishment of harmonious relations with the people around him, self-identification as a citizen of his country. The publication describes the sections of the Program, which include the organization of the educational process at school, the definition of the goals and objectives of education, its types and forms, as well as the direction of the reflexive activity of the entire school teaching staff and each teacher individually for the analysis and assessment of the educational work carried out by him.

The article analyzes the issues regarding the definition of some aspects of bringing to administrative responsibility for violation of the established temporary restrictive measures in the context of the COVID-19 pandemic. Special attention is paid to the analysis of changes in the Code of Administrative Offenses of the Russian Federation due to the need to strengthen measures of responsibility in the field of ensuring sanitary and epidemiological well-being. One of the novels are offenses under Part 2, Part 3 of Art. 6.3 Administrative Code, as well as Art. 20.6.1 Administrative Code of the Russian Federation. The features of the objective side of these offenses are established, as well as a list of subjects of these offenses.

“National interests” form the basis for the formation of not only foreign, but also the internal policy of the state. An objective indicator of this is the totality of socio-economic, political, organizational, legal actions of government bodies and management on their implementation. The practical expediency of the phenomenon of “national interests” depends on its theoretical consistency. As a new phenomenon for modern Russia, “national interests” require its understanding and scientific development. Guided by the provisions of political documents in the field of ensuring national security of the Russian Federation, relying on the results obtained by researchers in the field of philosophy, political science, the history of legal and political studies, ethnography, etc., the author of the article has undertaken a search for the conceptual nature and essential properties of this multicomponent phenomenon.

The authors emphasize that the system of strategic planning in Russia, which began to be updated in 2009-2014, has a number of methodological problems, which does not allow for the effective implementation of legislatively fixed basic principles (tradition of power and continuity), and makes it impossible to phrase a vertical goal setting in the strategic planning system thus violating the principle of decomposition of goals and objectives, and does not allow to achieve a balance in terms of validity of program and strategic documents. The article emphasizes that the principles of systematization of the whole complex of strategic planning documents need to be detailed. It is necessary to define more clearly their hierarchical structure, to develop a typology of these documents, depending on the purpose, the characteristics of vertical and horizontal relationships. The authors conclude that the basic system forming document of the goal-setting should be the “National Security Strategy of the Russian Federation”, which defines Russia’s national interests and strategic priorities taking into account the challenges and threats to national security. All other strategic goal-setting documents of a long-term nature should be formed as tools for the implementation of the provisions of this basic strategy; their task is to clarify and detail the directions for ensuring strategic national priorities in relevant areas. It is substantiated that in the hierarchy of strategic planning documents, when developing the “Guidelines for the Government of the Russian Federation”, the provisions of the medium-term forecast of the social and economic development of the Russian Federation, as well as the Decrees of the President of the Russian Federation that legally formulate the Addresses of the President of the Russian Federation should be taken into account. The main areas of activity of the Government of the Russian Federation are a reference point for the development of plans for the activities of federal executive bodies where the provisions of laws mention the development priorities of economic sectors from industry strategies. It is medium-term forecasts, according to the authors, that are the tool for the transition from the goal-setting to planning and programming.

The paper is devoted to the study of theoretical problems of legal provision of ecological, biosphere and genetic security in the system of national security of the Russian Federation. It is noted that from the legal point of view the process of «legitimization» of the term (concept) of environmental safety has been successfully completed. This term is widely used in legislation and law enforcement practice, however, the term «environmental safety» still does not have a pronounced context, distinguishable, for example, from the terms «environmental protection», «environmental risk», «sustainable development». If there is a legitimate (conservative) understanding of environmental safety, there is still no modern legal and clear, unambiguous and essential content of the concept of «safety» (including genetic, biological, biosphere, evolutionary and other currently relevant types of safety). Attempts to define safety (along with vulnerability) through threats, damages, stability, losses, have the right to exist, but do not give adequate and substantial sense. Based on the analysis of the current legislation and strategic planning documents, it is concluded that new theoretical and methodological approaches to the understanding of both the basic concept of «safety» and the concept of «environmental safety» are required. According to the authors, due to the emergence of new global challenges and threats (genetic, biosphere, biological, climatic, etc.) in a specific law it is advisable to revise the underlying definition of environmental safety, stressing its specificity. It is important to form the conceptual framework, including the definition and assessment of threats, risks; to select standards and methods of evaluation, classification of threats, their records; to provide for the variability of action of state authorities and local self-government in case of security threats and also the mechanism of participation of citizens and public associations in environmental decision-making on issues of environmental safety.
