Niniejszy artykuł stara się w miarę możliwości odpowiedzieć na pytanie, czy sys­tem aksjologiczny reprezentowany przez wyznawców islamu stanowi wyzwanie dla kultury europejskiej, czy też może jest jej integralną częścią składową. Na drodze do rozwikłania tego złożonego zagadnienia artykuł prezentuje w pierwszej kolejności, obok pewnych uwag wstępnych i metodolo­gicznych, pewien zasób informacji historycznych stanowiących niezbędne tło do dalszych rozważań. W głównej części praca skupia się na ukazaniu interferencji europejskiej i muzułmańskiej kultury oraz prawa. Wskazuje na pewne elementy wspólne, styczne oraz rozłączne. Artykuł usiłuje zdefi­niować pewne — kluczowe dla zadanego pytania — pojęcia, sygnalizując trudności interpretacyjne i będącą konsekwencją tych nieścisłości niemożność jednoznacznej odpowiedzi na postawione w temacie artykułu pytanie. Axiological system of Muslims — achallenge or an element of the common culture of Europe? This paper attempts to answer the question whether the axiological system, repre­sented by Muslim believers, is a challenge for European culture, or is it an integral part of this culture. At first, the article presents some introductory and methodological thoughts as well as provides a ne­cessary historical background for further analysis. In its main part, the paper focuses on the interfer­ence of European and Muslim culture as well as legal systems. Some common, tangent and disjoint elements are pointed out. The article attempts to define some terms, essential to a given question. It highlights the difficulties of interpretation and, as a consequence, inability to give an unequivocal answer to the question raised in the subject of this article.

ROMAN SOCIETAS AND THE COMMON LAW PARTNERSHIPThe construction of roman societas in comparison with the common law partnership was the subject of authors inquiry. The idea was to find whether these two contracts, being created in a very different time and situation, with ages of various experiences between them, could, in some way, resemble. In other words - is that possible that the similar aim of the contracts determined the shape of the legal form?Both constructions were analysed stressing their most significant points.The comparison was led due to the pattern established by the author, created to make it more readable.As a result every characteristic was composed of the following parts:1. description of the contract’s nature;2. types of the contract;3. inner relations between partners;4. societas/partnership in relation to outer world;5. dissolving the contract.On this basis author examined the findings.The pointed conclusions seemed to provide a very interesting start for further inquiries. The reason for this is, as it occurred, that between two legal systems, existing in separate ages and conditions, with settled opinion on their incompatibility, more than few similarities can be found.Author did not give a straight answer to the question why these similarities really exist. In fact she provides at least two possible explanations without prejudice.Actually to give a more exact answer deeper studies shall be undertaken. However even at this very early stage it can be said, that both constructions, even though so faraway in various dimensions from each other, developed compatible solutions on their way to find the best idea how the goal can be achieved. And this goal, as it occurred from the contracts’ nature, seemed to be analogous.Is the similar solution a question of reception? Or maybe both systems parallel found the way, which occurred to be the best and, in the same time, convergent? Maybe the catalogue of best solutions is closed and sooner or later every system shall come to it?These questions must be asked. Even if or especially that the answers are neither easy nor immediate.Author finished this first stage of her studies leaving them open but with the reservation that inquiry will be continued.

The article is devoted to the analysis of the views of Russian liberal leaders of the second half of the XIX - early XX centuries on Peter I and his transformation. The subject of the article is the historical and publicistic works of such authors as M. Pogodin, S. Soloviev, K. Kavelin, B. Chicherin, P. Vinogradov, S. Frank. Using textological analysis, the author aims to analyze the assessments made by representatives of the liberal Russian public of Peter I.'s transformational activities. According to the author, representatives of the Russian liberal discourse spoke about Russia as a part of Europe primarily in the geographical sense, and the common destiny of Russia and Western European countries is often determined by geography. Thinkers believed that European culture found its place in Russia, which before Peter I distinguished by its originality and firmness of the original principles. The author concludes that Russian liberals recognized Europeanization as an organic historical phenomenon caused by the whole progress of development of the country and expressing its needs. In general, the Europeanization of Russia under Peter I was given a positive assessment. Europeanization was considered as a factor in the integration of the Russian state into the European processes and a guarantee of its economic and political development. At the same time, the transformation of Russia in the European direction, as liberal intellectuals believed, was unfinished. Pointing to the incompleteness of the transformation, liberal thinkers put forward various reasons for the incompleteness of the transformation along the European path. The general assessment of the Europeanization of Russia was associated with the assessment of the personality and the activities of the King-converter himself, including in connection with his role in strengthening the state and the autocratic system in Russia.

Specific non-derivative nouns that are functioning in Smolensk dialect reveal a significant number of lexical parallels in the independent languageе structure of the contemporary Belarusian language. The analysis of these words is carried out in order to establish their status in two synchronous lexical and gram- matical systems for further clarification relating to the number of lexical parallels of different origins in Smolensk dialect. The subject of the study is the volume of lexical meaning of specific nonderivative nouns recorded in independent, but at the same time contact-located language formations, in one of which they have a regional status (Smolensk dialect), and in the other one they are included in the codified form of the standard language (the Belarusian language). The relevance of the study is explained by the complex history of the Russian-Belarusian borderland, which is reflected both in Smolensk dialect and in the Belarusian language, which has been developed on the dialect basis. The common material and spiritual culture typical for the dialects of the Russian-Belarus-ian borderland is a marker revealing the specifics of the region described. Due to the common culture, these conditionally distant language units regularly coincide in the volume of lexical meaning and demonstrate a stable distribution within lexical and semantic groups in each language formation at the present stage of its functioning.

Subject. The article focuses on the advanced time-driven tools for allocating overhead expenses, which are based on process-based budgeting. Objectives. We articulate a technique for cost allocation so as to assess the cost of each process with reference to the common time driver. Methods. The study relies upon methods of systematization, classification, analogy and comparison, and summarizes the scientific literature on the subject. Results. The article presents our own suggestions on implementing TD-ABC and TD-ABB into the strategic management accounting process of developer companies. The principles were proved to help more effectively allocate overhead expenses and assess the capacity load of each process performed by functions, departments and employees. Carrying out a comparative analysis, we found certain reserves for utilizing resources more effectively. Conclusions and Relevance. The findings are of scientific and practical significance and can be used by developer and construction businesses. The conclusions can prove helpful for scientific papers, student books, and further research.

The typology of rationality is one of major issues of modern philosophy. In an attempt to provide a typology to Oriental materials, a researcher faces additional problems. The diversity of the Orient as such poses a major challenge. When we say “Oriental,” we mean several cultures for which we cannot find a common denominator. The concept of “Orient” involves Arabic, Indian, Chinese, Turkish and other cultures, and the only thing they share is that they are “non-Western.” Moreover, even if we focus just on Islamic culture and look into rationality in this context, we have to deal with a conglomerate of various trends, which does not let us define, with full confidence, a common theoretical basis and treat them as a unity. Nevertheless, we have to go on trying to find common directions in thought development, so as to draw conclusions about types of rationality possible in Islamic culture. A basis for such a typology of rationality in the context of the Islamic world was recently suggested in A.V. Smirnov’s logic of sense theory. However, actual empiric material cannot always fit theoretical models, and the cases that do not fit the common scheme are interesting per se. On the one hand, examination of such cases gives an opportunity to specify certain provisions of the theory and, on the other hand, to define the limits of its applicability.

Abstract: This paper highlights similarities and different features of the category of kinesics “hand gestures”, its frequency usage and acceptance by different individuals in two different cultures. This study shows its similarities, differences and importance of the gestures, for people in both cultures. Consequently, kinesics study was mentioned as a main part of body language. As indicated in the article, the study kinesics was not presented in the Kyrgyz culture well enough, though Kyrgyz people use hand gestures a lot in their everyday life. The research paper begins with the common definition of hand gestures as a part of body language, several handshake categories like: the finger squeeze, the limp fish, the two-handed handshake were explained by several statements in the English and Kyrgyz languages. Furthermore, this article includes definitions and some idioms containing hand, shake, squeeze according to the Oxford and Academic Dictionary to show readers the figurative meanings of these common words. The current study was based on the books of writers Allan and Barbara Pease “The definite book of body language” 2004, Romana Lefevre “Rude hand gestures of the world”2011 etc. Key words: kinesics, body language, gestures, acoustics, applause, paralanguage, non-verbal communication, finger squeeze, perceptions, facial expressions. Аннотация. Бул макалада вербалдык эмес сүйлѳшүүнүн бѳлүгү болуп эсептелген “колдордун жандоо кыймылы”, алардын эки башка маданиятта колдонулушу, айырмачылыгы жана окшош жактары каралган. Макаланын максаты болуп “колдордун жандоо кыймылынын” мааниси, айырмасы жана эки маданиятта колдонулушу эсептелет. Ошону менен бирге, вербалдык эмес сүйлѳшүүнүн бѳлүгү болуп эсептелген “кинесика” илими каралган. Берилген макалада кѳрсѳтүлгѳндѳй, “кинесика” илими кыргыз маданиятында толугу менен изилденген эмес, ошого карабастан “кинесика” илиминин бѳлүгү болуп эсептелген “колдордун жандоо кыймылы” кыргыз элинин маданиятында кѳп колдонулат. Следовательно, здесь было упомянуто понятие “кинесика” как основная часть языка тела. Как указано в статье, “кинесика” не была представлена в кыргызской культуре достаточно хорошо, хотя кыргызский народ часто использует жестикуляцию в повседневной жизни. Исследовательская работа начинается с общего определения “жестикуляции” как части языка тела и несколько категорий жестикуляции, таких как: сжатие пальца, слабое рукопожатие, рукопожатие двумя руками, были объяснены несколькими примерами на английском и кыргызском языках. Кроме того, эта статья включает определения слов “рука”, “рукопожатие”, “сжатие” и некоторые идиомы, содержащие данных слов согласно Оксфордскому и Академическому словарю, чтобы показать читателям их образное значение. Данное исследование было основано на книгах писателей Аллана и Барбары Пиз «Определенная книга языка тела» 2004 года, Романа Лефевра «Грубые жестикуляции мира» 2011 года и т.д. Ключевые слова: кинесика, язык жестов, жесты, акустика, аплодисменты, паралингвистика, невербальная коммуникация, сжатие пальца, чувство восприятия, выражение лиц.

This chapter considers the meaning of the terms that appropriately denote the subject matter protectable by registered trade mark and allied rights, including the common law action of passing off. Drawing on the earlier analyses of the objects protectable by patent and copyright, it defines the trade mark, designation of origin, and geographical indication in their current European and UK conception as hybrid inventions/works in the form of purpose-limited expressive objects. It also considers the relationship between the different requirements for trade mark and allied rights protection, and related principles of entitlement. In its conclusion, the legal understandings of trade mark and allied rights subject matter are presented as answers to the questions identified in Chapter 3 concerning the categories and essential properties of the subject matter in question, their method of individuation, and the relationship between and method of establishing their and their tokens’ existence.

Gender affirmative action (AA) in management remains a controversial topic among scholars, practitioners, and employees. While some individuals may support the use of AA policies as a means of increasing representation of women, others are not supportive at all, further understanding gender AA as an unacceptable violation of merit—even when targeted by it. With the aim of analyzing how scholars have approached the subject, we systematically reviewed 76 published articles (SCOPUS database), covering the extant literature on gender AA and management. Findings indicate a consensus regarding the common antecedents of attitudes towards gender AA with prior experiences with AA and diversity management (DM) (as well as general perceptions of AA). Performance and satisfaction appear as the predominant outcomes. In addition, while investigating the differences among AA, equal employment opportunity (EEO) and diversity management (DM), scholars are mainly focused on the effectiveness of AA as a means of increasing the inclusion of minorities in general. We conclude that despite marginal studies on employees’ attitudes toward gender AA, there is a gap in the literature, particularly an absence of research on the bivalent position of meritocracy (or merit violation) as both an antecedent and outcome of attitudes towards AA, which deserves further scrutiny.

The title of this talk is really just a different phrasing from one I have used at several IAU meetings on the subject of numbers and kinds of variables in globular clusters. To furnish this material, I have finished the Third Catalogue of Variables in Globular Clusters. Since many of you are coming to this Colloquium with new information, the Catalogue is in draft form with a request that corrections and additions be given me by October 2, after which the draft will go to the printer.The First Catalogue of Variables in Globular Clusters was published at this observatory in 1939 and the Second Catalogue in 1955. In 1966 appeared the excellent Catalogue of Variables South of Declination—29° by Fourcade, Laborde and Albarracin, with splendid large prints of identification charts.
