FORMATION OF TEENAGERS’ LEGAL CULTURE: ESSENCE AND IMPACT FACTORS

We give the definition of the essence of the formation of teenager’s legal culture, which is understood as a purposeful, specially organized, managed social and pedagogical process that provides the assimilation of legal knowledge by teenagers, the manifestation of the legal position in socially useful activities. We also consider the impact factors of formation of legal culture of a modern teenager in society. The leading factors affecting teenager’s legal culture include a single national policy in the field of legal culture (“Fundamentals of State Policy of the Russian Federation in the Field of Legal Literacy and Legal Awareness of Citizens”), the organization of space for the participation of teenagers in socially significant activities and for the implementation of legal education (for example, the program “Do not Stumble!”), socializing the potential of the family in the process of legal education, the impact on the legal culture of the teenager media, first of all, Internet (methodical recommendations about placement on information stands, official Internet sites and other information resources of the educational organizations and bodies exercising management in the sphere of education, information on safe behavior and use of the Internet), legal education of teenagers in educational institution, attraction of the new subjects influencing formation of legal culture (interdepartmental interaction) (it is considered on the example of activity of the Children’s rights ombudsman and legal clinics), influence of features of teenage age.

Abstract Due to the vast ocean area and limited human and material resources, hydrographic survey must be carried out in a selective and well-planned way. Therefore, scientific planning of hydrographic surveys to ensure the effectiveness of navigational charts has become an urgent issue to be addressed by the hydrographic office of each coastal state. In this study, a reasonable calculation model of hydrographic survey cycle is established, which can be used to make the plan of navigational chart updating. The paper takes 493 navigational charts of Chinese coastal ports and fairways as the research object, analyses the fundamental factors affecting the hydrographic survey cycle and gives them weights, proposes to use the BP neural network to construct the relationship between the cycle and the impact factors, and finally establishes a calculation model of the hydrographic survey cycle. It has been verified that the calculation cycle of the model is effective, and it can provide reference for hydrographic survey planning and chart updating, as well as suggestions for navigation safety.

Актуальность статьи связана с поиском новых способов и методов повышения эффективности борьбы с преступностью, оперативного раскрытия преступлений, а также с набирающим популярность среди криминалистов направлением «криминалистического мышления», овладение навыками которого будет способствовать наиболее полноценному и объективному расследованию уголовных дел. Проблемным в настоящее время является недостаточное качество следствия и необходимость повышения когнитивных способностей следователей (дознавателей). Задачей исследования являлось выявление факторов, влияющих на развитие и формирование криминалистического мышления следователей. Цель работы - провести анализ составных частей процесса становления следователя и особенностей его практической деятельности, влияющих на когнитивные способности с точки зрения криминалистики, путем изучения и сравнения имеющихся материалов по данной тематике. Анализу подвергнуты личностные качества следователя, особенности образовательного процесса и влияние опыта на результаты работы, а также факторы, сопутствующие следственной деятельности (организация труда, уровень стресса, нагрузки и т. д.). Результат проведенного исследования выражен в определении проблемных факторов, влияющих на формирование криминалистического мышления следователя (дознавателя) и возможных путей их преодоления, важности такого мышления, которое остается знанием, постоянно сориентированным в сторону практики. The relevance of the article is related to the search for new ways and methods to improve the effectiveness of the fight against crime, the prompt detection of crimes, as well as the trend of «forensic thinking», which is gaining popularity among criminalists, mastering the skills of which will contribute to the most complete and objective investigation of criminal cases. Problems at present are insufficient quality of investigation and the need to improve the cognitive abilities of investigators (inquirers). The task of the study was to identify factors that influence the development and formation of forensic thinking of investigators. The purpose of the work is- to analyze the components of the process of formation of an investigator and features of his practical activities affecting the cognitive abilities in terms of forensics by studying and comparing existing materials on this topic. The analysis is subjected to the personal qualities of an investigator, the peculiarities of the educational process and the impact of experience on the results of work, as well as factors associated with the investigative activity (organization of work, stress and stress levels, etc.). The result of the study is expressed in the definition of problematic factors affecting the formation of forensic thinking of an investigator (inquirer) and possible ways to overcome them, the importance of such thinking, which remains knowledge, constantly oriented towards practice

Purpose The operation safety of the high-speed railway has been widely concerned. Due to the joint influence of the environment, equipment, personnel and other factors, accidents are inevitable in the operation process. However, few studies focused on identifying contributing factors affecting the severity of high-speed railway accidents because of the difficulty in obtaining field data. This study aims to investigate the impact factors affecting the severity of the general high-speed railway. Design/methodology/approach A total of 14 potential factors were examined from 475 data. The severity level is categorized into four levels by delay time and the number of subsequent trains that are affected by the accident. The partial proportional odds model was constructed to relax the constraint of the parallel line assumption. Findings The results show that 10 factors are found to significantly affect accident severity. Moreover, the factors including automation train protection (ATP) system fault, platform screen door and train door fault, traction converter fault and railway clearance intrusion by objects have an effect on reducing the severity level. On the contrary, the accidents caused by objects hanging on the catenary, pantograph fault, passenger misconducting or sudden illness, personnel intrusion of railway clearance, driving on heavy rain or snow and train collision against objects tend to be more severe. Originality/value The research results are very useful for mitigating the consequences of high-speed rail accidents.

The paper attempts to conduct a comprehensive study of legal education as a legal category. Modern scientific approaches to the definition of the concept of legal education are considered, a distinction is made and the relationship between the legal phenomenon under study and related legal categories is determined. The author comes to the unequivocal conclusion that legal education as a legal category has an independent legal significance. Based on the analysis of modern scientific legal literature and current legislation, the author identifies features of legal education that clarify and supplement the existing concepts. Today, legal education is an independent direction of state policy. The measures implemented in the system of legal education act as a kind of tool for the formation of a legal culture and stimulate the active lawful behavior of individuals. The purpose of legal education is to ensure the full legal socialization of a person, and the final expected result is the formation of a high legal culture of society.

The broad objective of this study is to evaluate the vulnerabilities of an organization's information technology infrastructure, which include hardware and software systems, transmission media, local area networks, wide area networks, enterprise networks, intranets, and its use of the internet to cyber intrusions. To achieve this objective, the chapter explains the importance of social engineering in network intrusions and cyber-theft and the reasons for the rapid expansion of cybercrime. The chapter also includes a complete description and definition of social engineering, the role it plays in network intrusion and cyber identity theft, a discussion of the reasons for the rise in cybercrimes, and their impact on organizations. In closing the authors recommend some preventive measures and possible solutions to the threats and vulnerabilities of social engineering. The chapter concludes that while technology has a role to play in reducing the impact of social engineering attacks, the vulnerability resides with human behavior, human impulses, and psychological predispositions.

Context: Insomnia is prevalent among elderly individuals and has become a public health problem receiving increasing concern. Low sleep quality is related to a number of negative health outcomes. Objective: This research aims to investigate the sleep status of community-dwelling elderly individuals (aged 60 years or older) in Shanghai, China, to explore the impact factors affecting sleep quality. Methods: One street in Shanghai city was randomly selected, and 50% of the elderly residents were randomly selected as participants for a total number of 9,616 people. Investigations were conducted by indoor surveys through home doctors and paper questionnaires. For statistical analysis, univariate and multivariate regression analysis and the Spearman correlation model were performed using SAS 9.4 to analyze the effects of the impact factors on the sleep quality of elderly individuals. Results: Sleep quality is greatly affected by physical pain in both the elderly individual and the individual’s spouse. Healthy elderly people tend to have better sleep quality, and the more chronic diseases an elderly individual suffers, the worse their sleep quality is. In addition, the physical pain of a cohabiting spouse is one of the most significant impact factors influencing sleep quality. Conclusion: We suggest that community-dwelling elderly people maintain moderate outdoor activities and a healthy mental state, which will improve their sleep quality.

The article highlights the main destructive factors influencing the economic security of business, namely: risks, threats and dangers, the impact of which leads to undesirable changes in the structure, functions, parameters and effectiveness of business. In the context of scientific research on the nature and relationship of the concepts of «risk», «danger», «threat», as well as their impact on business, the work of both foreign and domestic scientists. The analysis of modern economic scientific literature made it possible to explore the theoretical and methodological approaches of both domestic and foreign scientists in the interpretation of these economic categories. In turn, this allowed us to summarize and present the most common of the existing approaches to defining the categories of «threat», «risk» and «danger» using a table. According to this study, a significant variety of approaches to these economic categories was identified, which led to an imbalance among scientific views and made it difficult to establish a single link between them. In addition, groups of scientists have been singled out, where some researchers identify the concepts of «risk», «threat» and «danger», while others distinguish them and see each other's sources of origin. Given the analysis of the essence of the definition of «risk», «threat» and «danger», we present our own author's approaches to their interpretations, established the distinctions and relationships between them. The vision of interaction of categories «risk», «threat» and «danger» is resulted by means of the scheme-drawing. The importance of a clear understanding of the nature and delimitation of each of the destructive factors, which is necessary for the implementation of research methodology of economic security of business, which allows to determine their scale and assess the impact on economic security. Thus, the identification and neutralization of potential and real risks, threats and dangers that negatively affect the state and effectiveness of entrepreneurial activity, necessitate new requirements to strengthen the economic security of entrepreneurial activity, and its level will determine the ability to resist destructive factors in the long run. Thus, in turn, the results of the research provide an opportunity to prepare a basis for further research related to the definition of methods and areas of prevention and neutralization of destructive factors affecting the economic security of business.

The COVID-19 pandemic has disrupted health care delivery globally. Patients on in-centre haemodialysis(HD) are particularly affected due to their multiple hospital visits and the need for uninterrupted care for their well-being and survival. We studied the impact of the pandemic and the national policy for pandemic control on the HD care delivery in Karnataka state in India in April 2020, when the first and second national lockdown were in place. An online, questionnaire based survey of dialysis facilities was conducted and the responses analysed. The questions were pertaining to the key areas such as changes in number of dialysis treatments, frequency, duration, expenses, transportation to and from dialysis units, impact on availability of consumables, effect on dialysis personnel and on machine maintenance. 62 centres participated. Median of dialysis treatments for the months of March and April 2020 were 695.5 and 650 respectively. Reduction in dialysis treatments was noted in 29(46.8%) facilities , decreased frequency reported by 60 centres. In at least 35(56.5%) centres, dialysis patients had to bear increased expenses. Cost and availability of dialysis consumables were affected in 40(64.5%) and 55(88.7%) centres respectively. Problems with transportation and movement restriction were the two key factors affecting both patients and dialysis facilities.This survey documents the collateral impact of COVID -19 on the vulnerable group of patients on HD, even when not affected by COVID. It identifies the key areas of challenges faced by the patients and the facilities and implores the care-providers for finding newer avenues for mitigation of the problems. The paper reports the results of the strengthening simulation process. A new kinematics of deforming rollers ensuring a surface plastic deformation of shafts of low rigidity was considered. On the basis of the theory of low elasto-plastic deforma-tions and a method of finite elements there were formed simulators of a strengthening process allowing the definition of a stressed state in a sample depending on the form and kinematics of an indenter. With the aid of ANSYSWB software there was considered the impact of some circuits of deformation upon a stressed state: running-in by rolling, running-in by slip, running-in by one and two rollers with the rotation with regard to a diametrical axis. On the basis of simulation results it was revealed that the basic factors affecting a stress-strain state of parts are geometry, a form, a mutual location of elements of a tool deformed and their kinematics with regard to a part worked.

This paper discusses the factors affecting GDP growth. By processing the data related to GDP, this paper uses AHP method, BP neural network, SVR method and economic policy correction model to quantitatively analyze the impact of different candidate countries on the U.S. economy and China’s economy. Combined with political, economic, social, environmental and other factors, referring to the national policy, the index system is obtained. The judgment matrix is constructed by AHP, and the more important one is extracted as the main index. Then the evaluation is carried out by using neural network. Firstly, the index is combined with the existing GDP standard system, and then network training and simulation are carried out. After substituting the data, we get and analyze the interaction between the indicators of each factor, and determine the positive correlation and negative correlation between the factors in the schematic diagram. As for the influence of policy factors, GDP is indirectly affected through tangible influence.
