ABSTRAKArtikel ini memaparkan gagasan baru tentang teknologi informasi urun dana ekuitas (equity crowdfunding), berdasarkan Undang-Undang Pasar Modal dan peraturan otoritas jasa keuangan. Metode penelitian menggunakan metode pendekatan undang-undang  termasuk yang berasal dari aturan yang berkaitan dengan topik dan pendekatan konseptual yaitu pendapat hukum dari para ahli yang diambil dari jurnal, buku, dan sumber terverifikasi lainnya yang terkait dengan topik tersebut). Hasil penelitian menyimpulkan bahwa equity crowdfunding merupakan sistem baru yang penting dalam dunia bisnis oleh karena itu diperlukan payung hukum yang memadai untuk melindungi komunitas pengguna layanan. Meski sudah ada beberapa regulasi hukum terkait urun dana ekuitas, namun belum cukup menjelaskan keterkaitannya dengan pasar modal. Sehingga, aturan hukum teknologi baru informasi harus dijelaskan sedemikian rupa agar tidak menimbulkan kebingungan di kemudian hari dan dapat digunakan untuk perlindungan masyarakat. Kata Kunci: Pasar Modal, Teknologi Keuangan, Urun Dana Ekuitas ABSTRACT This article presents a new idea of equity crowdfunding information technology, based on the Capital Market Law and financial services authority regulations. The research method uses the statutory approach method including those derived from rules related to the topic and conceptual approaches, namely legal opinions from experts drawn from journals, books and other verified sources related to the topic). The results of the study conclude that equity crowdfunding is an important new system in the business world. Therefore, an adequate legal umbrella is needed to protect the community of service users. Although there are several legal regulations related to equity crowdfunding, they do not adequately explain its relationship to the capital market. Thus, the new information technology law rules must be explained in such a way so as not to cause confusion in the future and can be used for public protection. Keywords: Capital Market, Financial Technology, Equity Crowdfunding

<p class="JudulAbstrakIndonesia"><em>This objective of this research is to examine conflicts of interest for legal consultants in capital market crime. The method used in this study is normative juridical analysis with a library approach and using secondary data. The role of legal consultants is very important in the capital market, this is because legal consultants are required to provide legal opinions regarding a company. So, because it has an important role, a legal consultant needs to know the duties and obligations. Beside that, the information from legal opinions will be used by investors in deciding whether to invest their capital or not, because information in the capital market is a factor that causes the fluctuations in the price of securities or shares on the price of securities or shares. Therefore, in each assignment of a legal consultant, it is expected that legal consultants can act independently and impartially and in accordance with the code of ethics, professional standards and applicable regulations. Sanctions will be given to legal consultants who act independently and do not fulfill the code of ethics, professional standards and applicable regulations. The application of sanctions is also related to the role of the Financial Services Authority.</em></p>

The main issue discussed here, using a juridical normative method, regards the legal validity and implementation of, and legal protection given to investors, found in the Financial Services Authority Regulation No. 41/POJK.04/2020 re. Electronic Public Offering of Equity, Debt Securities and/or Syaria’ Undivided Share. Important to note is the fact that the Financial Services Authority is established by virtue of Law No. 21 of 2011 to replace and take over the functions of the Capital Market and Financial Institution Supervisory Agency and the Central Bank in regulating and supervising Indonesian Banks and Capital Markets and lastly protect consumers in the financial services industry.  Here should also mentioned the fact that the Capital Market Law (No. 8/1995) and its implementing regulations has yet to respond to how advances in information technology can be utilized to regulate-control and supervise public offering of shares or equity in the Capital Market.

The readiness of the community in the era of information technology has opened up opportunities in online businesses such as equity crowdfunding, equity crowdfunding as an alternative capital is increasingly in demand, especially by novice businesses. The Financial Services Authority issues regulations regarding the Equity Crowdfunding transaction model by issuing the Financial Services Authority Regulation Number 37 / POJK.04 / 2018. This provides questions for the regulation of Equity Crowdfunding in Indonesian Capital Market Law. The writer in this study would like to examine and analyze the Equity Crowdfunding activities and legal protection for investors, because legal protection is a form of legal certainty. The research method used is a normative juridical types, the problem approach uses the legislation approach and the conceptual approach. The results show that equity crowd funding is a form of new innovation in funding sources. The service mechanism has many similarities with public offering activities in the capital market, only the implementation is simpler. Equity Crowdfunding legal protection for investors who have been registered in the provisions of Chapter 54 paragraph (2) POJK Number 37 / POJK.04 / 2018, providing the latest information is only placed on the organizer's website or website.

This journal aims to find out how to apply the precautionary principle of a bank as a custodian bank in Indonesian capital market. Whereas with the enactment of Law Number 1995 concerning the Capital Market, it is deemed necessary to enact a Bapepam Decision regarding the Custodian Bank's Report. In the context of carrying out Indonesia's economic development, of course the challenges are not insignificant for financial institutions, one of which is in banking institutions. The role of banking institutions that carry out the main task as a vehicle that can collect and distribute funds effectively and efficiently, requires continuous improvement in order to be able to have a comparative advantage. This journal is how about the application of the precautionary principle in the capital market in Indonesia. Custodian Bank is a commercial bank that has obtained the approval of the Financial Services Authority (OJK) to carry out business activities as a custodian. The object of legal research is legal norms, which have the aim of examining whether or not a regulation is appropriated and applied.

Digital technology is able to give a new face to the development of the capital market industry in Indonesia. Licensing process, wider reach and ease in transactions (financial technology) become faster, more efficient, cheaper, and transparent. However, the development of digital or scripless systems is still constrained by various factors. The purpose of this study is to try to dig deeper into the basic concepts of digital planning for issuers in the list of Islamic securities. A development model based on the results of the literature review is expected to contribute to the acceleration of digital technology in the capital market. The results of the study suggest that it is important for digital planning so that organizations have planning standards with special characteristics to create a 'positioning' that is in accordance with Islamic principles. The novelty in this research is that social cognitive theory and technology adoption can also be applied to sharia-based digital planners in the capital market. Sharia-based digital technology will have a positive impact on the empowerment of issuers, prospective issuers, and investors in the list of sharia securities.

AbstractInvestors who want to invest in the capital market in Indonesia, which include securities in the form of shares, need to have a good knowledge of investment objects because basically all investments contain risk and there is no guarantee of getting profits. Investor protection fund operators have the main goal of forming investor protection funds to increase protection and trust that investors’ assets are safe without being worried about the inability of securities companies to fulfill their obligations. The capital market can fail due to loss of investor distrust caused by the failure or bankruptcy of securities companies, resulting in a systemic effect that can reduce the reliability of the capital market industry. Through the organizer of the protection fund investors will provide compensation claims to investors who are victims of violations and securities crimes, not from loss of personal transactions. Penyelenggara dana perlindungan pemodal mempunyai tujuan utama membentuk dana perlindungan pemodal untuk meningkatkan perlindungan dan kepercayaan bahwa aset investor aman tanpa dihinggapi rasa khawatir atas ketidakmampuan perusahaan efek dalam memenuhi kewajibannya. Pasar modal dapat mengalami kegagalan akibat hilangnya ketidakpercayaan pemodal yang disebabkan kegagalan atau kebangkrutan perusahaan efek, sehingga menimbulkan efek sistemik yang dapat menjatuhkan kridibilitas industri pasar modal. Melalui penyelenggara dana perlindungan pemodal akan memberikan klaim ganti rugi kepada investor yang menjadi korban dari pelanggaran dan kejahatan sekuritas, bukan dari kerugian transaksi pribadi. Abstract: Legal Protection for Investors in the Capital Market. Supervision in the financial services industry capital markets experienced a change of control by Bapepam-LK be supervised by the Financial Services Authority. Institutionally, Bapepam-LK is responsible to the Minister of Finance, as Bapepam-LK is under the auspices of the Ministry of Finance, while the Financial Services Authority is responsible to Parliament or the public. Crucial aspect on which the formation of the FSA is not maximum protection of the interests of consumers of financial services. In accordance with the problems that occur as above, the authors feel the need to examine the legal protection in the capital market. This writing will also examine the parties are entitled to legal protection based on Law No. 8 of 1995 and the Capital Market Law No. 21 of 2011 on the Financial Services Authority. Abstrak: Perlindungan Hukum Bagi Investor Dalam Pasar Modal. Pengawasan di bidang industri jasa keuangan pasar modal mengalami perubahan dari pengawasan yang dilakukan oleh Bapepam-LK menjadi diawasi oleh Otoritas Jasa Keuangan. Secara kelembagaan, Bapepam-LK bertanggung jawab kepada Menteri Keuangan, karena Bapepam-LK berada di bawah naungan Kementrian Keuangan, sedangkan Otoritas Jasa Keuangan bertanggung jawab kepada Dewan Perwakilan Rakyat atau masyarakat. Aspek krusial yang menjadi dasar pembentukan OJK adalah tidak maksimalnya perlindungan kepentingan konsumen jasa keuangan. Sesuai dengan permasalahan yang terjadi seperti diatas, maka penulis merasa perlu untuk meneliti tentang perlindungan hukum di pasar modal. Penulisan ini juga akan meneliti para pihak yang berhak atas perlindungan hukum berdasarkan pada Undang-Undang Nomor 8 Tahun 1995 Tentang Pasar Modal dan Undang-Undang Nomor 21 Tahun 2011 Tentang Otoritas Jasa Keuangan. Abstract –In the business world, a website in the form of e-commerce is a necessity of a business to develop a business because it has various benefits. E-commerce has huge benefits for businesses, among others consumers do not need to come to the seller's shop to choose the items they want to buy, and in terms of financial consumers can save costs incurred, if thestore location is far away, consumers can save on travel costs by replacing shipping costs that are much cheaper and useful for users, it can be seen that the application of new information technology can be accepted by users. The purpose of this study isto describe the current sales system, identify existing problems and implement e-commerce in order to provide solutions to the problems encountered. Data collection techniques in this research is through the process of interviews with sources, direct observation of several existing processes, and literature studies on the Implementation of E-Commerce. The results of this study are implementing the E-Commerce System by using an open source program called Prestashop. By using Prestashop the sales system can run well where the batik weaving businesses do not need to use promotional media in the form of distributing brochures and banners that require a lot of money. By implementing E-Commerce using the prestashop program the system will run more effectively andefficiently.

Financial Technology is the implementation and utilization of technology to improve banking and financial services which are generally carried out by startup companies by utilizing the latest software, internet, communication and computing technologies.The research conducted was juridical empirical and normative juridical research, namely field research with interviews as a basis for problem solving and analyzing statutory regulations. The data used are primary and secondary data, then the data collection methods used in this study are library research and field research. The data analysis used is a qualitative method.The results show that the legal protection of users of the Financial Technology (Financial Technology) service of borrowing and borrowing money based on information technology (Peer to Peer Lending) has been carried out by the Financial Services Authority (OJK) and its staff by means of supervision, examination and investigation based on the Financial Services Authority Regulation No. 77 / POJK.01 / 2016 concerning Information Technology-Based Lending and Borrowing Services.The conclusion is that the legal protection of users of the Financial Technology (Financial Technology) service of lending and borrowing money based on information technology (Peer to Peer Lending) can be realized in a preventive and repressive manner. Basically, the Operator does not have direct legal consequences that make risk transfer to the Operator. Keywords: Financial Technology, Peer to Peer Lending, Legal Protection for Users / Consumers.

This study investigates the capital market response to Financial Accounting Standards Board (FASB) policy deliberations on foreign currency translations (FCT) by concentrating on five specific events associated with such deliberations. Examining the possible effects of these events, we argue that a market response to FASB policy deliberations on FCT could result from the effects of new information or from the effects of expected changes in managerial decisions. The tests utilized in this paper are designed to detect effects of both types. Generally, no apparent significant market reaction to three of the five events was observed. We found an apparent weak but significant reaction to one event and inconclusive results for a fifth.
