Religious court as forefront in economic sharia dispute resolution in litigation has not ideal place to perform their duty since there are still regulation conflicts such as implementation of encumbrance right execution which still becomes a domain in district court. As explained, this article discusses phi-losophical foundation of Religious Court competence to resolve economic sharia issues. In regard to this, conceptual approach, law approach and historical approach are respectively used. Based on the analysis, basic competence of religious court is Islamic personality principle which carries the use of Islamic law elements (sharia principle) in its legal relationship. From the analysis the implication is drawn that as long as a dispute belongs to economic sharia, then it is Religious Court which is com-petent to handle including court decision.Keywords: law enforcement, economic sharia dispute, absolute competence, court decision implementation

This research aims to determine the legal implications of the agreement on which the sharia banking dispute resolution clause was submitted through the state court's post-decision of the Constitutional Court No. 93/PUU-X/2012. The research method used normative research with a statute approach and a conceptual approach and analyzed descriptive qualitative. The results of the study show that the contract that contains the clause for the settlement of Islamic banking disputes through the District Court after the Constitutional Court decision has the implication of being null and void because it contradicts the contract or causa that is lawful, so that the parties make an addendum so that no future disputes occur.

<p align="center"><strong><em>Abstract</em></strong></p><p><em>The purpose of this reseach is to describe the reality of peace at investigation levels,  then compared to islah according to Islamic law as the reason of criminal removing, to find / to know the relevance. Based on the relevance, it possible become material for the legislators to formulate islah as a model of law enforcement at the level of investigation. This research is the normative research supported by empirical research. The data used was primary and secondary data. Data was collected by means of study documentation and interviews. Data were analyzed quatitatively dan and presented quatitatively. The research showed that the completion of criminal case based on the agreement between perpetrator and victim, along the case have not reached the judge. If the agreement is violated, they agreed to use the formal law. Criminal case which are resolved with peace/islah personalized and value of the loss is relatively small. Islam placing islah as an alternative the completion of criminal matters, along the case have not reached the judge. In the literature and practice, settling disputes with peace  known as Alternative Dispute Resolution (ADR), which is based on Restorative Justice Theory. Al Qur’an has set peace/islah as a model the completion of criminal matters, long before these theories arises.  Peace/ islah in the completion of a criminal case at the level of investigation relevant to satisfy the principle of fast, simple, and inexpensive.</em></p><p><strong><em>Keyword : </em></strong><em>Islah, Islamic Law, Relevance and Investigation</em></p><p align="center"><strong>Abstrak</strong></p><p>Tujuan penelitian ini adalah mendeskripsikan realitas perdamaian pada tingkat penyidikan, selanjutnya akan dibandingkan dengan islah menurut hukum Islam sebagai alasan penghapus pidana, untuk diketahui/ ditemukan relevansinya. Berdasarkan relevansi tersebut, dimungkinkan menjadi bahan bagi pembentuk undang-undang  untuk menformulasikan islah sebagai model penegakan hukum pidana pada  tingkat penyidikan. Penelitian ini merupakan penelitian normatif  yang didukung dengan penelitian  empiris. Data yang digunakan mencakup data primer dan data sekunder. Teknik pengumpulan data  dilakukan dengan cara studi dokumentasi dan wawancara. Data dianalisis secara kualitatif dan disajikan secara deskriptif. Hasil penelitian menunjukan penyelesaian perkara pidana dengan perdamaian pada tingkat penyidikan mendasarkan kesepakatan pelaku dan korban. Apabila kesepakatan itu dilanggar, mereka sepakat untuk menggunakan hukum formal. Perkara pidana yang diselesaikan dengan perdamaian/ islah, bersifat personal dan nilai kerugiannya relatif kecil. Islam menempatkan perdamaian/islah sebagai alternatif penyelesaian perkara pidana, sepanjang perkara tersebut belum sampai ke tangan hakim. Dalam literatur dan praktik,  penyelesaian perkara dengan perdamaian disebut <em>Alternative Disput Resolution </em>(ADR) yang mendasarkan pada teori <em>Restorative Justice. Al-Qur’an </em>telah menetapkan Perdamaian/ Islam sebagai model penyelesaian perkara pidana, jauh sebelum teori-teori itu muncul<em>. Perdamaian/ Islah  </em>dalam penyelesaian perkara pidana ditingkat penyidikan, relevan untuk pemenuhan asas cepat, sederhana dan biaya ringan.</p><p><strong>Kata Kunci: </strong>Islah, Hukum Islam, Relevansi dan Penyidikan</p>

The concept of omission or culpa from the legal aspect is very different from the concept of omission or culpa that is understood everyday. Many events include omission or culpa but the incident may not be a criminal act. Thus, law enforcement must be careful in giving meaning to a legal act related to omission. Court Decision Number 18 / Pid.B / 2017 / PN.TOb. is a decision which is the object of research in this paper, in which the author disagrees about the concept of omission or culpa which is considered by the Tobelo District Court judge in that decision, although I agrees that the defendant's actions were omission. The analysis used is legal analysis using a statute approach and case approach so that it can find out the basis of the court's consideration of choosing Pasal 359 KUHP dropped against the defendant Imsal Ilahi Baksi. In its consideration, it was found that Tobelo District Court judges interpreted omission as " not careful " or " lack of attention" so that the defendant was proven legally and convincingly committed a crime of omission. Meanwhile, in the criminal law doctrine, many concepts of omission or culpa are not always interpreted as "not careful" or "lack of attention" such as omission in the sense of onbewuste schuld. Because of the fact, in this case the defendant was careful and gave attention by notifying his actions (installing electricity), but only did not imagine the possibility of consequences

ABSTRAKPutusan Pengadilan Negeri Bekasi Nomor 95/PDT.G/2008/PN.BKS menolak dan menghukum gugatan penggugat untuk membayar biaya perkara, dan memutuskan bahwa harta pewaris seluruhnya menjadi hak anak luar kawin tidak diakui karena hibah dari pewaris. Dari sisi penegakan hukum positif, hakim mendasarkan putusan hanya pada pembuktian tanpa menelusuri realitas dari akta hibah tersebut yang cacat hukum. Kajian penelitian putusan ini menggunakan teori hukum progresif dalam upaya mencari keadilan, dengan mengkaji permasalahan, serta bagaimana penyelesaian konflik pewarisan akibat hibah berdasarkan hukum progresif. Penelitian ini adalah penelitian socio-legal dengan pendekatan induktif yang berparadigma post-positivisme. Penelitian ini dilakukan secara kualitatif dengan mengutamakan kedalaman data dengan narasumber yang berkompeten di bidangnya. Dari penelitian ini, realita bahwa anak luar kawin tidak diakui dapat menguasai seluruh harta pewaris dengan hanya berdasarkan pada akta keterangan hibah, mestinya tidak terjadi. Hal ini menunjukkan betapa lemahnya peradilan yang hanya menggunakan hukum formalisme semata, sebagai puncak kepastian hukumnya, sehingga tujuan manfaat dan keadilan belum terpenuhi. Pola hukum progresif berfondasi pada progresivitas manusia, bahwa manusia sebenarnya baik, penuh kasih sayang, saling tolong menolong, dan empati kepada sesama manusia. Berhukum yang benar adalah berhukum yang bertujuan demi tercapainya keadilan masyarakat.Kata kunci: hibah, harta warisan, anak luar kawin tidak diakui, hukum progresif. ABSTRACTBekasi District Court Decision Number 95/PDT.G/2008/ PN.BKS objected the claim and give sanction to the plaintiff to pay court costs, and decided that all the assets of the testator became solely the possession or title of the child out of wedlock of no recognition owing to the grant of the testator. In terms of positive law enforcement, the judges based the ruling solely on proving without probing the legitimacy of the legally flawed grant deed. This analysis employed the theory of progressive laws in an effort to seek justice by studying the problems as well as the conflict settlement of the case of grant-based heir derived from progressive law. This is a socio-legal research study using inductive approach through the perspective of post-positivism. Qualitative research was conducted primarily by collecting references from the experts in the relevant field. From this research, it can be inferred that the granting of ownership to the entire inheritance to the child out of wedlock of no recognition based solely upon a Grant Deed should not have occurred. This indicates just how weak the judiciary is, barely imposing a mere formal law as the culmination of its legal certainty resulting in the unfulfilled objectives of law, those of the benefit and equity. The pattern of progressive law is based on the progression of humans that human beings are actually good, compassionate, mutually helpful to each other, and empathetic for their fellow human beings. Indeed the true law is aimed at achieving social justice.Keywords: grant, inheritance, child out of wedlock of no recognition, progressive law.

The Indonesian Ulema Council (MUI) has an important role in answering the increasingly complex problems of Muslims through fatwas. However, in the Indonesian legal system, fatwas are not considered a source of material law that has legal validity as a solution to the problems of Muslims in Indonesia. Therefore, this study aims to describe the position of fatwas in the legal system in Indonesia and the existence of the fatwas of the Indonesian Ulema Council in addressing the problems of the ummah. This research is a normative legal research using three types of approaches consisting of a statutory approach, a historical approach, and a conceptual approach. The results of this study concluded that: firstly, the position of fatwas in the construction of Islamic law has a high position. Fatwas are seen as a solution that can break the ice in legal development that is not accommodated by the texts of the Quran. So, substantively and sociologically, fatwas have a strong and binding position in Islamic law. Secondly, the existence of the fatwa of the Indonesian Ulema Council in responding to the problems of the Ummah can be seen in two aspects. The first aspect, fatwas in the perspective of Islamic legal authority are binding sociologically in substance. This is because fatwas are explanations and interpreters of the texts of the Quran regarding Islamic law. The second aspect, fatwas from the perspective of the hierarchy of laws and regulations, legally and formally, do not have any position in the ranking of legal norms. However, it is constitutionally guaranteed through Article 29 of the 1945 Constitution that guarantees the realization of the fulfillment of all Islamic law for Muslims in Indonesia.

The banking sector as one of the drivers of the national economy plays an important role in funding a business through bank credit distributing activities. In practice, this banking service raises legal problems, not only banking crimes but also corruption. Supreme Court Decision No. 1812 K / PID.SUS / 2014 on behalf of the Defendant Dian Siswanto, S.E. MM., in the case of a corruption shows this. This paper examines the element of unlawful and abuse of authority in cases of corruption in the banking sector. The research method used is normative law which is prescriptive with a statute approach, a conceptual approach, and a case approach. The results show 2 (two) things, first, that the defendant's actions met the unlawful element in the act of corruption as charged in the primary indictment. Second, the judge had wrongly in the application of law based on the subsidiary indictment concerning abuse of authority which was not fulfilled. The judge in this case, was not punctilious in digging up legal facts and was not correct in applying the law. Therefore, in the case of deciding a case, if the charges are of subsidiarity, the judge should prove the primary indictment carefully before deciding based on the subsidiary indictment to create justice, benefit and legal certainty in law enforcement in general, and especially for the accused.

Dari sudut pandang syariah, pasar modal adalah produk muamalah. Transaksi dalam pasar modal diperbolehkan sepanjang tidak terdapat transaksi yang bertentangan dengan ketentuan yang telah digariskan oleh syariah. Perkembangan pasar modal syariah di Indonesia yang sedemikian pesat, akan turut meningkatkan jumlah dan ragam potensi masalah hukum yang mungkin terjadi di pasar modal syariah. Setidaknya, diperlukan dua upaya hukum dalam penguatan kerangka hukum pasar modal syariah, yaitu pertama, upaya preventif yang dapat meminimalisir terjadinya masalah-masalah hukum, seperti perlunya pembentukan regulasi yang merujuk kepada syariah Islam agar tercipta kestabilan dan suasana kondusif bagi penegakan hukum di pasar modal syariah, Kedua, upaya penyelesaian sengketa pasar modal syariah dilakukan melalui dukungan terhadap pengadilan agama sebagai satu-satunya lembaga peradilan yang memiliki kewenangan absolut dalam menyelesaikan perkara perdata pasar modal syariah, perlunya peningkatan kompetensi hakim dan aparatur pengadilan agama serta perlunya pedoman, yurisprudensi dan referensi sebagai rujukan dalam penyelesaian sengketa pasar modal syariah di Indonesia. According to the sharia point of view, sharia capital market is muamalah product. Capital market transactions are allowed as long as it does conflict with the terms outlined by sharia. The rapid development of Indonesia sharia capital market results in the increasing number and variety of potential legal problems. It takes two legal efforts in strengthening the legal framework for sharia capital market. First, preventive measures to minimize the legal issues occurrence, such as the establishment of islamic law regulations in order to produce stability and good atmosphere of sharia capital market law enforcement. Second, efforts in sharia capital market mediation which is done through support the religious court as the only judicial institutions having the absolute authority in resolving sharia capital market civil cases. We need to increase the judges and religious courts officials competencies, make guidelines, jurisprudence and the references of sharia capital market dispute resolution in Indonesia.

This study aims to determine what forms of sexual violence against wives are based on Law no. 23 of 2004 and Islamic Law. To find out what forms of sexual violence against wives in the decision of the Bangil District Court No. 912/Pid/B/2011/PN.Bgl, Denpasar District Court Decision No.89/Pid.Sus/2014/PN.Dps and Medan District Court Decision No.264/Pid.Sus/2018/PN Mdn. To find out what were the basis for the judge's consideration in giving a decision at the Bangil District Court, the Denpasar District Court decision, and the Medan District Court decision regarding sexual violence against wives. Qualitative research was conducted with a revelatory approach, a statute approach, a case approach and a comparative approach. The results of this study indicate that: (1) forms of sexual violence against wives based on Law no. 23 of 2004 and Islamic Law is any act in the form of coercion of sexual relations, in an inappropriate and/or inappropriate manner, forcing sexual relations with other people for commercial purposes and/or for specific purposes. (2) the forms of sexual violence against wives in the decisions of the Bangil District Court, Denpasar District Court decisions and Medan. (3) The consideration of the Bangil District Court judge.

The unbalanced and unequal economic growth in society often creates social and social jealousy in the community. On the one hand, there is a group of people who have sufficient capacity economically, but on the other hand there is a group of people who have no economic capacity in their lives, so that the latter group is often a social problem that even commits the crime of theft, for example. The criminal act of theft according to the Criminal Code, there is an element of "burdensome" as regulated in Article 363 paragraph (1) of the 5th Criminal Code, namely: "It is punished with a maximum imprisonment of seven: Theft committed by a wrongdoer by entering the place. the crime or it can reach the goods to be taken, such as the example of the case presented by the author in this thesis research, namely the theft of a helmet which was committed by the defendant, preceded by the defendant entering the campus environment, the case of which was decided by the Sukabumi District Court with a decision Number: 17 / Pid. B / 2010 / PN. Skh. The formulation of the problem that will be discussed by the author are: 1) How is the application of material law to the perpetrator of the crime of theft with weighting? and 2) How is the law enforcement against the perpetrators of the crime of theft of a helmet with a weight as in Court Decision Number 17 / Pid.B / 2010 / PN. Skh? The research method that the author uses is the normative juridical method, meaning that the data used comes from library research, carried out by searching, quoting, taking notes, inventorying, analyzing, and studying data in the form of library materials needed and related to law enforcement against perpetrators. theft by weight. Finally, based on the results of the research, the authors conclude that law enforcement against the perpetrators of the crime of theft of a helmet with a weight as in Court Decision Number 17 / Pid.B / 2010 / PN. Skh, the defendant was threatened with article 363 paragraph (1) to 5 of the Criminal Code, so that the defendant Agus Hery Santoso Bin Diyono was found legally and convincingly guilty of committing a criminal act. for 2 (two) months and 15 (fifteen) days.
