The concept of omission or culpa from the legal aspect is very different from the concept of omission or culpa that is understood everyday. Many events include omission or culpa but the incident may not be a criminal act. Thus, law enforcement must be careful in giving meaning to a legal act related to omission. Court Decision Number 18 / Pid.B / 2017 / PN.TOb. is a decision which is the object of research in this paper, in which the author disagrees about the concept of omission or culpa which is considered by the Tobelo District Court judge in that decision, although I agrees that the defendant's actions were omission. The analysis used is legal analysis using a statute approach and case approach so that it can find out the basis of the court's consideration of choosing Pasal 359 KUHP dropped against the defendant Imsal Ilahi Baksi. In its consideration, it was found that Tobelo District Court judges interpreted omission as " not careful " or " lack of attention" so that the defendant was proven legally and convincingly committed a crime of omission. Meanwhile, in the criminal law doctrine, many concepts of omission or culpa are not always interpreted as "not careful" or "lack of attention" such as omission in the sense of onbewuste schuld. Because of the fact, in this case the defendant was careful and gave attention by notifying his actions (installing electricity), but only did not imagine the possibility of consequences

Religious court as forefront in economic sharia dispute resolution in litigation has not ideal place to perform their duty since there are still regulation conflicts such as implementation of encumbrance right execution which still becomes a domain in district court. As explained, this article discusses phi-losophical foundation of Religious Court competence to resolve economic sharia issues. In regard to this, conceptual approach, law approach and historical approach are respectively used. Based on the analysis, basic competence of religious court is Islamic personality principle which carries the use of Islamic law elements (sharia principle) in its legal relationship. From the analysis the implication is drawn that as long as a dispute belongs to economic sharia, then it is Religious Court which is com-petent to handle including court decision.Keywords: law enforcement, economic sharia dispute, absolute competence, court decision implementation

Penelitian bertujuan untuk menganalisis perlindungan hukum terhadap anak korban kekerasan seksual, dan menganalisis faktor yang mempengaruhi perlindungan hukum terhadap anak korban kekerasan seksual. Tipe penelitian ini adalah yuridis empiris. Hasil Penelitian bahwa; Perlindungan hukum terhadap anak yang menjadi korban kekerasan seksual dalam praktik penegakan hukum pidana oleh Kepolisian di Polewali Mandar adalah perlindungan dalam proses penyelidikan serta melalui upaya preventif/pencegahan dengan bekerja sama dengan Lembaga Swadaya Masyarakat (LSM) di Kabupaten Polewali. Sedangkan perlindungan hukum oleh Pengadilan Negeri Polewali adalah perlindungan dalam proses persidangan yang berupa korban anak tidak disumpah, hakim dalam memberikan pertanyaan sangat hati-hati dan tidak formal, serta adanya pendamping yang dipercaya oleh korban anak. Perlindungan hukum terhadap anak korban kekerasan seksual tidak berjalan secara efektif dikarenakan masih terdapat tindak kekerasan seksual anak yang pada kenyataannya saat ini masih banyak yang menimpa anak di Kabupaten Polewali Mandar. This study aims to analyze the legal protection of child victims of sexual violence, and to analyze the factors that influence the legal protection of child victims of sexual violence. ABSTRAK�Penelitian dengan judul Peranan Dan Fungsi Praperadilan Dalam Menegakkan Hukum Pidana di Polda Jateng. Berdasarkan uraian dalam Tesis ini, permasalahan yang akan yang akan di teliti adalah: 1) Bagaimanakah fungsi dan peran praperadilan dalam penegakan hukum di Indonesia berdasarkan peraturan perundang-undangan yang berlaku? 2) Apa hambatan dalam pelaksanaan fungsi dan peran pra peradilan dalam penegakan hukum di Polda Jateng? 3) Bagaimanakah solusi dari hambatan dalam pelaksanaan fungsi dan peran pra peradilan dalam penegakan hukum di Polda Jateng?Hasil penelitian menyimpulkan bahwa : 1) Maksud dan tujuan utama yang hendak ditegakkan dan dilindungi, dalam proses praperadilan yaitu tegaknya hukum dan perlindungan hak asasi tersangka dalam tingkat pemeriksaan penyidikan dan penuntutan. Pasal 1 butir 10 KUHAP dipertegas dalam Pasal 77 KUHAP yang menyebutkan Pengadilan Negeri berwenang untuk memeriksa dan memutus, sesuai dengan ketentuan yang diatur dalam undang-undang. Wewenang pengadilan untuk mengadili dalam praperadilan dijelaskan dalam Pasal 95 KUHAP. 2) Hambatan dalam pelaksanaan fungsi dan peran praperadilan dalam penegakan hukum di Polda Jateng meliputi : a. hakim lebih banyak memperhatikan perihal dipenuhi atau tidaknya syarat-syarat formil penangkapan dan penahanan, atau ada tidaknya perintah penahanan dan sama sekali tidak menguji dan menilai syarat materilnya. b. setiap pelaksanaan upaya paksa selalu ada perenggutan HAM. c. pemeriksaan untuk melakukan penahanan, masih ada penyalahgunaan dalam tahap penyidikan oleh Polisi dan penuntutan oleh jaksa. d. selain luasnya kewenangan penyidikan dalam menentukan bukti permulaan yang cukup, pengawasan terhadap kewenangan tersebut juga lemah. 3) Solusi dari hambatan dalam pelaksanaan fungsi dan peran praperadilan dalam penegakan hukum di Polda Jateng meliputi : ����������� a. Diperlukan upaya kontrol terhadap setiap aparat penegak hukum pada lembaganya masing-masing secara vertikal. b. KUHAP perlu direvisi khususnya mengenai mekanisme saling mengawasi antara penegak hukum dan lembaga dalam subsistem peradilan. c. diperlukan peran aktif hakim dalam menggunakan kewenangannya pada saat pemeriksaan pokok perkara untuk mempertimbangkan penyidikan atau penuntutan yang tidak sesuai dengan ketentuan hukum acara atau yang melawan hukum guna menghindari penyalahgunaan HAM. d. dalam tahap ajudikasi, hakim seharusnya berkonsentrasi untuk menentukan hasil pembuktian di persidangan dan dalam tahap ini, hakim dapat menilai apa yang terjadi dalam tahap praajudikasi.Kata Kunci : Peranan dan Fungsi, Praperadilan, Penegakan Hukum Pidana�ABSTRACT�Research with the title Role And Practice Function In Enforcing Criminal Law in Central Java Regional Police. Based on the description in this Thesis, the issues that will be examined are: 1) How is the function and role of pretrial in law enforcement in Indonesia based on the prevailing laws and regulations? 2) What are the obstacles in the implementation of pre-justice functions and roles in law enforcement in the Central Java Regional Police? 3) How is the solution of the obstacles in the implementation of functions and the role of pre-judiciary in law enforcement in Central Java Regional Police?The results of the study conclude that: 1) The main purpose and objectives to be upheld and protected, in the pre-trial process, namely the enforcement of the law and the protection of human rights of suspects in the level of investigation and prosecution investigation. Article 1 point 10 of the Criminal Procedure Code is affirmed in Article 77 of KUHAP stating that the District Court has the authority to examine and decide upon, in accordance with the provisions stipulated in law. The jurisdiction of the courts to adjudicate in pre-trial is described in Article 95 of the Criminal Procedure Code. 2) Obstacles in the implementation of functions and the role of pretrial in law enforcement in Central Java Police include: a. judges pay more attention to whether or not the formal conditions for arrest and detention, or whether there is a detention order and not test and judge material requirements at all. b. every execution of forced efforts is always a rush of human rights. c. checks for detention, there is still abuse in the investigation stage by the Police and prosecution by the prosecutor. d. besides the extent of investigative authority in determining sufficient preliminary evidence, the oversight of the authority is also weak. 3) Solutions from obstacles in the implementation of functions and pretrial roles in law enforcement in Central Java Police include: a. Control of each law enforcement apparatus is required on each institution vertically. b. The Criminal Procedure Code needs to be revised, especially regarding the mechanism of mutual supervision between law enforcement and institutions within the judicial system. c. an active role of the judge in the use of authority at the time of examination of the principal matter to consider investigations or prosecutions that are not in accordance with the provisions of procedural law or against the law in order to avoid abuse of human rights. d. in the stage of adjudication, the judge should concentrate on determining the results of the evidence in the hearing and in this stage the judge can judge what happened in the pre-certification stage.Keywords: Roles and Functions, Pretrial, Criminal Law Enforcement

Pre-requisites: legal discretion in criminal law just as in other branches has only partially been a subject matter of legal analysis. Predominantly, a law-enforcement type of discretion was studied, which is implemented by law-enforcement authorities during criminal prosecution. However, modern surveys in the field of law theory consider discretion as a general law phenomenon including law-enforcement, law-making, and law-interpretation aspects. This suggests the need to study legal discretion in criminal law from new points of view. Moreover, one should also take into account a dual-aspect nature of legal discretion, e.g., a combination of characteristics of the subject implementing discretion and law-regulated relations where this takes place. The research objective is to define an opportunity of affecting subjects implementing individual types of legal discretion (law-enforcement, law-making, and law-interpretation) intended for optimization of the discretion level in criminal law. Methods: a combination of common, general scientific, specific scientific, and specific legal methods. First of all, the paper uses a systemic and functional approach. Results. Legal discretion in legal law is represented by law-enforcement, law-making, and law-interpretation discretion of respective subjects. These types of discretion are interdependent and indissolubly related. Currently, an integrated approach to studying these types of discretions in legal law is poorly discussed in literature. Meanwhile, only this approach allows for a systematic study of legal discretion limits (in general and for individual types) and for adequate evaluation of their efficiency in criminal law.

ABSTRACT             PPAT Deed is an authentic deed in the case of certain legal actions, especially in the case of transfer of land rights from one party to another party. An authentic deed is a deed made by an authorized official for that, in the place where the deed was made and the format is in accordance with the provisions of the legislation in force. The authentic PPAT deed must be read in front of the parties, and signed by the witnesses and PPAT. The legal standing of witness in the PPAT authentic deed is as an instrument witness who witnessed and knew the making of the PPAT deed and also as evidence to strengthen the PPAT deed was made. If there is a legal problem with the PPAT deed, the instrumentair witness who signed the PPAT deed can be asked for information relating to the implementation of the PPAT deed, including information about the presence of the parties who signed the PPAT deed before the PPAT and the witnesses. The problem in this research is how the legal arrangement of witnesses in the PPAT deed, How is the legal effect on the PPAT deed whose signature was carried out in the presence of two witnesses and How is the legal analysis considered by the Panel of Judges in the Karanganyar District Court Decision No. 16 / Pdt.G / 2015 / PN.Krg.             This type of research is empirical juridical research, in which the approach to the problem is carried out by reviewing the implementation of PPAT obligations based on the applicable laws and regulations in this case are Articles 21 and 22, PP No. 24 of 2016 concerning amendments to PP No. 37 of 1998 concerning PPAT position regulations and this research was also supported by conducting direct interviews with 3 PPAT people whose working area was in Medan City.The results of the study stated that the legal arrangements regarding witnesses in the PPAT deed contained in Articles 21 and 22, PP No. 24 of 2016 concerning amendments to PP No. 37 of 1998 concerning PPAT position regulations, Article 18 paragraphs 3, 4 and 5 of the regulation of the State Minister for Agrarian Affairs / Head of the National Land Agency (BPN) Number 1 of 2006 concerning Provisions for Implementing Government Regulation Number 37 of 1998 concerning PPAT Position Regulations, Article 1895-1912 Civil Code in the description of the criteria for witnesses recognized in making the PPAT deed and Article 37 PP No. 24 of 1997 concerning land registration, the legal consequence of the PPAT deed which was signed before two witnesses was that the PPAT deed was degraded to a deed under the hand, because it contained a formal legal flaw and the legal analysis of the Judge Panel's consideration in the Karanganyar District Court Decision No. 16 / Pdt.G / 2015 / PN.Krg which states that the PPAT has committed acts against the law and the authentic deed has been degraded to a deed under the hand.Keywords: PPAT Law, PPAT Deed, and the Witness Position

ABSTRAKPutusan Pengadilan Negeri Bekasi Nomor 95/PDT.G/2008/PN.BKS menolak dan menghukum gugatan penggugat untuk membayar biaya perkara, dan memutuskan bahwa harta pewaris seluruhnya menjadi hak anak luar kawin tidak diakui karena hibah dari pewaris. Dari sisi penegakan hukum positif, hakim mendasarkan putusan hanya pada pembuktian tanpa menelusuri realitas dari akta hibah tersebut yang cacat hukum. Kajian penelitian putusan ini menggunakan teori hukum progresif dalam upaya mencari keadilan, dengan mengkaji permasalahan, serta bagaimana penyelesaian konflik pewarisan akibat hibah berdasarkan hukum progresif. Penelitian ini adalah penelitian socio-legal dengan pendekatan induktif yang berparadigma post-positivisme. Penelitian ini dilakukan secara kualitatif dengan mengutamakan kedalaman data dengan narasumber yang berkompeten di bidangnya. Dari penelitian ini, realita bahwa anak luar kawin tidak diakui dapat menguasai seluruh harta pewaris dengan hanya berdasarkan pada akta keterangan hibah, mestinya tidak terjadi. Hal ini menunjukkan betapa lemahnya peradilan yang hanya menggunakan hukum formalisme semata, sebagai puncak kepastian hukumnya, sehingga tujuan manfaat dan keadilan belum terpenuhi. Pola hukum progresif berfondasi pada progresivitas manusia, bahwa manusia sebenarnya baik, penuh kasih sayang, saling tolong menolong, dan empati kepada sesama manusia. Berhukum yang benar adalah berhukum yang bertujuan demi tercapainya keadilan masyarakat.Kata kunci: hibah, harta warisan, anak luar kawin tidak diakui, hukum progresif. ABSTRACTBekasi District Court Decision Number 95/PDT.G/2008/ PN.BKS objected the claim and give sanction to the plaintiff to pay court costs, and decided that all the assets of the testator became solely the possession or title of the child out of wedlock of no recognition owing to the grant of the testator. In terms of positive law enforcement, the judges based the ruling solely on proving without probing the legitimacy of the legally flawed grant deed. This analysis employed the theory of progressive laws in an effort to seek justice by studying the problems as well as the conflict settlement of the case of grant-based heir derived from progressive law. This is a socio-legal research study using inductive approach through the perspective of post-positivism. Qualitative research was conducted primarily by collecting references from the experts in the relevant field. From this research, it can be inferred that the granting of ownership to the entire inheritance to the child out of wedlock of no recognition based solely upon a Grant Deed should not have occurred. This indicates just how weak the judiciary is, barely imposing a mere formal law as the culmination of its legal certainty resulting in the unfulfilled objectives of law, those of the benefit and equity. The pattern of progressive law is based on the progression of humans that human beings are actually good, compassionate, mutually helpful to each other, and empathetic for their fellow human beings. Indeed the true law is aimed at achieving social justice.Keywords: grant, inheritance, child out of wedlock of no recognition, progressive law.

The development of digital technologies and their interaction with criminal law are extremely important for lawmaking, law enforcement, and the study of criminal law. In this connection, the author in the article aims to investigate the impact of digitalization on criminal law as a branch of law and as an academic discipline. The methodological basis of this research is a set of methods of scientific knowledge, among which the main place is occupied by the methods of consistency, analysis and comparative legal. The author's position grounded in the work is based on the legislation and the opinions of the competent scientific community on the question of how artificial intelligence can be useful in assessing an act as a crime, what new offenses have appeared in connection with the development of digital technologies. With the helpof legal analysis of the provisions of the theory of law, the question of whether artificial intelligence can be a subject of law and be liable in the event of harm to the object of criminal law protection is investigated.

This study aims to determine what forms of sexual violence against wives are based on Law no. 23 of 2004 and Islamic Law. To find out what forms of sexual violence against wives in the decision of the Bangil District Court No. 912/Pid/B/2011/PN.Bgl, Denpasar District Court Decision No.89/Pid.Sus/2014/PN.Dps and Medan District Court Decision No.264/Pid.Sus/2018/PN Mdn. To find out what were the basis for the judge's consideration in giving a decision at the Bangil District Court, the Denpasar District Court decision, and the Medan District Court decision regarding sexual violence against wives. Qualitative research was conducted with a revelatory approach, a statute approach, a case approach and a comparative approach. The results of this study indicate that: (1) forms of sexual violence against wives based on Law no. 23 of 2004 and Islamic Law is any act in the form of coercion of sexual relations, in an inappropriate and/or inappropriate manner, forcing sexual relations with other people for commercial purposes and/or for specific purposes. (2) the forms of sexual violence against wives in the decisions of the Bangil District Court, Denpasar District Court decisions and Medan. (3) The consideration of the Bangil District Court judge.

The unbalanced and unequal economic growth in society often creates social and social jealousy in the community. On the one hand, there is a group of people who have sufficient capacity economically, but on the other hand there is a group of people who have no economic capacity in their lives, so that the latter group is often a social problem that even commits the crime of theft, for example. The criminal act of theft according to the Criminal Code, there is an element of "burdensome" as regulated in Article 363 paragraph (1) of the 5th Criminal Code, namely: "It is punished with a maximum imprisonment of seven: Theft committed by a wrongdoer by entering the place. the crime or it can reach the goods to be taken, such as the example of the case presented by the author in this thesis research, namely the theft of a helmet which was committed by the defendant, preceded by the defendant entering the campus environment, the case of which was decided by the Sukabumi District Court with a decision Number: 17 / Pid. B / 2010 / PN. Skh. The formulation of the problem that will be discussed by the author are: 1) How is the application of material law to the perpetrator of the crime of theft with weighting? and 2) How is the law enforcement against the perpetrators of the crime of theft of a helmet with a weight as in Court Decision Number 17 / Pid.B / 2010 / PN. Skh? The research method that the author uses is the normative juridical method, meaning that the data used comes from library research, carried out by searching, quoting, taking notes, inventorying, analyzing, and studying data in the form of library materials needed and related to law enforcement against perpetrators. theft by weight. Finally, based on the results of the research, the authors conclude that law enforcement against the perpetrators of the crime of theft of a helmet with a weight as in Court Decision Number 17 / Pid.B / 2010 / PN. Skh, the defendant was threatened with article 363 paragraph (1) to 5 of the Criminal Code, so that the defendant Agus Hery Santoso Bin Diyono was found legally and convincingly guilty of committing a criminal act. for 2 (two) months and 15 (fifteen) days.
