The article studies the legal consciousness of participants to educational activities in the process of achieving educational objectives and realizing their right to education. Obstacles that are typical of such a type of research conditioned by an insufficient theoretical basis for studying legal consciousness in general and as a category accompanying the realization of goals, capabilities and rights of participants to educational activities. In the Russian legal science, these obstacles are caused by the prevalence of ideological dogmas over objective scientific approaches (for example, the concept that state and law will wither away as unnecessary institutes alongside the formation of communism), which is emphasized by Russian scholars concerned with these issues. Over time, the above-mentioned difficulties have been overcome and today the issues associated with legal consciousness (in particular, individuals and collectives in the educational sphere) are an integral part of scientific interests in the field of jurisprudence. The article aims at reviewing and analyzing the process of studying legal issues (including participants to educational activities) by Russian and foreign scholars, summarizing the results of their scientific research and drawing the relevant conclusions. Relying on the existing theoretical and practical experience and an extensive set of different research methods (general scientific and specific legal methods), the authors have achieved certain results and reached several conclusions. Their main achievement is new data on various aspects of justice.

AbstractFifty years after UNESCO’s publication of Learning to be: The world of education today and tomorrow, the author of this article provides an assessment of this seminal report, commonly known as “the Faure report”. He characterises the educational vision of the report as humanistic and democratic and highlights its emphasis on the need for educational provision throughout the life-course. He demonstrates how the right to education has, over time, been transformed into a duty to learn, Moreover, this duty has been strongly tied to economic purposes, particularly the individual’s duty to remain employable in a fast-changing labour market. Rather than suggesting that Edgar Faure and his International Commission on the Development of Education set a particular agenda for education that has, over time, been replaced by an altogether different agenda, the author suggests a reading of the report which understands it as making a case for a particular relationship between education and society, namely one in which the integrity of education itself is acknowledged and education is not reduced to a mere instrument for delivering particular agendas. Looking back at the report five decades later, he argues that it provides a strong argument for the emancipation of education itself, and that this argument is still needed in the world of today.

WHY SHOULD PHILOSOPHY TEACHERS TEACH THE RIGHT TO EQUALITY IN THE CLASSROOM?¿POR QUÉ LOS PROFESORES DE FILOSOFÍA DEBERÍAN ENSEÑAR EL DERECHO A LA IGUALDAD EN LA SALA DE CLASE?O artigo trata a respeito da possibilidade de trabalhar, com estudantes do ensino médio, um dos principais direitos fundamentais do homem, o direito à igualdade, arrolado no art. 5º da Constituição Federal de 1988. Símbolo da democracia, esse direito consiste formalmente em tratar de maneira igual os iguais, desigual os desiguais, ciente de que a desigualdade do tratamento aumenta na proporção em que as pessoas se desigualam entre si. Diante disso, realizou-se uma pesquisa por meio da qual se reuniram professores de Filosofia com o escopo de apresentar métodos com que pode ser trabalhado o tema em questão. Metodologicamente, partindo de uma fundamentação em estudos teóricos, utilizou-se a análise de conteúdo como forma de sintetizar as principais categorias discutidas e promover contribuições para uma aplicabilidade da temática no processo de ensino e aprendizagem. Os resultados apontaram a necessidade de trabalhar com questões legais nas aulas de Filosofia no ensino médio como forma de esclarecer os alunos acerca da importância social e pessoal do direito à igualdade entre as pessoas e ampliar as reflexões sobre a realidade que o cerca.Palavras-chave: Igualdade; Metodologia de Ensino-Aprendizagem; Filosofia.ABSTRACTThe article deals with the possibility of working with students of high school, one of the main fundamental rights of man, the right to equality, listed in art. The symbol of democracy, this right consists formally of treating equals equally, unequal and unequal, aware that inequality of treatment increases in the proportion in which people are unequal to each other. Faced with this, a research was carried out whereby Philosophy teachers met with the purpose of presenting methods with which the theme in question could be worked out. Methodologically, based on a theoretical basis, content analysis was used as a way to synthesize the main categories discussed and to promote contributions to an applicability of the theme in the teaching and learning process. The results pointed out the need to work with legal issues in Philosophy classes in high school as a way to clarify the students about the social and personal importance of the right to equality between people and to broaden the reflections about the reality that surrounds it.Keywords: Equality; Teaching-Learning Methodology; Philosophy.RESUMENEl artículo trata de la posibilidad de trabajar, con los estudiantes de secundaria, uno de los principales derechos fundamentales del hombre, el derecho a la igualdad, arrollado en el artículo 5º de la Constitución Federal de 1988. Símbolo de la democracia, este derecho consiste formalmente en tratar equitativamente a las personas iguales, y desigual a las desiguales, conscientes de que la desigualdad del tratamiento aumenta en proporción a la que las personas son diferentes entre sí. En vista de ello, se realizó una encuesta mediante la cual se reunieron profesores de filosofía con el alcance de la presentación de métodos con los que se puede trabajar el tema en cuestión. Metodológicamente, basándose en una lógica en los estudios teóricos, se utilizó el análisis del contenido como forma de sintetizar las principales categorías discutidas y promover contribuciones a una aplicabilidad de la temática en el proceso de enseñanza y aprendizaje. Los resultados señalaron la necesidad de trabajar con cuestiones jurídicas en las clases de filosofía en la escuela secundaria como una manera de clarificar a los estudiantes sobre la importancia social y personal del derecho a la igualdad entre las personas y ampliar las reflexiones acerca de su realidad.Palabras clave: Igualdad; Metodología de Enseñanza-Aprendizaje; Filosofía.

The article focuses on concrete examples - the visits of Emperor Franz Joseph, and how the city of Lviv presented itself. And how this representation has changed over time - from the neo-absolutism of the 50s of the XIX century to the broad autonomy of the early XXth century. What social groups dominated, how national communities fought for the right to be heard. How they built a symbolic relationship between the emperor and his subjects. The methodological basis of the study comprises the principles of historicism, objectivity and systematics. General scientific and special research methods were used in solving the set tasks: historiographical analysis, generalization, quantitative, chronological, retrospective. The scientific novelty of the work lies in a comprehensive analysis of the state of study of the issue in modern historiography and comparison of existing data with the available evidence of the time. Conclusions. For almost 70 years, from the mid-nineteenth to the early twentieth century, Galicia as part of the Habsburg Empire went from brutal rule from Vienna to broad autonomy. At the same time, the nature of relations between the main national groups (Poles, Jews and Ukrainians) changed. These groups, using the opportunities provided by the constitution,

FALSEAMENTO DA REALIDADE DO DIREITO UNIVERSAL À EDUCAÇÃO DISTORTION OF THE REALITY OF THE UNIVERSAL RIGHT TO EDUCATION Anário Dornelles Rocha Junior* RESUMO: A pesquisa compreende analisar os preceitos ideológicos inseridos nos marcos reguladores da educação apresentados sob a forma de direito universal da pessoa e da coletividade humana e o tipo de educação que está sendo aplicado na realidade, alinhados aos pressupostos liberais derivados dos instrumentos jurídicos, sob o fim de auxiliar os estudos acerca do direito, educação, ideologia e, tem, como objetivo: a) compreender o caráter ideológico presente na educação como garantia universal; b) verificar os meios utilizados pelo Estado para disseminar sua visão de mundo acerca do direito a educação. Os procedimentos metodológicos utilizados referem-se à pesquisa qualitativa documental, com caráter exploratório, visando identificar os condicionantes legais e seus efeitos na educação, especificamente na prática pedagógica e o conceito de Ideologia, no Direito, no Estado e na Educação. As análises documentais da ideologia presente na educação são evidentes na legislação sob a vertente das Leis de Diretrizes e Bases da Educação, especificamente a lei 9.394/96; e na Constituição Federal de 1988. A base teórica de análises da realidade parte dos pressupostos de ideologia em diferentes autores como Marx (1998), Lowy (2003) e Duarte (2008). Conclui-se que a legislação educacional induz um sentido de educação nos diferentes momentos históricos, privilegiando a ação de controle, coerção, repressão e submissão a ordem estabelecida. Neste sentido o destino do aluno, via ato educativo, está impregnado de certa visão de mundo quanto ao que seja seu direito à educação universal formal/material e o direito do outro, tendo em vista os diferentes sujeitos numa dada sociedade. PALAVRAS-CHAVE: Direito universal à educação. Estado. ABSTRACT: The research comprises analyzing the ideological precepts inserted in the regulatory frameworks of education presented in the form of universal right of the person and the human collectivity and the kind of education that is being applied in reality, aligned to liberal assumptions derived from legal instruments, in order to assist the studies about law, education, ideology, and has, as its objective: a) to comprehend the ideological character that prevails in the education as universal guarantee; b) to verify the methods used by the State to disseminate its worldview about the right to education. The methodological procedures resorted refer to documental qualitative research with exploratory character, aiming to identify the legal determinants and its effects on education, specifically on the pedagogical practice and the concept of Ideology in Law, State, and Education. The documental analysis of the ideology that prevails in education is evident in the legislation under the aspect of the Laws of Guidelines and Bases of the Education, specifically the law 9394/96; and the Federal Constitution of 1988. The theoretical basis of analysis of the reality is founded on assumptions of ideology of different authors such as Marx (1998), Lowy (2003), and Duarte (2008). It is concluded that the education laws induce a sense of education in different historical moments, favoring the action of control, coercion, repression and submission to the established order. In this sense the fate of the student, through the educational act, is redolent of a certain worldview regarding what is his procedural/substantive right to universal education and the right of the other, considering the different subjects in a particular society. KEYWORDS: Universal Right to Education. The equality of the rights of men and women is not only in a career in the world of work during, but more importantly in the review of Islamic philosophy is the equal right to education both religious and general education. The purpose of this article is to examine how the resilience of women's education in the philosophy of Islamic education. This study uses a literature review approach, first the author examines how the resilience of women's education then views of some Muslim philosophers on women's education. Furthermore, it examines the role and position of women, the verses of the Koran that deal with the role of women, children's education and women's education and women's public space in the perspective of Islamic education philosophy. This article concludes that in Islam every Muslim male and female are required to know about aqeedah, halal and haram and other legal issues, so that the position of women is equal to men in obtaining teaching with the provisions that they must be able to maintain their nature as Muslim women and there are no restrictions in getting more knowledge for women than that Islam gave them the right to learn in the same opportunities as men, even the Prophet Muhammad gave permission for them to go out to prepare their future on condition that they should cover their genitals.

AbstractThis paper explores how a regime recognizable as a Rawlsian property-owning democracy might be enshrined constitutionally in the context of the U.S. Five specific constitutional amendments are proposed: establishing an equal right to education, establishing a guaranteed social minimum, clarifying the legitimacy of regulating corporate political speech for the sake of political equality: establishing an individual right to a share of society’s productive wealth, and assuring communities of significant size the right to remain economically viable over time. The substance and reasoning behind each proposal is discussed in length, and the paper also briefly discusses why a focus on constitutional amendments may be helpful both in clarifying how a property-owning democracy might be realized in practice and in establishing clear goals for social movements motivated by the aim of establishing a more equitable distribution of wealth, power, and opportunity in the United States.

Purpose. The purpose of the article is to analyze and systematize the views of social and political thinkers of Galicia in the 19th - beginning of the 20th centuries. on the right and manner of organizing a nation-state as a cathedral. Method. The methodology includes a set of general scientific, special legal, special historical and philosophical methods of scientific knowledge, as well as the principles of objectivity, historicism, systematic and comprehensive. The problem-chronological approach made it possible to identify the main stages of the evolution of the content of the idea of catholicity in Galicia's legal thought of the 19th century. Results. It is established that the idea of catholicity, which was borrowed from church terminology, during the nineteenth century. acquired clear legal and philosophical features that turned it into an effective principle of achieving state unity and integrity. For the Ukrainian statesmen of the 19th century. the idea of catholicity became fundamental in view of the separation of Ukrainians between the Russian and Austro-Hungarian empires. The idea of unity of Ukrainians of Galicia and the Dnieper region, formulated for the first time by the members of the Russian Trinity, underwent a long evolution and received theoretical reflection in the work of Bachynsky's «Ukraine irredenta». It is established that catholicity should be understood as a legal principle, according to which decisions are made in dialogue, by consensus, and thus able to satisfy the absolute majority of citizens of the state. For Galician Ukrainians, the principle of unity in the nineteenth century. implemented through the prism of «state» and «international» approaches. Scientific novelty. The main stages of formation and development of the idea of catholicity in the views of social and political figures of Halychyna of the XIX – beginning of the XX centuries are highlighted in the work. and highlighting the distinctive features of «national statehood» that they promoted and understood as possible in the process of unification of Ukrainian lands into one state. Practical significance. The results of the study can be used in further historical and legal studies, preparation of special courses.

One of the key concepts in the right to education is access: access to the means to fully develop as human beings as well as access to the means to gain skills, knowledge and credentials. This is an important perspective through which to examine the solutions to access enabled by Open Educational Resources (OER) and online learning. The authors compare and contrast OER and online learning and their potential for addressing human rights “to” and “in” education. The authors examine OER and online learning growth and financial sustainability and discuss potential scenarios to address the global education gap.

Introduction. The era of digitalization sets for researchers the task of systematizing the essential features of digital space, identifying the essence of the “right to the Internet” and the legitimacy of limiting the digital rights of citizens. Theoretical Basis. Methods. The authors studied the peculiarities of the digital environment as a specific integral area of legal regulation, the doctrine and legislation of several countries on the topic which determines the basis for the regulation of digital space in Russia. The formal legal method, synthesis, analysis, induction and deduction were used as research methods. Results. The wording of the basic concepts in the area under study is proposed: digital space, digital region, digital platform, etc. The measures to eliminate “digital wells” are indicated. The main properties of the information space and its derivatives are considered. The effects of any contradictions in the legislation of the country are shown. Discussion and Conclusion. As the study showed, the latest innovations in the legislation contravene the principle of the balance of interests, fail to meet the requirements of observing the rights of a person and citizen, and contradict the Constitution and international treaties of Russia. When comparing these measures with their foreign counterparts, a search was made for their potential shortcomings and proposals were presented on possible directions for their correction, taking into account the particular characteristics of digital space.
