<p><em>The purpose of this study is to explain the influence of the positivism paradigm in making land acquisition law and its application which is oriented towards formalism in Indonesia. This type of research is normative and prescriptive legal research, a paradigm that should be used to develop land acquisition law that can realize respect for land rights. To answer the research problem a concept approach is used with the analysis of the syllogism of deduction and interpretation. The paradigm of science as its major premise, while the regulation and application of land acquisition for public use as a minor premise. The results of this study are the positivism paradigm imbued with capitalism causing compensatory injustice and formal injustice in land acquisition for public use. Globalization, through international treaties, causes the importation of the laws of donor countries, which have a capitalist ideology to the Indonesian legal system, which has a family ideology. This harmonization problem if not resolved properly can cause injustice. To realize convergence, it is necessary to consider the use of realistic socio legal theory in land acquisition legal research.</em></p><p><em> </em></p><p><strong>Keywords</strong>: <em>Positivism, Realistic Legal Socio, Land Acquisition, Justice.</em><em></em></p>

<p align="center"> </p><p><em>As happened to the Notary Eli SatriaPilo, S.H, Mkn, who was appointed as the Notary who made the Deed of Relinquishment of Land Rights in the Land Acquisition activities for the Construction of Campus III of the State Islamic Institute (IAIN) of Padang which was located in Sungai Bangek District, Padang</em><em> </em><em>in 2010. The method used was descriptive, in which describing the applicable legislation associated with legal theory in the facts and realities about the Notary’s Responsibility in Making Deed of Land Acquisition for the construction of Campus III of IAIN Padang in Sungai</em><em> </em><em>Bangek. This study used a Normative Juridical approach, in which researching by using and processing secondary data or literature related to the</em><em> </em><em>study. The data collected were in the form of primary data obtained from the District Court of Padang, secondary data obtained from secondary legal materials and primary legal materials. Based on the study, it was found that the role of Notary Eli</em><em> </em><em>Satria</em><em> </em><em>Pilo, in the land acquisition of campus III IAIN was proven to have misused the authority resulting in violation of the Notary Ethics Code and was responsible for accepting termination disrespectfully. Furthermore, he was also shown to be committing a Criminal Corruption made based on the Deed of Relinquishment of Land Rights in the land acquisition for the construction of Campus III of IAIN Padang, so that the State incurred losses of Rp. 1</em><em>.</em><em>946</em><em>.</em><em>701</em><em>.</em><em>050 (one billion nine hundred forty-six million seven hundred one thousand and fifty rupiahs). And he was responsible for receiving and carrying out the sentence that had been handed down by the District Court of Padang, a prison sentence of 4 (four) years, and paying a fine of Rp. 200</em><em>.</em><em>000</em><em>.</em><em>000 (two hundred million rupiahs)</em><em>.</em></p><p> </p>

The Ministry of ATR/BPN organizes land registration innovations based on the national strategic program, namely PTSL. The implementation of PTSL aims at accelerating land registration in a fair and equitable manner, including anticipating disputes in the field of utilization and spatial planning. One important issue is the dispute over road access. The Land Office of Bekasi Regency applies a policy of implementing servituut rights in land registration activities as an anticipation of disputes related to road access. This research was conducted to understand the implementation of servituut rights as the actualization of the social function of land in the PTSL program at the Bekasi Regency Land Office. This study uses empirical legal research methods. The results of the research show that the implementation of the servituut rights policy is motivated by the dualism of road status, the existence of regional development and land acquisition, and the relatively high land value. The implementation of the policy has undergone a change in meaning, from restrictions on land use to the obligation to surrender some land rights. For PTSL participants who agree to give up part of their rights for roads, the administration of the transfer of rights is carried out in a Declaration Letter on Land Boundaries and Land Areas. For those who disagree, the plot of land is included in the K3 category and a land register is made.

The activity of borrowing money, which is often related to the condition of submitting debt guarantees, is mostly carried out individually or by business entities. In fact, in carrying out credit agreements, it is often found that debtors apply for credit in the form of land guarantees to get credit with a certain nominal value. The bank will be more daring to provide land loans that have a high economy and the value of the land always increases from time to time and Mortgage Rights are created, namely collateral rights imposed on land rights. The purpose of this study was to determine the mechanism for registering mortgage rights through electronic means at PT.BPR Pedungan Denpasar, and to find out the obstacles faced in determining mortgage registration through electronic means at PT.BPR Pedungan Denpasar. This type of research is part of sociological legal research which includes identifying unwritten laws and examining the effectiveness of laws. In the analysis of legal theory through the view of legal science, starting from normative and empirical. The primary data collection technique in this research is the interview method.

<p>Abstract<br />This article aims for reviewing how the settlement of compensation as the consequences of the tenure <br />of land rights unlawfully in civil law Surakarta state court verdict number 106/pdt.g/2017/PN.SKT and <br />number 103/pdt.G/2006/PN.SKT where the court’s decision has a permanent legal force. This research is <br />a juridical normative legal research. The location of this research at Notary Office and PPAT Adib Sujarwadi <br />and the State Court Surakarta Class 1A Specific. Kinds and the sources of data in this research are <br />consist of primary data and secondary data. The technique of data collection through interview and library <br />study. The analytical technique used by the author is by the method of syllogism that uses the deduction <br />mindset. Regarding the settlement of compensation due to unlawful tenure of land rights is a compensatory <br />damages, in the form of payment to the victim amounting to a loss that is actually experienced. Based on <br />the decision of the Panel of Judges. Regarding the non-granting of immaterial compensation because <br />the Plaintiff does not attach the appropriate evidence. After the verdict is declared incracht, outside the <br />court, the Defendant and the Plaintiff may hold deliberations to determine the amount of the indemnity or <br />the Plaintiff waived the indemnity obligation, but the Defendant must leave the land of the object of the <br />dispute voluntarily. In the case of still occupy it will be executed by the bailiff from the Court.<br />Keywords: Compensation; Tort; Tenure Of Land Rights.</p><p>Abstrak<br />Artikel ini bertujuan untuk mengkaji bagaimana penyelesaian ganti rugi akibat penguasaan hak atas <br />tanah secara melawan hukum pada perkara perdata Putusan Pengadilan Negeri Surakarta Nomor 106/<br />Pdt.G/2017/PN SKT dan Nomor 103/Pdt.G/2006/PN SKT, dimana putusan pengadilan tersebut telah <br />berkekuatan hukum tetap. Penelitian ini merupakan penelitian hukum normatif yuridis. Lokasi penelitian <br />yaitu di Kantor Notaris dan PPAT Adib Sujarwadi dan Pengadilan Negeri Surakarta Kelas IA Khusus. Jenis <br />dan sumber data penelitian ini meliputi data primer dan data sekunder. Teknik pengumpulan data melalui <br />wawancara dan studi kepustakaan. Teknik analisis yang digunakan oleh penulis adalah dengan metode <br />silogisme yang menggunakan pola pikir deduksi. Penyelesaian ganti rugi akibat penguasaan hak atas <br />tanah secara melawan hukum yaitu dengan ganti rugi kompensasi, berupa pembayaran kepada korban <br />sebesar kerugian yang benar-benar dialami. Berdasarkan keputusan Majelis Hakim. Mengenai tidak <br />dikabulkannya ganti rugi immateriil dikarenakan Penggugat tidak melampirkan bukti-bukti yang sesuai. <br />Setelah putusan dinyatakan incraht, di luar pengadilan, Tergugat dan Penggugat dapat mengadakan <br />musyawarah untuk menentukan jumlah ganti rugi atau Penggugat membebaskan kewajiban pembayaran <br />ganti rugi, namun Tergugat harus meninggalkan tanah obyek sengketa secara sukarela. Dalam hal masih <br />tetap menempati maka akan dilakukan eksekusi oleh juru sita dari Pengadilan.<br />Kata Kunci : Ganti Kerugian; Perbuatan Melawan Hukum; Penguasaan Hak Atas Tanah.</p>

The 2008 ITE Law regulates fraudulent acts that are applied online. The researcher wrote a scientific article with the title Legal Impacts on the Implementation of Online Arisan Based on Law No. 19 of 2016. There are two formulations of this research problem How is the Legal Protection for Parties Conducting Online Arisan based on Law Number 19 of 2016? and What are the Criminal Sanctions Against BandarArisanOnlinein the event of Default? Normative legal research is a method applied by the author in this scientific article. The author carries out a literature study by collecting legal material to answer the formulation of research problems. The author carries out a literature study by collecting legal material to answer the formulation of research problems. This study's findings explain that there are legal protections for parties who carry out online social gathering criminal sanctions against online social gathering based on ITE Law No. 19 of 2016 against online social gathering fraud perpetrators focused on individual legal subjects. This finding is supported by Article 28 paragraph (1), which explains that consumers who get losses due to online transactions can obtain legal protection.

Abstract: The construction of Bendung Slinga in Purbalingga Regency begins with land acquisition carried out in 2009 and 2010, but the land acquisition process has not been completed in the land rights certificate, especially the object that comes from the village cash lands of Banjaran. The purpose of this research is to explain the implementation of land acquisition for Development of Bendung Slinga in Banjaran Village, Bojongsari District, Purbalingga Regency and explain the constraints faced and the solution. This research uses qualitative method with descriptive approach. The results show that the implementation of land acquisition for the construction of Bendung Slinga until the payment of compensation has been implemented in accordance with the prevailing regulations, namely Perpres 65/2006 and Perkaban 3/2007. Problems that occur is not complete the condition of the release of cash land Banjaran village which became the object of land acquisition. Terms of release that can not be fulfilled are village regulations, permission of the bupati, and permission of the governor. In addition, replacement land for disbursed village cash lands has not been fully controlled by the Banjaran Village Government and has not yet registered its land rights on behalf of the Banjaran Village Government. Intisari: Pembangunan Bendung Slinga di Kabupaten Purbalingga diawali dengan pengadaan tanah yang dilaksanakan pada tahun 2009 dan 2010, Namun proses pengadaan tanahnya belum selesai pada tahap sertipikasi hak atas tanah, terutama objek yang berasal dari Tanah Kas Desa (TKD) Banjaran. Tujuan dari penelitian ini adalah untuk menjelaskan pelaksanaan pengadaan tanah untuk pembangunan Bendung Slinga di Desa Banjaran, Kecamatan Bojongsari, Kabupaten Purbalingga dan menjelaskan kendala yang dihadapi dan solusinya. Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif. Hasil penelitian menunjukkan bahwa pelaksanaan pengadaan tanah untuk pembangunan Bendung Slinga sampai dengan pembayaran ganti rugi telah dilaksanakan sesuai dengan peraturan yang berlaku, yaitu Perpres 65/2006 dan Perkaban 3/2007. Permasalahan yang terjadi adalah belum lengkapnya syarat pelepasan TKD Banjaran yang menjadi obyek pengadaan tanah. Syarat pelepasan yang belum dapat dipenuhi yaitu peraturan desa, izin bupati, dan izin gubernur. Selain itu, tanah pengganti untuk tanah kas desa yang dilepaskan belum sepenuhnya dikuasai oleh Pemerintah Desa Banjaran dan belum didaftarkan hak atas tanahnya atas nama Pemerintah Desa Banjaran. Penetapan kawasan hutan laposo niniconang menyebabkan konflik agraria antara masyarakat dan Pemerintah selama bertahun-tahun. Hal tersebut menimbulkan ketidakpastian hak atas tanah karena masyarakat yang tinggal di kawasan hutan kehilangan sumber penghidupan yang telah dikelola secara turun-temurun. Atas dasar persoalan tersebut dilakukan penelitian yang bertujuan untuk mengetahui dasar hukum masyarakat melakukan penguasaan tanah. Pendekatan yang dilakukan dalam penelitian ini adalah kajian yuridis empiris. Penelitian artikel ini menggnakan metode penelitian yuridis empiris, menggunakan hasil wawancara untuk diolah an dianalisis dengan menggunakan pendekatan hukum. Hasil dari penelitian menunjukkan bahwa penguasaan tanah yang dilakukan masyarakat meyakinkan bahwa tanah yang mereka kuasai adalah hak milik masyarakat setempat. Akan tetapi, banyaknya petani yang ditangkap membuat kekhawatiran untuk mengelola lahan tersebut. Oleh sebab itu, melalui penelitian ini maka disimpulkan bahwa kebijakan reforma agraria yang komprehensif dibutuhkan untuk penyelesaian konflik-konflik semacam ini. AbstrakThe implications of establishing a forest of Laposo Niniconang Watangsoppeng on the protection of people’s rights to land. This research aims to find out and analyze the status of land rights controlled for generations. The research type is empirical legal research where data collection is carried out by interview methods on several related parties. The legal materials used are primary and secondary legal materials. Furthermore, the data is analyzed qualitatively and presented descriptively. The results showed that traditional societies having lived for generations managing land in forest areas are worried about being arrested by the police. Reflecting on the site, a comprehensive agrarian reform policy is needed for the resolution of forest conflicts.
