<p align="center"><strong><em>Abstract</em></strong></p><p><em>The aim of the study is to determine the model of traffic settlement through a system of criminal law enforcement or mediation as the criteria used when the system through the enforcement of the criminal law or mediation. Judging from the type of sociological research, including research to take place in the Central Java Police Region. The data used in the primary and secondary. As research material is in the police traffic unit and Central Java Police docket of traffic accidents in the Traffic Unit Police Central Java. The results showed that the Central Java Police region in resolving cases of traffic accidents that result in death, serious injury, minor injuries or material losses using models of settlement through legal means, never use mediation. Ditinjau dari jenis penelitian termasuk penelitian hukum sosiologis dengan mengambil lokasi di Kepolisian Daerah Jawa Tengah. Data yang digunakan primer dan sekunder. Sebagai bahan penelitian adalah polisi di Satuan lalu lintas Kepolisian Daerah Jawa Tengah dan berkas perkara kecelakaan lalu lintas yang ada di Satuan Lalu Lintas Kepolisian Daerah Jawa Tengah. Hasil penelitian menunjukkan bahwa Kepolisian Daerah Jawa Tengah dalam menyelesaikan perkara kecelakaan lalu lintas yang mengakibatkan meninggal dunia, luka berat, luka ringan maupun kerugian material menggunakan model penyelesaian melalui jalur hukum, tidak pernah menggunakan mediasi. Perkara kecelakaan lalu lintas yang mengakibatkan meninggal dunia digunakan berita acara pemeriksaan biasa, sedangkan yang mengakibatkan luka berat, ringan dan kerugian material digunakan berita acara pemeriksaan cepat.</p><p><strong>Kata kunci: </strong>perkara kecelakaan lalulintas, penegakan hukum, mediasi</p>

ABSTACTEquality before the law is an important principle in modern law, which is one of the joints of Rule of Law doctrine in a developing country like Indonesia, so this principle is used as the basis for every human being in enforcing the law. Increased traffic activity triggers an increase in traffic-related issues, one of which is a traffic accident. The problem is that it is difficult to provide law enforcement that can lead to a deterrent effect resulting in traffic awareness. The purpose of this study is to review criminal law enforcement in terms of legislation and review accountability in cases of criminal acts of traffic accidents that result in the loss of life of people in the traffic accident crime in Semarang City. Types of normative juridical research. The nature of the research using descriptive qualitative. Techniques of collecting data using secondary data (verdict number 599 / Pid.Sus / 2017 / PN.Smg and number 625 / Pid.B / 2017 / PN.Smg.). The results indicate that criminal law enforcement of traffic accidents resulting in the loss of life of persons still has some weaknesses and for accountability the crime has fulfilled the element of criminal liability in general. Makin meningkatnya aktivitas lalu lintas memicu peningkatan masalah yang berhubungan dengan lalu lintas, salah satunya dalah kecelakaan lalu lintas. Masalahnya adalah sulit dalam memberikan penegakan hukum yang dapat menimbulkan efek jera sehingga timbul kesadaran berlalu lintas. Tujuan dalam studi ini adalah untuk meninjau penegakan hukum pidana yang ditinjau dari perundang-undangan dan meninjau pertanggungjawaban pada kasus tindak pidana kecelakaan lalu lintas yang menyebabkan hilangnya nyawa orang pada tindak pidana kecelakaan lalu lintas di Kota Semarang. Jenis penelitian yuridis normatif. Sifat penelitian menggunakan deskriptif kualitatif. Teknik pengumpulan data menggunakan data sekunder (putusan nomor 599/Pid.Sus/2017/PN.Smg dan nomor 625/Pid.B/2017/PN.Smg.). Hasil menujukkkan bahwa penegakan hukum pidana kecelakaan lalu lintas yang mengakibatkan hilangnya nyawa orang masih memeiliki beberapa kelemahan dan untuk pertanggungjawaban pidanya telah memnuhi unsur pertanggungjawaban pidana secara umum.Kata kunci: penegakan hukum, tindak pidana, kecelakaan, lalu lintas

Basic principles of transportation are safety and security, efficiency and equity. The traffic accident rate in Indonesia is still considerably high. In 2014 as reported by the national police, with around 263 accidents per day. Of reported casualties per day, 77.5 people are fatalities, 73.5 people are serious injuries, and 301 people are slightly injuries. Total of the Property Damage Only (PDO) is IDR250,110,380,000 (US$18.547 million). To estimate the economic impacts of accidents, the number of accident casualties and accident costs are the most needed data. The aims of this study is to analysis traffic accidents cost using Human Capital Method. The research location in Purbalingga, Central Java, Indonesia using data from 2010-2015. The accident cost analysis based on the casualty severity of accidents is fatal, seriously injured, slightly injured, and PDO. Components of accident costs include costs to repair vehicle, administrative cost, medical care, and potential loss of human productivity, and human cost. Casualty accident costs by severity type: fatality is IDR501,210,320 (US$37,168), serious injury is IDR18,874,950 (US$1,400), slight injury is IDR6,255,708 (US$464), and property damage only is IDR3,047,914 (US$226). Total accident cost in Purbalingga was estimated IDR236,517,103,652 (US$17,539,274) or 1.27% of the gross domestic product.

ABSTRAK�Penelitian dengan judul Peranan Dan Fungsi Praperadilan Dalam Menegakkan Hukum Pidana di Polda Jateng. Berdasarkan uraian dalam Tesis ini, permasalahan yang akan yang akan di teliti adalah: 1) Bagaimanakah fungsi dan peran praperadilan dalam penegakan hukum di Indonesia berdasarkan peraturan perundang-undangan yang berlaku? 2) Apa hambatan dalam pelaksanaan fungsi dan peran pra peradilan dalam penegakan hukum di Polda Jateng? 3) Bagaimanakah solusi dari hambatan dalam pelaksanaan fungsi dan peran pra peradilan dalam penegakan hukum di Polda Jateng?Hasil penelitian menyimpulkan bahwa : 1) Maksud dan tujuan utama yang hendak ditegakkan dan dilindungi, dalam proses praperadilan yaitu tegaknya hukum dan perlindungan hak asasi tersangka dalam tingkat pemeriksaan penyidikan dan penuntutan. Pasal 1 butir 10 KUHAP dipertegas dalam Pasal 77 KUHAP yang menyebutkan Pengadilan Negeri berwenang untuk memeriksa dan memutus, sesuai dengan ketentuan yang diatur dalam undang-undang. Wewenang pengadilan untuk mengadili dalam praperadilan dijelaskan dalam Pasal 95 KUHAP. 2) Hambatan dalam pelaksanaan fungsi dan peran praperadilan dalam penegakan hukum di Polda Jateng meliputi : a. hakim lebih banyak memperhatikan perihal dipenuhi atau tidaknya syarat-syarat formil penangkapan dan penahanan, atau ada tidaknya perintah penahanan dan sama sekali tidak menguji dan menilai syarat materilnya. b. setiap pelaksanaan upaya paksa selalu ada perenggutan HAM. c. pemeriksaan untuk melakukan penahanan, masih ada penyalahgunaan dalam tahap penyidikan oleh Polisi dan penuntutan oleh jaksa. d. selain luasnya kewenangan penyidikan dalam menentukan bukti permulaan yang cukup, pengawasan terhadap kewenangan tersebut juga lemah. 3) Solusi dari hambatan dalam pelaksanaan fungsi dan peran praperadilan dalam penegakan hukum di Polda Jateng meliputi : ����������� a. Diperlukan upaya kontrol terhadap setiap aparat penegak hukum pada lembaganya masing-masing secara vertikal. b. KUHAP perlu direvisi khususnya mengenai mekanisme saling mengawasi antara penegak hukum dan lembaga dalam subsistem peradilan. c. diperlukan peran aktif hakim dalam menggunakan kewenangannya pada saat pemeriksaan pokok perkara untuk mempertimbangkan penyidikan atau penuntutan yang tidak sesuai dengan ketentuan hukum acara atau yang melawan hukum guna menghindari penyalahgunaan HAM. d. dalam tahap ajudikasi, hakim seharusnya berkonsentrasi untuk menentukan hasil pembuktian di persidangan dan dalam tahap ini, hakim dapat menilai apa yang terjadi dalam tahap praajudikasi.Kata Kunci : Peranan dan Fungsi, Praperadilan, Penegakan Hukum Pidana�ABSTRACT�Research with the title Role And Practice Function In Enforcing Criminal Law in Central Java Regional Police. Based on the description in this Thesis, the issues that will be examined are: 1) How is the function and role of pretrial in law enforcement in Indonesia based on the prevailing laws and regulations? 2) What are the obstacles in the implementation of pre-justice functions and roles in law enforcement in the Central Java Regional Police? 3) How is the solution of the obstacles in the implementation of functions and the role of pre-judiciary in law enforcement in Central Java Regional Police?The results of the study conclude that: 1) The main purpose and objectives to be upheld and protected, in the pre-trial process, namely the enforcement of the law and the protection of human rights of suspects in the level of investigation and prosecution investigation. Article 1 point 10 of the Criminal Procedure Code is affirmed in Article 77 of KUHAP stating that the District Court has the authority to examine and decide upon, in accordance with the provisions stipulated in law. The jurisdiction of the courts to adjudicate in pre-trial is described in Article 95 of the Criminal Procedure Code. 2) Obstacles in the implementation of functions and the role of pretrial in law enforcement in Central Java Police include: a. judges pay more attention to whether or not the formal conditions for arrest and detention, or whether there is a detention order and not test and judge material requirements at all. b. every execution of forced efforts is always a rush of human rights. c. checks for detention, there is still abuse in the investigation stage by the Police and prosecution by the prosecutor. d. besides the extent of investigative authority in determining sufficient preliminary evidence, the oversight of the authority is also weak. 3) Solutions from obstacles in the implementation of functions and pretrial roles in law enforcement in Central Java Police include: a. Control of each law enforcement apparatus is required on each institution vertically. b. The Criminal Procedure Code needs to be revised, especially regarding the mechanism of mutual supervision between law enforcement and institutions within the judicial system. c. an active role of the judge in the use of authority at the time of examination of the principal matter to consider investigations or prosecutions that are not in accordance with the provisions of procedural law or against the law in order to avoid abuse of human rights. d. in the stage of adjudication, the judge should concentrate on determining the results of the evidence in the hearing and in this stage the judge can judge what happened in the pre-certification stage.Keywords: Roles and Functions, Pretrial, Criminal Law Enforcement

<p>Kecelakaan lalu lintas di jalan raya masih menjadi penyumbang tingginya angka kematian di Indonesia, sehingga menjadi perhatian khusus bagi kepolisian di negara ini. Termasuk Kepolisian Resor (Polres) Tanah Laut, yang telah membuktikan perhatian tersebut dengan membentuk komunitas korban kecelakaan lalu lintas dan Pelatihan Pertolongan Pertama Gawat Darurat (PPGD). Tahapan awal pencegahan kecelakaan lalu lintas adalah dengan mengetahui faktor-faktor penyebab kecelakaan lalu lintas yang diperoleh melalui analisa data kecelakaan. Analisa tersebut dapat dilakukan dengan data mining, yaitu <em>K-Means Clustering.</em> <em>K-Means Clustering</em> mengelompokkan data menjadi beberapa <em>cluster</em> sesuai karakteristik data tersebut. Data kecelakaan lalu lintas dibagi menjadi 2 dataset, yakni dataset 1 dan dataset 2. Hasil <em>cluster </em>penerapan <em>K-means clustering </em>terhadap dataset 1 dan dataset 2 kemudian dilakukan pengujian <em>silhoutte coefficient </em>untuk mencari hasil <em>cluster </em>dengan kualitas terbaik<em>. </em>Pengujian <em>silhoutte coefficient</em> secara berurutan menghasilkan <em>distance measure </em>paling optimal yakni <em>clustering </em>dengan 4 <em>cluster</em> untuk dataset 1 dan <em>clustering </em>dengan 2 <em>cluster</em> untuk dataset 2. Selain memperoleh <em>cluster </em>dengan kualitas terbaik, penganalisaan data juga menghasilkan beberapa informasi kecelakaan lalu lintas yang sering terjadi, yakni faktor penyebab dan korban kecelakaan adalah pengemudi, umur korban adalah 9 sampai 28 tahun, dan keadaan korban kecelakaan adalah luka ringan.</p><p> </p><p class="Judul2"><strong><em>Abstract</em></strong></p><p><em>Traffic accidents on the highway are still contribute to the high mortality rate in Indonesia, which are becoming a special concern for the police. Including the Police of Tanah Laut Resort where prove themselves by established The Community of Traffic Accident Victims and Emergency First Aid Training. The first prevention of traffic accidents is knowing the factors causing traffic accidents which is obtained through the analysis of traffic accident’s data. It can be done through data mining, i.e. K-Means Clustering, which is clustering data into clusters according to characteristics of the data. Traffic accident data is divided into two datasets, namely dataset 1 and dataset 2. After obtaining the cluster results, the next step is to calculate silhoutte coefficient which is used to find the best quality cluster result. The result of testing silhoutte coefficient are clustering with 4 clusters for dataset 1 and clustering with 2 clusters for dataset 2. Analyzing data in this research also produces some information on traffic accidents that often occur, namely the causes and victims of accidents are drivers, the age of the victims is between 9 and 28 years old, and the circumstance of the accidents victims are minor injuries.</em></p>

The study aimed to determine epidemiological characteristics of road traffic accidents in Japan during the year 2010-2019. A cross-sectional descriptive study depended on a retrospective analysis of road traffic accident data that were obtained from the National Police Agency (NPA) for the years 2010 – 2019 in Japan. The relationship of road traffic accident consequences as dependent variables with age, road user type, helmet, and seatbelt use as independent variables during the studied years was analyzed with Chi-square test. The case fatality rate has been declining every year from 3.88 in 2010 to 2.54 per 100,000 persons. More than half of fatality cases have occurred among the elderly. There was a statistically significant relationship between road user type and accident severities. 36.21% fatality occurred in pedestrians. Otherwise, 27.61% of motor vehicle occupants were dominant in serious injury cases and 66.87% in slight injury cases. Most of the casualties revealed for fatality cases were in the head, whereas the leg part was dominant in serious injury cases and the neck region was raised in slight injuries. There was a significant relationship between the use of helmets and seat belt use with casualties of road traffic accidents. There was a declined trend of road traffic accidents in Japan during 10 years of study. The result of the epidemiological study could be a valid consideration for the design of road safety policy in the future.

Penerapan restorative justice dalam menyelesaikan kasus kecelakaan lalu lintas yang menimbulkan korban jiwa sering dijumpai dan seakan menjadi dalil bagi para pihak untuk dijadikan bentuk kesepakatan pertanggung jawaban pidana. Permasalahan timbul ketika kebutuhan akan pentingnya restorative justice dalam menyelesaikan kasus kecelakaan lalu lintas khususnya yang menimbulkan korban jiwa dihadapkan dengan berbagai benturan sehingga memunculkan ambiguitas terhadap penerapan restorative justice itu sendiri, dan melihat bagaimana prospek pelaksanaan restorative justice dalam menyelesaikan kasus kecelakaan lalu lintas di masa yang akan datang. Dengan menggunakan pendekatan yuridis normatif dapat disimpulkan bahwa restorative justice sangat dibutuhkan oleh para pihak baik pelaku, korban maupun masyarakat serta aparat penegak hukum, namun dalam pelaksanaannya mengalami berbagai benturan antara lain benturan sistem pemidanaan yang berlaku, benturan kepentingan pelaku dan korban, serta benturan terhadap nilai kepastian hukum. Seiring dengan berkembangnya pemikiran mengenai tujuan pemidanaan maka penerapan restorative justice terhadap kasus-kasus kecelakaan lalu lintas memiliki prospek yang terbuka untuk dapat diterapkan secara formil. Melalui perumusan kebijakan restorative justice secara formil kedalam Undang-undang Lalu Lintas dan Angkutan Jalan maka nilai kepastian hukum akan di dapat oleh para pihak.<p>Implementation of restorative justice to resolve the traffic accident cases which caused victims are common and seemed to be an argument which will be used by the parties as a form of criminal law liability agreement. The problems appear when the restorative justice needed as an important thing to resolve the traffic accidents cases which caused victims are faced to various conflict which will be arose the ambiguity in application of restorative justice itself, let see how is the prospect of restorative justice implementatiton to resolve the traffic accident cases in the future. By using the normative approach, it can be concluded that restorative justice is needed by the conflict parties such as applicable criminal system conflict, conflict of interest between prepetrators and victims, and the conflict of legal certainty system. Along with the growing thingking about the purpose of punishment, the restorative justice application on the traffic accident cases has an open prospect to formally apply. Through the policy formulatization in formal restorative justice into Traffic ergulation and Road Transportation, the parties will get the value of legal certainty.</p>

Prostisusi becomes one of the social problems that continues to develop over time. Various internal and external factors trigger this activity to continue to exist until now. This research examines the business of prostitution as a form of disease in society and social problems. This research tries to reveal the karaoke business under the guise of illegal prostitution business, especially in Central Java. This research uses the approach of Criminal Law, Criminology, and Social Structure. The research method used is qualitative research, where the writer directly looks at existing social phenomena and seeks field facts through observation, interviews, and investigations. This research found that various factors become the background of the existence of the karaoke business under the guise of illegal prostitution in Central Java, ranging from economic and business factors to weak rules and law enforcement. The study also revealed the fact that the karaoke business secretly provided sex or prostitution services, but law enforcement was ineffective. One of the ineffectiveness of law enforcement is the problem of law enforcement apparatuses and bribery resources that occur within the law enforcement environment. In addition, this business also deals directly with business and economic investment holders.

This study aims to: 1) Review and analyze the implementation of the criminal investigations against theft by weighting with the modus of prying Automated Teller Machine (ATM) in the jurisdiction area of Central Java. 2) Assess and analyze the factors that hinder the investigation related to solve investigator in the criminal investigations against theft by weighting with the modus of prying Automated Teller Machine (ATM) in the jurisdiction area of Central Java. 3) Assess and analyze the efforts of investigators linked the criminal investigations against theft by weighting with the modus of prying Automated Teller Machine (ATM) in the jurisdiction area of Central Java? Results: 1). The process of investigations conducted by the Central Java Police in solving criminal cases of theft through Automated Teller Machine (ATM) with prying mode in accordance with the rules contained in the Criminal Procedure Code and the Law on Police No. 2 of 2002. 2). Based on the description of the Central Java Police investigators, the obstacles faced by the team of investigators of Central Java Police, among others: a. Evidence is hidden and difficult for investigators to look suspect. b. The suspect managed to flee with his colleagues by car, so investigators have to chase. c. In providing information with convoluted.3) Relatedwith efforts to overcome obstacles investigator in a criminal law enforcement ATM theft with prying mode is as follows: a. Act No. 22 the year 2009 about Lalu Lintas dan Angkutan Jalan (road traffic and transportation) raises perspectives in criminal law regarding criminal liability for public transportation companies. Furthermore, it raises problems on how criminal liability of technology companies for traffic accidents and how law enforcement practice. The purpose of this study is to analyze and describe the criminal liability of technology companies for traffic accident by online motorcycle taxi drivers and for criticizing law enforcement. Normative research methods will be used to answer the problem. There are two approaches to assess the problem, namely case approach the and law approach. The conclusion is that technology companies can be criminally accounted for by the vicarious liability perspective and the Road Traffic and Transportation Act. Undang-Undang No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan (UULLAJ) memunculkan perspektif dalam hukum pidana menyangkut pertanggungjawaban pidana bagi perusahaan angkutan umum. Selanjutnya memunculkan permasalahan mengenai bagaimana pertanggungjawaban pidana perusahaan teknologi atas tindak pidana kecelakaan lalu lintas dan bagaimana praktek penegakan hukumnya. Tujuan penelitian ini untuk menganalisis dan mendeskripsikan mengenai pertanggungjawaban pidana perusahaan teknologi atas tindak pidana kecelakaan lalu lintas oleh pengemudi ojek online dan untuk mengkritisi penegakan hukumnya. Metode penelitian normatif yang akan digunakan untuk menjawab permasalahan ini. Terdapat dua pendekatan untuk mengkaji permasalahan ini yaitu pendekatan kasus dan pendekatan undang-undang. Dari hasil pembahasan dapat disimpulkan bahwa perusahaan teknologi dapat dipertanggungjawabkan secara pidana dengan perspektif vicarious liability dan Undang-Undang Lalu Lintas dan Angkutan Jalan.
