The author of the article study problems of enforcement and implementation of principles in activities of police and mechanisms of implementation of principles in activities conducted by police. Its mean that the operations of the police shall be organised observing lawfulness, humanism, human rights, social justice, transparency and an undivided authority, and relying on the assistance of the public. The police shall protect the rights and lawful interests of persons irrespective of their citizenship, social, economic and other status, race and nationality, gender and age, education and language, attitude towards religion, political and other convictions. The police, by its operations, shall ensure the conformity with the rights and freedoms of persons. Restriction of such rights and freedoms shall be permitted only on the basis of law and in accordance with procedures specified in law. Author discloses the meaning and content of the principles of the organization and activities of the police, enshrined in the law. The authors also stress out particular disadvantages of law ”On Police” and make suggestions how to improve it.

A poetic sale. Horace, Epistula 2.2.
Starting from the analysis of a poem by Horace, I have tried to highlight the image of the Law that was held by Roman society in the first century BC, that is, both by the poet and by the public that he wanted to entertain with his works. He chose a legal topic as the theme of his narrative – the responsibility for hidden defects in the contract of sale –; he applied the Roman legal lexicon with total precision and, more specifically, he showed that he was aware of the debate about the case-law related to the Edict by which the magistrates regulated the sale of slaves in the public markets. This is apparent from a comparison of the poem with book 21, title 1 of Justinian’s Digest concerning the Edict of the curule aediles and with documents from legal practice (testatio) that record the agreement of the will of the parties. A study of this kind, moreover, also contributes to a better understanding of poetic composition.

Abstract In this article it is shown that the institutional preconditions of the activity type adjudicating a freedom of speech case leave much room for strategic manoeuvring with topical selection. To this end, an analysis is presented of the argumentation of the District Court in a case against the Dutch anti-immigration politician Geert Wilders. In order to show the space for manoeuvring, this argumentation, resulting in acquittal, is compared with the argumentation put forward by the Court of Appeal, which had ordered, after the Public Prosecution Service’s refusal to do so, that Wilders be prosecuted. The analysis shows that the District Court made ample use of the space for manoeuvring provided at the normative level concerning the interpretation of legal rules and case law, and the space provided at the factual level of classifying the contested facts in light of the previously identified meaning of a rule.

<p>The article is of a scientific-research nature. The author discusses the problem of limits of judicial review of discretionary decisions made by taxation authorities, which aim at applying relief in payments of tax liabilities under Polish regulations and case-law of administrative courts. It may be noted that despite the issue of administrative discretion being discussed in the academic literature, the question of limits of judicial review in the practice of administrative courts still raises doubts. It is therefore reasonable to undertake the analysis of the main views formulated in the literature and the case-law of administrative courts addressing this problem, from the point of view of the limits of judicial review of discretionary decisions. The thesis of the article is that the nature of discretionary decisions on relief in payment of tax liabilities, determined by the function of administrative discretion, and, at the same time, the criteria set out in the law for judicial review of public administration, limit the role of the administrative court in examining the compliance with procedural law of the tax proceedings preceding the issuance of such a decision and the respecting by tax authorities of the fundamental values of the system of law expressed in the Polish Constitution. This is because they define the limits of administrative discretion, within which the choice of one of the possible solutions remains beyond the judicial review of the public administration. For the law, as it stands (<em>de lege lata</em>) there are no grounds for administrative courts, provided that the tax authorities respect the basic values of the legal system expressed in the Polish Constitution, to formulate assessments as to the circumstances and reasons justifying the granting or refusal to grant a tax relief, or its scope. The concept of internal and external limits of administrative discretion may therefore be useful for administrative court rulings.</p>

<p>Belakangan ini. kasus Baiq Nuril benar-benar menyita perhatian publik. Kasus hukum ini bermula saat Nuril yang saat itu masih bekerja sebagai pegawai honorer di SMAN 17 Mataram, merekam percakapan telepon Kepala Sekolah kepadanya yang berkonten kesusilaan dan bernada melecehkan dirinya. Singkat cerita, melalui rekannya, rekaman pembicaraan tersebut tersebar. Nuril pun dilaporkan atas sangkaan Pasal 27 (1) Undang-Undang Informasi dan Transaksi Elektronik (ITE). Proses hukum bergulir, Pengadilan Negeri Mataram memberikan vonis bebas kepada Nuril. Namun, Penuntut Umum mengajukan kasasi dan Mahkamah Agung akhirnya memvonis Nuril bersalah dengan hukuman pidana penjara 6 bulan kurungan dan denda lima ratus juta rupiah. Inilah yang kemudian memunculkan polemik. Masyarakat memprotes putusan yang dianggapnya tidak adil tersebut. Kekecewaan masyarakat kepada hukum sangat terasa melalui berbagai gerakan untuk membela Nuril, baik melalui penggalangan dana maupun aksi demonstrasi. Mereka kecewa kepada hukum yang nyatanya malah memberi hukuman pada seorang korban pelecehan seksual. Berbagai persepsi buruk terhadap hukum bermunculan, masyarakat ramai memberi pandangan awam mereka terhadap kasus ini. Secara ilmiah, kasus ini semestinya dapat diuraikan dengan jelas melalui ilmu hukum, terlebih melalui filsafat hukum. Adalah tugas kita sebagai akademisi untuk menguraikan setiap duduk peristiwa kasus menjadi lebih terang, agar tidak menimbulkan kesesatan berpikir di masyarakat. Berdasarkan uraian ini, penulis akan menjawab permasalahan mengenai bagaimanakah cara berhukum objektif yang diterapkan dalam kasus ini, serta bagaimana telaah filsafat hukum melalui kajian paradigma akan menguraikan persoalan hukum ini. Pembahasan akan dijabarkan dalam paradigma penulis yakni paradigma konstruktivisme dan melalui metode hermenutikal/dialektikal.</p><p><em>Recently, the Baiq Nuril case really caught the public's attention. This legal case began when Nuril, who at that time was still working as a temporary employee at the SMAN 17 Mataram, recorded the principal's telephone conversation with him who was in decency and insulted him. Long story short, through his colleague, the recording of the conversation was spread. Nuril was reported on the suspicion of Article 27 (1) of the Electronic Information and Transaction Law (ITE). The legal process was rolling, the Mataram District Court gave Nuril a free verdict. However, the Public Prosecutor filed an appeal and the Supreme Court finally sentenced Nuril guilty to a sentence of 6 months imprisonment and a fine of five hundred million rupiah. This is what later led to the polemic. The community protested the decision which he considered unfair. The people's disappointment in the law was felt through various movements to defend Nuril, both through fundraising and demonstrations. They are disappointed in the law which in fact actually punishes a victim of sexual abuse. Various bad perceptions of the law have sprung up, people are busy giving their lay views on this case. Scientifically, this case should be clearly explained through legal science, especially through legal philosophy. It is our duty as academics to elaborate on each sitting the case of the case becomes brighter, so as not to cause an error in thinking in society. Based on this description, the author will answer the problem of how the objective legal method applied in this case, and how the study of legal philosophy through the study of paradigms will describe this legal issue. The discussion will be elaborated in the author's paradigm of the constructivism paradigm and through the hermenutical / dialectical method.</em></p>

Abstract: Land Acquisition for Development in the Public Interest in Indonesia still often causes polemic, as is still often found in various mass media. The problem in the implementation of land aquisition is because the Law of the Republic of Indonesia Number 2 of 2012 concerning Land Aquisition for Development in the Public Interest, and the Presidential Regulation that follows it, has not rigidly stipulated the basis for determining the compensation value used to determine the compensation value. This research was conducted by making a comparison between ius constitutum and in concreto events in the field. Primary data in this study were obtained byinterviewing several sources in August 2017, which can be accounted for, while the secondary data were obtained byliterature studies. Based on the research, it is known that there is injustice in determining the value of compensation to the entitled parties. Seeing this, the author tried to describe the existing problems and provide solutions tailored to the situation and conditions in land aquisition in Indonesia. This was intended to actualize the value of social justice in the aquisition of land for development in the public interest in Indonesia.Intisari: Pengadaan Tanah bagi Pembangunan untuk Kepentingan Umum di Indonesia masih sering menimbulkan polemik, sebagaimana yang masih kerap ditemui dalam berbagai media massa. Permasalahan dalam pelaksanaan pengadaan tanah disebabkan karena Undang-Undang Republik Indonesia Nomor 2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum, serta Peraturan Presiden yang mengikutinya belum mengatur secara rigid tentang dasar penetapan nilai ganti kerugian yang digunakan untuk menetapkan nilai ganti kerugian. Kajian ini dilakukan dengan melakukan komparisi antara ius constitutum dengan peristiwa in concreto yang ada di lapangan. Data primer dalam kajian ini diperoleh dari hasil wawancara dari beberapa narasumber pada Agustus 2017 yang dapat dipertanggungjawabkan dan data sekunder dalam kajian ini diperoleh dari studi kepustakaan. Berdasarkan penelitian diketahui bahwa terdapat ketidakadilan dalam penetapan nilai ganti kerugian terhadap pihak-pihak yang berhak. Melihat hal tersebut penulis mencoba menguraikan permasalahan yang ada dan memberikan solusi yang disesuaikan dengan situasi dan kondisi dalam pengadaan tanah di Indonesia. Hal ini dimaksudkan untuk mengaktualisasikan nilai keadilan sosial dalam pengadaan tanah bagi pembangunan untuk kepentingan umum di Indonesia

This note concerns a controversial issue that has, surprisingly, received limited academic interrogation: whether the Public Protector has the power to instruct the President of South Africa to appoint a commission of inquiry. In this respect, I critique a high court decision which answered the question in the affirmative. I contend that the judgment contradicts prior case law, including Constitutional Court precedent. Thus, I argue that the court misconstrued the law on the President’s powers, particularly when it concluded that those powers are not purely discretionary but entail ‘responsibilities’ which are ‘coupled with a duty’. This reasoning led the court to conclude that the President thus has a constitutional ‘obligation’ to appoint a commission. In summary, I take issue with the court’s conclusion that the Public Protector has the power to instruct the President to appoint a commission of inquiry. I conclude that the decision caused uncertainty on the limitations of the Public Protector’s powers. I further say it is questionable whether the commission, better known as the ‘State Capture’ commission, was established lawfully.

This chapter describes the Cauca Valley Corporations (CVC) that performed the iconic functions of the developmental state, giving the national government unprecedented reach and power. The autonomous corporation was in fact the public authority that administered Colombia's 1961 land reform law in one of Latin America's richest agricultural regions. No policy more powerfully symbolized the promise of mid-century developmentalism, and none depended more systematically on local intermediaries whose skills and relationships undergirded every property negotiation, cadastral survey, and forcible eviction. The CVC translated the letter of the law into facts on the ground. The CVC also interpreted the law and sealed its fate in the Cauca Valley. Crafted in the wake of the Cuban revolution, Colombia's agrarian reform aimed to show Latin Americans that capitalist development could deliver economic redistribution and social justice.

<p>The origins of the modern Polish system of notaries date back to the period of the Polish Second Republic. At the end of World War I, the institution of notaries in Polish lands was heterogeneous. There were three separate notary organizations, which regulated differently the systemic position, tasks and functions of the notary. The rebirth of the Polish State brought the issue of unification of the system of notaries. Works on this ground-breaking task took place for several years and ended with the creation of the Law on Notaries of 27 October 1933. The article is intended to precisely determine the systemic position of the notary under the first Polish Law on Notaries. Article 1 of the Regulation defined notary as a public functionary appointed to draw up acts and documents to which the parties were obliged or wanted to give the public attestation and to carry out other acts as entrusted to him by law. Attempts to define the concept of a public official revealed numerous terminological problems and generated the need to conduct research on the issue of the notary’s position both in terms of scholarly reflection and dogmatic terms. In order to determine the systemic position of the notary, the article presents a detailed analysis of the term “public functionary” used in Article 1 of the Law on Notaries, views of the most eminent representatives of legal science in Poland on this subject and the scope of activities of the notary. The doubts and terminological difficulties identified in the course of these activities led to a deeper analysis of the provisions of Section I of the Law on Notaries, entitled “System of Notaries” (provisions of Chapters I–III) and of the case law. However, the attempt undertaken in the article to clearly define the position of the notary under the first Polish Law on Notaries did not bring a fully satisfactory result. The analysis of the position of the notary in the light of the Law on Notaries of 1933 indicates that there are serious difficulties in defining it precisely, both among the scholars in the field and the judicature. To fully define it, a closer analysis of the provisions of the Law on Notaries concerning the supervision of notaries, disciplinary and compensation liability of notaries, the professional self-government of notaries and the rules of preparation for the profession of notary was necessary. These issues have a significant impact on the final shape of the notary’s position within the legal system. Due to editorial limitations, these issues will be addressed in the second part of this article, along with final conclusions.</p>

Abstrak Penelitian ini bertujuan untuk mengetahui unsur Ignorantia Legis Excusat Neminem (ketidaktahuan tentang hukum) yang terdapat dalam fiksi hukum, jika diterapkan dalam kasus pembakaran mayat yang terjadi Sanden Bantul Yogyakarta. Metode penelitian ini menggunakan kualitatif deskriptif. Adapun tempat penelitian dilakukan di Polres Bantul dan Pengadilan Negeri Bantul, penelitian dilakukan pada bulan Maret sampai Mei 2019. Subjek dari penelitian ini dua orang yaitu Penyidik dari Polres Bantul dan Hakim Pengadilan Negeri Bantul. Teknik analisis data yang digunakan adalah dengan mereduksi data yang diperoleh, kemudian menyajikan data yang mempunyai hubungan dengan judul penelitian. Keabsahan data menggunakan triangulasi teknik untuk menguji kredibilitas data dan dilakukan dengan cara mengecek data kepada sumber yang berbeda dengan teknik yang sama. Hasil penelitian menyimpulkan bahwa unsur Ignorantia Legis Excusat Neminem (ketidaktahuan tentang hukum), bukan menjadi alasan untuk meringankan atau membebaskan pelaku dari tuntutan hukum, yang dapat membebaskan pelaku jika tidak bisa mempertanggungjawabkan perbuatannya, contohnya adalah orang gila dan yang dapat meringankan adalah pertimbangan hakim, selain itu kekuasaan hakim dapat meringankan penahanan pelaku dengan menggunakan sisi kemanusiaannya. Unsur Ignorantia Legis Excusat Neminem bagian dari fiksi hukum menandakan masih kurang maksimalnya penyebarluasan aturan perunang-undangan kepada masyarakat, karena masih ada warga masyarakat yang melakukan kejahatan, berpangkal dari ketidaktahuannya tentang hukum. Seperti kasus yang terjadi di Sanden Bantul tentang pembakaran mayat ini. Kata Kunci: Ignorantia Legis Excusat Neminem, Pembakaran Mayat, Fiksi Hukum Abstract This study aims to determine the elements of Ignorantia Legis Excusat Neminem (ignorance of the law) contained in legal fiction, if applied in the case of the burning of bodies that occurred in Sanden Bantul, Yogyakarta. This research method uses descriptive qualitative. The place of research was conducted in Bantul District Police and Bantul District Court, the study was conducted in March to May 2019. The subjects of this study were two people, namely Investigators from Bantul Regional Police and Bantul District Court Judges. The data analysis technique used is by reducing the data obtained, then presenting data that has a relationship with the research title. The validity of the data uses triangulation techniques to test the credibility of the data and is done by checking data to different sources with the same technique. The results of the study concluded that the element Ignorantia Legis Excusat Neminem (ignorance of the law), is not an excuse to relieve or free the perpetrators of lawsuits, which can free the perpetrators if they cannot account for their actions, for example, crazy people who can alleviate judges, besides the power of judges can alleviate the detention of perpetrators by using their humanity side. The element of Ignorantia Legis Excusat Neminem, part of legal fiction, indicates that there is still a lack of maximum dissemination of regulations to the public, because there are still people who commit crimes, stemming from their ignorance of the law.
