The increasing corruption in Indonesia occurs because of the indecision of the leader. This is contrary to the 1945 Constitution of the republic of Indonesia that the position of the president is the chief executive. This has repercussions on the position where the president to act without pressure in combating corruption. The leader can apply the Niccolo Machiavelli’s idea that is to take the ideas of the people and focus on those ideas, and then restore those ideas to the people so that they apply them, and to make corrections in case of errors. Such is the basic method of leadership. In conclusion, Niccolo Machiavelli’s ideais appropriate to be applied in combating corruption because in the Law Bo. 20 of 2001 has created a justice for the perpetrators of corruption when declared as the accused of corruption. The main concern is to take advantage with the position of president as the chief executive, in which the president may also be subject to the decisive law. This firm attitude will have an impact on law enforcement to implement legislation fairly. The suggestions that can be put forward in combating corruption is understanding the doctrine of jurisprudence, from countries, that are considered poor should be a critical review in the development of legal science in Indonesia, extending the meaning of gratification by incorporating sexual elements, and applying social sanctions.

The purpose of law enforcement is to harmonize the relationship of the values that are outlined in the rules, and to create, maintain and preserve peace in social life. Women and children are very vulnerable to becoming victims in all forms of violence or criminal acts, including violence in the domestic sphere. This research is descriptive analysis because it only explains about legal arrangements, law enforcement, as well as barriers and efforts to enforce the law by Medan Police against perpetrators of criminal acts of domestic violence (Research Study at Medan Police).The regulation of domestic violence law is contained in the Article 4 of Law of the Republic of Indonesia Number 23 of 2004 concerning Domestic Violence which states that the purpose of domestic violence is to prevent all forms of domestic violence, protect victims, take action against perpetrators, and maintain the integrity of the household. The application of the law by the police against the perpetrators of criminal acts of domestic violence prioritizes prevention, protection of victims, and maintaining household integrity. Barriers and efforts in law enforcement are that the regulations contained in PKDRT Law have not been integrated with other statutory regulations for law enforcement against criminal acts of domestic violence, so that the police strive to deal with restorative justice in order to improve and maintain the integrity of the households of the people dealing with the law.Keywords: Law Enforcement, Perpetrator, Criminal Acts, Domestic Violence

This chapter explores how gendarmes in the Republic of Niger, notwithstanding their aspiration for popular legitimacy, try to justify their actions, not to others, but to themselves. Civilians bring the stories of their problems to the gendarmes’ attention in the form of complaints. Whether a complaint turns into a case, and thus whether the gendarmes become active, depends on their appreciation of the complainant’s story and whether their ‘vocational ear’ is attuned to this story; and their vocational ear functions much more in terms of the material and moral gravity of the alleged offence, not in terms of the law.

Land given to and owned by people with rights provided by the UUPA is to be used and utilized. The granting and possession of land with these rights will not be meaningful if its use is limited to land as the surface of the earth. The land also has a significant role in the dynamics of development. According to the 1945 Constitution of the Republic of Indonesia NRI,  "earth and water are natural resources contained therein controlled by the state and used for the greatest prosperity of the people." This research uses a normative juridical approach that is research based on the rules / according to the law because this research focused on the use of document studies and literature or secondary data. The research specification used is descriptive-analytic, which describes the law of the land in the era of globalization based on local wisdom. The results of the study illustrate that the role of the land ruling state, which used for the prosperity of the people, is regulated under Law No. 5 of 1960 concerning Basic Regulations on Agrarian Principles (UUPA).On the other hand, the globalization of law is nothing more than a legal intervention from developed countries towards developing countries in order to adjust their laws globally. One way to address the problem of globalization of land law is to reaffirm local wisdom. In other words, they are upholding the customary provisions related to land. Example: provisions of customary land. Customary land is communal land that is jointly owned and thus does not need to be certified.Keywords: globalization, land law, local wisdomABSTRAKTanah diberikan kepada dan dipunyai oleh orang dengan hak-hak yang disediakan oleh UUPA, adalah untuk digunakan dan dimanfaatkan. Diberikannya dan dipunyainya tanah dengan hak-hak tersebut tidak akan bermakna, jika penggunaannya terbatas hanya pada tanah sebagai permukaan bumi saja. Tanah juga mempunyai peranan yang besar dalam dinamika pembangunan. Undang-undang Dasar 1945 menjelaskan bahwa “Bumi dan air dan kekayaan alam yang terkandung didalamnya dikuasai oleh negara dan dipergunakan untuk sebesar-besar kemakmuran rakyat.” Penelitian ini menggunakan pendekatan yuridis normatif yaitu penelitian yang didasarkan kepada kaidah-kaidah/menurut hukum, oleh karena penelitian ini dititik-beratkan pada penggunaan studi dokumen dan bahan pustaka atau data sekunder. Spesifikasi penelitian yang digunakan adalah deskriptif analitis yang menggambarkan tentang hukum tanah di era globalisasi berdasarkan kearifan lokal. Hasil penelitian menggambarkan bahwa peran negara penguasa tanah yang digunakan untuk kemakmuran masyarakat diatur berdasarkan Undang-undang No. 5 tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA). Disisi lain, globalisasi hukum tak lebih sebagai intervensi hukum dari negara maju terhadap negara berkembang agar menyesuaikan hukumnya secara global. Salah satu cara menyikapi persoalan globalisasi hukum tanah ini adalah dengan menegaskan kembali kearifan lokal. Dengan kata lain, menegakkan kembali ketentuan-ketentuan adat terkait dengan tanah. Misalnya ketentuan tanah ulayat. Tanah ulayat merupakan tanah komunal milik bersama, dengan demikian tidak perlu disertifikatkan.

ABSTRAKKetentuan Pasal 4 dan Pasal 16 ayat (1) huruf f Undang-Undang Jabatan Notaris mewajibkan notaris untuk menjaga kerahasiaan segala sesuatu mengenai akta yang dibuatnya dan segala keterangan yang diperoleh guna pembuatan akta sesuai dengan sumpah janji jabatan kecuali undang-undang menentukan lain. Kemungkinan terhadap pelanggaran kewajiban tersebut berdasarkan Pasal 16 ayat (11) Undang-Undang Jabatan Notaris, seorang notaris dapat dikenai sanksi berupa teguran lisan sampai dengan pemberhentian dengan tidak hormat. Terlebih lagi dengan adanya putusan Mahkamah Konstitusi Republik Indonesia dengan Nomor: 49/PUU–X/2012 memutuskan telah meniadakan atau mengakhiri kewenangan Majelis Pengawas Daerah (MPD) yang tercantum dalam Pasal 66 ayat (1) UUJN membuat notaris seakan-akan tidak ada perlindungan hukum bagi notaris dalam menjalankan tugas jabatannya. Ikatan Notaris Indonesia (INI) harus berusaha menjalankan peranan pembinaan dan perlindungan meningkatkan pengetahuan, kemampuan dan keterampilan para notaris. Demikian juga menjalin hubungan dengan para penegak hukum lainnya, agar penegak hukum lainnya yang ada hubungan dengan notaris dapat memahami kedudukan notaris sesuai UUJN.Berangkat dari pemikiran inilah kewajiban ingkar notaris masih tetap dipertahankan oleh pembuat undang-undang dalam revisi Undang-Undang Jabatan Notaris Tahun 2014 yang merupakan konfigurasi kekuatan perlindungan terhadap profesi dan jabatan notaris dari sisi politik.Kata Kunci : Jabatan Notaris, Hak Ingkar, Perlindungan Hukum.ABSTRACTThe provisions of Article 4 and Article 16 paragraph (1) sub-paragraph f of the Notary's Office Law require a notary to maintain the confidentiality of all matters concerning the deeds it has made and all the information obtained for the deed in accordance with the oath of pledge of office except the law otherwise. The possibility of breach of such obligation under Article 16 paragraph (11) of Notary Law Regulation, a notary public may be subject to sanctions in the form of oral reprimands until dismissal with disrespect. Moreover, with the decision of the Constitutional Court of the Republic of Indonesia with the number : 49 /PUU-X/2012 deciding to have canceled or terminated the authority of the Regional Supervisory Board (MPD) listed in Article 66 paragraph (1) UUJN made a notary as if there was no legal protection for a notary in performing duties. The Indonesian Notary Bond (INI) should endeavor to undertake the role of guidance and protection to increase the knowledge, abilities and skills of the notaries. Likewise establish relationships with other law enforcers, so that other law enforcement who has relationship with the notary can understand the position of notary under the UUJN.Departing from this thought the obligation of notarization is still maintained by the lawmakers in the revision of the Law Regulation of Position Notary on Year 2014 which is the configuration of the strength of the protection of the profession and the notary's position from the political side.Keyword : Position of Notary, Right of Remedy, Legal Protection.

The article discusses and analyzes some of the provisions of the current operational-search legislation of the Republic of Kazakhstan. Based on comparative analysis and study of legal literature, the problems arising in law enforcement activities in the implementation of certain provisions of the law are raised. The author makes suggestions and recommendations for improving legal norms aimed at solving problems related to the prevention, prevention and suppression of the most dangerous criminal offences.

During the early days of 1859, Port-au-Prince was busy with holiday celebrations, dramatic addresses and colorful events. Haitians possess a certain genius for properly observing a great day, and indeed it seemed that halcyon days had at last arrived in the Caribbean. Before the national legislature that April came a new president, a man for all the people. He was a person of medium height, rather slender and very erect and dignified. A mixture of Negro and mulatto elements, the new national hero had a very dark complexion, gray hairs befitting his fifty-three years, and courteous airs. In fact, his decorum was striking, set off as it was with a quiet gentleness, polish and evident idealism that seemed almost out of place in a Haitian warrior who had just dethroned an emperor.The ownerless imperial crown, symbolic of the recently defunct regime, was brought before the restorer of the old Republic. Fittingly, the chief executive employed allegory to express his adventure into reform. After a long, flowery speech denouncing the exiled Emperor Faustin I, President Nicolas Fabre Geffrard swore fidelity to the popular government, announced some preliminary political changes, and took up a small gavel. With this he struck the crown three times, condemning the magnificent diadem and its regime as he inaugurated the Republic which must not waver. From that day on the crown of Soulouque became a museum piece, but what is symbolized could not be so easily defeated and discarded.

Studying of issues regarding criminal infractions – whether intended or imprudent – plays quite a significant role. Fundamental changes taking part in world economy and politics, globalization processes, as well as internal dynamics of country development, undoubtedly, have impact on national legal framework, including criminal law. Therefore, the main goal of the present paper is the analysis of legislation of the Republic of Kazakhstan regarding criminal infractions and the law enforcement practice. To reach this goal authors have used methods of comparison, analysis and data systematization. As a result it has been found that in Kazakhstan there are at average 4,3 registered criminal infractions per a convict. The term of criminal infraction has appeared in the Criminal Code in 2014 to cover offences of small gravity and administrative violations that cannot be referred to the sphere of state administration. Authors have revealed the punishment in the present day Kazakhstan is not a main form of criminal responsibility realization. In the majority of cases linked to criminal infractions the persons committed them are relieved from criminal responsibility at the stage of prejudicial inquiry.
