In this paper, I reflect on the role and function of the camera ’acting’ (that is, the camera placed in the hands of the protagonists of films by Wojciech Smarzowski) that appears on the screen as often as an axe, which as an item is strongly associated with this director’s cinematography. I also refute the ‘digital’ legends of his debut – The Wedding, which has not been recorded using a digital camera, but an analogue one. A camera ‘cast’ in Smarzowski’s film should not be considered an extra, but a full-fledged protagonist, a witness seeing (and therefore recording) more than can be seen by the characters holding it in their hands. This perfectly corresponds with the last shot – perhaps the most characteristic one for the author of the films discussed – the shot in which the One who reigns over the world, but does not interfere with it (since we have free will) gazes at the universe created by Wojciech Smarzowski.

The recent decision in Phillips v. Ford Motor Co. of Canada Ltd. et al.t has reopened question which some might have considered to be somewhat settled: the role and function of the trial judge. Professor Silverman has taken the Phillips decision as cue for making comprehensive analysis of the English and Cana dian case law concerning the trial judge's function, in civil as well as criminal cases. Such issues as the rule requiring the presentation of evidence in open court, the limitations on the trial judge's right to call witnesses, his interference in the examination of witnesses and his intervention in the trial as whole are examined. Professor Silverman notes that although there may be dicta in some criminal and civil cases which apply to both, the better approach for the trial judge is to restrict himself "as much as possible" to the principles set out in cases of the same nature (criminal or civil) as the one before him. However, the author does lay down several general propositions delineating the boundaries of the trial and the role of the trial judge, which are applicable to both criminal and civil cases. Professor Silverman concludes, that although a trial judge may be pilot he "is certainly more than an umpire, watching the sporting-theory of litigation in action; and he is less than participant in that he should not enter into the fray of combat nor take on the mantle of counsel".

The article attempts to reanalyze the concept of God, human, and their relation. God, in Islam, is The One, The Life, The Eternal, and The Endless. His Oneness is absolute, but His Absoluteness is unlike the absoluteness of the universe. God is transcendent and immanent at the same time. Al-Attas distinguishes the concept of God as Rabb and God as Ilāh. Human, to al-Attas, is spirit and organism, and body and soul. The organismic side of human beings along with their five senses functions to help them living in the world. The spiritual dimension of human beings, on the other side, has an ability to formulate a set of meanings which involve assessment, differentiation, and explanation. When we observe the relation of God and human from the concept of tawḥīd ulūhīyah and tawḥīd rubūbīyah we will find two interrelated role of human, namely the role as God’s servant and the role as God’s representative and mandate (khalīfah) on the earth. These two roles are inseparable. Al-Attas argues that separation of the two will create imbalance personality of the human. It will subsequently jeopardize their existence and the earth they live on.

This chapter discusses contemporary debates regarding the use of artificial intelligence as a vehicle for criminal justice reform. It closely examines two general approaches to what has been widely branded as “algorithmic fairness” in criminal law: the development of formal fairness criteria and accuracy measures that illustrate the trade-offs of different algorithmic interventions; and the development of “best practices” and managerialist standards for maintaining a baseline of accuracy, transparency, and validity in these systems. Attempts to render AI-branded tools more accurate by addressing narrow notions of bias miss the deeper methodological and epistemological issues regarding the fairness of these tools. The key question is whether predictive tools reflect and reinforce punitive practices that drive disparate outcomes, and how data regimes interact with the penal ideology to naturalize these practices. The chapter then calls for a radically different understanding of the role and function of the carceral state, as a starting place for re-imagining the role of “AI” as a transformative force in the criminal legal system.

The leading death cause in the world is diseases of the cardiovascular system, with CHD as the leader in the structure of cardiovascular diseases. The cause of this disease is atherosclerosis. One of the possible causes of atherosclerosis is an increase in LDL-C and a decrease in HDL-C in the blood. Many epidemiological studies have reliably shown that HDL cholesterol reduces the risk of developing cardiovascular diseases. Data from recent studies cast doubt on this data. The review briefly describes the current understanding of the effect of HDL-C high levels on morbidity and mortality, lists the new approaches to assessing the role and function of these particles, presents the results of clinical studies of drugs that affect their concentration in blood plasma and the probable causes leading to an increase of the HDL-Cin content in the blood.

- The positive law tradition has hitherto had nothing to say about the legal profession's role and function, focusing more interest on questions of justice, of the legitimisation of power and of the genesis and organisation of normative material. This trend is now subject to a reversal promoted by new, neo-constitutionalist, narrativist, analytical and hermeneutic experiences, which no longer focuses attention on the moment when law is produced, but on the one when it is applied, reappraising and revitalising the function of the judge, of the attorneys and of other legal professionals. The attorney becomes an active protagonist, an intermediary not only between conflicting interests in a controversy, but also between opposing public interests, while the reappraisal of his role stimulates thinking about the ethical dimension of how the legal profession is practised. Referring to the theories of Habermas and of Alexy, the author treats the reasonable status of argumentation as the supreme ethical instance necessary for a decision that interferes in the sphere of another person's action. At the same time, however, the control of the reasonable status of the respective arguments on both sides is the ethical instance required of the attorneys taking part in the legal proceedings. It takes the form of compliance with the rules characteristic of the practical discourse, primarily the rule of free discursive participation that enables the onus of the argumentation to be explained. Russian political emigration from the beginning of its birth in the first half of the nineteenth century was constantly in search of forms and methods of struggle with royal power in the homeland. Detachment from Russia, the feeling of isolation that was inherent in emigration to the early twentieth century, were an important factor in the ongoing conflicts that took place in its environment. We note the conflicts between the «old» and the «young» emigration in the late 1860’s, between the Marxists and the populists of the 1880’s, between the revolutionary Marxists and the «economists» at the end of the 1890’s. All of these, as a rule, were due to excessive the ambitions of some leaders, the attempt to become the «rulers of ideas» for revolutionary youth, due to significant financial problems. In the list of these and similar conflicts there are events of 1870, when in the environment of political emigration there are two serious confrontations between the leader of anarchists M. Bakunin on the one hand and S. Nechaev or «Russian section of the First International» - on the other. These conflicts significantly influenced the situation in emigration, disorganized it, weakened the ability to fight the tsarist regime. They were accompanied by sharp accusations, searches for compromising materials, attempts to get support from leaders of the world revolutionary movement. The ambitions of young revolutionaries such as S. Nechaev or M. Utin were also connected with the attempt to take the main place among the emigrants, moving to the background of former leaders M. Bakunin, M. Ogarev, P. Lavrov. All this led to split in emigrant colonies, which consisted mainly of student youth. Violent discussions, accusations, boycotts became a hallmark of emigrant life. Basically, all these events took place in Switzerland, which at that time already became the center of not only Russian, but also international political emigration. Conflicts were directed at the political annihilation of the opponents, which subsequently resulted in the arrest and extradition to the Russian government of S. Nechaev in 1872, the cessation of the activities of the Russian Section of the First International and the return of M. Utin to Russia and the cessation of revolutionary activity in general. The positive side of these conflicts was the rallying of emigrants around their leaders, better information on the state of affairs in their environment, the development of new forms and methods of interaction and the strengthening of the role of revolutionaries from Russia itself.
