In the Criminal Code Bill, there are articles of criminal acts of decency either from the Criminal Code (KUHP) or from several other laws. In the Criminal Code Bill there is also criminalization of several acts that are considered to violate decency. The criminalization of some of these acts was considered violating morality, including incest, revision of adultery, revision of homosexual perpetrators, cohabitation, and sodomy. Both the revised and the new articles on decency have caused pros and cons in society. This paper aims to examine the criminalization of actions deemed to violate morality in the Criminal Code Bill from the perspective of moral theory. Based on the moral theory, the policy of criminalization of several acts that are considered to violate morality is in accordance with the criteria of criminalization, namely the act is immoral and harmful to individuals and society. In addition, criminalization of acts deemed violating morality is also because it is contrary to cultural and religious norms of most Indonesian people. However, in criminalization, the legislator must also take into account matters related to the problem of proof and law enforcement so as not to violate the rights of one's privacy. Besides, the legislator must also consider how the provisions in the Criminal Code Bill as a legal codification can prioritize the principle of unification so that it can be accepted and applied in the community.AbstrakSelain memuat kembali pasal-pasal tindak pidana kesusilaan baik yang bersumber dari Kitab Undang-Undang Hukum Pidana (KUHP) maupun dari beberapa Undang-Undang (UU) lainnya, Pembentuk Rancangan Undang-Undang tentang Hukum Pidana (RUU HP) juga menentukan kriminalisasi terhadap beberapa perbuatan yang dinilai melanggar kesusilaan. Dalam RUU HP, beberapa perbuatan dikriminalisasi karena dinilai melanggar kesusilaan, antara lain yaitu: inses, perluasan pelaku perzinaan, perluasan pelaku homoseksual, kumpul kebo, dan sodomi. Baik mengenai pasal-pasal kesusilaan yang direvisi maupun pasal-pasal kesusilaan yang baru telah menimbulkan pro dan kontra di masyarakat. Tulisan ini bertujuan untuk mengkaji kriminalisasi perbuatan asusila dalam RUU HP dari perspektif teori moral. Berdasarkan pada teori moral maka kebijakan kriminalisasi terhadap beberapa perbuatan yang dinilai melanggar kesusilaan dalam RUU HP memenuhi kriteria kriminalisasi, yaitu perbuatan tersebut amoral dan berbahaya bagi individu dan masyarakat. Selain itu, kriminalisasi perbuatan yang dinilai melanggar kesusilaan juga karena bertentangan dengan norma budaya dan agama sebagian besar masyarakat Indonesia. Namun demikian, dalam kriminalisasi, Pembentuk UU (DPR dan Pemerintah) juga harus memperhitungkan hal-hal terkait dengan masalah pembuktian dan penegakan hukumnya agar tidak melanggar hak privasi seseorang. Selain itu Pembentuk UU juga harus mempertimbangkan bagaimana ketentuan-ketentuan dalam RUU HP sebagai kodifikasi hukum dapat mengedepankan prinsip unifikasi sehingga dapat diterima dan diterapkan di masyarakat.

The existence of human rights is a concept that in principle is inherent in the existence and life of humans, human rights actually have a long history in which history can be traced from daily intercourse between humans. The international world knows the form of capital punishment is a type of crime that is very controversial and heaviest imposed on the perpetrators of crime so that it always raises a variety of pros and cons opinions in it. Based on this, the purpose of this paper is to find out and understand the basic legal arrangements for the death penalty in Indonesia and the application of capital punishment in the perspective of human rights. This research uses normative legal research. The death penalty is a very old type of crime that may even be as old as the existence of humanity itself. Capital punishment is the most severe type of criminal offenses of all types of basic crimes, so that capital punishment sanctions constitute a threat imposed on the perpetrators of serious crimes that have been decided by the court. In the international worldview, capital punishment is one of the most controversial forms of crime of all types of criminal sanctions in the criminal justice system in force in the world. Regarding law enforcement applied in Indonesia itself, it still applies the provisions of criminal sanctions in the Criminal Code (KUHP) and there is also listed in the Law outside the Criminal Code. Keberadaan hak asasi manusia merupakan suatu konsep yang pada prinsipnya melekat pada keberadaan dan hidup manusia, hak asasi manusia sesungguhnya memiliki sejarah panjang yang mana sejarah tersebut dapat ditelusuri dari pergaulan sehari-hari antarmanusia. Dunia Internasional mengenal bentuk pidana mati adalah merupakan jenis pidana yang sangat kontroversial dan terberat dijatuhkan kepada pelaku kejahatan, sehingga selalu menimbulkan berbagai opini pro-kontra di dalamnya. Berdasarkan hal tersebut maka tujuan dalam penulisan ini yaitu untuk mengetahui dan memahami tentang pengaturan dasar hukum pidana mati di Indonesia serta penerapan pidana mati dalam perspektif hak asasi manusia. Penelitian ini menggunakan jenis penelitian hukum normatif. Sanksi pidana mati merupakan salah satu jenis pidana yang sangat tua bahkan mungkin sama tuanya dengan keberadaan umat manusia itu sendiri. Sanksi pidana mati yaitu jenis pidana yang paling berat dari segala jenis pidana pokok, sehingga sanksi pidana mati merupakan ancaman yang dikenakan kepada pelaku kejahatan berat yang telah diputus oleh pengadilan. Dalam pandangan dunia internasional, pidana mati adalah salah satu jenis bentuk pidana paling kontroversial dari semua jenis sanksi pidana dalam sistem peradilan pidana yang berlaku di dunia. Mengenai penegakan hukum yang diterapkan di Indonesia sendiri masih menerapkan ketentuan sanksi pidana dalam Kitab Undang-Undang Hukum Pidana (KUHP) dan ada pula yang dicantumkan di dalam Peraturan Perundang-undangan di luar KUHP.

Purpose. The aim of the work is to consider the novelties of the legislative work, which provide for the concept and classification of criminal offenses in accordance with the current edition of the Criminal Code of Ukraine and the draft of the new Code developed by the working group and put up for public discussion. Point out the gaps in the current legislation and the need to revise individual rules of the project in this aspect. The methodology. The methodology includes a comprehensive analysis and generalization of the available scientific and theoretical material and the formulation of appropriate conclusions and recommendations. During the research, the following methods of scientific knowledge were used: terminological, logical-semantic, system-structural, logical-normative, comparative-historical. Results In the course of the study, it was determined that despite the fact that the amendments to the Criminal Code of Ukraine came into force in July of this year, their perfection, in terms of legal technology, raises many objections. On the basis of a comparative study, it was determined that the Draft Criminal Code of Ukraine needs further revision taking into account the opinions of experts in the process of public discussion. Originality. In the course of the study, it was established that the classification of criminal offenses proposed in the new edition of the Criminal Code of Ukraine does not stand up to criticism, since other elements of the classification appear in subsequent articles, which are not covered by the existing one. The draft Code, using a qualitatively new approach to this issue, retains the elements of the previous classification and has no practical significance in law enforcement. Practical significance. The results of the study can be used in law-making activities to improve the norms of the current Criminal Code, to classify criminal offenses, as well as to further improve the draft Criminal Code of Ukraine.

The responsibility of the progressive law enforcement agency is to gain compliance with laws that promote harmony in society. Alcohol tends ,to alter the attitudes of otherwise law-abiding citizens so that there is a high correlation between the excessive use of alcohol and antisocial behavior. Laws in the criminal code dealing with alcohol fall roughly into four categories—those dealing directly with public safety, those that reflect moral at titudes, those reflecting the attitudes of loud minorities, and those dealing with the licensing, revenue, or sale of alcoholic beverages. From the standpoint of the general law enforcement agency, the only laws worthy of energetic enforcement are those dealing with public safety. The others are usually enforced by agencies with special and limited jurisdiction.

This study investigates child sexual abuse cases that remain high in Manado as well as its law enforcement against the perpetrators, especially for underage perpetrators. By using a normative legal method, this research paper aims to examine legal materials, namely the Criminal Code and the Child Protection Law No. 35 of 2014 by collecting empirical data about law enforcement by the North Sulawesi Regional Police. The findings indicate that the law enforcement on underage perpetrators depends on the investigators in charge, in principle, under Law no. 35 of 2014, and they are detained in Child Care Centers of Tomohon. Also, this research specifically underlined that law enforcement against underage perpetrators has followed the procedures of the juvenile justice system, while the victims do need special attention of institutions outside the police. To ensure the rights to education in detention, this study suggests to make special rules regarding the obligation of teachers to provide private lessons.

Progressive law puts forward the sociology of law rather than legal certainty which is the focus of legal positivism. In Indonesia, this law was coined by Satjipto Rahardjo. This study aims to determine the formulation of progressive law in future criminal law, and to determine the actualization of the concept of progressive law in regulating corruption in Indonesia. The research method used is a normative legal research method with statute and conceptual approaches. The technique of collecting legal materials in this study is a descriptive method that aims to obtain the meaning of reality related to the problems to be discussed and solved in this study. The results show that in the current Criminal Code Bill, progressive law has been regulated, to be precise in Article 2 paragraph (1) and (2). Progressive law is also regulated in Law no. 48 of 2009 concerning Judicial Power. Then, the actualization of progressive law in regulating corruption in Indonesia is a judge with the powers that take into account the sociological context of society in making decisions. Judges, prosecutors and lawyers can certainly discuss together in eradicating corruption. Efforts are also being made to reconstruct and redefine the power of law enforcement. This arrangement can also encourage the KPK to be more progressive in eradicating corruption, as well as building law enforcers who have morality so that they can become role models and increase public participation, for example by forming NGOs in preventing or fighting corruption in various agencies.

A crime or criminal act, usually perpetrators of criminals because of an encouragement based on the importance of fulfilling the necessities of life that is relatively difficult to fulfill. In principle the crime problem does not stand alone, but it relates to other issues such as social, economic, political and cultural which is as a phenomenon that affects each other. To tackle crimes and criminal acts such a thorough enforcement and anticipation policy is required. One of the most common criminal acts in the community is the violence of violent blackmail. Perpetrators can be assessed by the community, therefore it is necessary to be handled by the law enforcement officers intensively with the severity of the criminal that was dropped. The problem in this study is how the judge's consideration in dropping a criminal against perpetrators of criminal offenses with violence against motorcycles belonging to others, what are some factors causing perpetrators of criminal extortion with violence. The method of study used is the normative juridical approach and empirical approach obtained directly at the District Court of Kls II Kalianda, state Attorney of South Lampung. Based on the results of the study can be concluded that the judge's judgment in the criminal offence against the perpetrator of violent criminal offence is in accordance with the element contained in article 368 paragraph (1) of the criminal CODE and was sentenced to 2 years imprisonment. Factors affecting the cause of perpetrators of criminal extortion in violence are environmental factors, economic factors on society, the law enforcement. The advice given is to be expected to the Tribunal, the attorney general and the police in providing or establishing the article can be in accordance with its elements and actions, to the rationing punishment against the defendant is considered fair and give a deterrent effect so that the defendant can not repeat it again. There is cooperation between law enforcement and the community in minimizing the crimes that occurred.

В статье рассматриваются уголовно-правовые нормы, содержащиеся в гл. 26 УК РФ, устанавливающие ответственность за экологические преступления с точки зрения определения причин их низкой применяемости в судебной практике. Выделены наиболее актуальные уголовно-правовые проблемы, раскрыт ряд вопросов эффективности применения норм об ответственности за экологические преступления и проиллюстрированы ключевые моменты примерами правоприменительной практики, предложены пути законодательного их разрешения. The article discusses the criminal law contained in Sec. 26 of the Criminal Code, establishing liability for environmental crimes in terms of determining the causes of their low applicability in judicial practice. The most relevant criminal law problems are highlighted, a number of issues of the effectiveness of the application of the rules on liability for environmental crimes are revealed, key points are illustrated with examples of law enforcement practice, and ways to legislatively resolve them are proposed.

Indonesia has a law on education, namely Law No. 14 of 2005 on Teachers and Lecturers. In its implementation, there is a case that causes pros and cons to the statement of every article of the Teacher and Lecturer Law, especially in relation to the right to defend oneself in criminal acts of persecution. The purpose of this research is to know the arrangement of teaching methods for students during the learning process and to know the criminal sanctions against teachers who abuse students during the learning process. This study uses a normative method with the main data sources namely laws and regulations. The results showed that the element of an act, and / or the result of an act, pain in the body, and injuries to the body contained in Article 351 paragraph (1) of the Criminal Code refers to the Teacher and Lecturer Law, namely in Article 77 paragraph (6). This article defines the basis of persecution, namely actions that cause pain to a person. The criminal act of persecution in the world of education, at least, must be considered with the intention of disciplining and educating the nation's life.

The relevance of the study is based, on the one hand, on high public danger of crimes in the sphere of labor relations and, on the other hand, on a very low interest of law enforcement, control and supervision bodies in these crimes. The authors show that modern criminal legislation in the sphere of protecting labor rights has a high potential in comparison with both Soviet and foreign criminal law norms. At the same time, this potential, primarily expressed in Chapter 19 of the Criminal Code of the Russian Federation, remains untapped. Many norms, including Art. 136 of the Criminal Code of the Russian Federation «Violating the Equality of Rights and Freedoms of Man and Citizen», are virtually never used against discrimination in the labor sphere, although such discrimination is quite common. No such cases have been found in court statistical data, thus it is impossible to provide a comprehensive criminological description of these crimes. The norm of Art. 136 of the Criminal Code of the Russian Federation is seldom used by law enforcers because it is legally ambiguous. In this connection the authors suggest complementing the disposition of Art. 136 of the Criminal Code of the Russian Federation with such factors of discrimination as «age» and «marital status». The latter factor will make it possible to provide extra protection to pregnant women and women with children under three years old against unmotivated refusal of employment and firing. The authors argue that such actions of the employer should constitute an aggregate of crimes and should be punished simultaneously under Art. 136 and 145 of the Criminal Code of the Russian Federation. At the same time, the authors think that it is not appropriate to make the disposition of Art. 136 a blanket one due to vague grounds for discrimination in special legislation, including labor legislation. The obtained results could be used for the improvement of Russian legislation based on theoretical research and the practice of law enforcement.
