The involvement of children in the ISIS network has left a complex problem in the legal discourse in Indonesia, including how to deal with children involved in this terrorism network. This article aims to expose the problem of children in conflict with the law in the crime of terrorism. Due to this problem, the Indonesian government is often faced a dilemma between the neccessity to apply serious efforts to eradicate terrorism and the obligation to guarantee a protection to the children. Through a juridical-normative approach, focusing on ISIS children, this article demonstrates that one of the problems in dealing with children involved in terrorism networks lies in the vagueness of the rules addressing the children involved in this terrorism network as well as its implementation by the government. Therefore, this article argues that in order to be able to deal with children involved in terrorism networks, some of the legal instruments concerning the issue, especially the law on terrorism and the laws of children in conflict with the law as long as terrorism is concerned needs to be revised just to accommodate this issue in a more obvious normsto actually maintain a balance between the responsibility to protect the children and the need to preserve stability of the nation and state. Under the new revised laws, the government is hoped to work with and apply the provisions regarding children in conflict with the law in the case of terrorism crimes in the frame of justice and protection for children. Abstrak Keterlibatan anak dalam jaringan ISIS menyisakan permasalahan yang kompleks dalam wacana hukum di Indonesia berikut penanganan anak yang terlibat dalam jaringan terorisme ini. Artikel ini bertujuan untuk memaparkan masalah penangangan anak yang berkonflik dengan hukum dalam tindak pidana terorisme. Terkait hal ini, pemerintah Indonesia seringkali dihadapkan pada dilema antara upaya serius untuk memberantas tindak pidana terorisme dan kewajiban untuk memberikan perlindungan kepada anak. Melalui pendekatan yuridis-normatif, dengan mengambil kasus anak-anak ISIS, artikel ini memperlihatkan bahwa salah satu masalah yang ditemui dalam penanganan anak yang terlibat dalam jaringan terorisme terletak pada ketidakjelasan aturan sejauh menyangkut masalah penangangan anak tersebut berikut pelaksanaannya di lapangan oleh negara. Oleh karena itu, artikel ini berargumen bahwa untuk bisa menangani anak-anak yang terlibat dalam jaringan terorisme, beberapa instrumen hukum yang mengatur masalah ini, utamanya undang-undang terorisme dan undang-undang yang berhubungan dengan anak yang berkonflik dengan hukum harus direvisi guna mengakomodasi permasalahan ini secara lebih jelas yang benar-benar menjaga keseimbangan antara kepentingan anak dan kepentingan bangsa dan negara. Selanjutnya, pemerintah sejatinya mampu mengacu dan menerapkan segala ketentuan hukum yang berlaku mengenai anak yang berkonflik dengan hukum dalam kasus tindak pidana terorisme sebagaimana yang diakomodasi dalam undang-undang tersebut.

The inception of the regulation No. 6 year concerning immigration 2011 and No. 13 year 2003 and regarding the employment has had a huge impact in the political direction of the law controlling foreign workers who works in Indonesia. The controlling system of foreign workers who work in Indonesia aims to protect the rights of Indonesian citizens from losing their jobs because of the high number of foreign workers who come to work in Indonesia. As the implementation of an Article 27 paragraph 2 of the national constitution in 1945 specifies where every citizen of Indonesia has the right to work and a decent subsistence for humanity. As the state which constituted by the law, Indonesia has a responsibility to protect the rights of its citizens in accordance with Article number 28, paragraph 4 where the protection, promotion, enforcement and fulfillment of human rights is the responsibility of the state, especially in this case is the responsibility of the government. The utilization of foreign labor in Indonesia should be limited in number and areas that can be occupied by the foreign labor. The Labor law and regulation limit the positions that can be occupied by the foreign labor. The positions which are prohibited (closed list) should be considered by the employer before filing the utilization of foreign labor. Apart from having to comply with the provisions regarding the positions, the employer should also pay attention to the standards of an applicable competency.

Indonesia is a country that adopts a democratic system. In carrying out general elections it is a necessity that has been mandated by the 1945 Constitution in accordance with the sounds of Article 22E Paragraphs (1), (2), (3), (4), (5) and (6). This requirement makes it a condition in selecting Regional Representative Council Members. The  government, through Perppu No. 2 of 2020, remains unmoved that the regional head election will be held on 9 December 2020. Apparently this year 2020 has become a year unlike previous years, because in this year specifically Indonesia is in the Covid-19 pandemic and broadly Covid-19 has become a world epidemic today. Initially the 2020 elections will be held on September 23, 2020 to select 9 governors, 224 regents, and 37 mayors simultaneously. In conducting this analysis, the author uses a juridical normative approach, which is an approach aimed at studying the principles of law, and legal schemes. The discussion that the author will elaborate on is how the election is based on laws and regulations, also what kind of problems will arise in the holding of the elections during a pandemic, and what kind of implementation techniques, In order to know the limits of the application of the law to elections in the Covid-19 pandemic.

The creation of policy is one of the prerogatives of a free and uninhibited (freies ermessen, or free discretion) government administrations. Although freies ermessen grants free authority to the government, within the framework of national the law said the government should still observe legislation and the Principles of Good Governance. However, at the implementation level, there are still many policies that which are difficult to put into effect due to ambiguous interpretation and conflicts of interest, thus resulting in legal uncertainty. Based on this, there needs to be an affirmation of the position taken by the Indonesian government regarding the contradictory relationship between written law and implementation, so as to ensure the appropriate application of the principles of freies ermessen. This paper tries to explain the legal policy of the law carried out by the Indonesian government about zakat which is an obligation for capable Muslims as a manifestation of human empathy to others in need. Zakat has a noble goal, namely to alleviate poverty and eliminate social inequality in society. This objective is in line with one of the objectives of the Indonesian government which has been mandated in the opening of the 1945 Constitution, namely to advance public welfare. Thus, the management of zakat in Indonesia will be better, if implemented by the government, given that zakat is a very potential source of funds that can be used for public welfare for all Indonesian people. This article explains the process of formulating zakat laws in Indonesia, the substance of Islamic law in zakat, and the purpose of the Law (maqa>s}id al-risa>lah) about zakat in Indonesia, so that readers can fully comprehend the purpose of zakat law.

One of the agricultural problems in Indonesia is the crops supply chain that hampers the ability of the farmers to achieve better income from their farming activities. Although the government has issued the Law of the Farmer No 19 the year 2013 to protect and empower the farmer, the problem is still prevalent. It leads to a question of how to implement the law to tackle the problem of the crops supply chain. The study explains that the government has issued an Economy Digital Policy to create electronic commerce in agribusiness (E-Agribusiness) for farmers and to solve their agribusiness problem. However, the use of electronic agribusiness is not yet ample to solve the problem of the crops supply chain. The solution is a suggestion to apply Internet of Things which is using RFID technology to solve the problem of crops supply chain and distribution in E- Agribusiness. The methodology of the study is the normative approach and literature review.

The Law on the Conduct of Hajj Pilgrimage mandates the management of the Hajj pilgrimage is organized by the government. This management includes the coaching, service, and protection of the pilgrims from Indonesia, in Saudi Arabia, to returning to the homeland. This law also stipulates that the authority to conduct Hajj pilgrimage management is not only vested to the Ministry of Religious Affairs but also may involve the local government. This article aims to look at the role of local governments in providing service assistance and legal protection to the conduct of Hajj pilgrimage by means of regional regulations or bylaws. Using a normative approach, this article analyzes the extent to which the importance of bylaws in helping implement services for pilgrims. The results of this study confirm that there are 3 important arguments for why the local government must issue regional regulations to provide legal services and protection for pilgrims. First, philosophically, the pilgrimage journey does not depart from Jakarta only, but through the origin area which is still in the corridors of power of the local government. Second, sociologically, it is a form of the local government responsibility to the local people who perform the Hajj pilgrimage. Third, juridically, bylaws should regulate technical matters in order to provide optimal service in the conduct of the Hajj pilgrimage which is pursuant to the Law and regulations on Hajj pilgrimage in Indonesia.Keywords: legal protection, hajj pilgrims, regional regulation.AbstrakUndang-Undang penyelenggaraan ibadah haji mengamanatkan pengelolaan pelaksanaan ibadah haji yang meliputi pembinaan, pelayanan, dan perlindungan jamaah haji semenjak dari tanah air, di Arab Saudi, hingga kembali ke tanah air. Undang-undang ini juga memerintahkan kewenangan pelayanan masalah haji tidak hanya pada kementerian Agama, namun boleh melibatkan pemerintah daerah. Artikel ini bertujuan untuk melihat peran pemerintah daerah dalam memberikan bantuan layanan dan perlindungan hukum melalui peraturan daerah. Dengan menggunakan pendekatan normatif, artikel ini menganalisis sejauh mana pentingnya peraturan daerah menjadi peraturan di tingkat daerah dalam membantu melaksanakan pelayanan terhadap jamaah haji. Hasil dari artikel ini menegaskan bahwa terdapat 3 argumen penting mengapa Pemerintah Daerah harus mengeluarkan peraturan daerah guna memberikan pelayanan dan perlindungan hukum bagi jamaah haji. Pertama, secara filosofis perjalanan ibadah haji tidak berangkat dari Jakarta, tetapi melalui daerah asal yang masih dalam koridor pemerintah daerah. Kedua, Kedua, secara sosiologis sebagai bentuk tanggung jawab Pemerintah Daerah kepada masyarakat daerah yang menunaikan ibadah haji. Ketiga, secara yuridis PERDA mengatur secara teknis dalam rangka memberikan pelayanan yang optimal dalam penyelenggaran ibadah haji sesuai dengan Undang-Undang Republik Indonesia Nomor 13 Tahun 2008 tentang Penyelenggaraan Ibadah Haji dan Peraturan Pemerintah Republik Indonesia Nomor 79 Tahun 2012 tentang Pelaksnaan Undang-Undang Republik Indonesia Nomor 13 Tahun 2008 tentang Penyelenggaraan Ibadah Haji.Kata kunci: perlindungan hukum, ibadah haji, peraturan Daerah

Abstract Law protection of the consumer stipulated in Law No. 8 of 1999. In connection with this, in this thesis raised two issues, namely first, whether the Law No. 8 of 1999 on Consumer Protection has provided protection to the consumer in e-commerce transactions. Second, how the law protection for consumers in e-commerce transactions that should be regulated in the Consumer Protection Act. The methodology is used in this study using a normative approach because it is a law research aimed at writing regulations that are closely related research at the library that need data that is secondary. The conclusion of the research is Law No. 8 of 1999 has not been able to protect the consumer because of the provisions contained in this Law not accommodate consumer rights in this transaction. The Government should make a revision of Law No. 8 of 1999 so that it can protect not only conventional transactions but also e-commerce transactions.Abstrak Perlindungan hukum terhadap konsumen diatur dalam Undang-Undang Nomor 8 Tahun 1999. Sehubungan dengan hal tersebut, dalam tesis ini diangkat dua permasalahan yaitu Pertama, apakah UU Nomor 8 Tahun 1999 tentang Perlindungan Konsumen telah memberikan perlindungan  terhadap konsumen dalam melakukan transaksi e-commerce. Kedua, Bagaimana perlindungan hukum terhadap konsumen dalam transaksi e-commerce yang seharusnya diatur dalam UU Perlindungan Konsumen. Metodologi yang dipakai dalam penelitian ini menggunakan pendekatan normatif karena merupakan penelitian hukum yang ditujukan pada peraturan-peraturan tertulis sehingga penelitian ini sangat erat hubungannya pada perpustakaan yang membutuhkan data-data yang bersifat sekunder. Kesimpulan dari penelitian yang dilakukan adalah UU No 8 Tahun 1999 belum dapat melindungi konsumen karena ketentuan-ketentuan yang tercantum dalam hukum ini belum mengakomodirhak-hak konsumen dalam transaksi ini. Pemerintah seharusnya merevisi Undang-Undang Nomor 8 Tahun 1999 supaya dapat melindungi bukan hanya transaksi konvensional tetapi juga transaksi e-commerce.

This research uses a normative approach, which is carried out by examining laws and theories. Also, this study uses a case approach, namely the 2017 village fund corruption case in Pekon Sukaratu. The main problem in this res­earch is what is the authority of the prosecutor in conducting investigations into criminal acts of corruption after the passage of Law Number 30 of 2014 concerning Government Administration and whether the investigation carried out by the prosecutor at the Pringsewu District Prosecutor's Office in coordination with the Government Internal Supervisory Apparatus or Aparatur Pengawas Internal Pemerintah (APIP) against the allegations a criminal act of corruption in the management of village funds in 2017 in Pekon Sukaratu whose losses to the state have been returned have met the principle of legal certainty. The research results show that the prosecutor has the authority to carry out the law enforcement process, namely the investigation of suspected corruption crimes as stipulated in Article 30 paragraph (1) letter d of the law on the Prosecutor's Office of the Republic of Indonesia. Based on the results of the research that has been done, it is better if changes in laws and regulations related to the elements of corruption in Law No. 31 of 1999 concerning Eradication of Corruption Crime because there is a product of the Constitutional Court with the decision No. 25/PUU-XIV/2016. Besides, there is a need for socialization for prosecutors regarding their authority in TPK investigations and related to coordination patterns with the authority of APIP in carrying out investigations and calculating state financial losses.

The government through the law makes a policy to aggressively seek rehabilitation for the drug users. This is done in the context of tackling the abuse of narcotics in Indonesia. Thus, it is necessary to study the policy objectives based on the perspective of maqashid sharia by conducting qualitative research using secondary data. From the results of the research, the Indonesian Government has implemented rehabilitation sanctions for the narcotics user because the users are victims of other people's crimes, namely illegal narcotics dealers. If a narcotics user is given a sanction of imprisonment / imprisonment, it will have a worse impact and cannot eliminate his dependence on narcotics. Seen from the perspective of maqashid sharia, this government policy does not conflict with the objectives contained in the maqashid sharia concept, as the goal of rehabilitation which requires the users to be aware of their mistakes, so that they will become better humans both towards their God and those around him.

Indonesia is a country that is a tourist center for foreigners from various countries. This is supported because Indonesia has a wealth and stunning natural charm that makes Indonesia an attraction to become a tourist destination. Seeing this potential, the Indonesian government facilitates access to enter the country of Indonesia. But in reality, the kindness of the Indonesian government was abused by these foreigners. Many of the immigration violations they committed while in Indonesia, such as staying beyond a predetermined time limit or often called Overstay. In handling these cases, the government made various efforts in dealing with the problem of immigration violations. Supervision of foreigners is a form of effort by the government in terms of handling Overstay cases carried out by foreigners in Indonesia. In its implementation, the government also enforces the law against foreigners who commit Overstay violations so as to reduce the number of violations.
