Die Hauptfrage, die ich in diesem Aufsatz diskutieren will, ist die folgende: Welche sind die ästhetisch-normativen Voraussetzungen für das richtige Verständnis und die richtige Evaluation von Jazz? Meine These lautet: Die Jazzästhetik ist eine Ästhetik der gelungenen Performanz. Sie ist nicht eine Ästhetik der Unvollkommenheit. Ich werde meine Argumentation in die folgenden Abschnitte gliedern. Nach der Einleitung (I.) wird in Abschnitt II. die ›These der Unvollkommenheit‹ dargestellt und in III. werden anschließend einige Argumente dagegen diskutiert. In den Abschnitten IV. und V. werden die für die Jazzästhetik wichtige Frage nach dem »Fehler« und das entscheidende Thema der Normativität untersucht. Dazu werde ich geltend machen, dass die ›These der Unvollkommenheit‹ insbesondere deswegen unbefriedigend ist, weil sie die spezifische Normativität von Jazz als Improvisationskunst missversteht. In Abschnitt VI. wird schließlich erklärt, in welchem Sinne von einer Normativität der gelungenen Performanz die Rede sein kann und warum dies für unser Verständnis von Jazz bedeutend ist. Abschließend (VII.) wird diese Idee gegen mögliche Einwände verteidigt.<br><br>In this paper I aim at discussing the aesthetic-normative conditions for the right understanding and the right evaluation of jazz. My main point is this: The aesthetics of jazz is an aesthetics of the successful performance, rather than an aesthetics of imperfection. The paper will be structured as follows. SectionI introduces the topic. SectionII presents the ›imperfection thesis‹, while III discusses some arguments against it. Sections IV and V investigate two related questions: the first is about the role of the »mistake« in jazz; the second concerns the crucial topic of normativity. At this regard I will maintain that the ›imperfection thesis‹ does not work, especially because it misunderstands the specific normativity of jazz as improvisational art. Section VI is devoted to clarifying both in which sense the idea of a normativity of the successful performance is sound and why this idea is important for understanding jazz. Finally (VII) I defend this view against possible objections.

The main purpose of this study is to investigate the effects of Training and Information Technology (IT) Management on Organizational Performance. Based on a theoretical foundation and a wide review of the literature, the model of the research was proposed.  To achieve the research purpose, this study has integrated different theories such as Resource Based View of the Firm (RBV), Knowledge Based View (KBV) in order to analyze the effect of Training and IT Management on Organizational Performance. 341 Questionnaires were distributed among random selected sample of Sharjah Police departments in Sharjah city in Emirates. 245 questionnaires were returned and used in the analysis using the SPSS system. The results of this study demonstrate that including Information Technology (IT) Management has positive and significant effect on Organizational Performance in Sharjah Police. This study reflects the importance of the right implementation to the Training and IT Management to have successful performance. This study also supported the premises of the resource-based view theory by reaffirming the importance of the including Training and IT Management to enhance organizational performance.

The main purpose of this study is to investigate the effects of Strategy Management (ST) and Balanced Scorecard (BSC) on Organizational Performance (OP). Based on a theoretical foundation and a wide review of the literature, the model of the research was proposed. 220 Questionnaires were distributed among random selected sample of Civil Defense departments in the Northern Emirates. 188 questionnaires were returned and used in the analysis using the PLS-SEM. The results of this study demonstrate that Strategy Management and Balanced Scorecard have positive and significant effect on Organizational Performance. This study reflects the importance of the right implementation to the strategy management and BSC to have successful performance. This study also supported the premises of the resource-based view theory by reaffirming the importance of the Strategy Management and BSC as drivers to enhance organizational performance.

In two experiments, we investigated whether body posture influences people’s estimation of quantities. According to the mental-number-line theory, people mentally represent numbers along a line with smaller numbers on the left and larger numbers on the right. We hypothesized that surreptitiously making people lean to the right or to the left would affect their quantitative estimates. Participants answered estimation questions while standing on a Wii Balance Board. Posture was manipulated within subjects so that participants answered some questions while they leaned slightly to the left, some questions while they leaned slightly to the right, and some questions while they stood upright. Crucially, participants were not aware of this manipulation. Estimates were significantly smaller when participants leaned to the left than when they leaned to the right.

An understanding of videogame performance may increase our knowledge of human performance generally and clarify ways in which performance can be enhanced. Few studies to date have examined factors that may contribute to successful performance in videogames. The hypothesis, based on preliminary observation, was that the position one occupies—right or left—affects performance in a television ping-pong game (“pong”). Analysis showed that right-handed male university students ( n = 40) performed better when seated on the right than on the left. The right-side advantage was maintained even when subjects were presented a mirror-image of the game, indicating that characteristics of the apparatus were not solely responsible for the effect. Perhaps compatibility of certain display and response components in the pong game accounted for the advantage of the player's position.

A pair of autistic monozygotic twins were assessed on relevant portions of the Geddes Psychomotor Inventory. Over-all motor development of the 3-yr., 6-mo. old twins was similar and considered a partial consequence of the same genotype and comparable environmental experiences from birth. The twins exhibited poor or unsuccessful performance on tasks requiring abilities in language, communication, and appropriate relationships to objects; superior performance on specific fine manual motor skills, walking balance board, and climbing; at-age performance on tasks which were considered measures of patterned gross movement, balance, postural maintenance, and spatial orientation; and few typical autistic motor characteristics.

The article is devoted to the analysis of some problematic questions related to the duty of proving of civil suit in criminal proceedings in Ukraine. In the criminal procedure doctrine there is no unanimous opinion of which subjects are required to engage into proving activities aimed at detection of civil suit circumstances in criminal proceedings. Concepts «duty of proving» and «burden of proving» are delineated by author. The position that the burden of proving is determined by the interests of participants in criminal proceedings was supported. The content of the burden of proving of civil suit in criminal proceedings covers the need to representation of evidence to justify (or refute) the amount of property damage, the depth of the suffering, and the amount of property compensation for non-pecuniary damage. The material and procedural interest of the civil plaintiff and the civil defendant in the outcome of the criminal proceedings encourages them to take an active part in the criminal procedural proving, in particular by representation of evidence available to them. The publicity (officiality) of criminal proceedings causes differences in the procedure for proving the grounds and size of a civil suit in criminal proceedings compared to civil proceedings. It is concluded that the duty of proving of civil suit circumstances lies on the prosecution party (investigator, prosecutor). The civil plaintiff, the civil defendant, their representatives are complete subjects of proving, but their activity in proving is a right, but not a duty. For the successful performance of their procedural functions, the defense of their legitimate interests, these persons are empowered to represent evidence, to participate in their research. So, they are given the opportunity to contribute to the correct resolution of criminal proceedings, in particular in the civil suit part. The subjects involved in the criminal proceedings who have a duty of proving should provide a possibility of realization of the right to represent evidence by other participants in the process.

Background. Impairment of fine motor skills in the hand is one of the most frequent causes of the persistent loss of professional skills, social maladjustment, and the impossibility of self-care in patients after a stroke, which ultimately leads to a significant reduction in the quality of their life. The article discusses the features of the fine motor skills’ impairment in the hand in patients after a stroke, in the context of a lateralized hemispheric lesion. Methods. We have studied 26 patients after a primary ischemic stroke in the pool of middle cerebral artery of the right (n=12) or left (n=14) brain hemisphere. The average age of patients was 55.7±7.3 years. Patients with a right-sided ischemic stroke were comparable to those with a left-sided stroke in their age, disease duration, size of the lesion and the gender ratio. Results. All the patients after an ischemic stroke had motor impairment in the form of a hemiparesis of a mild or moderate degree. Discussion. We suggest the existence of differentiated mechanisms for the development of fine and highly coordinated voluntary movements in the hand of patients after an ischemic stroke, depending on the lateralization of the supratentorial lesion: diffuse deficit of the afferent support in a right-sided ischemic stroke vs. bilateral efferent deficit for a left hemisphere lesion. Conclusion. The obtained data on the differentiated mechanisms for the development of fine and highly coordinated voluntary movements in the hand of patients after an ischemic stroke warrant the necessity of a further, more targeted research on those disorders in the post-stroke period, on order to optimize the existing rehabilitation approaches and improve the functional potential and quality of life of such patients.

The purpose of writing this article is to find out about the importance of overcoming motor problems of elementary school-aged students. The method used is a literature review study. Impaired motor development can cause learning difficulties. This will have an impact on students such as low scores, low achievement, and difficulties in learning. In addition to matters related to academics, students usually feel embarrassed or make other friends feel annoyed and uncomfortable. Seeing the impact caused by motor problems can interfere with the learning process of children, it requires intervention from the school, especially by teachers who interact more intensively with children. Motor problems experienced by elementary school students certainly require intervention, as an initial screening to find out problems that may be experienced by students, it is necessary to do a universal intervention. This universal intervention is an intervention given to students whose problems at first are not known. Four aspects can benefit from optimizing the development of children's motor skills. The four aspects are the child's physiological, emotional, cognitive, and social. Other benefits are also grouped based on the optimization of fine and gross motor skills. Recommendations for future research to examine more deeply the motor problems of elementary school-aged students, so that the right method can be found to overcome them.
