This article aims to look at the current reality, which is marked by the proliferation of post-truth phenomena in the community, marking the many developments in the views and perspectives of each individual who considers something as an absolute truth by shifting the existence of facts, data. , and reality. This is the reality of challenges in the current era, so that in responding to the challenges posed by the post-truth era, scientific frameworks, including law as one of the main components that interact directly with society must try to avoid the formation of analyzes that lead to absolute truth. This article is the result of legal research using secondary legal materials. The results show that, critical constructivism as a method of reasoning that determines the process of legal reasoning, is able to prove its never-ending thought process by placing a gap between materialism and idealism, and its epistemological aspects provide a simultaneous relationship between empiricism and rationalism. The results of legal interpretation through the pattern of critical constructivism will continue to be criticized as long as the results of the interpretation cannot show the truth, this process will obtain an analysis result that will never lead to the absolute truth inherent in post-truth. world.

Ketuhanan Yang Maha Esa ditempatkan sebagai sila pertama Pancasila. Implikasinya, pembaharuan, pembentukan, dan penegakan hukum di Indonesia harus bersumber pada nilai yang terkandung di dalam sila pertama tersebut. Penelitian ini bertujuan untuk secara filosofis menganalisis ontologi, epistemologi, dan aksiologi ilmu hukum berketuhanan. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan filosofis dan konseptual. Hasil penelitian ini mengungkap bahwa hakikat ilmu hukum berketuhanan adalah ilmu hukum yang dikembangkan berbasis pada nilai-nilai ketuhanan. Ia bukanlah ilmu hukum yang sekuler yakni ilmu hukum yang melepaskan diri nilai-nilai moral dan agama, melainkan ilmu hukum yang menjadikan nilai-nilai moral dan agama sebagai fondasi dalam pembaharuan, pembentukan, dan penegakan hukum. Kebenaran pengetahuan menurut ilmu hukum berketuhanan beranjak dari kebenaran firman Tuhan yang diwujudkan dalam bentuk nilai-nilai Pancasila yang selaras dengan nilai-nilai budaya bangsa Indonesia. Kebenaran di sini tidak hanya mengacu kepada kebenaran korespondensi, kebenaran koherensi, dan kebenaran pragmatis, tapi juga menjadikan ketiganya menyatu di bawah payung kebenaran ilahiah. Sedangkan nilai yang hendak diwujudkan oleh ilmu hukum berketuhanan sedemikian komperensif yang memuat semua nilai-nilai bangsa Indonesia baik yang religius maupun yang kultural. Nilai-nilai ini sudah dipraktikkan sejak lama oleh bangsa Indonesia sebelum merdeka. Meskipun nilai-nilai itu universal dan abstrak, tapi ia sudah mendarah daging dan menjiwai kehidupan sehari-hari bangsa Indonesia.Believing in the only and one God is set as the first pillar of Pancasila. This will have an implicate that the law reform, law making, and law enforcement must refer to the values. This article is aimed at analysing the ontology, epistemology, and axiology of God law. This research is normative legal research, white the approach used is both philosopical and conceptual. This article reveals that the essence of God law is the law founded by the values of God. It combines the values of morality and religion. The truth of knowledge stands from the truth of Gods sayings and is manifested in the form of values of Pancasila which are in accordance with the cultural values of Indonesia. The absolute truth of Gods sayings is a combination of correspondence, coherence, and pragmatic rightness. Finally, the value directed by the Gods law is so comprehensive consisting all Indonesian values religiously and culturally which have been practised at long time. Although these values are universal dan abstract, they have been embedded in the soul and daily life of Indonesian people.

The Albanian scholar Muḥammad Nāṣir al-Dīn al-Albānī (d. 1999) established a unique type of Salafism, a movement whose adherents follow a puritanical model of Muslim creed, exegesis, and conduct that is critical of madhhab Traditionalism. In this article I present an annotated translation of an audio lecture in which Albānī attempted to defend Salafism against its anti-madhhab image. I shed light on the religious and social climate that played a critical role in triggering Albānī’s disdain for Traditionalism and led him to discredit madhhab Traditionalist fiqh and replace it with his own interpretation of the jurisprudential requirements of Islamic scripture. Among the arguments I make is that Albānī’s claim to follow only the Qurʾān and Sunna is a rhetorical strategy designed to present Salafism as the absolute truth and distinguish it from being categorized as another madhhab or religious movement.

AbstractMedical actions by doctors who act not in accordance with the rules and applicable moral ethics are now beginning to emerge frequently. At this time, the problem of malpractice in health services began to be discussed by various groups in the community. This can be seen from the many indictments of malpractice cases submitted by the public about the profession of doctors who in carrying out their duties have committed wrong actions that result in losses resulting in death or disability. Medical malpractice, this is related to the task of the doctor or medical personnel under his command intentionally or negligence to do something (active or passive). The problem that the writer takes here is that the malpractice case which the writer carefully sourced from the decision of Nganjuk District Court No.288 / Pid.sus / 2018 / PN NJK, The theory used in this research is the theory of law enforcement. While the method used is empirical juridical legal research, where in analyzing the problem carried out by the method of combining legal materials (Decisions) with primary data obtained in the field. The output of this paper is that the handling of malpractice cases by doctors without the need for procedures according to medical regulations needs to be considered.Keywords: Abortion, Doctors, Law Enforcement, Malpractice.AbstrakTindakan medis oleh dokter  yang bertindak tidak sesuai dengan aturan dan etika moral yang berlaku ini kini mulai sering muncul. Hal itu terlihat dari banyaknya dakwaan kasus malpraktik yang disampaikan oleh masyarakat tentang profesi dokter yang dalam melakukan tugasnya telah melakukan tindakan yang salah yang menimbulkan kerugian yang berujung pada kematian atau cacat. Malpraktik medik, hal ini berkaitan tugas dokter atau tenaga medis yang ada di bawah perintahnya dengan sengaja atau kelalaian melakukan perbuatan (aktif atau pasif). Permasalahan yang penulis ambil disini dimana Kasus malpraktek yang penulis teliti bersumber pada putusan Pengadilan Negeri Nganjuk No.288/Pid.sus/2018/PN NJK, Teori yang digunakan dalam penelitian ini ialah teori penegakan hukum. Sementara metode yang digunakan adalah penelitian hukum yuridis empiris, dimana dalam menganalisis permasalahan dilakukan dengan metode memadukan bahan-bahan hukum (Putusan) dengan data primer yang diperoleh di lapangan. Adapun output dari tulisan ini, bahwa penanganan perkara malpraktek dokter yang diilakukan dokter tanpa danya prosedur sesuai aturan medis perlu di perhatikan.Kata kunci : Aborsi, Dokter, Malpraktek,Penegakan Hukum.

The aims of this research were to examine the legal protection on the farmer rights in international trade under Indonesian law. The research was important to provide various alternative solutions over the problem of inabilities of farmer to be a subject of international trade and to review whether the Indonesian Government gave legal protection to farmer rights. It was an empirical legal research, which using primary and secondary data. Primary data was collected from the respondents and informants while the secondary ones were taken from primary and secondary legal materials. The validity of data used sources triangulation method while all of data were analysed by analysis of editing style through legal interpretation. The result showed that Indonesian Government through enactment of its legislation has not been providing the legal protection to the farmer rights in international trade optimally. Moreover, this study was expected to contribute in reforming over legislation that regulates the protection of farmer rights.

The article considers the story by Henry James (1843 – 1916) «The Turn of the Screw» (1898 – first edition, 1908 – second edition) in connection with the emergence of a new type of narrator in the writer's late prose. The worldview and creative method of H. James are formed under the influence of the philosophy of pragmatism, which became widespread at the turn of the XIX-XX centuries thanks to the works of the writer's elder brother, the philosopher William James (1842 – 1910). The core of pragmatism is the pluralistic concept of William James based on the assumption that knowledge can be realized from very limited, incomplete, and inadequate «points of view» and this leads to the statement that the absolute truth is essentially unknowable. The epistemological statements of William James's theory is that the content of knowledge is entirely determined by the installation of consciousness, and the content of the truth in this case depends on the goals and experience of the human, i.e. the central starting point is the consciousness of the person. Henry James not only creates works of art, but also sets out in detail the principles of his work both on the pages of fiction works of small and large prose, putting them in the mouths of their characters – representatives of the world of art, and in the prefaces to his works of fiction, as well as in critical works.

The problem of the principle of submission in the divorce law in the Religious Court by a non-Muslim couple occurs because the couple's marriage is based on Islamic law. What cannot be separated from Islamic law is Islamic family law because it is related to the faith of a Muslim. Islamic family law can only apply to Muslims and cannot apply to non-Muslims. The problem of the principle of submission to the divorce law was incomplete (incomplete norm) or the existence of a legal vacuum (vacuum of norm) in marriage law in Indonesia. This research is a legal research and is normative in nature. The approach used is statutory, case, and conceptual. The legal materials used are primary, secondary and tertiary. The method of collecting legal materials is first to qualify the facts and then to qualify the law. The analytical tool used is legal interpretation in the form of principal, systematic and grammatical interpretation.

In this author-meets-critics dialogue, Douglas Allen, author of argues that Gandhi-informed philosophies and practices, when creatively reformulated and applied, are essential for developing positions that are ethical, nonviolent, truthful, and sustainable, providing resources and hope for confronting our ‘Gandhi after 9/11’ crises. Critics Sanjay Lal and Karsten Struhl applaud Allen’s demonstration that Gandhi’s nonviolence is serious and broadly adaptable to the twenty-first century. Yet, Lal poses two philosophical challenges, arguing first that the nonviolent message of the Bhagavad Gita is perhaps more essential than Allen allows. Second, Lal raises difficulties involved in placing the needs of others first, especially in response to terrorism. Struhl wonders if the Gita is not more violent than Gandhi or Allen represent it to be. Struhl also questions whether relative claims are always resolved in the direction of Absolute Truth, as Gandhi and Allen assert. Finally, critic Struhl wonders how we can restrain institutions from escalating cycles of violence once we grant Gandhi-based exceptions that would allow violence to suppress terrorism. Against Lal’s objections, Allen defends a more open-ended reading of the Gita and agrees that our service to the needs of others cannot go so far as to embrace their terrorism. In response to Struhl, Allen agrees that there are indeed problems with a nonviolent reading of the Gita, but there are resources to support Gandhi’s view. Likewise, regarding relations between our limited truths and the Absolute, Allen grants that Struhl has identified real problems but that a final defense is possible, especially when we consider motivational factors. As for limiting cycles of violence, Allen argues that a Gandhi-informed use of violence implies considerations that limit its use.

Research in connection with jurnal writing thesis takes the theme the protection of the law against companies factor in billing accounts receivable factoring transactions. Problems studied involves two things; the first what factors the company’s legal position as a buyer on receivables in factoring and financing institution both what form of legal protection that can be given to companies factor of a possible failure of the trade receivables collection. This includes research conducted legal research categories, namely normative legal research literature or legal research based on secondary data. The approach used is the approach ot the laws and facts approach. Next to for further analysis techniques use the description legal interpretation techniques based argumentative theory, principles, and concepts relevan laws. The results showed that the company,s legal position as a purchaser of  factoring receivables is very weak and vulnerable than risk the possibility of failure of collection of accounts receivable due to non fulfillment of the achievements by the customer. In this context there is no guarantee of  legal protection for the company for the payment or refund factor its receivables in full. The next from legal protection that can be given to the factor as a buyer of receivables is; a) apply the type of recourse factoring in the factoring agreement with the burden of responsibility is on the client in case of failure of collection of accounts receivable, b) implement a system of personal/corporate guarantees, and c) apply the prudential banking principles
