E-commerce is a form of trade which has its own characteristics that are cross-border trade, not to meet the seller and buyer, use media internet. The birth of Law No. 11 of 2008 is about Information and Electronic Transactions (ITE Law) seems to be the solution to provide protection for consumers. In the ITE Law has set the terms validity of e-commerce transactions, establishing the rights and obligations, prohibited acts, responsibility, legal protection, remedies, and dispute resolution in e-commerce transactions. This study analyzes the dispute settlement for e-commerce dispute in Indonesia.

Over the past decade, electronic commerce has expanded and has provided new ways of conducting businesses in a brand new environment. Lately u-commerce seems to be pioneering the field of electronic transactions. Where ‘u’ stands for ubiquitous, unison, unique and universal, u-commerce offers the opportunity to users to conduct business everywhere and at any given moment in time. The simplicity of u-commerce transactions makes the issue of domain names more relevant than ever before. This chapter examines the procedural unfairness of the Uniform Domain Name Dispute Resolution Policy (UDRP) in an effort to demonstrate that the ‘regulatory’ framework surrounding domain names does not respect their technological necessity.

<p>Abstract<br />This article examines the legal problems of resolving online sale and purchase disputes through social media, this is regulated in Law number 11 of 2008 concerning Electronic Information and Transactions in article 28 paragraph (1). This study included normative legal research with a legal approach and a case approach. The results of the study show that the seller has committed a misleading action that has resulted in consumer losses in electronic transactions, in accordance with Law number 11 of 2008  concerning Information and Electronic Transactions. Dispute resolution if the seller conducts a default is  attempted to take a non-litigation route by deliberation or it can be through mediation or litigation lines or commonly referred to through a district court.<br />Keywords: Buy and Sell; Credit Promise; Social Media</p><p>Abstrak<br />Artikel ini mengkaji mengenai problematika hukum penyelesaian sengketa jual beli online melalui media sosial, hal ini diatur dalam Undang-Undang nomor 11 tahun 2008 Tentang Informasi Dan Transaksi Elektronik dalam pasal 28 ayat (1). Penelitian ini termasuk penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukan bahwa penjual telah melakukan tindakan menyesatkan yang mengakibatkan kerugian konsumen dalam transaksi elektronik, telah sesuai dengan Undang-Undang nomor 11 tahun 2008 tentang Informasi dan Transaksi Elektronik. Penyelesaian sengketa apabila penjual melakukan wanprestasi diupayakan menempuh jalur non litigasi dengan musyawarah atau bisa dengan mediasi maupun dengan jalur litigasi atau biasa disebut melalui pengadilan negeri. <br />Kata kunci: Jual Beli; Ingkar Janji; Media Sosial</p>

Traditional judicial mechanisms did not offer an adequate solution for cross-border electronic commerce disputes. Although there has been expected great potential in solving disputes online and the rise of Online Dispute Resolution (ODR) use, the assumptions has not been confirmed yet. Only a few examples demonstrate the success stories of ODR, which is in big contrast to the continuous growth of electronic transactions and in general with the use of the online environment. The European Commission however understood the potential of ODR and it is trying to foster the use of it by adopting the ODR Regulation and the ADR Directive. Such legal framework has been developed to apply in consumer disputes arising out of sales or providing services between an EU consumer and an EU trader.The ADR Directive sets out basic standards of ADR entities and processual rules under which it is possible to solve the dispute. Then under the ODR Regulation the complainant will be able to submit a complaint using the ODR platform. The complaint (and any related documentation) will be submitted to the ODR platform via an electronic form.Yet it is necessary to assess the risks of above mentioned legal framework. One of the great concerns are connected with possible forum shopping while providers are registering as ADR entities. Experienced trader (unlike the consumer) is able to choose ADR provider, which is more likely to decide in his favour. Possible exclusion of online negotiation or even online tools in general is then further underlining possible. The paper will thus assess main legal aspects of ADR / ODR legal framework of European Union Law and will deal with main problematic parts of it.

Online Dispute Resolution is a solution in resolving problems outside the court where online dispute resolution is an appropriate solution to resolve online trade disputes, the settlement must apply Pancasila values. Method The approach used in this research is normative juridical. The results of the research show that the application of Online Dispute resolution in addition to legal reform in the field of electronic transactions is also related to efforts to create legal certainty in online dispute resolution in Indonesia. The basic principles of online dispute resolution in Pancasila values are reflected in the spirit of kinship and mutual cooperation, these principles is a reflection of Pancasila values leading to basic values which are the elaboration of the same spirit and within the limits allowed by these basic values. Agreed values in realizing the law as the goal of justice and creating justice

<p>Abstract<br />This article describes and examines the problem, first, the legal standing of the Arbitration Online  according to Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. Secondly, there are legal problems if online arbitration is carried out in Indonesia. This research is prescriptive normative legal research. Types of data and sources of research material include primary and secondary legal materials. The data collection technique used is the study of literature and through Cyber media, furthermore the technical analysis used is the deductive method. The results show that online arbitration can actually be carried out in Indonesia. Through Law No. 11 of 2008 concerning Electronic Information and Transactions that were changed using Law No. 19 of 2016 concerning Amendments to Law No. 11 of 2008 and Government Regulation No. 71 of 2019 concerning the Implementation of Electronic Transactions and Systems the government has provided the means and foundation for carrying out online arbitration. Online arbitration has advantages in the speed and efficiency of dispute resolution times. However, online Aribtrase also has some disadvantages such as how to registering decisions in court, the presence of witnesses in court, piracy and hacking, and unequal electronic means.<br />Keywords: Alternative Dispute Resolution; Online Arbitration; Electronic Document; Law No. 30 of 1999</p><p>Abstrak<br />Artikel ini ini mendeskripsikan dan mengkaji permasalahan, pertama, kedudukan hukum Arbitrase  Online menurut UU No. 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa. Kedua, problem hukum apabila arbitrase online dilaksanakan di Indonesia. Penelitian ini adalah penelitian hukum normatif bersifat preskriptif. Jenis data dan sumber bahan penelitian meliputi bahan hukum primer dan sekunder. Teknik pengumpulan data yang digunakan adalah studi kepustakaan dan melalui Cyber media, selanjutnya teknis analisis yang digunakan adalah metode deduktif. Hasil penelitian menunjukkan bahwa arbitrase online sebenarnya sudah dapat dilaksanakan di Indonesia. Melalui Undang- Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elekronik yang diubah menggunakan Undang- Undang No. 19 Tahun 2016 tentang Perubahan Atas Undang- Undang No. 11 Tahun 2008 serta Peraturan Pemerintah No. 71 Tahun 2019 tentang Pelaksanaan Sistem dan Transaksi Elektronik pemerintah telah memberikan sarana dan landasan untuk melaksanakan arbitrase online. Arbitrase online memiliki kelebihan dalam kecepatan dan efisiensi waktu penyelesaian sengketa. Abstract.An internet purchase agreement (E-commerc) in terms of aspects of civil law is very fundamental. E-commerce is quite easy to use in terms of buying and selling transactions, so there is a legal relationship inherent through internet transactions. The Electronic Information and Transaction Law (UUITE) is the basis for regulating electronic transactions through internet media such as mobile computers and others, so that these activities result in accountable legal actions. In order for the legal actions taken to be accountable, the transaction made in the form of an electronic agreement is written. The importance of legal issues in the field of E-commerce aims to provide protection and settlement of disputes in sale and purchase agreements for parties that use electronic media as a media transaction. This study emphasizes the legality (strength of law) of E-commerce agreements, and choice of law dispute resolution (choice of law) in the implementation of dispute resolution between parties in transactions through electronic media.Keywords: Alternative Dispute Resolution-ADR, E-commerce, Online Buying and Selling Abstrak.Perjanjian pembelian melalui internet (E-commerc) dalam hal aspek hukum perdata sangat fundamental. E-commerce cukup mudah digunakan dalam hal transaksi jual beli, sehingga terdapat hubungan hukum yang melekat melalui transaksi internet. Undang-Undang Informasi dan Transaksi Elektronik (UUITE) sebagai dasar pengaturan transaksi elektronik melalui media internet seperti komputer handphone dan lainnya, sehingga dari kegiatan tersebut mengakibatkan perbuatan hukum yang dapat dipertanggungjawabkan. Agar perbuatan hukum yang dilakukan tersebut dapat dipertanggungjawabkan, maka transaksi yang dibuat berupa perjanjian elektronik secar tertulis. Pentingnya permasalahan hukum di bidang E-commerce bertujuan untuk memberikan perlindungan dan penyelesaian sengketa dalam perjanjian jual beli bagi para pihak yang menggunakan media elektronik sebagai media transaksi. Penelitian ini lebih menekankan pada legalitas (kekuatan hukum) perjanjian E-commerce, dan penyelesaian sengketa choice of law (pilihan hukum) dalam pelaksanaan penyelesaian sengketa antara para pihak dalam transaksi melalui media elektronik.Kata kunci: Alternative Dispute Resolution-ADR, E-commerce, Jual-beli Online.

Electronic transactions or E-commerce are buying and selling transactions carried out through the internet. As a result of over the internet, the nature of e-commerce can be done without knowing the borders. When a default or fraud occurs in e-commerce conducted by one of the parties who are abroad, it must pay attention to the principle of International Private Law related to the Court forum, Arbitration, or other dispute resolution institutions. That means that it is necessary to pay attention to the basic arrangements for dispute resolution of international business transactions that have been regulated in Indonesia and the authority of the Indonesian District Court in resolving international electronic transaction disputes. In the juridical perspective as the basis for solving electronic transaction cases to be legal strengthening takes a sense of justice so that it can be seen that the basis of international e-commerce arrangements in accordance with Article 18 Paragraph (4) of the ITE Law. District Courts has a role to be the main and complementary institution in dispute resolution international electronic transactions.

This study focuses on electronic contracts in the Indonesian Home Credits Financing Institution by analyzing the effect of electronic contracts on electronic transactions in Indonesia. Then find the ideal model of electronic contracts as a form of e-commerce legal dispute resolution. This study uses normative legal research methods, with a legal approach and a conceptual approach. Based on the research that has been done, the influence of electronic contracts in electronic transactions (e-commerce) in Indonesia has brought about major changes by changing the model of non-electronic (conventional) commercial transactions into electronic (modern) transactions and inspiring online dispute resolution. Then the ideal model of electronic contracts as a form of e-commerce legal dispute resolution in Indonesia, must contain 10 important things in the e-contract clause namely: 1. Freedom of Contract; 2). Offers and Receipts; 3). Good intention; 4). Use of Terms; 5). Risk Transfer; 6). Please Loss; (7). Emergencies; 8). Changing Contracts; 9). Termination reasons; 10). Choice of Law and Dispute Resolution online, as stated in the e-contract of Indonesian Home Credits.

Legal protection to consumers by BPSK through means of mediation or conciliation or arbitration is made on the choice and consent of the parties concerned. Consumer dispute resolution is not a gradual dispute resolution process. Factors affecting the process of providing legal protection to the sale and purchase through electronic transactions are legal factors that still weaken the parties, especially the consumer, the requirement of the agreement in Article 1320 of the Civil Code can not be fulfilled in full, especially the matter of proficiency. The activities of the cyberspace can not be approached by conventional law size and classification alone, because if this method is taken too much difficulty and passes the enforcement of the law.  AbstrakPerlindungan hukum kepada konsumen oleh BPSK melalui mediasi atau konsiliasi atau arbitrasi dilakukan berdasarkan pilihan dan persetujuan dari pihak-pihak terkait. Resolusi perselisihan konsumen bukanlah proses penyelesaian perselisihan bertahap. Faktor-faktor yang mempengaruhi proses pemberian perlindungan hukum terhadap jual beli melalui transaksi elektronik adalah faktor hukum yang masih melemahkan para pihak, terutama konsumen, persyaratan perjanjian dalam Pasal 1320 KUHPerdata tidak dapat dipenuhi secara penuh, terutama soal kemahiran. Kegiatan dunia maya tidak dapat didekati dengan ukuran hukum konvensional dan klasifikasi saja, karena jika metode ini diambil terlalu banyak kesulitan dan melewati penegakan hukum.
