Penelitian ini bertujuan untuk mengetahui perlindungan hukum tenaga kerja Indonesia terkait penerimaan Tenaga Kerja Asing. Kajian yang dibahas yaitu mengenai kebijakan pemerintah dan perlindungan hukum Tenaga Kerja Indonesia terkait dengan kebijakan penerimaan Tenaga Kerja Asing di Indonesia. Metode yang digunakan untuk mengkaji permasalahan yang akan dibahas menggunakan metode penelitian yuridis normatif yang merupakan penelitian kepustakaan dengan pengumpulan bahan-bahan hukum sekunder seperti buku-buku, karya ilmiah hukum, bahan-bahan tertulis lain yang memberikan penjelasan mengenai kajian yang akan dibahas. Jika dilihat dari kebijakan yang ada pemerintah telah membuat peraturan untuk memberikan jaminan hak Tenaga Kerja Asing selama bekerja di Indonesia. Penerimaan Tenaga Kerja Asing dalam Perpres No. 20 Tahun 2018 memberikan syarat-syarat yang wajib dipatuhi oleh pemberi pekerja untuk menggunakan Tenaga Kerja Asing. Legal Protection of Indonesian Workers on Government Policy Relating to Acceptance of Foreight Workers In Indonesia This study aims to determine the legal protection of Indonesian workers related to the acceptance of foreign workers. The study discussed is about government policy and legal protection of Indonesian Workers related to the policy of accepting Foreign Workers in Indonesia. This research uses a normative juridical method which is a library research by collecting secondary legal materials such as books, legal scientific works, other written materials that provide an explanation of the study to be discussed. If seen from the existing policies the government has made regulations to provide guarantees for the rights of foreign workers while working in Indonesia. Acceptance of foreign workers in the Presidential Regulation No. 20/2018 provides conditions that must be complied with by employers for employing foreign workers.

Legal protection for a mark of a place or origin of MSMEs can be done by first registering the mark to obtain legal force. In this case the Office/Agency/Community Organization assists by facilitating MSMEs in terms of socialization and assistance for trademark registration. Law Number 20 of 2016 concerning Marks and Geographical Indications provides improvements to previous laws, especially regarding preventive protection measures, namely registration procedures and registration fees. Brands produced by Indonesian MSMEs can help increase competitiveness in the development of new products. This research is normative or library research method, namely legal research carried out by reviewing and researching library materials in the form of primary legal materials and secondary legal materials. This study concludes: First, the problems in the protection of intellectual property rights in the field of branding for MSME products are due to the understanding of MSME actors on brand rights is still low/shallow so that MSME actors do not register the brand of MSME products. Second, efforts to provide brand protection to the MSME industry are by registering MSME brands and the government makes it easy for MSME industry players to register trademarks.

The effort of providing protection for all Indonesian migrant workers abroad is focused on two categories. Firstly, the phase of pre-departure of Indonesian migrant workers in which an approach of cross sectors is carried out by both the Indonesian government and the private agencies in order to prepare them with all the things needed when they arrive at countries of their destination. Secondly is the phase of arrival and post-arrival of Indonesian migrant workers abroad. As in Malaysia, the policy on the arragenment of labor affairs either for Malaysian workers or for foreign workers is officially and legally protected in Labor Act of 1955, Industrial Relation Act of 1967, Trade Union Act of 1959, and in Compensation Act of 1952. The process of labor trials is settled through The Labor Court. This Labor Court no more handles the process of trial of illegally foreign workers. There are needs of establishing Labor Cooperation Agreement (LCA) on the ministerail level, Implementaion Agreement serving as the general policy on the executors level as well as Standardized Labor Contract which has been amended. The establishments of Labor Cooperation Agreement, Implementing Agreement and Standardized Labor Contract should occur before all workers leave Indonesia and are aimed at providing legal protection for every single Indonesian migrant worker. In order that there is no collision between the Malaysian laws and Indonesian laws, the government officials of related issues of both countries must do observations and conduct discussions without neglecting the prevail laws of each country. Any issue of labor affairs should always be referred to the laws of both countries.

The waqf land certification is free charged whereas the general land is not. The research analyzes the article 22 from the government regulation Number 13 Year 2010 concerning the government policy of tax exemption of waqf land certification based on public administration law. The purpose of the research is to understand and to analyze the reasons of government publishing this kind of policy in the perspective of Administrative Law. The kind of research is library research, it needs secondary data, which consists of the material of primary, secondary and tertiary laws. The approach is juridical normative and the analysis is qualitative. The result of the research explains that the government publish the policy of tax exemption with the objective to make Waqf land useful for the society, to accelerate of Waqf land legalization, to protect and to optimize the function of Waqf land. This policy is one effort to understand the waqf action that having a sense of religious service as well as having law certainty. The government policy is the implementation of Administrative Law function in order to create a clean and appropriate government with the good general government principal, such as legality, equity, justice, law protection, wisdom, general need implementation and smart action.

Government in administrative law considered as a unit, as an authorized body. Therefore, it is authorized to establish action, according to administrative law, and affect the legal circumstances of others, or to carry out legal action (under the civil law) in the meaning of government bodies legally. The dutch literature interpreted administrative with the terms administrative recht with administrative besturen. Besturen has a functional meaning to means the function of governance, and institutional or structural whole organs of government. Bestuur is an environment outside formation of regulations (regulgeving), and judicature (rechtspraak). The data of this research was collected by library research. This research aims to know the form of legal protection for the people to government action based on the concept of State Administrative Law. The result of this research shows that Legal decisions were those which fulfill formal and material requirements. This was based on the presumptive principle of rechtmatig, that was het vermoeden van rechtmatigheid or presumtio justea causa (every decisions issued by the government or the administrative of the state were considered lawful). This principle means that every decision was not revoked, unless there was a vernietiging of the court closely related to the principle of legal certainty (rechtszekerheidbeginsel).

<p><em><span class="fontstyle0"><strong>Abstract</strong><br /></span></em></p><p><em><span class="fontstyle1">Nationalization of a Dutch-owned plantation company, NV Deli Maatschappij, was an attempt by the government to improve national economic situation. However, during the process, communal land which was concessioned to the plantation, was also nationalized and not given compensation by the government which resulted the indigenous people of Deli Sultanate losing their customary land. The former plantation land was converted to Cultivation Rights and handed over to the State Plantation Company This problem led to a prolonged conflict over ownership of the former estate. The purpose of this study is to determine the validity of the nationalization process carried out by Indonesian government on the existence of indigenous peoples’ customary land rights and obtain  settlement of customary land rights of indigenous peoples as the impact on nationalization. Tanah bekas perkebunan diubah menjadi Hak Guna Usaha dan diserahkan kepada Perusahaan Perkebunan Negara. Hal ini menimbulkan<br />konflik berkepanjangan tentang kepemilikan tanah bekas perkebunan tersebut. The reform of criminal law in Indonesia, which has become one of the discourses, is the Article regarding insults to the President and Vice President in the 2019 RUUKUHP. The government re-included several articles of insulting the president in the Draft Criminal Code formulation, which the Constitutional Court deleted through Decision Number: 013.022/PUU IV/2006. So the problem in this research is how the policy formulation of offense against the President and Vice President is following the formulation of the RUUKUHP and how the comparison of articles on insulting the President and Vice President in the formulation of the Draft Criminal Code with the Constitutional Court Judge Decision No: 013.022/PUU IV/2006. The research method used is juridical normative based on secondary data through library research data collection and data analysis. The discussion results show that the policy for the formulation of offense against the President/Vice President following the formulation of the RUUKUHP is an effort to provide legal protection to the President/Vice President as a symbol in state life. Comparing articles regarding insults to the President and Vice President in the formulation of the RUUKUHP with the Constitutional Court Decision No: 013.022/PUUIV/2006 have both similarities and differences.

Legal protection against a daily work is very urgent today given the increasing number of them. Governments have an obligation to ensure the protection of the rights of them. This study discusses two subjects. The first is the inventory of labour rights according to the constitution and rules of normative and the implementation for daily work. The second is the substance of the government’s policy to accommodate the protection of the rights of workers based on the Ministry of Manpower and Transmigration Republic of Indonesia Number: Kep.100 / Men/VI/2004 about the Provisions in the Implementation of Given Time Employment Agreement. The purpose of this study was to determine the protection of the constitutional and normative rights for daily workers. Next to determine the legal policy of the Indonesian government in providing protection to daily workers through Ministerial Decree No. 100/2004. Normative methods used to analyze the legal norms applicable in Indonesia governing the protection of daily workers. Based on this method, the portion of the protection of the rights of workers will be known. The results of this research are that the rights of an employee still do not fulfil the rights of workers constitutively and normatively. Government policy in the protection of daily workers was still not enough to provide legal certainty, usefulness, and fairness for workers. The government’s policy regarding the rights of daily workers still needs to be improved in order to accommodate the rights of daily workers.

The Maldives comprises 1,190 coral atolls lying in the India Ocean to the south-west of India and Sri Lanka. the overwhelming majority of the population is Muslim, with Islam dating back to the twelfth Century. Government policy places a high premium on the Islamic identity of the country, and conversion to Christianity is punishable by loss of citizenship and, allegedly, torture. Foreign workers are legally permitted to express their faith, but only privately in their homes when no Maldives citizens are present. Catholics (mainly Filipinos), the Church of South India, the Evangelical Mennonite Church and the Seventh-day Adventists have a small and low-key presence in the country. The number of Christian believers among the indigenous population is thought to be very low, and they are obliged to observe their faith under conditions of utmost secrecy. Criticism of its record on human rights and political freedoms led the government to announce in October 2016 that it will leave the Commonwealth.

Abstrack The study analyzed Article 22 of Government Regulation Number 13 of 2010 concerning government policies for the exemption of waqf land certification fees according to state administrative law. The analyze focus on the reasons for the government to issue such policies in the perspective of the state administrative law. The research type of library research requires secondary data, which consists of primary, secondary and tertiary legal materials, normative juridical approaches, and qualitative data analysis. The results of the study explained that the government issued a policy of freeing the cost of waqf land certificates aimed at empowering waqf land so that its designation could be felt by the community, accelerating the legality of waqf land, protecting and securing and optimizing the benefits of waqf assets. This policy is an effort to understand waqf deeds which means worship and legal certainty. Government policy is the implementation of the function of the  state administrative law in creating a government that is clean and in accordance with the principles of good general governance, namely; the principles of legality, equality, justice, legal protection, wisdom, implementation of public interest, and acting meticulously. Key Words: State Administrative Law, Free of Cost, Endowments Land Certification Abstrak Penelitian menganalisis Pasal 22 Peraturan Peemrintah Nomor 13 Tahun 2010 tentang kebijakan pemerintah pembebasan biaya sertifikasi tanah wakaf menurut hukum administrasi negara. Menganalisis alasan pemerintah mengeluarkan kebijakan demikian dalam perspektif HAN. Jenis penelitian library research, memerlukan data sekunder, yang terdiri dari bahan hukum primer, sekunder dan tersier, pendekatannya yuridis normatif, dan analisis datanya kualitatif. Hasil penelitian menjelaskan bahwa pemerintah mengeluarkan kebijakan  membebaskan biaya sertifikat tanah wakaf bertujuan untuk memberdayakan tanah wakaf supaya peruntukannya dapat dirasakan masyarakat, percepatan legalitas tanah wakaf, melindungi dan mengamankan serta mengoptimalkan manfaat aset wakaf. Kebijakan ini adalah salah satu upaya memahami perbuatan wakaf yang bermakna ibadah dan berkepastian hukum. Kebijakan pemerintah merupakan implementasi fungsi HAN dalam menciptakan pemerintahan yang bersih dan sesuai asas pemerintahan umum yang baik, yakni; asas legalitas, kesamaan, keadilan, perlindungan hukum, kebijaksanaan, penyelenggaraan kepentingan umum, dan bertindak cermat. Kata Kunci: Hukum Administrasi Negara, Bebas Biaya, Sertifikasi Tanah Wakaf

This research focuses on the form of legal protection for used clothing consumers based on Article 4 of Law Number 8 of 1999 concerning consumer protection and analyzes the impact of the use of used clothing by the community in the city of Semarang, related to the Thaharah aspects in Islamic Law.To achieve this goal, researchers used a sociological juridical approach with data collection techniques in the form of library research and field studies by conducting direct interviews with relevant parties in connection with this research. The data obtained were then processed and analyzed by descriptive qualitative.The results showed that the form of legal protection for used clothing consumers in the Consumer Protection Act under Article 4, namely the right of consumers to get comfort, security, and safety. This is closely related to the obligations of business actors in providing true, clear and honest information about the conditions and guarantees of goods and/or services; and the need for guidance and supervision by the government. The impact caused by used clothing is negative impact and positive impact for used clothing consumers, both in terms of economic, social and public health in Indonesia. Although in an Islamic perspective, it is recommended that people prioritize aspects of thaharah (cleanliness) as Allah SWT requires every Muslim to purify in accordance with the criteria of Allah and His Prophet.
