The purpose of this study to examine the protection of transformation of lontar copyrighted works in the form of digitalization and the mechanism of legalizing the transformation of works that were originally in the form of lontar. This study uses a socio-legal researchy method which is a mixture of normative legal research methods with empirical legal research methods. This study uses a statutory approachy, conceptuayl approach and facts. The study results show that the regulation of transformation of lontar copyright works in the form of digitalization is regulatedd in Article 40 paragraph 1 letter n of the Copyright Law which is made possible through an expanded interpretation. It can be stated that the transformation also includes works of traditional cultural expression. The process of legalizing the transformation is included in Article 26 paragraph (1) of the Cultural Promotion Act which explains that the Central Government and the Regional Government are obliged to save the Cultural Promotion Object. Transformation of lontar into the form of digitization is one form of saving against lontar but in the process of this transformation must still refer to the agreement of the owner of the lontar work.  Tujuan studi ini untuk mengkaji perlindungan transformasi karya cipta lontar dalam bentuk digitalisasi serta mekanisme legalisasi pentransformasian dari karya yang awalnya berbentuk lontar. Studi ini menggunakan metode penelitian sosio-legal yang merupakan campuran dari metode penelitian hukum normatif dengan metode penelitian hukum empiris. Studi ini menggunakan pendekatan perundang-undangan, pendekatan konseptual dan fakta. Hasil studi menunjukkan bahwa pengaturan transformasi karya cipta lontar dalam bentuk digitalisasi diatur dalam Pasal 40 ayat 1 huruf n UU Hak Cipta yang dimungkinkan melalui suatu penafsiran yang diperluas dapat dikemukakan bahwa transformasi juga mencakup karya ekspresi budaya tradisional. Proses legalisasi transformasi termasuk dalam Pasal 26 ayat 1 Undang-Undang Pemajuan Kebudayaan yang menjelaskan bahwa Pemerintah Pusat danjatau Pemerintah Daerah penyelamatan dilakukan wajib Objek Pemajuan Kebudayaan. Transformasi lontar ke dalam bentuk digitalisasi merupakan salah satu bentuk penyelamatan terhadap lontar tetapi dalam proses transformasi ini harus tetap

Department of Population and Civil Registration is one of the Regional Service which is part of the Regional Apparatus that has the task of carrying out Regional Government Affairs and Assistance Tasks in the field of Population and Civil Registration. The purpose of this paper is to analyze the arrangements for the authority of the appointment of heads of population and civil registration according to legislation, and the implementation of the appointment of the Head of the Population and Civil Registration Service. Research methods, types of normative legal research with regulatory approaches, conceptual approaches, and case approaches, using primary legal materials, secondary legal materials and tertiary legal materials. Legal materials obtained are processed and analyzed prescriptively normatively. Conclusion, there is a conflict of authority setting norms for the appointment of the Head of the Population and Civil Registration Service in force in Indonesia which results in juridical defects of State Administrative Decrees issued by officials deemed unauthorized, legal products in the form of decrees issued by unauthorized officials must be revoked and declared invalid as stipulated in Law No. 30 of 2014 concerning Government Administration.

<p>Abstract<br />The authority to issue Mining Business Licenses based on Law Number 4 of 2009 concerning  Mineral and Coal Mining is owned by the Central Government, Provincial Government and Regency/City Government. Meanwhile, based on Law Number 9 of 2015 concerning the Second Amendment to Law Number 23 of 2014 concerning Regional Government the authority to issue  Mining Business Permits is owned by the Central Government and the Provincial Government. This article objective to discuss the implications of the regulation of mining business licenses that are not synchronized and efforts to synchronize the regulation of Mining Business Permits. This article is a descriptive analytical legal research. This research was carried out by the law approach. The data used are secondary data, namely the statutory provisions, the Regulation of the Minister of Energy and Mineral Resources, and the mining law literature with the technique of collecting study documents or library materials. So that the implications of these asynchronous arrangements can be resolved and the creation of an ideal Mining Business Permit arrangement.<br />Keywords: Synchronization; Implications; Mining Business Licenses; Investment.</p><p>Abstrak<br />Kewenangan penerbitan Izin Usaha Pertambangan berdasarkan Undang-Undang Nomor 4 Tahun  2009 tentang Pertambangan Mineral dan Batubara dimiliki oleh Pemerintah Pusat, Pemerintah  Provinsi, dan Pemerintah Kabupaten/Kota. Sedangkan berdasarkan Undang-Undang Nomor  9 Tahun 2015 tentang Perubahan Kedua Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah kewenangan penerbitan Izin Usaha Pertambangan dimiliki oleh Pemerintah Pusat dan Pemerintah Provinsi. Artikel ini bertujuan untuk membahas mengenai implikasi pengaturan Izin Usaha Pertambangan yang tidak sinkron dan upaya sinkronisasi pengaturan Izin Usaha Pertambangan. Artikel ini merupakan penelitian hukum doktrinal yang bersifat deskriptif analitis. Penelitian ini dilakukan dengan pendekatan undang-undang. Data yang digunakan merupakan data sekunder yaitu ketentuan perundang-undangan, Peraturan Menteri Energi dan  Sumber Daya Mineral, dan literatur hukum pertambangan dengan teknik pengumpulan data studi dokumen atau bahan pustaka. Sehingga implikasi dari pengaturan yang tidak sinkron tersebut dapat diselesaikan dan terciptanya pengaturan Izin Usaha Pertambangan yang ideal.<br />Kata Kunci: Sinkronisasi; Implikasi; Izin Usaha Pertambangan; Investasi.</p>

Tulisan ini bertujuan untuk mengkaji perubahan atas undang-undang tentang pemerintahan daerah yang dimana adanya pergeseran kewenangan Kepala Daerah dan DPRD semenjak pemerintahan orde baru sampai reformasi, dengan menggunakan teori hukum Separation Of Power dan Distribution Of Power sebagai pisau analisis berdasarkan metode penelitian hukum yuridis normatif. Hasil studi menunjukkan bahwa perundang-undangan tentang pemerintahan daerah ternyata telah mengalami lima kali pergantian dan dua kali perubahan atas undang-undang terbaru yang dampaknya berpengaruh terhadap pelayanan di masyarakat. Atas hal tersebut diketahui bahwa pergeseran atas penyelenggaraan pemerintahan daerah atas kewenangan Kepala Daerah dan DPRD ini dipengaruhi beberapa faktor, diantaranya yaitu faktor daerah, kepentingan, dan kebijakan politik dari setiap zaman. This paper aims to examine changes to the law on regional governance where there has been a shift in the authority of the Regional Head and DPRD from the New Order government to reform, using the legal theory of Separation of Power and Distribution of Power as an analysis knife based on normative juridical legal research methods. The results of the study show that the legislation on regional government has actually undergone five changes and two changes to the latest law which has an impact on services in society. Based on this, it is known that the shift in the administration of regional government to the authority of the Regional Head and DPRD is influenced by several factors, including regional factors, interests, and political policies from every era.

Changes to the implementation of the affairs of labor inspection with the enactment of Law Number 23 Year 2014 on Regional Government impact on the implementation and reporting procedures for compulsory labor report in the company, namely: 1) How the implementation of compulsory reporting of employment in the company at the office of the office in charge of manpower in the districts /city? 2) How is the reporting procedure required to report employment in the company following the enactment of Law Number 23 Year 2014? To find and find solutions to the problem formulation to be studied, then in this writing is done by normative legal research methods with the approach of legislation. As regulated in Article 4 paragraph (1) and paragraph (2) of Law Number 7 of 1981 concerning Obligatory Reporting of Employment in the Company, employers or managers of the company shall report in writing any establishment, termination, reestablishment, transfer or dissolve the company to the Minister who is responsible in the field of manpower or appointed official in this matter who is entrusted with the task of supervision in the field of manpower. Perubahan terhadap penyelenggaraan urusan pengawasan ketenagakerjaan dengan berlakunya Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah berdampak pada pelaksanaan dan tata cara pelaporan wajib lapor ketenagakerjaan di perusahaan,  yakni:  1) Bagaimanakah pelaksanaan wajib lapor ketenagakerjaan di perusahaan pada kantor dinas yang membidangi ketenagakerjaan di kabupaten/kota? 2) Bagaimanakah tata cara pelaporan wajib lapor ketenagakerjaan di perusahaan setelah berlakunya Undang-Undang Nomor 23 Tahun 2014? Untuk mencari dan menemukan pemecahan atas rumusan masalah yang akan dikaji, maka dalam penulisan ini dilakukan dengan metode penelitian hukum normatif dengan pendekatan perundang-undangan. Sebagaimana diatur dalam Pasal 4 ayat (1) dan ayat (2) Undang-Undang Nomor 7 Tahun 1981 tentang Wajib Lapor Ketenagakerjaan di Perusahaan, pengusaha atau pengurus perusahaan wajib melaporkan secara tertulis setiap mendirikan, menghentikan, menjalankan kembali, memindahkan atau membubarkan perusahaan kepada Menteri yang bertanggung jawab dalam bidang ketenagakerjaan atau pejabat yang ditunjuk dalam hal ini yang diserahi tugas pengawasan di bidang ketenagakerjaan.

ABSTRACTThis study aims to examine the policy synergy between the Provincial Government of East Java and the Central Government in dealing with Covid-19. The urgency of this study is to explain to what extent policies between the Local Governments and the Central Government are in sync. This research uses legal research methods. Primary data includes statutory regulations, especially the Law on Health quarantine and secondary data such as previous research, expert opinion, and other relevant document data. This study concludes that the East Java Provincial Government and the Central Government have a synergy in dealing with Covid-19 in Indonesia. However, neither the legal products that are produced nor policies that are political in nature do not conflict with one another.  ABSTRAKPenelitian ini bertujuan untuk mengkaji sinergitas kebijakan antara Pemerintah Provinsi Jawa Timur dengan Pemerintah Pusat dan dalam menghadapi Covid-19. Urgensi penelitian ini adalah menjelaskan sejauhmana kebijakan antara Pemerintah Pusat dan Pemerintah Daerah sinkron. Penelitian ini menggunakan metode penelitian hukum. Data primer mencakup peraturan perundang-undangan terutama Undang-undang tentang karantina Kesehatan dan data sekunder seperti penelitian terdahulu, pendapat para pakar, dan data dokumen lain yang relevan. Kajian ini menyimpulkan bahwa Pemerintah Provinsi Jawa Timur maupun Pemerintah Pusat memiliki sinergi dalam menangani Covid-19 di Indonesia. Baik produk hukum yang dihasilkan maupun kebijakan yang bersifat politis, tidak bertentangan satu sama lain.

Traditional Knowledge and Traditional Cultural Expression including traditional dance are constituted as cultural heritage of the ancestor which derived from generation to generation, high value and useful, therefore very important to protect. The purpose of this paper is to elaborate the implementation of Article 38 of Law No. 28 of 2014 on Copyright (Indonesia Copyright Law) related to traditional Balinese dance. This writing uses empirical legal research method. Traditional dance art as part of the traditional cultural expression is protected under Article 38 of Indonesia Copyright Law. In its implementation in Bangli regency, this provision has not been implemented effectively. One of the factors is because the community does not have a deep understanding on the substance specifically the importance of conducting inventory and documentation in the framework of legal protection through government cooperation with the community and related parties. Pengetahuan Tradisional dan Ekspresi Budaya Tradisional termasuk seni tari tradisional merupakan warisan budaya dari leluhur yang diturunkan dari generasi ke generasi berikutnya, bernilai dan memiliki daya guna yang tinggi, oleh karenanya sangat penting untuk dilindungi. Tujuan tulisan ini untuk mengelaborasi implementasi Pasal 38 Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta (UUHC 2014) berkaitan tari tradisional Bali. Penulisan ini menggunakan metoda penelitian hukum empiris. Seni tari tradisional sebagai ekspresi budaya tradisional dilindungi berdasarkan Pasal 38 UUHC 2014. Dalam implementasinya di Kabupaten Bangli, ketentuan ini belum terlaksana secara efektif. Salah satu faktor penyebabnya adalah masyarakat baru sebatas mengetahui, namun belum memahami substansinya, termasuk pemahaman tentang pentingnya melakukan inventarisasi dan dokumentasi dalam rangka perlindungan hukum melalui kerjasama pemerintah dengan masyarakat serta pihak terkait.

This study aims to find out the Analysis of Regional Government Policy in Handling Covid-19 perspectives on State Administrative Law. With qualitative research approaches using normative legal research. Both the central and regional governments reduce the spread of Covid-19 with some handling, especially in the perspective of state administrative law. In this case, an analysis of West Bandung Regency is needed in the handling of Covid-19. This gives an understanding that the regional government in making policy needs to synchronize with the central government, especially in analyzing a policy in accordance with state administrative law. AbstrakPenelitian ini bertujuan untuk menggetahui Analisis Kebijakan Pemerintahan Daerah dalam Penanganan Covid-19 perspektif Hukum Administrasi. Dengan penelitian kualitatif dengan pendekatan menggunakan penelitian hukum normatif. Pemerintah baik pusat maupun daerah menekan angka penyebaran Covid-19 dengan beberapa penanganan terutama dalam perpektif hukum administrasi. Dalam hal ini dibutuhkan analisis kebijakan daerah Kabupaten Bandung Barat dalam penanganan Covid-19. Hal ini memberi pengertian bahwa pemerintah daerah dalam membuat kebijakan perlu adanya sinkronisasi dengan pemerintah pusat terutama dalam menganalisis suatu kebijakan sesuai dengan hukum administrasi negara. Tiktok is a popular application, lots of videos from the Tiktok application are becoming famous. There are people who take advantage by uploading the famous TikTok video on other social media and receiving endorsement for the account. As for the formulation of the problem (I) How are the Copyright protection arrangements for content in the Tiktok application? (2) What is the responsibility of the owner of tiktok content whose content is distributed without the permission of the creator or creator? This journal uses normative legal research methods. The results of the study state that the regulation of copyright protection for content in the Tiktok application is regulated in Law umber 28 of 2014 concerning Copyright and Terms of Service for the Tiktok Application which prohibits someone from distributing and reproducing Tiktok content for commercial purposes. For the accountabi I ity of the owner of tiktok content that is disseminated without permission, namely sanctions for the distribution oftiktok videos according to Article 113 paragraph 3 of the Copyright Law and the tiktok application can demand compensation and stop distribution of tiktok content in accordance with Article 96 paragraph (I) of the Copyright Law

<p><em>In this study, there are two (2) issues that were examined. First, how the Central Government and Local Government gained authority in the land sector. Second, how the meaning of the relationship of authority of the Central Government and Local Government in the area of land according to the 1945 Constitution, This study uses normative legal research. The results of research are: First, the authority of the Central Government in the land sector is the inherent nature of authority, because as the sole power in a unitary state. In the development of central government authority derived from attributive authority and Local Government authorities in the land sector sourced from attributive authority and discretionary. Second, the meaning of the relationship of authority between the central government and the regional government in the land sector as: (a) the relationship of subordination; (B) the relationship of supervision; and (c) the relationship of responsibility in achieving the objectives of the State.</em></p>

The Regional Representative Council (hereafter called DPD) is one of the top state institutions that is directly elected in the General Election. In general, the members of the Regional Representative Council of the Republic of Indonesia (hereafter called DPD RI) are tasked with bringing up the interests and aspirations of the people in the regions to the central government as well as having the authority to carry out supervision in the regions. Supervision in question is the supervision of the implementation of laws, and the results of DPD supervision are submitted to the House of Representatives (hereafter called DPR) as a material for consideration for follow-up. Based on this background, this research was conducted with the aim of describing how DPD RI's supervisory function mechanism on the implementation of regional autonomy in Bali Province and what obstacles DPD RI faces in supervising regional autonomy in Bali Province. This research was conducted using a normative legal research method with a statutory approach. The results of this study showed that DPD RI oversight function is implemented with three mechanisms, namely the absorption of aspirations in the community, conveying aspirations through the preparation of reports and problem inventory lists, and submission of the results of supervision to DPR. While the obstacles faced by DPD RI in supervising regional autonomy in Bali Province are the weak authority of DPD RI compared to its legitimacy, the cooperation pattern between DPD and related regional government agencies that has not been clearly regulated, and the lack of support and community participation for participate in supervising after the enactment of a law.
