This is a research after state responsibility for the damages suffered by tourists in relation with the violation of the right to tourism as a part of Human Rights, aims to describe and analyze about the liability of Indonesian Government to respect, protect and fulfill the right of every individual toward to enjoy his/her rights to tourism under Article 28I (4) of the Indonesian Constitution Year 1945 and Article 8 Statute Number 39 Year 1999 regarding Human Rights. Furthermore this research is willing to assess the circumstances that might create a possibility for tourists to file a claim of compensation against the Indonesian Government for the losses suffered as a result of the failure/the negligence of Indonesian Government to fulfill its responsibilities. Based on statement mentioned above, the question arises, whether in concept, tourists are able to file a claim of compensation against the Indonesian Government in relation with the recognition of the right to tourism as a part of Human Rights? And also in terms of how tourists can possibly file a claim of compensation against the Indonesian Government? The method used in this research is the method of normative legal research using the statute approach, the comparative approach as well as the conceptual approach. Based on the research that has been done, the conclusion is that in concept tourists can file a claim of compensation against the Indonesian Government, if they can prove that the damage or loss is caused by a violation of Human Rights conducted by the Indonesian Government and the result of this research further shows that the claim should be filed together with stating prove that the Indonesian Government has conducted a violation of the rights to tourism as a part of Human Rights.

Freedom of speech is a principle that supports the freedom of an individual or a community to articulate their opinions and ideas without fear of retaliation, censorship, or legal sanction. This principle is one of the Human Rights principles that are necessary for the progress of humanity itself. But its existence has always triggered a dispute because of the abuse of the right. The abuse of the rights consists of Hate Speech and Hoaxes. This research is normative legal research that uses a comparative approach and conceptual approach. And also, this research will compare the Freedom of Speech and Broadcasting laws in Indonesia and Singapore, especially law in the broadcasting sector. Theoretically, the benefits of this research are to answer the problem of correcting Freedom of Speech, especially in broadcasting law. Practically, it is helpful for society to know much more about hate speech and hoaxes also the possibility to correct the broadcasting law in Indonesia based on the same regulation in Singapore.

AbstractCitizenship is fundamental in human life. A person who has the right to citizenship will be guaranteed in the constitution and this requires the state's responsibility to protect. However, there are actually some people who are stateless due to the state's withdrawal to their citizenship. This happened to Indonesian citizens who joined the Islamic State of Iraq and Syria (ISIS) after the Indonesian Government issued a statement that excluded its responsibility for Indonesian citizens who joined the ISIS organization. The Indonesian government statement also affects children who follow their parents to join the ISIS organization. Due to stateless parents, it is difficult for the child rights to be protected by the state, because the child's legal status is unknown. This legal research aims to unravel the legal status of ex-ISIS Indonesian citizen children and the responsibility of the Indonesian government to ex-ISIS Indonesian citizens.Keywords: State Responsibility; Legal Status; Human Rights;AbstrakKewarganegaraan merupakan hal yang sangat penting dalam kehidupan manusia. Seseorang dengan memiliki suatu kewarganegaraan terhadap suatu negara maka orang tersebut akan mendapatkan hak-hak asasi yang dijamin dalam konstitusi negara tersebut dan hal ini menimbulkan tanggung jawab negara tersebut untuk melindungi hal tersebut. Namun, pada faktanya terdapat beberapa orang yang berstatus tanpa kewarganegaraan akibat negara melepas kewarganegaraannya. Hal ini terjadi pada Warga Negara Indonesia yang bergabung dengan organisasi di Islamic State of Iraq and Syria (ISIS) setelah Pemerintah Indonesia mengeluarkan pernyataan melepas tanggung jawab terhadap Warga Negara Indonesia yang tergabung dengan organisasi ISIS tersebut. Pernyataan Pemerintah Indonesia tersebut juga berdampak pada anak dibawah umur yang mengikuti orangtua mereka untuk bergabung dengan organisasi ISIS. Dengan orangtua mereka berstatus tanpa kewarganegaraan maka hak asasi anak tersebut sulit untuk dilindungi oleh negara, dikarenakan status hukum anak tersebut tidak diketahui. Penelitian hukum ini bertujuan untuk menegaskan status hukum Anak Warga Negara Indonesia eks ISIS serta tanggung jawab Pemerintah Indonesia terhadap Anak Warga Negara Indonesia eks ISIS.Kata Kunci: Tanggung Jawab Negara; Status Hukum; Hak Asasi Manusia.

Freedom to express opinions in public is a human right guaranteed by the 1945 Indonesian Constitution and the Universal Declaration of Human Rights. The concept of human rights originating from the West resulted in its application often causing problems. This problem arises because the values of freedom that are generally upheld in the West are different from the specific values based on the philosophy and way of life in each country.  The purpose of this study is to describe how the freedom to express opinions in public is in accordance with the values of Pancasila ideology. This research is normative legal research with a statute approach and a conceptual approach. Using primary and secondary legal materials also analyzed qualitatively descriptively. The results of the study conclude that the right to express freedom in public must be in accordance with the values of Pancasila, which is to fulfill the principle of balance between the rights and obligations of every citizen with the goal of responsible freedom being realized. Rights should not be understood only as claims on others, but also contain an obligation to respect the rights of others. Rights always have implications for obligations. All obligations, like all rights, derive from law, because all obligations are moral imperatives and all moral imperatives arise from law. Its application always upholds the values of divinity, humanity, unity, democracy and aims to realize social justice for all Indonesian people.Keywords: right of freedom, express opinion, Pancasila

ABSTRAKDasar pertimbangan dikeluarkannya Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 10 Tahun 2020 tentang Persyaratan Pemberian Hak Asimilasi dan Integrasi bagi Narapidana dan Anak dalam rangka pencegahan dan penanggulangan penyebaran COVID-19. dengan banyaknya tingkat hunian di penjara, hal ini telah menimbulkan kekhawatiran bagi pemerintah. Namun, terpidana yang dibebaskan mengulangi kejahatannya lagi dan menimbulkan kecemasan publik. Tujuan dari penelitian ini adalah untuk mengetahui perbedaan antara Permenkumham Nomor 3 Tahun 2018 dengan Permenkumham Nomor 20 Tahun 2020 dan kesesuaian prinsip pembinaan dengan Undang-Undang Nomor 12 Tahun 1995 tentang pemasyarakatan. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual. Hasil penelitian ini menunjukkan bahwa perbedaan pemberian hak asimilasi dan integrasi narapidana dalam Permenkumham Nomor 3 Tahun 2018 diberikan sesuai dengan persyaratan substantif dan administratif secara lengkap. Namun dalam Permenkuham Nomor 10 Tahun 2020 terdapat beberapa perbedaan dalam hal pemberian hak asimilasi dan integrasi, baik persyaratan substantif maupun administratif, sehingga Permenkumham Nomor 10 Tahun 2020 memudahkan narapidana mendapatkan hak asimilasi dan integrasi. serta pelaksanaan ketentuan pemberian asimilasi dan integrasi dalam Permenkumham Nomor 10 Tahun 2020 tidak sesuai dengan prinsip pembinaan dalam undang-undang pemasyarakatan. Ketidaksesuaian tersebut dikarenakan adanya narapidana yang kembali melakukan tindak pidana, hal ini menunjukkan kegagalan dalam melakukan pembinaan terhadap narapidana. However, the convict who was released repeated the crime again and caused public anxiety. The purpose of this research was to find out the difference between Permenkumham (Regulation of the minister of Law and human righs) Number 3 of 2018 and Permenkumham Number 20 of 2020 and the suitability of the principles of development with Law Number 12 of 1995 concerning correctionalism. The method used in this research was a type of normative legal research using a statutory approach, a conceptual approach. The results of this study indicated that the differences in the provision of assimilation rights and integration of prisoners in Permenkumham No.3 of 2018 were given in accordance with the complete substantive and administrative requirements. However, in Permenkuham No.10 of 2020 there are several differences in terms of granting assimilation and integration rights, both substantive and administrative requirements, so that Permenkumham No.10 of 2020 made it easier for inmates to get the right of assimilation and integration. and the implementation of the provisions for assimilation and integration in Permenkumham No.10 of 2020 is not in accordance with the principles of guidance in the correctional law. This mismatch was due to the presence of prisoners who had returned to committing criminal acts, this indicated a failure to provide guidance to prisoners. The application of additional punishment of the revocation of political rights in the form of voting and/or voting rights elected in the elections to the corruption convicts was as an attempt to eradicate the extraordinary Corruption of crime and part of severe punishment and a charge of corruption convicts. The purpose of this research, namely: first, to know and analyze the implementation requirements of additional punishment of revocation of political rights to corruption prisoners in the perspective of human rights; Second, to know and analyze the position of additional penalty for the revocation of political rights in the purpose of punishment in Indonesia. The type of research used is normative juridical research with a legal approach, conceptual approach, a case approach approach, and a comparative approach. The results of the study proved that: first, political rights can be classified in the right to freedom of thought and a conscience that is unable to be reduced under any circumstance and attached to the status of citizens. The application of the additional penalty was the act of degrading and dignity of corruption prisoners as citizens because of the impact on the elimination of Rights and the disclosure of political rights of corruption prisoners until its application does not meet the requirements of the restriction on human rights in the perspective of the relative-particulate matter; Secondly, the theory of the goal of punishment in accordance with Indonesian philosophy is correctional which is also a rationality of the implementation of prison sentence as does Law No. 12 of 1995 about Correctional. The position of additional penalty for revocation of political rights is as an instrument of conforming or contrary to the purpose of punishment in Indonesia, namely correctional throughout its application to open an opportunity for the elimination of rights and not accompanied by an attempt to recover the rights that have been revoked

The purpose of this study is to analyze the freedom to embrace religion and belief and fulfill the right to work in Indonesia. This type of research is normative legal research specifically discussing human rights in the field of religion and work. Regulation on the role and sanction for the government in the context of guaranteeing religious freedom, especially for Muslims, is very important. One form of legal vacuum in the regulation of religious freedom in Indonesia is in the context of the release of someone from Islam who aims to save humanity (of course also for other religions in Indonesia) and embrace other religions of his own free will. Regulations regarding the role and sanctions for the government in the context of guaranteed rights to obtain decent jobs, especially at productive age, are very important. Technically, it is clearly impossible for employers to recruit workers if there are no jobs in accordance with the capacity of the company's needs. From this, it can be said that the fulfillment of the right to work has a correlation with other types of rights so that a worker can have competence. The amount of unemployment that cannot be reduced by the Indonesian government and discriminatory treatment is a form of violation of the right to work.

<p>Abstract</p><p>The purpose of this study is to explain the legal efforts that can be done if the parents do not implement the obligation of alimentation in the perspective of child protection. The method used is the method of legal research normatif (legal research), with the approach of the law (statute approach) and conceptual approach (conseptual approach). The legal substances used in this study include primary and secondary legal materials. The results of this study explain the parental remedies that do not carry out alimentation obligations in theoretical studies can be done by litigation or court and non-litigation or out of court. However, for non-litigation settlement in Indonesia is not yet available for family problems. Legal efforts through litigation may include the filing of livelihood rights and the execution of a permanent judge’s decision regarding the right of alimentation (cost of living).</p><p>Keywords: Legal effort;alimentation obligation; child; and child protection.</p><p> </p><p>Abstrak</p><p>Tujuan penelitian ini ialah untuk menjelaskan upaya hukum yang dapat dilakukan apabila orangtua tidak melaksanakan kewajiban alimentasi dalam perspektif perlindungan anak.Metode yang digunakan ialah metode penelitian hukum normatif (legal research), dengan pendekatan undang-undang (statute approach) dan pendekatan konseptual (conseptual approach).Bahan hukum yang dipergunakan dalam penelitian ini meliputi bahan hukum primer dan sekunder.Hasil penelitian ini menjelaskan mengenai upaya hukum orangtua yang tidak melaksanakan kewajiban alimentasi secara kajian teoritis dapat dilakukan dengan litigasi atau pengadilan dan non-litigasi atau di luar pengadilan.Namun, untuk penyelesaian melalui nonlitigasi di Indonesia belum difasilitasi Negara Mengenai masalah keluarga. Upaya hukum melalui Litigasi dapat berupa pengajuan hak nafkah dan eksekusi putusan hakim yang berkekuatan tetap mengenai hak alimentasi (biaya nafkah).</p><p>Kata Kunci: Upaya hukum; kewajiban alimentasi;anak;dan perlindungan anak.</p>

Tulisan ini ingin menjawab dua isu utama mengenai hubungan hukum internasional dan pengujian undang-undang oleh Mahkamah Konstitusi RI (MKRI). Isu pertama adalah legitimasi penggunaan hukum internasional sebagai alat interpretasi dalam pengujian undang-undang, sedangkan isu kedua adalah urgensi penguasaan hukum internasional oleh hakim MKRI. Tulisan ini merupakan penelitian hukum yang menggunakan pendekatan konseptual dan pendekatan historis dalam menjelaskan perkembangan pengujian undang-undang di Indonesia sekaligus menemukan legitimasi penggunaan hukum internasional oleh MK RI. Kesimpulan dari tulisan ini menegaskan bahwa hukum internasional memiliki sumbangsih yang penting dalam perannya sebagai alat interpretasi dalam proses pengujian undang-undang oleh Mahkamah Konstitusi, khususnya terkait hak asasi manusia. Justifikasi keabsahan praktik penggunaan hukum internasional tersebut ditarik dari tradisi ketatanegaraan yang secara implisit dikehendaki UUD NRI Tahun 1945. Manfaat positif yang diberikan hukum internasional nyatanya harus disertai juga dengan penguasaan hukum internasional oleh hakim MK RI supaya hukum internasional dapat digunakan secara tepat. Pembahasan dalam tulisan ini dibagi ke dalam empat sub bahasan inti yakni, pengujian undang-undang, penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang oleh MK, legitimasi penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang, pentingnya penguasaan hukum internasional oleh hakim MK.This article intentionally answers two principal issues regarding the relationship between international law and judicial review by the Constitutional Court of the Republic of Indonesia. The first issue is the legitimacy of international use as an interpretative tool in judicial review. The second issue talks about the necessity of urgent international law mastery by the Constitutional Court’s judges. This legal research utilizes both a conceptual approach and a historical approach to explain the development of judicial review in Indonesia, and to find legitimacy of international law by the Constitutional Court. The analysis in this article affirms that international law positively contributes as an interpretative tool in judicial review by the Constitutional Court, particularly pertaining to human rights. A justification of a legitimate international law use is withdrawn from constitutional tradition which is implicitly desired by the Indonesian Constitution (UUD NRI 1945). Since international law has provided better insights into norms, a mastery of international law should be encouraged. There are four main discussions in this article: judicial review, application of international law in judicial review process, legitimacy of international law application in judicial review, and the importance of international law mastering by Constitutional Court judges.

The purpose of this research is to determine the constitutional complaint mechanism based on comparisons in other countries, practices, and adaptation of constitutional complaints under the authority of the Constitutional Court of the Republic of Indonesia. Many cases with constitutional complaint substance have been submitted to the Constitutional Court of the Republic of Indonesia even though they don’t have this authority. This research uses a normative legal research method using a statutory approach, a conceptual approach, a comparative approach, and a case approach. This research indicates that the constitutional complaint mechanism in Germany, South Korea, and South Africa has been well implemented. In practice, cases with constitutional complaint substance are filed to the Constitutional Court of the Republic of Indonesia by changing the form by using the legal means of a judicial review, such as case number 16/PUU-VI/ 2008, case number 140/PUU-XIII/2015 and case number 102/PUU-VII/2009. Due to the consideration of the structure, substance, and culture of law, adaptation of constitutional complaint within the authority of the Constitutional Court of the Republic of Indonesia needs to be carried out by amending Law Number 24 of 2003 jo. Law Number 7 of 2020 concerning the Constitutional Court.

Smoking belongs to the right of all people, but smoking can interfere with Human Rights because the distribution of cigarette smoke produced by smokers can interfere with the health of people around. In Bali, tourist attractions are one of the non-smoking areas. This is stated in the Regional Regulation of Badung No. 10 of 2017 concerning Non-Smoking Areas. Related to this, the study examines two things, that is, the regulation of No-Smoking Areas in the tourist attractions in Badung Regency and the implementation of the Regional Regulation of Badung No. 10 of 2017 on the tourist attractions. The research method used is empirical legal research that is conducting a direct research followed by analyzing data and presented in qualitative manner. In its regulation, Civil Service Police Unit (Satpol PP) as the enforcer of the regional regulation has conducted supervision on tourist attractions and sanctions given in accordance with the Article 21 Number (10) of 2017 of the Badung Regency Regional Regulation. Its application has been done through socialization to the manager of tourist attractions, but the lack of public knowledge about the non-smoking areas in tourist attractions has been appearing as an inhibiting factor.
