The rapid development of tourism in Badung Regency requires the development and construction of accommodation facilities and other tourism supporting facilities.It is intended to support tourism and the tourists who visit Badung Regency. Based on the data of the Government of Badung Regency, there was an increased growth of tourism accommodation facilities in 2015 with the details as follows: 98 starred hotels, 885 budget hotels, and 38 condo hotels. A moratorium policy is required to control this very rapid development of construction of tourism accommodation facilities. The Government of Badung Regency follows up on this issue by issuingRegent’s Decree No. 36 year 2014 on Minimum Standards for Land Area, Room Area, And Supporting Facilities of Hotels and Condo Hotels. Furthermore, the problem is formulated as follows:What is the source of authority of Badung Regency to control the construction of tourism accommodation facilities? And what kind of policy is used to control the permit of construction of tourism accommodation facilities in Badung Regency? This research uses normative research method to study elements of law including norms, rules, principles of law, doctrines, and legislations. This research uses the statute approach and analytical and conceptual approach. The RTRW of Badung Regency mentions that the authority of the government of Badung Regency in the implementation of control of space utilization in Badung Regency includes arranging general provisions of Zoning Regulations, requirements of permit, provision of incentives and disincentives and guidance of sanctions. One of the permits that are applied to control the construction of tourism accommodation facilities is regulated in section 2 of Regent’s Decree No. 36 year 2014. Pesatnya perkembangan pariwisata di Kabupaten Badung, menuntut pula perkembangan dan pembangunan sarana akomodasi dan fasilitas-fasilitas penunjang pariwisata lainnya. Hal ini merupakan sebuah tujuan untuk mendukung pariwisata dan para wisatawan yang datang ke Kabupaten Badung. Menurut data Badung dalam angka tahun 2015 pertumbuhan sarana akomodasi pariwisata yaitu hotel bintang, hotel melati dan kondotel sampai tahun 2015 mengalami peningkatan pertumbuhan yang sangat pesat, pertumbuhan jumlah hotel bintang sampai tahun 2015 sebanyak 98 hotel, pertumbuhan jumlah hotel melati sampai tahun 2015 mencapai 885 hotel dan pertumbuhan jumlah kondotel sampai tahun 2015 mencapai 38 kondotel. Tingginya perkembangan pembangunan sarana akomodasi pariwisata, menuntut dikeluarkannya kebijakan moratorium untuk pengendalian pembangunan sarana akomodasi pariwisata. Untuk itu, Pemerintah Kabupaten Badung menindaklanjuti dengan kebijakan menerbitkan Peraturan Bupati (Perbup) Nomor 36 tahun 2014 tentang Standar minimal luas lahan dan luas kamar serta fasilitas penunjang hotel dan kondotel. Maka dari itu dirumuskan masalah: Apakah yang menjadi sumber kewenangan Pemerintah Daerah Kabupaten Badung dalam pengendalian pembangunan sarana akomodasi pariwisata? Dan Bagaimanakah kebijakan pengendalian perizinan pembangunan sarana akomodasi pariwisata di Kabupaten Badung?. Jenis penelitian ini menggunakan metode penelitian normative yang merupakan penelitian mengenai substansi hukum yang terdiri dari norma, kaidah, asas-asas hukum, doktrin dan peraturan perundang-undangan. Dengan jenis pendekatan menggunakan: The Statute Approach and Analitical and Conceptual Approach. Dalam RTRW Kabupaten Badung disebutkan bahwa Kewenangan Pemerintah Kabupaten Badung dalam pelaksanaan pengendalian pemanfaatan ruang di wilayah Kabupaten Badung yaitu dengan menyusun ketentuan umum Peraturan Zonasi, ketentuan perizinan, ketentuan pemberian insentif dan disinsentif dan arahan sanksi. Salah satu perizinan yang diterapkan untuk pengendalian pembangunan sarana akomodasi pariwisata diatur dalam Pasal 2 Peraturan Bupati (Perbup) Nomor 36 tahun 2014.

The Rapid development of electronics forced notary as a general officer who has the duty to serve the community is expected to be able to respond to the development of this information technology era appropriately. The journal was created to analyze and examine the role of the notary in electronic-based trading transactions. The research method used in the writing of this journal is the normative empirical, which uses secondary data as the primary data and primary data as supporting data. This writing using The approach used is a conceptual approach, a legislative approach, and a comparative approach. The results of the study, the notary must be able to act to authenticate to the parties who conduct transactions of electronic-based trading, verify the documents/information of electronic-based trading that is handled by the parties, securing the electronic document storage in the form of signatures and documents that are signed, but the notary authority in electronic-based trading transactions, for now, can be said to still be a discourse by the Government to be implemented, because The notary authority for making authentic electronic documents in electronic-based trading transactions has no-yet rules of implementing.

Perkembangan pandemi Covid-19 saat ini sangat mengkhawatirkan dimana terjadinya suatupeningkatan kasus corona khusus di Indonesia. Penelitian ini bertujuan untuk mengetahuidan menganalisis kebijakan yang diambil pemerintah dalam penanganan pandemi Covid-19serta langkah-langkah yang diambil pemerintah untuk menganggulangi dampak-dampak, terutama dampak dari segi ekonomi dan sosial akibat pandemi Covid-19. Metode penelitianhukum yang digunakan yakni metode penelitian hukum normatif. Adapun pendekatan yangdigunakan dalam penelitian ini adalah pendekatan perundang-undangan dan pendekatankonseptual. Penelitian ini berlandaskan pengaturan perundang-undangan yang mengaturmengenai penanganan dan penganggulangan pandemi Covid-19 serta analisis atas konseppenetapan peraturan perundang-undangan tersebut. Hasil dari penelitian ini adalah dalamrangka penanganan Covid-19, berawal dari pemerintah tmengeluarkan kebijakan tentangPembatasan Sosial Berskala Besar yang merujuk pada Undang-Undang Nomor 6 Tahun2018 tentang Kekarantinaan Kesehatan. Peraturan pelaksanaannya yaitu PeraturanPemerintah Nomor 21 Tahun 2020 tentang Pembatasan Sosial Berskala Besar, sertaKeputusan Presiden tentang Kedaruratan Kesehatan sampai dengan saat ini pemerintah telahmengeluarkan kebijakan PPKM yang dimana dilakukan secara berkala. Untukmenganggulangi dampak Covid-19 dari segi ekonomi dan sosial pemerintah mengambilbeberapa kebijakan-kebijakan, yang diantaranya adalah: Peraturan Menteri KeuanganRepublik Indonesia Nomor 23/Pmk.03/2020 tentang Insentif Pajak Untuk WajibPajakTerdampak Wabah Virus Corona; Peraturan Otoritas Jasa Keuangan Republik Indonesia Kata Kunci : Kebijakan, Penanganan, Covid-19 The current development of the Covid-19 pandemic is very worrying where there is anincrease in special corona cases in Indonesia. This study aims to identify and analyze thepolicies taken by the government in handling the Covid-19 pandemic and the steps taken bythe government to mitigate the impacts, especially the economic and social impacts of theCovid-19 pandemic. The legal research method used is the normative legal research method. The approach used in this research is a statutory approach and a conceptual approach. Thisresearch is based on the legislation governing the handling and handling of the Covid-19pandemic as well as an analysis of the concept of establishing these laws and regulations. The results of this study are in the context of handling Covid-19, starting with thegovernment issuing a policy on Large-Scale Social Restrictions which refers to Law Number6 of 2018 concerning Health Quarantine. The implementing regulations are GovernmentRegulation Number 21 of 2020 concerning Large-Scale Social Restrictions, as well as thePresidential Decree on Health Emergencies. Until now, the government has issued a PPKMpolicy which is carried out regularly. To address the economic and social impact of Covid- 19, the government has taken several policies, including: Regulation of the Minister ofFinance of the Republic of Indonesia Number 23/Pmk.03/2020 concerning Tax Incentives forTaxpayers Af ected by the Corona Virus Outbreak; Regulation of the Financial ServicesAuthority of the Republic of Indonesia Number 11 /Pojk.03/2020 concerning NationalEconomic Stimulus as a Countercyclical Policy for the Impact of the Spread of Corona VirusDisease2019; and Instruction of the President of the Republic of Indonesia Number 4 of2020 concerning Refocussing of Activities, Reallocation of Budgets, and Procurement ofGoods and Services in the Context of Accelerating Handling of Corona Virus Disease 2019(Covid-19). The political party's position as a determinant of government head nomination in Indonesia made the political party a central and strong role in the determination of the Cabinet in the presidential government of Indonesia and allowed the political party to determine the Cabinet domination established by the President elected. This research aims to determine the model of the presidential institution strengthening in the multi-party era in Indonesia and to know the political and juridical construction of the presidential institution in determining the cabinet in Indonesia. The method used is a normative legal research method with a conceptual approach. The results of this research are, firstly that the strengthening of the presidential institution in the multi-party era can occur when done with the restriction of political parties through the mechanism of the parliamentary threshold. Secondly, that the political construction of the cabinet determination by the President is based on the coalition of political party supporters of the government, and the juridical construction of the President may elect the Minister of the party proposal because it is based on article 6A paragraph (2) The Constitution of the Republic of Indonesia 1945. Kedudukan partai politik sebagai penentu pencalonan kepala pemerintahan di Indonesia menjadikan Partai Politik memiliki peran sentral dan kuat dalam penentuan kabinet di Pemerintahan Presidentiil Indonesia dan memungkinkan partai politik untuk menentukan dominasi kabinet yang dibentuk oleh Presiden terpilih. Penelitian ini bertujuan untuk mengetahui model penguatan lembaga kepresidenan pada era multi partai di Indonesia, dan untuk mengetahui konstruksi politis dan yuridis lembaga kepresidenan dalam menentukan kabinet di Indonesia. Metode yang digunakan adalah metode penelitian hukum normatif dengan pendekatan konseptual. Hasil penelitian memperlihatkan bahwa pertama, penguatan lembaga kepresidenan di era multi partai dapat terjadi apabila dilakukan dengan pembatasan partai politik melalui mekanisme parlementary threshold. Kedua, bahwa konstruksi politis penentuan kabinet oleh presiden didasarkan atas koalisi partai politik pendukung pemerintahan, dan konstruksi yuridis presiden dapat memilih menteri dari usulan partai karena didasarkan pada Pasal 6A ayat (2) UUD 1945.

The existence of large plantations in Indonesia has proven the failure of individualism value to uphold agrarian justice. This study aims to examine regulations regarding to the land ownership which contradicts with social function principles of Land Cultivation Rights (LCR) and provide recommendation for setting the land ownership which can realize land utilization for plantation ideally. This study employs normative legal research method by statute and conceptual approach. The legal materials were analyzed by inductive, deductive and interpretative syllogism. The results of this research are as follows. First, regulations on Site Permit, Plantation Operation Permit and Release of Forest Area for Plantation based on utilitarian justice and concentrative land ownership are not in accordance with social function principles of Land Cultivation Rights (LCR). Second, the setting of maximum ownership for plantation companies should be based on their type of plants and given fully assets that enable the plantation companies to use the land optimally.Keywords: Land Cultivation Rights, cultivation land area, people’s welfare

This research aims to describing and analyzing the equal and fair development and arrangement of minimarket in Pekanbaru based on Regional Regulation of Pekanbaru City No. 09 of 2014 on the Management of People's Market, Shopping Center and Supermarket; and explaining the obstacles and efforts to overcome the equal and fair development and arrangement of minimarket in Pekanbaru City. The research method is socio-legal research. The conclusion of the research is that based on the Regional Regulation No. 09 of 2014, the establishment of minimarket shall be based on RTRW, RDTRK, and zoning regulations; and that developing and arranging minimarket equally and fairly in Pekanbaru City still meet some obstacles. To overcome the obstacles, the Government of Pekanbaru City has carried out some efforts, so that the equal and fair development and arrangement of minimarket in Pekanbaru City can continuously run well.

Local Public (LPPL) Region based on Government Regulation which talks about the Implementation of the Broadcasting of a Public Broadcasting Institution. So that in this paper the researcher will use the normative juridical research method with the Legislative, Case and Conceptual approach. The comparative approach. Considering that local public broadcasting institutions do not yet exist in Situbondo Regency, the local government urgently needs to establish a local public broadcasting institution station to accelerate and contribute information. Mengingat lembaga penyiaran publik lokal belum ada di Kabupaten Situbondo, pemerintah daerah setempat sangat perlu untuk mendirikan satu stasiun lembaga penyiaran publik lokal guna mempercepat dan memberikan kontribusi informasi.Penelitian ini diharapkan dapat menjadi penelitian yang komprehensif terkait dengan status kelembagaa Lembaga Penyiaran Publik Lokal dan berguna bagi Pemerintah Daerah Kabupaten Situbondo dan tentunya bagi peneliti maka penelitian ini bisa memberikan sumbangsih pemikiran bagi akademik dan tentunya tata administratif tentang LPPL dengan lebih baik.

The corona virus or what is known as Covid-19 is an infectious disease caused by a new type of coronavirus that was discovered at the end of 2019 in the city of Wuhan, China, which has spread throughout the world, has killed hundreds of people and infected tens of thousands of others. Previously, Indonesia was one of the countries that had not been infected, and finally in February the corona virus entered Indonesia. The spread of the corona virus causes panic among Indonesian people. The purpose of this study is to uncover legal sanctions against state officials who violate health protocols during the COVID-19 pandemic. The research method used is a normative legal research method where the reference is based on a conceptual approach to legislation. Sources of materials and laws used are primary and secondary. The data collection technique used is to collect references related to research. Furthermore, the data will be processed and analyzed using legal data processing methods systematically. The results of this study indicate that cases of spread and death rates caused by the corona virus are now increasing quite rapidly, a number of countries have even taken action by prohibiting every citizen from traveling abroad or receiving visits from foreign nationals (lockdown). In order to deal with the unrest experienced by the Indonesian people and efforts to prevent the transmission of the corona virus which is increasingly increasing the number of positive patients, the government issued several regulations or policies, namely Government Regulation of the Republic of Indonesia Number 21 of 2020, concerning Large-Scale Social Restrictions. (PSBB) in the context of accelerating the handling of the 2019 coronavirus disease (covid-19).

Prostitution is a social crime that occurs within the community. Argorejo localization or famous as Sunan Kuning is a prostitution localization located in Semarang City. The Mayor of Semarang, through his policy, closed the Sunan Kuning localization. This research shows that there are new problems due to the issuance of Criminal Law Policy related to the closure of the Sunan Kuning Prostitution Localization in Semarang City, but the policy has an impact on the proliferation of Online Prostitution in the City of Semarang which actually creates a very big danger because it can be accessed by everyone and including minors, only on the condition of having a smartphone. This research is useful for the government so that in an effort to deal with crime is going to be carried out in an integrated manner, so that the crime in eradication can really really be resolved at the root of the problem the crime arises. This research focuses more on criminal law policy in dealing with crime in an integrated manner. This research method is a Normative Juridical research method or a doctrinal research method, using a statutory and conceptual approach.

The rise of corruption cases certainly forces the government to prevent corrupt measures, the wiretapping in Indonesia by the KPK, also in terms of tackling other criminal acts. So of course there is Ethics, Ethics so far has not been touched by the KPK because in conducting wiretapping it is only limited to following the laws and regulations even though in regard to laws and regulations there should be ethics that must be maintained to guarantee the right to life of one's privacy. The research method used in this study is the qualitative research method with the type of library research library research, using the statutory approach, and theories (conceptual approach), and the Case Approach (doctrinal approach) which is examined through various literatures relating to the regulation of privacy rights, also relating to the regulation of wiretapping of the KPK.Keywords: Ethics, Wiretapping by the KPK, Wiretapping in the Human Rights PerspectiveMaraknya kasus korupsi tentu memaksa pemerintah terhadap langkah-langkah preventive koruptor, maka penyadapan di Indonesia yang dilakukan oleh KPK, juga dalam hal menanggulangi tindakan-tindakan kriminal lainnya. Maka tentu ada Etika, Etika selama ini belum tersentuh oleh KPK karena dalam melakukan penyadapan hanya sebatas mengikuti peraturan perundang-undangan, padahal berkenaan dengan peraturan perundang-undangan seharusnya ada etika yang harus dijaga untuk menjamin hak kehidupan privasi seseorang. Metode penelitian yang dilakukan dalam penelitian ini adalah dengan metode penelitian kualitatif dengan jenis penelitian kepustakaan ( library research), menggunakan Pendekatan Perundang-undangan (statutory approach), dan Teori-teori (conceptual approach), serta Pendekatan Kasus (doktrinal approach) yang diteliti melalui berbagai literatur yang berkaitan dengan pengaturan hak-hak privasi, juga berkaitan dengan pengaturan penyadapan KPK.  Kata Kunci :  Etika, Penyadapan oleh KPK, Penyadapan dalam Presfektif  HAM

In running their business, what is often the main obstacle for business actors in developing their business is usually related to the provision of capital. In order to overcome this, the Government issued policies in the economic sector, one of which was the issuance of policies regarding Financing Institutions as regulated in Presidential Regulation Number 9 of 2009. Followed up by the Regulation of the Minister of Finance on Venture Capital Companies No. 18 of 2012. As one of the businesses in the financial services sector, its approach is not only in business but also needs to be accompanied by a legal approach (legal approch) so that its existence can be recognized in business traffic. Even though the agreement has been bound in a contract, it is still common for business partner companies to default, and even lead to disputes in court. The purpose of this study is to analyze the settlement of disputes due to default by PPU on the contents of the financing contract between the Venture Capital Company and the PPU. The research method is normative legal research, using primary legal materials, secondary legal materials and tertiary legal materials. The approach is carried out with a statutory approach (statute approach) and a conceptual approach (conceptual approach). From the results of the research it is known that the settlement of disputes due to default by PPU on the contents of the financing contract between the Venture Capital Company and PPU, the settlement of the dispute is carried out by prioritizing non-litigation mechanisms, but if no agreement is reached, the Litigation channel is used.
