AbstractConstitutional Court Verdict No. 35 / PUU-X / 2012 restore function indigenous forests to be managed by the indigenous peoples. The ruling establishes indigenous forest is no longer a part of the state forest but part of the forest rights. Forest rights are no longer only includes forests on lands of natural/legal entity but it also located in the area of indigenous peoples. The problem in this research is how the reconstruction of indigenous forest planning policy in Way Kanan regency after the issuance of the Constitutional Court Verdict No. 35 / PUU-X / 2012 on Traditional Forest. Research using normative juridical-empirical. The data used is secondary data and primary data, then performed by juridical qualitative data analysis. Based on the research results, that arrangement indigenous forests by Way Kanan District Government starts from the assistance and mediator, data collection, conduct research and confirmed the existence of customary law communities along with indigenous areas, cooperating with the partnership between indigenous peoples and the concessionaires, and accelerate the formation Regional Regulation on the Recognition of Indigenous Peoples. Indigenous forest planning policy has not been established was blocked because the region of Way Kanan District Regulation that specifically related to customary law communities, there is still confusing associated with the administration of indigenous forests and the interests of the party holding intervention Forest Management Rights (HPH). Keywords: Land Register, Court JudgementAbstrakPutusan Mahkamah Konstitusi No. 35/PUU-X/2012 mengembalikan fungsi hutan adat untuk dikelola oleh masyarakat adat. Putusan tersebut menetapkan hutan adat bukan lagi menjadi bagian dari hutan negara melainkan menjadi bagian dari hutan hak. Hutan hak tidak lagi hanya mencakup hutan yang berada di atas tanah perseorangan/badan hukum tetapi juga yang berada pada wilayah masyarakat hukum adat. Permasalahan dalam penelitian ini adalah bagaimana rekonstruksi kebijakan penataan hutan adat di Kabupaten Way Kanan  pasca dikeluarkannya Putusan Mahkamah Konstitusi No. 35/PUU-X/2012 tentang Hutan Adat. Penelitian menggunakan pendekatan yuridis normatif-empiris. Data yang dipergunakan adalah data sekunder dan data primer, selanjutnya dilakukan analisis data secara yuridis kualitatif. Berdasarkan hasil penelitian, bahwa penataan hutan adat oleh Pemerintah Daerah Kabupaten Way Kanan dimulai dari pendampingan dan mediator, pendataan, melakukan penelitian dan mengukuhkan keberadaan masyarakat hukum adat beserta wilayah adat, menjalin kerjasama dengan pola kemitraan antara masyarakat adat dengan pihak pemegang HPH, dan mempercepat pembentukan Peraturan Daerah tentang Pengakuan Masyarakat Adat. Kebijakan penataan hutan adat  mengalami hambatan karena belum terbentuknya Peraturan Daerah Kabupaten Way Kanan yang mengatur secara khusus terkait masyarakat hukum adat, masih adanya simpang siur terkait administrasi hutan adat, dan adanya intervensi kepentingan pihak yang memegang Hak Pengelolaan Hutan (HPH). Kata Kunci: Reconstruction, Arrangement, Indigenous Forests

The problem that occurs is how the indigenous people of swamps interpret the lack of management territory, the loss of livelihood resources and organize themselves to seize opportunities for management rights. The problem of customary land and indigenous peoples above, the researchers felt the need to study more deeply on the Determination of Indigenous Areas and Customary Law Communities in Penyengat Village, Sungai Apit Subdistrict, Siak Regency, Based on the Minister of Home Affairs Regulation No. 52 of 2014 concerning Guidelines for the Recognition and Protection of Indigenous Peoples. This type of research is sociological, so the data source used is primary data from interviews, secondary data from libraries and tertiary data from dictionaries, media, and encyclopedias. Data collection techniques are done by observation, interviews, and literature review.

This research was conducted in order to find out the objectivity of the media in delivering news of the 2019 presidential election dispute in the Republic of Indonesia. The research method used is qualitative using Robert N. Entman's framing approach. Sources of data in this study are primary data, data obtained from the Java post coverage from the 18 June to 28 June 2019 edition, and secondary data in the form of writing about Java post and books relating to Robert N. Entman's framing analysis. The results of his research are 1) The reporting written by journalists uses two depictions of moral values, namely positive values and negative values. Positive values are often raised to describe the actions of the Constitutional Court, KPU and candidate pair 01 JokowiMa'ruf Amin, while negative values are often raised against the depictions of the candidate pair 02 Prabowo-Sandi. Almost all news texts written by journalists describe the weak position of candidate pair 02 due to the weakness of the arguments submitted and the evidence and witnesses provided cannot be accounted for, even it is reported that candidate pair 02 has also submitted witnesses who provided false statements. The second aspect is regarding the position of Jawa Pos in reporting disputes over the results of the 2019 presidential election. Journalists in Jawa Pos felt less balanced in reporting the conflict. This can be seen from the emphasis which is indirectly more favorable for the position of candidate pair Jokowi-Ma'ruf Amin compared with candidate pair 02 Prabowo-Sandi. Almost all news taken as objects of study in this study tend to prioritize Jokowi-Ma'ruf Amin and marginalize Prabowo-Sandi's position.Candidate 01Jokowi-Ma'ruf Amin is depicted as a disadvantaged party by submitting the dispute of the 2019 presidential election results to the constitutional line while pair 02 of Prabowo-Sandi is described as a guilty party and does not have a strong basis to prove his allegations regarding fraud committed by the paslon 01 Jokowi-Ma'ruf Amin. 2) the reporting of postal Javanese journalists in reporting the 2019 Presidential Election Dispute conflict, lacking balance in presenting information, tended to support the candidate pair 1 Jokowi-Ma'ruf Amin. Keywords: Framing, 2019 Presidential Election Dispute, Newspaper, Jawa Pos Penelitian ini dilakukan dalama rangka ingin mengetahui objektifitas media dalam menyampaikan berita sengketa pilpres tahun 2019 di Republik Indonesia. Dalam penelitian ini mengungakan metode kualitatif dengan menggunakan pendekatan framing Robert. N. Entman. Sumber data dalam penelitian ini adalah data primer, data yang didapatkan dari pemberitaan Jawa pos dari edisi 18 Juni sampai 28 Juni 2019,dan data sekunder berupatulisan mengenai Jawa pos serta buku-buku yang berkaitan dengan analisisframing Robert. N. Entman. Hasil penelitiannya yaitu 1) Pemberitaan yang ditulis wartawan menggunakan dua penggambaran nilai moral, yaitu nilai positif dan nilai negatif. Nilai positif sering dimunculkan terhadap penggambaran tindakan MK, KPU dan paslon 01 Jokowi-Ma’ruf Amin, sedangkan nilai negatif sering dimunculkan terhadap penggambaran tindakan paslon 02 Prabowo-Sandi. Hampir seluruh teks berita yang wartawan tulis mengambarkan lemahnya posisi paslon 02 karena tidak kuatnya dalil-dalil yang diajukan serta bukti-bukti dan saksi yang diberikan tidak dapat dipertanggungjawabkan, bahkan diberitakan bahwa paslon 02 juga telah mengajukan saksi yang memberikan keterangan palsu. Aspek kedua adalah mengenai posisi Jawa Pos dalam memberitakan sengketa hasil pilpres 2019.Wartawan Jawa Pos dirasa kurang berimbang dalam memberitakan konflik tersebut. Hal ini dapat dilihat dari penekanan yang secara tidak langsung lebih menguntungkan posisi paslon 01 Jokowi-Ma’ruf Amin dibanding dengan paslon 02 Prabowo-Sandi. Hampir seluruh berita yang diambil sebagai objek kajian dalam penelitian ini cenderung mengutamakan pihak Jokowi-Ma’ruf Amin dan memarjinalkan posisi Prabowo-Sandi. Paslon 01 Jokowi-Ma’ruf Amin digambarkan sebagai pihak yang dirugikan dengan adanya pengajuan sengketa hasil pilpres 2019 ke jalur konstitusi sedangkan paslon 02 Prabowo-Sandi digambarkan sebagai pihak yang bersalah dan tidak memiliki dasar yang kuat untuk membuktikan tuduhannya mengenai kecurangan yang telah dilakukan oleh paslon 01 Jokowi-Ma’ruf Amin. 2) pemberitaan wartawan Jawa pos dalam memberitakan konflik Sengketa Pilpres Tahun 2019, kurang berimbang dalam menyuguhkan informasi, cenderung mendukung pada paslon 1 Jokowi-Ma’ruf Amin. Presently, pada gelahang marriages are still controversial within Balinese society in terms of their implementation and the implications. A certain percentage of Balinese approve of pada gelahang marriages, while a certain percentage of people disagree for various reasons. These pros and cons are not tolerated. In fact, the phenomenon of pada gelahang marriages is often confounding to the Hindu community in Bali. Hence, solutions are required. While pada gelahang marriages can be found in many districts and regions in Bali, however, many doubts and problems still arise in their philosophical and juridical foundations. Therefore, research on pada gelahang marriages from the perspective of legal pluralism needs to be done. This research is a qualitative research with a legal sociology approach. Primary data is derived from field data from observations and from the results of interviews of related parties, while secondary data is obtained from literature books using the theory of legal pluralism as a guiding theory in the discussion of research. The results of the study indicate that the pada gelahang marriage has a philosophical foundation, juridical foundation and sociological basis for the creation of values of justice, legal certainty and the benefit of law in the framework of legal pluralism that provides a way to meet Hindu religious law, traditional village customary law and state law to set pada gelahang marriages

The direct election of the Governor and Deputy Governor is the implementation of the mandate of the law, this study has the aim to determine the extent of the performance of the KPU Blitar City in increasing voter participation in the election of the Governor and Deputy Governor of East Java in 2018. There are various problems which includehuman resources from KPU has not been optimal in the level of village government and sub-district government, and lack of participation from the community due to factors of economic interests, domiciles in the outer areas of Blitar City, and lack of public awareness. The performance theory proposed by Mahsun (2012: 77) is used as a theoretical basis. The object of the research was the Blitar City KPU, carried out through a qualitative approach using interview methods and using secondary data in the form of literature studies from several scientific references suitable for following up the analysis of primary data obtained. The results of the study illustrate that the performance of the Blitar City KPU in the election of the Governor and Deputy Governor of East Java in 2018 cannot be said to be optimal. Because there are still obstacles to the Blitar City Election Commission in increasing voter participation which is seen from the indicators of input, process, results and impact.

This research is aimed identifying the advantages of the regulation of TUPE principles, as well as inhibiting factors for outsourcing companies to apply the TUPE principles after the Decision of the  Constitutional Court Number 27/PUU-IX/ 2011. The research was conducted by using normative-empirical method. The data of the research consisted of primary data and secondary data. All of the collected data were analyzed using qualitative method. The results of this research were presented in a descriptive analysis report. The results of the research indicated he advantages that could be obtained by workers in relation with regulation of the TUPE principles included protection of wages, welfare and working requirements, protection of workers when the company was taken over, protection of workers when there is a change of outsourcing company and regulation of the right to file a lawsuit to the industrial relations court. The inhibiting  factors in the application of the TUPE principles in the  outsourcing companies after the  Decision of Constitutional Court  were the lack of socialization and supervision of the government, various legal loopholes of discrepancies between the implementing regulation and  the Decision of Constitutional Court, uncertainty severance regulation, assumptions that TUPE was a new burden which may disadvantage employers, and the lack of understanding of the workers related to their rights.

This article examines the different legal articulations between indigenous typologies and topologies, that is, the relationship between someone classified as an indigenous subject, a grantee of minority rights, and the spatial arrangements such as reservations or ancestral territories considered necessary for indigenous “cultural survival.” I analyze how the jurisprudence of the Colombian Constitutional Court manifests and rests on the diverse combinations of these two factors. The typology/topology binary characterizes the manner in which these legal discourses portray indigeneity and culture. This binary also offers insight into a broad range of issues, including the access that indigenous peoples have to minority rights, the use of customary law, and the spatial delimitations that frame indigenous legal jurisdictions. Some of the complexities that arise from this binary are: the conceptualization of indigenous places as habitats, the idea of culture as a list of traits, and the concept of “degrees” of indigeneity that determine these peoples' access to minority rights.

One of traditional settlements in Indonesia is located in the residential area of Kajang, Bulukumba, South Sulawesi Province. Settlement community in Kajang is classified into two levels, the first is meso level consisted on spatial villaes, homes, and forest, and the second is macro level consisted on the spatial region consisting of kamase-masea region, and the region kuassayya. From the shape and function of artefacts and sites in Kajang area, it can be mentioned that the Kajang district has the Megalithic sites and Islamic sites which are still functioned until recently. The aim of this research is determining the  pattern of settlement in the area of the Kajang based on the location of the sites. The source of data consist of two namely secondary data which is obtained from literary research, and primary data obtained  through field research by observation and survey. The pattern of settlement in the Kajang area shows two characteristics; firstly,  Settlement patterns and placement of home in group, leading to the altitude, facing to the west; the sacred building that is located at high altitude and surrounded by indigenous forest areas and settlers' houses. Secondly, settlement patterns extend lengthwise in a row on both sides of a pathway up to the foothills, and on riverbanks. Those houses are characterised by the location of owner's social stratification. There is no specific orientation of houses to the wind directions. Sacred building is placed in higher space surrounded by residents' houses. Ammatoa as the spiritual leader, and a site that functions to inaugurate Karaeng as leaders of the governance. Salah satu permukiman tradisional di Indonesia adalah permukiman di kawasan Kajang, Kabupaten Bulukumba, Propinsi Sulawesi Selatan. Permukiman masyarakat di kawasan Kajang terdiri atas dua tingkat, yaitu bersifat meso yang menyangkut tata ruang desa, rumah tinggal, dan hutan adat, dan bersifat makro menyangkut tata ruang kawasan yang terdiri atas kawasan kamase-masea dan kawasan kuassayyya. Dari bentuk dan fungsi situs-situs di kawasan Kajang, dapat dikatakan bahwa kawasan Kajang memiliki situs Megalitik dan situs Islam yang masih dipergunakan sampai sekarang. Penelitian bertujuan untuk mengetahui pola permukiman di Kawasan Kajang berdasarkan letak situs-situs. Sumber data penelitian ada dua, yaitu data sekunder yang diperoleh melalui penelitian pustaka, dan data primer diperoleh melalui penelitian lapangan dengan cara observasi dan survei permukaan.Pola permukiman di kawasan Kajang menampilkan dua ciri, yaitu: 1). Pola permukiman dan penempatan rumah secara berkelompok mengarah pada ketinggian, arah hadap rumah ke arah barat, bangunan sakral berada di tempat ketinggian dan dikelilingi oleh kawasan hutan adat dan bangunan rumah penduduk, 2). Pola permukiman berbentuk memanjang dan berderet disebelah menyebelah jalan, kaki bukit, dan pinggir sungai dan pantai dengan ciri yang menunjukkan pelapisan sosial. Terdapat dua fungsi situs di kawasan Kajang, yaitu: situs yang berfungsi sebagai tempat pelantikan Ammatoa sebagai pemimpin di bidang spiritual, dan tempat pelantikan Karaeng yang dianggap pemimpin di bidang pemerintahan.

<p>ABSTRACT<br />The judicial review allegation conducted by the Nusantara Indigenous Peoples Alliance (AMAN) against Act No. 41/1999 on Forestry has resulted Constitutional Court Rulling No.35 (Putusan MK 35) which sucessfully excluded indigenous forests from the state forest. This ruling has implications for the process of new policy formulation related to the recognition and protection of indigenous people and their customary land. Therefore this study aims to look at the influence of the Putusan MK 35 on the formulation of the Village Law and Recognition and Protection of Indegenous People Bill (RUU PPMHA)through the role of actors and discourses. This study found that; The Putusan MK 35 affect the substance of the Village Law with the inclusion of the indegenous village nomenclature within the law. A common discourse and political interests among actors made the Village Law formed quickly. However the rulling did not succeed in promoting PPMHA Law given the conflict of the actors was very high and the discourse about social unit of indegenous people was unclear at that time<br />Keywords: indigenous peoples, indigenous forest, indigenous village, recognition and protection, costumary land</p><p>ABSTRAK<br />Gugatan judicial review yang dilakukan oleh Aliansi Masyarakat Adat Nusantara (AMAN) terhadap UU No.41 tahun 1999 tentang Kehutanan yang menghasilkan Putusan Mahkamah Konstitusi No.35 (Putusan MK 35) yang mengeluarkan hutan adat dari hutan negara. Kebijakan ini berimplikasi pada proses pembentukan kebijakan baru terkait dengan pengakuan dan perlindungan masyarakat adat dan wilayah adatnya. Karenanya, penelitian ini bertujuan untuk melihat pengaruh Putusan MK 35 terhadap Undang-Undang tentang Desa dan Rancangan Undang-Undang tentang Pengakuan dan Perlindungan Masyarakat Hukum Adat (RUU PPMHA) melalui analisis aktor dan diskursus yang berkembang. Penelitian menemukan bahwa Putusan MK 35 mempengaruhi subtansi Undang- Undang Desa dengan masuknya nomenklatur desa adat dalam undang-undang. Diskursus dan kepentingan yang saya sama dari aktor membuat undang-undang ini terbentuk secara cepat. Namun tidak berhasil dalam RUU PPMHA karena konflik para aktor sangat tinggi dan diskursus mengenai unit sosial masyarakat hukum adat tidak jelas.<br />Kata kunci: masyarakat adat, hutan adat, desa adat, pengakuan dan perlindungan, wilayah adat.</p>
