Kewenangan Peradilan Agama banyak bersentuhan langsung dengan kepentingan perempuan dan anak, terutama dalam perkara perceraian dan pengasuhan anak. Peradilan Agama berwenang mengadili sengketa di bidang hukum keluarga dan hukum ekonomi Syariah. Perkara-perkara yang termasuk dalam hukum keluarga seperti perceraian, gugatan nafkah, hak asuh anak, nafkah anak, dan perkara-perkara yang merupakan akibat perceraian, banyak bersentuhan dengan hak-hak perempuan dan anak. Dalam penegakan hukum terkait hak-hak perempuan dan anak, Mahkamah Agung telah mengesahkan Peraturan Mahkamah Agung Nomor 3 Tahun 2017 yang menekankan lembaga peradilan lebih memerhatikan aspek perlindungan hak-hak perempuan dan anak dalam memutus perkara. Penelitian ini merupakan penelitian normatif, dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach).  Hasil penelitian menunjukkan bahwa Peradilan Agama, dalam hal ini telah mengambil peran dalam melindungi hak perempuan dan anak melalui beberapa regulasi dan putusan perkara. Peradilan Agama berupaya memaksimalkan pelaksanaan putusan dengan mengimplementasikan kaidah-kaidah hukum yang responsif sebagaimana dikehendaki dalam Peraturan Mahkamah Agung Nomor 3 Tahun 2017 sehingga putusan tersebut dapat dieksekusi dengan baik. Selain itu, perlu adanya sinergitas lintas instansi agar upaya melindungi hak-hak kaum perempuan dan anak dapat terwujud secara lebih signifikan.The authority of Indonesia’s Religious Court has direct relation to women and children interest, especially in divorce and childcare cases. Religious court has the authority in adjudicating cases of family law and Islamic economy law. Divorce, livelihood, child custody, child allowances, and cases related to the direct consequences of divorce have significant matter to the women and children rights. In case of enforcing law that concern to the protection of women and children rights, Indonesia Supreme Court has enacted Peraturan Mahkamah Agung Nomor 3 Tahun 2017 that insist judicial institution to emphasize the protection of those rights in adjudication processes. The Religious Courts have taken a role in protecting the rights of women and children through several regulations and case decisions. This research is a normative study, using a statute approach and a conceptual approach. The results of the study indicate that the Religious Courts has a shot to implement comprehensively legal norms in Perma Nomor 3 Tahun 2017 as of the court decision more executable. Moreover, it is an urgent demand to hold an inter-institutions cooperation to raise the effectiveness of securing women and children rights.

This research aims to investigate access to justice for children and women in the Religious Court Decisions after the issuance of Circular Letter of Supreme Court No. 4 of 2016, Point 5 on Religious Chamber. This particular point states that the Religious Court can require a father to provide child maintenance if the child is under the custody of the mother. This is a normative study, with the data obtained from interviews and 150 Religious court decisions. These decisions are issued by the Religious Courts of East Jakarta and Central Jakarta from 2015-2017. The examination of those Decisions reveals that most of the decisions on divorce do not mention any stipulation about child maintenance. This means that the Supreme Court Circular No. 4 of 2016 has not been able to protect children rights in the case of divorce, as well as women’s rights. From the court used in this study, only 14% that require the fathers to provide child maintenance after divorce. This percentage is almost similar to the decisions issued before the issuance of the Circular, which only 12% in 2016, and 14% in 2017.     AbstrakPenelitian ini bertujuan untuk mengetahui akses keadilan bagi anak dan perempuan dalam Putusan Pengadilan Agama pasca terbitnya Keputusan Mahkamah Agung Nomor 4 Tahun 2016 Poin 5 tentang Kamar Beragama. Dalam poin khusus ini disebutkan bahwa Pengadilan Agama dapat meminta seorang ayah untuk mengasuh anak jika anak tersebut berada di bawah asuhan ibunya. Penelitian ini bersifat normatif, dengan data diperoleh dari wawancara dan 150 putusan Pengadilan Agama. Putusan-putusan tersebut dikeluarkan oleh Pengadilan Agama Jakarta Timur dan Jakarta Pusat dari tahun 2015- 2017. Berdasarkan pemeriksaan terhadap Putusan tersebut, sebagian besar Putusan perceraian tidak menyebutkan ketentuan tentang pengasuhan anak. Artinya, Surat Edaran Mahkamah Agung Nomor 4 Tahun 2016 belum mampu melindungi hak anak dan hal perempuan dalam kasus perceraian. Data pengadilan yang digunakan dalam penelitian ini, menyebutkan hanya 14% yang mewajibkan ayah untuk mengasuh anak setelah perceraian. Persentase ini hampir sama dengan keputusan yang dikeluarkan sebelum keluarnya keputusan tersebut, yaitu hanya 12% pada 2016, dan 14% pada 2017.

The article is devoted to the problem of social orphanage registered in Mexico, its importance for the state. Social orphanage is a phenomenon, which is commonly found in countries characterized by social and political lack of stability caused by different reasons. In the paper the concept of social orphanage in Mexico is revealed, causes of the scale of the problem are given, the role of the country and international organizations in the children rights protection and their cooperation. The directions are questioned for getting out of the current situation.

Artikel ini bertujuan untuk mengetahui peranan PKPA Medan Sunggal sebagai suatu lembaga swadaya masyarakat yang fokus terhadap perlindungan anak, khususnya anak jalanan. Penelitian ini merupakan penelitian deskriptif kualitatif, yaitu penelitian yang akan menggambarkan objek penelitian secara transparan berdasarkan data dan fakta yang dikumpulkan oleh peneliti. Hasil penelitian menunjukkan bahwa PKPA memiliki peranan dalam memberikan perlindungan terhadap hak asasi anak jalanan yang ditunjukkan dengan dibentuknya unit sanggar kreativitas anak yang memberikan perlindungan terhadap anak-anak telantar, anak-anak jalanan dan pekerja anak agar dapat tumbuh dan berkembang sesuai dengan harkat dan martabat kemanusiaan, serta mendapatkan perlindungan dari kekerasan dan diskriminasi.----------------------------------------------------------------------------------------------------------------------------------------This article was aimed at exploring the role of PKPA Medan Sunggal as a Non-Government Organization (NGO) focusing on children rights protection, especially street children. It was a descriptive qualitative research. The results reveal that PKPA has a role to protect street children rights by establishing a house in order to protects and fosters street children rights, child labor, homeless children. It also protects them from discriminative and bullying.

Summary The contemporary legal landscape in Southern Africa and its responsiveness to the challenges in the region can be explained in many ways. Part of the explanation has been the idea of legal transplants—which entails borrowing and adapting legal norms, and structures from different legal systems in order to resolve legal problems in the region. The end of apartheid and other rapid changes in the region—political, racial, economic and social—has directly placed the courts on the frontlines of human rights protection especially on socio-economic rights and other overarching concerns of law reform. The adoption of constitutional courts in some of the countries, and consequent judicial activist turn in the jurisprudence of courts in the region generally; has inserted the courts into the mainstream of policy deliberations. Thus, this paper claims that legal transplant per se does not explain the full reality of what is going on in the region—in terms of nomativization, transmission, adoption, and adaptation of legal ideas within the respective systems in the region. It further claims that a mesh of different understandings and approaches to legal comparison and development is more suitable as a method of studying pluralist complex systems as we see in the region. Hence, the notion of judicial translation—the judiciary forming the membrane, purveyor and capillary of legal transmission—as an essential lens through which we can better view and understand the legal evolution in the region. Taking the institution of courts – particularly constitutional courts—and examining their jurisprudence as epitomized in some of their decisions of finality—the work seeks to begin a meaningful deliberation about the role of courts in law, social change, and policy in the region. It is divided into three major parts for ease of discourse. It is hoped that this would be a fitting exordium into the more significant meaning of legal transplant through judicial intervention in otherwise predominantly policy questions in the Southern African region.

Abstract Children are the hope of the nation. But reality shows that children are still involved in various forms of crime. Meanwhile, the police as law enforcers are expected to handle criminal cases involving children as a perpetrator with a different approach, namely the approach of restroative justice. This is what becomes the rationale for research with two objectives: (1). The role of police investigators on children in conflict with the law with a restroative approachjustice; (2). Forced efforts that can be carried out by police investigators on children in conflict with the law. This research is a normative study with two approaches, namelylegislation approach and conceptual approach. Based on this approach, the overall results of the study were analyzed argumentatively qualitatively. The results of the study indicate that police investigators have a very important roleimportant in handling crime cases involving children by exposing the child to putting forward the approach of restroative justice. The results of subsequent research, that forced efforts by police investigators againstchildren who are in conflict with the law in the approach of restroative justice, which should prioritize human values by integrating the role of the community, given the development of the child's soul. The recommendation of researchers is that police investigators handling child crimes should be provided with special skills that prioritize the approachrestroative justice. Keywords: Children, Police Investigators, and Restorative Justice

Abstract This study aims to analyze the legality issues of siri marriages which have become polemic in the life of the people in Indonesia and their impact on women and children according to Indonesian marriage law, which is regulated according to Law Number 1 of 1974 concerning marriage. This study uses the type or type of Normative Legal research and library research, using the statutory approach, conceptual approach, and the comparative approach. This study uses these approaches because what is examined here is the rule of law and/or legislation relating to marital marriages. The research results are then analyzed and described qualitatively. The results of this study indicate that, Law Number 1 of 1974 concerning marriages is still ambiguous, there is a norm conflict between one article and another that causes confusion and differences in perception among the community that triggers polemics. So that through the results of normative juridical studies, this research concluded that based on legal principles and legal norms in Law No. 1 of 1974 concerning marriages along with other statutory regulations, Siri marriages are marriages that are considered illegal. Thus, this legal juridical illegitimate marriage will have a very detrimental effect on the parties, especially women and children who are bound in the marital relationship of Siri. This study aims to review the discussion on how the role of the Religious Courts towards the protection of women's rights in the distribution of joint assets in the decision Number 4698/Pdt.G/2019/PA.Tgrs and also how the considerations of the Religious Court Judges based on the Decision Number 4698/Pdt.G/2019 /PA.Tgrs. The research method used is normative juridical with a conceptual approach and a statutory approach. Data analysis uses a qualitative approach. The Religious Courts in protecting women's rights in cases of the distribution of joint property have a role and function to examine, adjudicate and decide on a case applying human rights values with respect for human dignity, non-discrimination, equality before the law, justice, benefit, legal certainty, and ex officio judges provide protection for women, by giving 70% of joint property to women and 30% to men by ignoring the Marriage Law and the Compilation of Islamic Law. Consideration of judges who ignore women's rights and have a patriarchal mindset towards child support. It is the duty of a man to provide for his children, an obligation that is neglected causes a man to be able to collect wealth while a woman to provide a living for children is the cause of not being able to collect wealth. Judges should consider this to create legal justice.

The main issues elaborated in this legal research are the legal principles of tender during a pre-contractual stage and the principles of contract law on Cooperation Contract known as Production Sharing Contract (PSC) based on Laws Number 22 Of 2001 Concerning Oil and Gas. The type of this research is normative study and the approach of this research are conceptual approach, statute approach, and case approach. There are two results in this research. Firstly, in the process of tender during a pre-contractual stage of Cooperation Contract, the principles of responsive competition, transparency and the principle of accountability must be applied. The principle of responsive competition is the most important to be implemented since the tender process produces a competition to get a working area. In addition, the tender process of Cooperation Contract is also related to the principles of transparency and accountability that plays to protectthe interests ofthe state and to get a competent contractor.Secondly, in formation and performance of the Cooperation Contract, the principle of proportionality sharing should be emphasized, especially when formulating the proportion of production sharing. Cooperation Contract is also related to the principle of transparency that plays an important role on state revenues from the upstream oil and gas business activities, because a transparent process will result in optimal outcomes. Finally, in Cooperation Contract, the principles of responsive competition, transparency, accountability, and the principle of proportionality sharing should be clearly stated in the rules and legal norms.

This study aims to examine and analyze the role of the judiciary in the cancellation of the Sharia Arbitration award as an alternative settlement of sharia economic disputes. This research uses a type of normative legal research and a law and conceptual approach. The data obtained both primary and secondary data are then analyzed using qualitative descriptive methods. The results of the analysis show that the judiciary has the authority to adjudicate requests to cancel the Sharia Arbitration decision, namely the Religious Courts as a forum that represents Islamic justice in Indonesia. With this authority granted, the Religious Courts have the authority to examine at the same time the substance of the reasons for canceling the Sharia Arbitration award which is included in a criminal act which, in general terms, is the authority of the District Court. Therefore, it is necessary to have an arrangement that reinforces the authority of the Religious Court in canceling the Sharia Arbitration award so that it can more effectively support the enforcement of the sharia economy.

The article deals with key tendencies in the development of Russia’s market of mergers and acquisitions in the first decade of the 21st century. Quantitative parameters are analyzed by using available in the open access data bases for the years 2003-2008 taking into consideration new tendencies relating to 2008 financial crisis. An active role of the state played in the market of corporate control represents an important factor. Special attention is given to issues of development of Russia’s system of legal norms regulating the market of mergers and acquisitions.
