The social security system in Albania consists of social assistance and social services, health services and health care insurance and social insurance schemes. In the social objectives of the constitution are declared that the State within the constitutional competencies and the probable means as well as in the fulfillment of private initiatives and responsibilities, aims to higher possible standards of health, physical and mental; social care and services of elderly, orphan and invalids; medical rehabilitation, special education and integration in the community, of disabled persons. The Constitution foreseen that everyone has the right of social insurance when retired or in case of incapacity of work under a certain system established by a law. Everyone, when is unemployed for any reasons independent on individual will and when there is no living means, has the right of need under the conditions foreseen by law. Social insurance is a scheme protecting by benefits persons in respect of temporary incapacity due to sickness, maternity, old-age, disability and loss of breadwinner, employment accidents/occupational diseases, unemployment. Social Services are benefits in kind for disabled persons or vulnerable persons. Social Assistances are cash benefits given to families in need, that means families with lower incomes comparable with minimum standard of living or families without incomes. Health services consist of public health, primary health care, hospitalization services nurse's service, dental and pharmaceutical net. The Institutions of Social Protection in Albania are Social Insurance Institute, National Social Services and Health Care Insurance Fund.

This article discusses the ways in which the Constitution of the Portuguese Republic has embodied to the political choices made during the process of creating and defining a democratic welfare state and how the various constitutional principles are reflected in the architecture of the system and have gradually changed over the years. The authors argue that when Portugal transitioned to democracy, unlike other areas of the country’s social policies the social security system retained some of its earlier organising principles. Having said this, this resilience on the part of the Portuguese system’s Bismarckian template has not prevented social protection from expanding here in accordance with universal principles, and has given successive governments manoeuvring room in which to define programmatically distinct policies and implement differentiated reformist strategies. The paper concludes by arguing that while the Constitution has not placed an insurmountable limit on governments’ political action, it has served as a point of veto, namely by means of the way in which the Constitutional Court has defended the right to social protection, be it in the form of social insurance, be it in the imposition of certain social minima.

Health insurance according to the Law No. 3/1992 obout the social employment guarantee which consist of responsiver and the addressee and health service provider is the health social insurance which is aimed to give the health care guarantee toward the addressee that is enterprenaur and worker.  The law relationship which is consisted between: Responssiver-Addressee is the insurance relationship; Responssiver-Health services provider is the user of health service belong to the health service provider toward to the addressee; Health services provider-Addressee is gives the health service to the addresse is patient.  The responsibility of the responssiver toward the addressee is to give the health care insurance to the addressee gives the health service provider for the importance of the addressee. Kata Kunci:  Asuransi Kesehatan

Badan Penyelenggara Jaminan Sosial (BPJS) berfungsi menyelenggarakan program jaminan kesehatan secara nasional berdasarkan prinsip asuransi sosial dan prinsip ekuitas dengan tujuan menjamin agar peserta memperoleh manfaat kesehatan. Pasal 1 angka 2 Undang-Undang Nomor 24 Tahun 2011 tentang Badan Penyelenggara Jaminan Sosial menyatakan bahwa Jaminan sosial adalah salah satu bentuk perlidungan sosial untuk menjamin seluruh rakyat agar dapat memenuhi kebutuhan dasar hidupnya yang layak. Dalam Pasal 224, 225, dan 226 Undang-Undang Nomor 11 tahun 2006 tentang UUPA, kewajiban kepada Pemerintah Aceh untuk memberikan pelayanan kesehatan secara menyeluruh kepada penduduk Aceh terutama penduduk miskin, fakir miskin, anak yatim dan terlantar. Pasien BPJS Kelas 3 di beberapa Rumah Sakit di Kota Banda Aceh memerlukan perlindungan secara hukum dalam menerima pelayanan kesehatan yang bertujuan menjamin adanya kepastian hukum yang didapatkan oleh pasien, sehingga pasien terhindar dari kerugian saat menerima pelayanan kesehatan yang seharusnya diberikan secara baik dan optimal oleh tenaga kesehatan.Kerugian sebagaimana dimaksud berupa kerugian atas kerusakan, pencemaran, dan atau kerugian menderita penyakit/cacat sebagai akibat perbuatan/kesalahan dokter. Bentuk ganti kerugian berupa perawatan kesehatan dalam rangka memulihkan kondisi pasien, pengembalian uang atau pengembalian barang dan atau pemberian santunan yang sesuai dengan ketentuan perundang-undangan.National Social Security Agency (BPJS) has a function to conduct national health of social security based social insurance principle and equity principle aiming at securing the members in order to obtain the benefit of health care. Article 1 point 2 of the Act Number 24, 2011 regarding National Social Security Agency stipulates that Social Security is one of the forms of social protection in securing all people to fulfill basic need of proper lives. Articles 224, 225, and 226 of the Act Number 11, 2006 regarding Aceh Governance Act oblige the Aceh Government especially the poor, orphan and abandoned kids. Patients of the National Social Security Agency of Class 3 in several hospitals in Banda Aceh need law protection in providing health services aiming to secure the existence of law certainty acquired by the patients hence it prevents from the loss while accepting the health services that should be provided well and optimally by medical staffs. The loss aforementioned are damages, contamination, or suffering from illness/disability resulted from medical malpractice. The kinds of the loss are health care in recovering patients’ condition, compensating or returning things or the compensation that is not based on existing rules.

Introduction. In the conditions of digital society formation, the informatization of the social security sphere is a necessary component and guarantee of successful implementation of social policy aimed at quality and timely satisfaction of citizens' needs. Therefore, a prerequisite for the effective functioning of social protection and public service authorities is the development and technical innovation of social services and channels for their implementation through automated information systems, should be consistent with the innovation strategy of development of the social sphere as a composite digital economy of the state. Purpose is to substantiate the expediency of application of the newest digital technologies in the sphere of social security and novelization of social services on this basis, as well as to reveal features and advantages of social protection of the population through automated information systems and channels of their implementation. Results. The necessity and role of informatization in the modern digital society and the main challenges that lead to its implementation in the field of social security have been substantiated. The key automated information systems, which contribute to the construction of a common information space of the social sphere and allow to increase social protection of the population in domestic conditions, as well as the emergence of a new service-oriented social service with a wide range of information and communication services, have been analyzed. The necessity of training and retraining of highly qualified creative specialists of new specialties was noted and generalized principles of systems of skills development in the conditions of informatization, which are important in the selection of social workers, were defined. Conclusions. Social protection and social welfare institutions, when formulating their own strategies, should consider the information and communications technology vector of development as an essential means of improving their functioning, since this will determine the effectiveness of social policy implementation in the State and the level of satisfaction of citizens with social services. The results of informatization of social processes are manifested in the implementation of automated information systems and the construction of a single unified information space of social security, the development of new service products, electronic filing of documentation and simplification of procedures for obtaining social security, transparency of social security and, as a result, successful social policy.

Annotation. Introduction. The article investigates the main problems in the field of social protection of the population in Ukraine that require an immediate solution. The theoretical approach to the financial support of the social sphere is considered. The reasons for the negative impact on the implementation of budget policy in the social protection system are investigated. The financing of social protection and social security, health and education from state and local budgets of Ukraine is analyzed. Changes in the system of social protection through the transformation of financing of the social protection system are determined. The purpose of the article. It is worth exploring the financial support of social services in Ukraine in recent years. It is also worth offering possible ways to counteract the underfunding of the social sphere from the budgets of different levels. Results. Formation of national social security in the system of public finance management should be carried out on the basis of the system of fiscal norms and to be focused; to ensure effective forms of supporting various social groups that require social protection; transition to cash provision of welfare; Personal assistance to the state is included in income of individuals and families. Taking into account that wages are still the main source of income in Ukraine, it is necessary to increase its share in income, paying special attention to minimal hourly remuneration. Conclusions. The main reason for the negative impact on the implementation of fiscal policy in the social security system is mainly reflected in the implementation of the budget expenditures approved by the state. In addition, during the research process, we have found that in the state budget of Ukraine, social security expenditures and social insurance funds have increased more than doubled over the past five years, indicating the lack of funds in this area.

AbstractThis chapter discusses the general legal framework regulating Russia’s welfare system and access for national citizens, foreigners residing in the country, and national citizens residing abroad to social benefits in five policy areas: unemployment, health care, family benefits, pensions, and guaranteed minimum resources. Our analysis shows that the eligibility of Russian nationals for social benefits depends either on their employment status and contribution record (for pensions and other social insurance benefits), or their residence status (for social assistance and healthcare). The overall level of social protection of citizens residing in different parts of the country may differ substantially due to the decentralized structure of the social protection system in Russia. The rights of foreign residents to social security benefits are essentially the same as those of the nationals, as long as they are legally employed and make social security contributions. However, there are two major exceptions: pensions and unemployment benefits. Social assistance benefits provided at the regional level are typically available to all legal residents, foreigners included, with few exceptions. When deciding to permanently move abroad, Russian citizens lose their entitlement to claim social benefits from Russia, apart from acquired contributory public pensions.

The paper analyzes the main aspects of the organization and support of territorial communities in the field of social security of the population of Ukraine. The main directions of development of the process of providing social services are outlined. The main instruments of budget financing of social protection and social security of the population of Ukraine are determined and the effects that affect the volume of expenditures of the State and Consolidated budgets on the social sphere are investigated. The existing problems in the field of social security are studied and the need to harmonize social standards with the standards of the European Union is emphasized. The thesis is put forward on the need to implement a number of measures for Ukraine's timely response to the sharp increase in socio-economic needs in the global crisis. Emphasis is placed on the problems and prospects for the development of social security in the decentralization process. The range of problems for the effective response of social policy to rapid changes in the development of the modern world economy is outlined. The necessity of the analysis of the EU experience in the field of social security and the need to adapt the best European practices in order to comply with the Western European models of social protection and / or social insurance is substantiated. The need to apply the tools of theoretical and methodological analysis of the conceptual foundations of sustainable development of social security to specific circumstances and realities in Ukraine. The study focuses on the relevance of strategic and operational objectives of the new Law of Ukraine "On Social Services" and the need for further harmonization of existing legislation with the basic standards of the Council of Europe and the European Union.

The article analyzes the activities of the social protection system and social services of Ukraine. The concept of «social protection» is defined, the classification of the social protection system according to the models of social policy of other countries (Austria, England, Germany, USA, France, Japan) is given. The only principle of social protection according to the given models is formulated – joint action of a complex of measures which are directed on increase of well-being and quality of life of the population (economic, household, social). The socially-oriented policy of Ukraine, which is aimed at overcoming poverty, introduction of social insurance and targeted assistance, solving problems related to unemployment, is indicated. It was found that the basic state social standard in the field of income is the subsistence level. The social service is defined as a multifunctional state executive body that acts as a guarantor in ensuring the stability of the functioning of the system of social protection and social security of socially vulnerable groups. It is established that social services are an organizational form of social work, because they implement the practice of social security. Ensure orderly communication and interaction of all social work bodies (departments and social services). The organizational structure of the social security system is an orderly connection and interaction of all bodies of social work (departments and social services), which provide general conditions for rational organization and normal functioning of the support system for individuals, groups of communities at risk of social risk. The leading direction in social security is to support a person who finds himself in a difficult life situation at the minimum (not lower) social and household level – the provision of cash benefits, social benefits, benefits, subsidies and more.

Introduction. Achieving public welfare is impossible without an effective social protection system, which combines pension insurance, social insurance, health care, as well as material support in difficult life situations. Low budget funding for social protection of population necessitates the use of insurance instruments to neutralize major social risks. However, the role of social and personal insurance in the financial provision of social protection remains insufficient, and its potential in improving the welfare of Ukrainians is underestimated. However, the role of social and personal insurance in the financial provision of social protection remains insufficient, and its potential in improving the welfare of Ukrainians is underestimated. The purpose is to define the role and outline the prospects for the development of social and personal insurance in the context of ensuring public welfare in Ukraine. Results. The essence and main components of social welfare are revealed. It was found that the level of well-being of Ukrainians is ten times lower than in European countries. There are the main negative factors which influence the social protection system defined, in particular: low income and rising expenditures of the Pension Fund of Ukraine and the Social Insurance Fund of Ukraine, the widespread practice of minimizing SSPs by refusing to enter into classic employment contracts in favor of civil agreements with individual entrepreneurs, reduction of the number of insured persons working for hire, high level of labor emigration of Ukrainians. The health care system impact on the growth of public welfare in Ukraine is analyzed. The inefficiency of the current financial support model of the health care system is substantiated, which makes it necessary for households to pay for most of the cost of medical services. Tendencies in the development of the domestic health insurance market are highlighted. Perspectives. It is proposed to revise the principles of building accumulative pension insurance and introduce a budget-insurance model of financing the health care system, which will help to improve the welfare of the population of Ukraine.
